Call to Action! Tell the FCC “No” to Charter Spectrum on Data Caps!

Charter Communications has petitioned the FCC for permission to impose DATA CAPS on customers at least two years before the FCC’s prohibition on caps — a key condition imposed on the cable company in return for approval of its 2016 merger with Time Warner Cable and Bright House Networks — is scheduled to expire.

In 2016, the FCC told Spectrum its merger was NOT in the public interest without requiring some changes and conditions that would benefit you as a Spectrum customer. Because the FCC recognized that competition was uncommon in the cable industry, it knew there would be a temptation after a merger to slap data caps on internet customers for no good reason, other than the fact the company could. In fact, data caps have long been discussed as a deterrent to keep customers from dropping cable TV subscriptions in favor of streaming video. Why? Because if you stream TV programming from Netflix, Hulu, YouTube TV, Sling, and others, that data usage would quickly eat up any data allowances Spectrum would include with its data cap. Most companies with data caps make sure you pay dearly if you go over your allowance. The de facto standard overlimit fee is $10 for each 50 GB of usage, up to a maximum ranging between $100-200 a month! That kind of bill shock would likely push you back to cable TV.

The FCC hoped that a seven-year ban on Spectrum imposing data caps would give competition a chance to develop, and not just with streaming video. In fact, the FCC argued newly arriving cable operators, fiber to the home providers, and 5G services could probably create so much competition, data caps would likely disappear. Unfortunately, consumers have seen little competition emerge in the last four years. In fact, many still have only one choice — a cable monopoly — for internet service that meets the FCC’s minimum speed (25 Mbps) to qualify as broadband. DSL from the phone company rarely provides the speed available from your local cable operator. Fiber to the home competition is growing in some areas, but many homes still lack access. Although there has been much hype in the media about 5G, robust and fast wireless home internet will only be available in a fraction of homes for years to come.

Despite this reality, Charter is asking the FCC to let the ban on data caps expire two years early, which means they could slap data caps on customers just like you by next spring. Charter argues there are lots of streaming services now competing for your business, so there is no evidence Spectrum is hurting the marketplace for streaming television. Therefore, there is no need to protect consumers from data caps.

We argue several points in response:

Most large streaming video providers are owned by giant satellite, cable and telephone companies (Comcast’s Peacock, AT&T’s TV/TV Now and HBO Max, Dish Network’s Sling TV), giant TV conglomerates (ABC-Disney’s Hulu/Disney +, CBS-Viacom’s All Access), or tech companies (Apple TV, YouTube TV). Netflix has raised prices for its service, in part because it has been pushed to pay cable companies like Comcast “interconnection fees” to guarantee Comcast customers will get suitable service. Most streaming services not affiliated with telecom companies have opposed data caps all along, understanding they can be anticompetitive and hurt subscriber numbers.

What competition? Charter Spectrum customers likely still have the same competitive options they had in 2016, if any, which is not enough. Imposing data caps on home broadband service illustrates that lack of competition in action. Comcast has avoided imposing data caps on its customers in the more competitive northeast and mid-Atlantic regions, where it faces Verizon’s FiOS service, which does not have data caps.

Charter asked for and was granted approval of a merger consumers did not need or want. Charter voluntarily agreed to the FCC’s conditions to close the deal. A deal is a deal, but Charter now wants to walk away. The company is spending thousands on its attorneys to free itself from the FCC’s data cap ban while claiming they have no plans to implement data caps. Do you honestly believe them?

Consumers hate data caps. In fact, just having data caps on internet service can undermine a provider’s marketing and ad campaigns and make signing up new customers difficult. Companies with data caps lose more customers than those that don’t because customers switch if a new cap-free competitor comes to town. Just dealing with implementing complicated usage meters and upset customers complaining about their accuracy costs more than any revenue companies earn from overlimit fees. Remarkably, those are not just the views of Stop the Cap! Charter itself told the FCC those were just some reasons there was a strong business case against implementing data caps. Now it is asking the FCC for permission to impose data caps despite all that!

Monroe County Legislator Rachel Barnhart has teamed up with Stop the Cap! to fight Charter’s request to allow it to data cap customers.

Data caps do not protect broadband networks from congestion, and they are not about equitably sharing internet capacity. The ongoing pandemic just proved that big cable and phone companies have existing broadband networks more than capable of handling a large spike in network traffic. Reasonable, cost-effective upgrades will continue that success story for years to come with no need for arbitrary data caps. Make no mistake. Data caps are just another way telecom companies can monetize your usage to increase their already fat profits.

What can you do?

Until July 22, 2020, you can send a comment directly to the FCC urging them NOT to allow Charter’s request to sunset merger deal conditions early. Monroe County (N.Y.) legislator Rachel Barnhart and Stop the Cap! have teamed up to push this message through to Spectrum customers everywhere. We need to put the FCC on notice it must leave well enough alone and allow the deal conditions to remain in place. We also want to send a clear message to executives at Charter that customers do not want data caps… ever. It’s a message Stop the Cap! successfully delivered in 2009 to the top leadership of Time Warner Cable, and they listened. It’s now time to send another message to the folks at Charter. We sincerely hope they will listen too.

Here is a sample letter, which we urge you to adjust to reflect your own views and circumstances before submitting:

To Whom It May Concern:

Please reject Charter’s request to sunset the deal conditions it agreed to as part of its merger with Time Warner Cable and Bright House Networks.

A deal is a deal, and Charter agreed not to impose data caps on its customers for at least seven years. It now wants that prohibition lifted two years early, arguing competition has flourished over the last four years. In fact, little has changed for us. Competition has not flourished. We still do not have choices for broadband service and although there are more streaming video providers, most are owned by large cable, satellite, and phone companies or giant media conglomerates. Data caps will make me reconsider using these services because I cannot afford an even higher internet bill.

Competition is supposed to bring pricing down in a healthy marketplace. But my bill is only going up. What kind of company would ask for permission to slap usage limits on customers in the middle of a pandemic, after telling everyone their networks were more than robust enough to handle increased stay-at-home usage? The answer is a company that faces little competition and has no fear a competitor will use this request against them. Internet affordability is already an enormous problem, and data caps just make internet service even more expensive. We already pay among the highest prices in the world for service.

My family did not ask for this merger, and the FCC in 2016 determined it was not in the public interest to approve it without imposing a handful of conditions to allow consumers to benefit from the transaction. The FCC should insist Charter be true to its word and not impose data caps. Charter told the FCC in 2016 it had an “aversion to data caps, stating that instead of enforcing usage limits it chooses to market the absence of data caps as a competitive advantage” and that “there is a strong business case for not implementing caps” and that caps “undermined” its marketing messaging. Was Charter being honest with the FCC in 2016? Their current request for permission to lift data caps seems to ignore the positions Charter itself took with the FCC just a few years ago.

We urge you to deny Charter’s petition, which will allow Charter to continue making plenty of money from the sale of unlimited internet access and continue honoring its advertising commitments to sell internet service “with no data caps” as it does now.

Capped Comcast Customers Play Columbo to Identify Data Hogging Services

Nathan Gray woke up one morning this month and received an alarming notification from Comcast, his internet provider, claiming he had exceeded his Comcast terabyte data cap and was being billed an additional $10 for a 50 GB allotment of extra data.

“This has never happened before and I was only six days into my monthly billing cycle, so I assumed it must be a mistake,” Gray told Stop the Cap! “But Comcast told me it wasn’t a mistake.”

Gray was hardly alone. One month earlier, “Bogreenwoo” discovered his family had blown the roof off their internet usage, exceeding 1 TB by the middle of the billing cycle, with more usage piling up hour after hour.

“Xfinity was adding 50 GB blocks every day at $10 each and calls to tech support were no help,” he shared on Comcast’s customer support forum.

Similar complaints are brought up on that forum at least weekly, if not more often. Comcast counterclaims that usage exceeding 1 TB a month is so rare, it represents only about 1% of its customer base. But customers with huge internet bills from Comcast who stumble their way to the company’s support forum strongly dispute that notion.

“Well good luck with finding a solution or even finding anyone at Comcast who cares or anyone anywhere else as far as that goes,” shared “Amaasing.” “I have had this issue more than once and have talked with every vice president of customer service and had discussions with the security department and even filed a complaint with the FCC and nothing happened at all.”

Some users, like Amaasing, have received so many bills stung with overlimit fees they now turn their computers off in the evening and unplug their cable modems. In many cases the usage keeps rising anyway.

“Today when I logged in, I had apparently used 196 GB yesterday,” Amaasing wrote. “196 GB in 24 hours?  Seriously?”

For most customers in this predicament, Comcast is quick to blame customers for the usage and leave the detective work up to them. Customer support will not entertain suggestions their usage meter is inaccurate. In their view, it is more likely someone is illicitly connected to your Wi-Fi and stealing your service or you are running some bandwidth-heavy application or your computer has been hijacked by hackers or pirates.

While you are left to investigate which of these might be true, Comcast is free to continue billing your account overlimit fees.

Comcast claims it will forgive customers who exceed their data allowance twice ‘a year’:

“We’ll provide you with two courtesy months, so you will not be billed the first two times you exceed a terabyte while you are getting used to the new data usage plan. This means that you will only be subject to overage charges if you use more than a terabyte for a third time in a 12-month period. If you use more than a terabyte two times or less in a 12-month period, your courtesy month balance will reset to two at the end of these 12 months. However, if you use more than a terabyte three times in a 12-month period, no more courtesy months will be given.”

After “courtesy months” expire, you are on the hook for whatever excess usage Comcast determines you have consumed. Some Comcast customers assume the courtesy month counter resets each calendar year, but in fact it only resets after 12 consecutive months of staying within your allowance limit.

What causes “excess usage” is anyone’s guess. Comcast customers have documented several recent causes why they have mysteriously started blowing through their 1 TB data allowance:

  1. The growing prevalence of 4K video, the highest streaming video quality available through online video streaming services can be responsible for a sudden spike of usage. Netflix and other services that support 4K video content with high dynamic range can eat up 7 GB to 10 GB of data per hour. Many services allow you to downgrade your video settings with minimal quality loss. We recommend trying settings typically labeled 720 or 1080 — the lower the better if you are running up against your allowance.
  2. Third party backup and cloud storage tools: That online backup or cloud storage service you are using may be malfunctioning. There are several reports about Amazon Drive having problems recently, causing files to be repeatedly transferred and driving up usage to several hundred gigabytes a day in some cases. If you use Amazon Drive and have seen a huge spike in usage, try uninstalling or turning off the service for several days and see if usage falls dramatically. Other file and computer backup services that store your data in the cloud can consume a lot of data, especially when installing them on a new computer for the first time. Even some cell phone backup services designed to store your photos in the cloud can malfunction and repeatedly try to send the same photos over and over. Disable these tools for several days and check your usage levels.
  3. Third party usage: Family members doing something bandwidth intensive can also be responsible for dramatic usage spikes. Although downloading video game updates can consume very large amounts of data, game play itself typically has little impact on your data usage. Check with family members to see if they are watching high bandwidth video or have installed a file backup service. Less common is an uninvited guest on your Wi-Fi network. Comcast often points to Wi-Fi security as a major problem when a neighbor gains access to your internet connection to download huge numbers of files. You can change your Wi-Fi password to help lock down your network. Make sure not to use plain word passwords — use a mixture of letters, numbers, and symbols.
  4. Comcast’s meter is simply inaccurate. There is no independent third-party verification or government oversight of Comcast’s usage meter. Most ISPs hire a third-party contractor to design and implement their data measurement meters, but those contractors are ultimately answerable to the provider — not to you, giving little peace of mind to consumers who are forced to trust their cable company to be honest. Our country’s Founding Fathers placed great importance on accurate measuring and weighing tools, so much so it is addressed in Section VIII of Article I of the U.S. Constitution. That section gives authority to Congress to establish accurate and regulated measurement tools. Each state has their own way of managing this, often with a bureau of weights and measurements that independently verifies and certifies — with a tamper-evident sticker, the accuracy of the food scale at your local grocer or the gas pump at a nearby service station. Comcast has resisted similar third-party oversight for its usage meter. But considering the company’s overlimit fees can add a substantial sum to customer bills, having this kind of oversight seems appropriate.

Avoiding the usage cap: Comcast ironically provides its own insurance plan to protect customers from its own arbitrary data allowance. For peace of mind, Comcast collects an extra $50 a month ($20 for gigabit speed DOCSIS 3.1 plans) if you wish to waive the data cap altogether. Data caps are completely under the control of Comcast and are especially prevalent in regions of the country where a lack of competition exists. But Comcast’s arguments in favor of data caps don’t wash at the nation’s second largest cable company – Charter Communications, which markets its internet service as having no data caps at all. In fact, Charter CEO Thomas Rutledge never saw much use for data caps at Charter or Cablevision, the company he used to head.

Verizon Wireless Bill Shock is Back; Customers Complaining About Sudden Usage Increases

bill shockSome Verizon Wireless customers are reporting data usage numbers spiked on their bills to unprecedented levels this summer, giving the cellular company’s bean counters a heaping helping of overlimit fees, charged when customers exceed their data allowance.

The phantom usage problem has become noticeable enough to win attention from the consumer reporter at Cleveland’s The Plain Dealer, who found her own family of four suddenly blowing past their shared 15GB a month, resulting in a $30 overlimit fee.

“My family’s data usage has mysteriously increased significantly every month since February, except for one month,” wrote Teresa Dixon Murray. “My family of four pays for 15GB a month. We’re grandfathered in the old More Everything family share plan. We typically were using no more than 10GB a month. But for the last six months, that has increased steadily — and inexplicably. 8.2. Then 9.7. Then 10.6. Then 12.7. Two months ago, we got alerts that we were nearing our allotment and managed to take care to avoid going over. Last month, despite our efforts, we went over by 1.057GB, and were charged an extra $30.”

Murray questioned why her family’s phones were burning through their data allowance in the middle of the night, while connected to the family’s home Wi-Fi.

A Verizon representative explained phones may be connecting to Verizon’s network because of a new feature installed on some phones, including the Apple iPhone, called “Wi-Fi Assist.” This feature, which could also be called “Verizon Profit Assist” automatically ignores the fact you are connected to Wi-Fi and switches back to the Verizon Wireless network if the phone determines your Wi-Fi connection is “poor.”

“So what’s the definition of poor? I guess Verizon and our iPhones decide that,” Murray questioned.

But that hasn’t always stopped the overlimit fees. Some customers report they still incur overlimit fees even after switching cellular data off when they reach a warning from Verizon they are about to exhaust their allowance. Verizon charges $10 in overlimit fees, even in instances where the offending extra usage amounts to .0001GB.

Verizon claims its usage meter only provides an estimate of usage, and there are instances where the warning comes too late for a customer to stop using data before they’ve already exceeded their plan allowance. Verizon’s solution is to sell a $5/month “family coverage” add-on that allows parents to monitor data usage before it gets out of hand. But Verizon doesn’t guarantee it will stop overlimit fees based on the measurements of usage it provides.

That add-on plan may or may not have helped Valarie Gerbus, who is now facing a $9,100 Verizon cell phone bill she is adamantly refusing to pay.

The suburban Tampa customer regularly paid $118/month for her cell phone plan, which included 4GB of data usage — an amount she never exceeded, at least until July. Gerbus was shocked to open her bill and discover her normal monthly bill now also included $8,535 in overlimit fees for using 569GB of data in a single month:

On July 21, Verizon sent her a text, notifying her that she had used nearly all of her 4 gigabytes of data. The text said she could get 4 more gigabytes for $20. Realizing that she had two weeks before the end of the month, Gerbus bought the additional data.

Within an hour of the purchase, she received another text that told her she only had 10 percent left on the data that she had just purchased. The next text message she received said she could change her plan to 8 gigabytes for an additional $20 a month. She said she bought that upgrade to ensure she didn’t have any data overages.

In a span of several hours, she estimates that she received 40 to 50 texts saying that she needed to purchase more data. She turned the notification off, believing that there had been a glitch in Verizon’s system.

Gerbus said she realizes now that she should have contacted the company at that point, but she didn’t, as she feared being placed on hold by a customer service representative.

She later went to work and planned on paying the bill online. When she found her online statement, it said she owed $6,480 for using 490 gigabytes of data. She was shocked.

“I told them that I won’t pay the bill,” Gerbus told the newspaper. “I can either wait until they take it to a collection agency or when they take it to court. Either way, my credit history will be ruined. I can go bankrupt here.”

Verizon said they are not aware of any widespread problem, but is looking into phantom phone usage at night and some of the more extreme examples of bill shock, where bills extend into the thousands of dollars.

Affected customers report the high bills are, in some cases, tearing families apart.

“It got to the point that we were battling in our family,” reported Lockport, N.Y. resident Tom Walker, who told the newspaper their data usage soared for no apparent reason. “We were really asking each other, ‘Have you been on Facebook too much? What have you been doing?’ We were trying to figure out who was using all this data.”

Gerbus is almost thankful to pay Verizon Wireless a nearly $600 fee to exit her contract early as she switches to T-Mobile. Verizon’s engineers have no explanation for Gerbus’ bill, other than noting her phone contacted Amazon.com at least 400 times over a few days.

Providers with usage caps and usage-based pricing often consider their usage meters more reliable than their own customers, and when customers complain, many representatives trust the meter and insist on payment. When a customer like Gerbus complains about usage that is considerably above average usage, customer service representative are not always receptive.

“I told them that there was no way that I could have gone from 490 to 560 in a day,” Gerbus said. “The [Verizon] person said, ‘Yes there is.'”

Comcast’s 1TB Usage Cap Goes Live, Replaces Old 300GB Usage Allowance

1024gbAfter four years of a gradually expanding “beta test” no customer wanted to be part of, Comcast’s never-ending data cap trial has increased data allowances for the first time since 2012.

It’s a major improvement over the old 300GB cap many customers endured with expensive overlimit fees that applied when they exceeded their allowance. Comcast will continue to bill those overlimit fees of $10 for each 50GB increment of excess usage over the allowance, but now plans to cap those overlimit fees at $200 a month.

“The new meter showed up June 1st in southern Florida, and it’s about time,” said our reader Javier from Miami. “But wouldn’t you know, Comcast screwed us out of one more month of paying their $30 extortion fee to keep unlimited.”

Javier is referring to Comcast’s unlimited usage insurance plan. For $30-35 extra, the cable company removes your data cap and you face no overlimit fees. But since Comcast bills one month ahead, a customer enrolled in the insurance plan paid for an unlimited June on their May bill. Now that usage allowances have more than tripled, Javier wanted to cancel his insurance for this month because he doesn’t come close to Comcast’s new cap.

No dice, replied Comcast, who canceled his unlimited insurance plan effective July 1.

“Once you begin a new month, you cannot stop the charges until the following month,” Javier explained, even though he canceled the plan on the 1st of the month. “They told me it was too late.”

Javier is still glad he canceled the insurance.

“If I didn’t, they planned to auto-enroll me in their new unlimited option, which costs a ridiculous $50 a month,” said Javier.

In this trial, XFINITY Internet Economy Plus customers can instead choose to enroll in the Flexible Data Option to receive a $5 credit on their monthly bill if they reduce their data usage plan to 5 GB. If you choose this option and use 6 GB of data or more in any given month, you will not receive the $5 credit and will be charged an additional $1 for each gigabyte of data used over the 5 GB included in the Flexible Data Option. Currently, the Unlimited Data Option is not available in these markets.

In the Tucson, Arizona, market, we have increased our monthly data usage plan for Economy Plus through Performance XFINITY Internet tiers to 300 GB. Those customers subscribed to the Performance Pro and Blast! Internet tiers receive 350 GB in their data usage plan; Blast! Pro customers receive 450 GB in their data usage plan; and Extreme customers receive 600 GB in their data usage plan. As in our other trial market areas, we offer additional gigabytes in increments/blocks of 50 GB for $10 each in the event the customer exceeds their included data amount. Currently, the Unlimited Data Option and the Flexible Data Option are not available in this market.

In Fresno, California, Economy Plus customers have the option of enrolling in the Flexible Data Option.

AT&T Tells Customers $30 Extra for Unlimited Internet is Good News (for AT&T)

fat cat attAT&T has indirectly announced it will enforce hard data caps on its U-verse broadband service for the first time, imposing overlimit fees for customers that exceed their allowance unless they agree to pay $30 extra a month for a new unlimited add-on plan.

AT&T’s Consumer Blog announced effective May 23, AT&T was increasing the usage allowances on its DSL and U-verse broadband service and is introducing a new $30 unlimited option for broadband-only customers many actually had all along because AT&T never enforced its cap for U-verse.

Customers currently bundling video and data services from AT&T/DirecTV will get a break – the unlimited option will apply at no extra charge if you agree to a single, combined bill for all of your AT&T services. The decision to apply usage caps to broadband-only customers, often cord-cutters, while effectively exempting current U-verse TV/DirecTV video customers is sure to raise eyebrows.

AT&T originally told customers its usage caps were designed “to ensure it is providing a sustainable network to customers.”  But in a company FAQ, AT&T destroys its own argument for the need to cap anyone. “Will offering unlimited data negatively impact the AT&T network? No. AT&T will continue to actively manage the network to handle the increasing demand for data.”

AT&T’s need for data caps is also eroded by company claims only a small percentage of customers exceed them.

“Today, our home Internet customers use just over 100GB of data per month on average,” AT&T wrote. “So even with our smallest U-verse Internet data allowance of 300 GB the average customer has plenty of data to do more.”

At least for now.

A review of AT&T’s past average usage claims is revealing. In 2011, AT&T told Tom’s Hardware the average customer consumed about 18GB a month. In 2015, AT&T’s cached support site claimed average customers used around 35GB a month. As of this week, AT&T says average users now exceed 100GB a month. If AT&T decides not to regularly revisit allowances (AT&T took five years to revisit the subject this week, having introduced 150GB caps on DSL and 250GB on U-verse in 2011), customers are likely to face pressure to sign up for the $30 unlimited add-on or buy television service from AT&T to avoid overlimit charges that will top out at $200 in penalties for DSL customers, $100 for U-verse overlimit fees.

Beginning May 23, AT&T’s website will include a data usage meter to help avoid AT&T’s overlimit penalty: $10 for each 50GB increment one exceeds their allowance. AT&T claims only 4% of its customers will exceed their future data allowances. They wouldn’t say how many exceed the current ones.

Because U-verse customers have avoided AT&T’s usage caps in the past, the company is now reminding customers it will give several warnings before you experience bill shock:

  • In the first bill cycle when you reach 100% of your data allowance, AT&T will update you via email, but there will be no charges.
  • In the second bill cycle, AT&T will notify you via email at 65%, 90%, and 100%, and still without charges.
  • In the third bill cycle, and each bill cycle thereafter, you’ll receive reminder emails at 65% and 90%. At 100% AT&T will notify you and add an additional 50GB of data to your account for $10 each time you exceed the allowance. Customers will receive reminders about their data usage for the additional 50GB at 75% and 100%.

All usage — including uploads and downloads — counts towards the cap. There is just one exception. Wireless traffic from an AT&T MicroCell, designed to boost weak cell signals inside the home, is not included in AT&T’s Internet data usage allowance. To help ensure accurate billing, you have to register your AT&T MicroCell account and residential AT&T Internet account.

DSL Reports’ Karl Bode is skeptical of the “consumer benefits” AT&T is touting as part of the change:

That last bit is a fairly transparent ploy to address a spike in cord cutting at AT&T — by forcing customers into signing up for television services they may not actually want if they want to avoid usage restrictions. Whether using arbitrary caps to force users to sign up for TV technically violates net neutrality (either the FCC’s rules or the concept in general) is something that’s likely to be hotly debated.

It’s also curious that just as AT&T indicates it’s backing away from U-Verse TV (which should technically free up more bandwidth on the AT&T network), it’s implementing caps on a network it originally stated didn’t need caps thanks to “greater capacity.” That’s because as with Comcast, caps really aren’t about capacity or financial necessity, they’re about protecting traditional TV revenue from Internet video. At the end of the day, AT&T’s just charging $30 a month (or more) for the same service, while trying to frame it as a net positive for consumers.
