Wall Street Journal’s Distorted Views on Broadband Only See the Industry’s Point of View

The Wall Street Journal’s not-living-in-the-real-world editorial page strikes again.

The commentary pages have always been the weakest part of the Journal, primarily because they screech pro-corporate talking points in contrast to the more balanced reporting in the rest of the newspaper.

Mr. Holman W. Jenkins, Jr. decided to distort broadband reality (again) in yesterday’s edition with a glowing commentary on how wonderful broadband providers are in his piece, “Springtime for Broadband.” The only thing missing was a border in fine print labeled, “Sponsored by Verizon, AT&T, and your cable company.”

While your Internet bill is being hiked at the same time your provider is slapping usage limits on your connection, Jenkins dismisses consumer-fueled complaints about broadband price gouging, assaulting Net Neutrality, and overall poor customer service as part of Washington’s “broadband policy circus.”

Charges fly hourly that Google or some other company is guilty of gross insult to net neutrality (that sacred principle nobody can define). Oregon Sen. Ron Wyden has introduced legislation to regulate data caps and Internet pricing. Law professor Susan Crawford, until recently a White House technology adviser, clearly craves to be America’s next go-to talking head on broadband. Lately she’s been everywhere calling for a crackdown on the competing “monopolists” who supply Internet access.

How dare they complain, decries Jenkins in a robust defense of the 21st century version of the railway robber barons.

Comfortably playing patty cake with provider-fed talking points from the industry echo chamber, Jenkins is ready for battle, facts or not.

But wireless providers have invested big money to deploy high-speed mobile networks, and fixed and mobile are inevitably beginning to compete. The latest evidence: Australia recently predicted that up to 30% of households will go the all-wireless route and won’t be customers for its vaunted national broadband project.

Not exactly. The basis for this 30% figure is the National Broadband Network’s own business plan, which warns if– the company raised prices to a maximum theoretical level, up to 30 percent of its customers would rely on wireless instead… by the year 2039. That is 26 years from now. You have nothing better to do in the meantime, right?

In fact, conservative critics of the fiber network, some defending the big wireless cell phone industry in Australia, have suggested fiber optics is a big waste of money because “wireless is the future.”

That old chestnut again.

“Now you can present a bulletin without touching a typewriter … it’s just there on the computer system, you don’t need a reel to reel tape recorder. I’ve got a touchscreen in front of me. Back then I had a big cartridge deck,” said Ray Hadley on 2GB radio. “Can you imagine the advances in technology in the next 26 years? I can’t. I can’t comprehend it. By the time they finish the NBN, it could be superseded by something we don’t even know about.”

NBN Myths, a website set up to tackle the disinformation campaign from political and industry opponents has one simple fact to convey: “Despite what you may have read from certain clueless commentators, there is not a single country or telecommunications company anywhere in the world that is attempting to replace fixed networks with wireless in urban areas, or even planning to do so in the future.”

Even Telstra, the biggest telecom company in Australia scoffs at such a notion, noting a growing number of its customers have both wired and wireless service, and they do not depend on one over the other.

Research firm Telsyte found that 85 per cent of Australians want speeds of 50Mbps or higher, speeds impossible for wireless to offer. In fact, when the NBN fiber network became available to Australians, almost half the current users as of October last year had chosen an even-faster 100Mbps plan option. But Australians also want mobile broadband, and they are signing up for that as well.

The Australian Bureau of Statistics notes the number of mobile broadband Internet connections also grew by around 40% in Australia between 2009 and 2010. But here is the Achilles heel of wireless: it cannot deliver the same speeds or capacity, and providers charge high prices and deliver low usage caps. As a result, the wireless industry has pulled off a coup: they earn enormous revenues from networks they have successfully rationed. The total amount of data downloaded over Australia’s wireless networks actually fell on a per user basis, despite the growth in customers.

Much of Jenkins’ commentary is spoon-fed by the industry-funded Information Technology and Innovation Foundation, which produces industry-sponsored studies designed to tell America all is well in our broadband duopoly.

In the latest federal survey, the average broadband speed in America is up to 15.6 megabits per second, from 14.3 a year earlier. Nearly half of customers who six months ago made do with one megabit or less have now moved up to higher speeds. Since 2009, the U.S. has gone from 22nd fastest Internet to the eighth fastest.

The 15.6Mbps figure comes from the Federal Communications Commission. The statistics about our global speed ranking come from Akamai’s voluntary speed test program. Other studies rate America much lower. More importantly, while providers in the U.S. try to squeeze out more performance from their copper networks, other countries are laying speedier fiber networks that are destined to once again leapfrog over the United States. Most charge less for their broadband connections as well.

Jenkins also quotes the ITIF which touts 20 million miles of fiber were laid in America last year. But the ITIF, when pressed, will admit the majority of that fiber was “middle mile” connections, institutional or business network fiber you cannot access, or fiber to cell towers. Fiber to the home expansion has stalled, primarily because Verizon has suspended expansion of its FiOS network to new areas after Wall Street loudly complained about the cost.

Jenkins argues that if we leave providers alone and stop criticizing their growing prices, declining competition, and fat profits, the marketplace will suddenly decide to invest in network upgrades yet again.

“The day may come when even Verizon, which visibly soured on its $23 billion FiOS bet, rediscovers an urge to invest in fixed broadband infrastructure to meet growing consumer lust for hi-def services,” writes Jenkins.

Would Wall Street rather see providers invest in network upgrades or return profits to shareholders? Investment expansion in the broadband industry comes when a company senses if they do not spend the money, their business will be swept away by others that will. Cable broadband threatens telephone company DSL, so AT&T cherry-picked communities for investment in its half-measure U-verse fiber to the neighborhood network. Google Fiber, should it choose to expand, will be an even bigger threat to both cable and phone companies. Municipal fiber to the home networks upset the incumbent players so much, they spend millions of ratepayer dollars in efforts to legislate them out of existence.

Jenkins’ view that giving the industry carte blanche to do and charge as it pleases to stimulate a better broadband future is as fanciful as NBN critics in Australia suggesting fiber upgrades should be canceled in favor of waiting 20+ years for improved wireless to come along.

He even approves of Internet Overcharging schemes like usage caps and consumption billing, calling it proper price discrimination in a “fiercely competitive” environment to defray a network’s fixed costs.

Broadband’s fixed costs are so low and predictable, it literally calls out consumption pricing as just the latest overreach for enhanced profits. As Suddenlink’s CEO himself admitted, the era of big expensive cable upgrades are over. Incremental upgrades are cheap, the costs to offer broadband are declining, so it is time to reap the profits.

Jenkins closes with one recommendation we can agree with: “A low-tech way to stir up broadband competition would be to relax the regulatory obstacles to the actual physical provision of broadband.”

We can start by scrapping all the state laws the industry lobbied to enact that prohibit community-owned broadband competition. If big cable and phone companies won’t provide communities with the quality of broadband service they need to compete for 21st century jobs, let those communities do it themselves.

West Virginia’s Conundrum Proves Inflexible Broadband Grants, Poor Planning Wastes Taxpayer Money

Still keeping their fingers on the pulse of West Virginia’s broadband.

The state of West Virginia has a money problem.

In 2009, the state applied for and won a $126 million federal Broadband Technologies Opportunity Program (BTOP) grant to expand broadband service in a state plagued with some of the worst Internet access around. That grant will expire Jan. 31, without all of the money spent and equipment in place.

Whatever money is left unspent will be returned to the federal treasury and lost for good. That represents the absolute worst-case nightmare scenario for government officials loathe to leave money on the table. As a result, the state continues to hurry depleting the remaining grant funds before the clock runs out, even if it results in controversial spending decisions.

Last week, the chairman of the West Virginia Broadband Deployment Council openly admitted the state does not have a unified, coherent broadband deployment plan and has been running the broadband expansion effort on an ad hoc basis. That’s a big mistake in the eyes of Dan O’Hanlon, a retired Cabell County circuit judge who leads the Council.

It should not be this difficult. Ask virtually any consumer in rural West Virginia about what needs to be done and the answer is always the same: expand access in unserved areas and raise speeds for those who already have the service.

Unfortunately, $126 million of consumers’ tax dollars will be spent without really doing either.

The Obama Administration’s efforts to expand rural broadband came with lofty rhetoric, but far too often failed to directly address the problem. Consumers and small businesses want Internet access, and the local phone company simply won’t deliver it. Forget about cable broadband — most rural areas without Internet access are not served by any cable operator.

That leaves the federal government in the position of trying to fund rural Internet connections in ways that don’t appear as blatant corporate welfare — paying off phone companies to provide service where they have simply refused for revenue and cost reasons. Competitors are also outraged at the precedent of directly subsidizing certain players but not others, and a lot of taxpayers might question why their tax dollars are going to the phone company.

As a result, the government has discovered a politically palatable alternative: throwing money at non-controversial “institutional” networks built to serve local governments, hospitals, public safety agencies, libraries, and schools. They also have political cover funding obscure “middle mile” networks that interconnect telecommunications company offices, but don’t directly serve any homes or businesses.

Since most people don’t understand the differences between these types of networks and the services they actually provide, broadband expansion projects offer politicians headache-free ribbon cutting ceremonies, applause, and positive publicity from local media reports that mistake institutional and middle mile networks with broadband finally coming to rural towns and villages. Long after the cartoon-sized ribbon-cutting scissors are put away, rural residents still find themselves stuck with dial-up or satellite fraudband.

Last week, the Joint Committee on Technology overseeing the BTOP grant learned the state lacks a plan to get the most broadband bang for the buck, despite hiring some big dollar Verizon subcontractor-consultants that are supposed to be experts at this kind of thing.

As Stop the Cap! reported in May, the state decided to spend $24 million of taxpayer money to buy 1,064 overpowered Cisco routers built (and priced) for big city university use. Imagine the surprise of rural schools and libraries when routers valued at $22,000 each arrived to serve a handful of concurrent users that would have been just as well-served with equipment you can find at Best Buy. Those routers were coincidentally supplied by a familiar vendor: Verizon Network Integration.

Two years later, more than 300 of those routers were in storage, unused. As of this week, 175 are still there.

Two rural librarians in May told Stop the Cap! they were in a quandary over the equipment installed in their tiny libraries because they had no idea how to switch them on, much less maintain them over the long term. Even worse, both told us, they cannot begin to afford the ongoing monthly service fees that are required to participate in the new broadband network.

“We are getting a Hummer network on a Kia operating budget,” one librarian told Stop the Cap! last spring. “The network sounds great, but in our case we have to find the money to pay the bill to run it every month, and that money is hard to find in a library with five outdated public terminals.”

Seven months later and not a lot has changed.

“We have complained to our local leaders this has created more problems for us than it solved,” that same librarian, who could not use his name because of local politics, told Stop the Cap! “If you have worked in government or community service as long as I have, you cringe whenever you have one of these grants because you have to follow the federal government’s rules and you end up spending the money where it least needs to be spent.”

Committee members echoed that sentiment, observing facilities are ending up with equipment they don’t know how to use or cannot afford because monthly service charges for upgraded broadband from Frontier Communications, the state’s largest phone company, are unaffordable.

One proposed solution to cut further taxpayer expense would be to sell the excess network capacity, deemed significant in many communities, to third party Internet Service Providers to directly resell to individual homes and businesses. After all, taxpayers are footing the bill for the $126 million grant that largely paid for the network and independent ISPs would help solve the problem of extending broadband to the unserved.

No deal. Frontier claims it is selling the project broadband access far below normal commercial rates, offering high capacity speeds at an unspecified “entry-level” price. Allowing third party companies to resell that service would put independent ISPs in direct competition with Frontier.

Unfortunately, well-intentioned members the West Virginia Broadband Deployment Council, the Joint Committee on Technology, and other government officials are in over their heads and increasingly appear captive to the design, recommendations, and implementation of a network plan heavily influenced by high-paid Verizon consultants and implemented on a broadband network owned and operated by Frontier Communications.

That left Gale Given, the state’s chief technology officer claiming critics of earlier spending decisions were engaged in “second guessing.” With the expensive routers mostly already in place, Given offered it was better for schools and other institutions to have more capacity than they need now so they won’t be hamstrung if they ever want to expand.

“Only one problem: Ms. Given assumes we can afford to turn the key on the network they are building us now,” said one librarian this week. “Only we can’t. Worrying about what we can do tomorrow is pointless when we can’t even afford to do it today.”

Start the Countdown Clock on Julius Genachowski’s Departure from the FCC

FCC Chairman Julius Genachowski’s cowardly lion act. The rhetoric rarely matched the results.

Washington insiders are predicting Federal Communications Commission chairman Julius Genachowski will leave his position early in President Obama’s second term.

It cannot come soon enough, as far as we’re concerned.

One of the biggest disappointments of the Obama Administration has been the poor performance of a chairman that originally promised a departure from the rubber stamp-mentality that allowed Big Telecom providers to win near-instant approval of just about anything asked from the Republican-dominated FCC of the Bush Administration. If only to underline that point, former FCC Chairman Michael Powell joined Republican ex-commissioner Meredith Atwell-Baker on a trip through the D.C. revolving door, taking lucrative jobs with the same cable industry both used to oversee.

We had high hopes for Mr. Genachowski when he took the helm at the FCC — particularly over Net Neutrality, media consolidation, and predatory abuse of consumers at the hands of the comfortable cable-telco duopoly. Genachowski promised strong Net Neutrality protections, better broadband — especially in rural areas, an end to rubber stamping competition killing mergers and acquisitions, and more aggressive oversight of the broadband industry generally.

What we got was the reincarnation of the Cowardly Lion.

The Washington Post reviews Genachowski’s tenure during the first term of the Obama Administration and reports he has few unabashed supporters left. Telecom companies loathe Genachowski’s more cautious approach and consumer groups hate his penchant for caving in when lobbyists come calling. In short, another Democrat that talks tough and caves in at the first sign of trouble.

“His tenure has been nothing but a huge disappointment because he’s squandered an opportunity to give consumers the competitive communications market they deserve,” Derek Turner, head of policy analysis at public interest group Free Press told the Post. “If someone like him upholds compromise, it quickly leads to capitulation, which is what he’s done. He folds…to the pressure of big companies.”

CenturyLink CEO Thinks AT&T Has a Tough Road Ahead Cutting Off Rural Landlines

CenturyLink CEO Glenn Post does not think much about AT&T’s plans to shift its most rural landline customers to wireless in its efforts to decommission traditional landline service.

“From a regulatory standpoint, that could be a tough go,” Post explained to Wall Street investors on a conference call last week. “There may be some areas that will have better service with wireless in some ways. As far as a competitive threat, we don’t see that being a real issue for us because just the bandwidth requirements and the limited wireless access or capability in a lot of areas.”

CenturyLink, one of four large independent phone companies and owner of former Baby Bell Qwest, is doubling down on its wired infrastructure to reach customers. The company recently announced Phoenix would be the latest city to get its fiber-to-the-neighborhood service Prism TV — the first legacy Qwest market to get IPTV service from CenturyLink. The service soft-launches in Phoenix this month, with a second city in the region or Pacific Northwest slated to get Prism sometime next year.

The company has spent much of 2012 investing in broadband, managed hosting and cloud computing for business customers, and fiber expansion to reach more than 15,000 cell towers across CenturyLink’s national service area, depicted in green on the accompanying map.

But CenturyLink executives stress their investments are “strategic” — made in areas that are most likely to deliver quick returns for the company.

While CenturyLink spends money to secure video franchising agreements in metro Denver and Colorado Springs for Prism TV service, it is moving at “a snail’s pace” to deliver broadband service in northeastern North Carolina’s Northampton County. County officials there anticipate CenturyLink will take years to deploy basic DSL service to communities outside and around Conway and Gaston.

The broadband problem in income-challenged parts of North Carolina illustrate the conundrum for county officials, who have to advocate for broadband improvement while combating misleading broadband maps that suggest access is not a problem in the state.

Donna Sullivan with the Department of Commerce notes that broadband maps in states like North Carolina have a census block granularity which does not always reveal the true picture of broadband availability.

“That means if one household in that census block can receive broadband services, the entire census block is considered covered—even though there very well may be households who cannot receive broadband to that location,” she told the Roanoke-Chowan News-Herald.

CenturyLink is in no hurry to expand broadband to the 1,921 households in the county of 22,000 who cannot buy broadband service at any price.

Derek Kelly, a CenturyLink spokesman, said the company is working to expand broadband services in the region, but noted the costs to lay down a fiber network to help reach the unserved is “one of the largest costs.”

That cost is much less of a problem if the customer at the end of the line happens to be a wireless company like Verizon or AT&T.

Company officials admit they are spending enormous sums “investing in fiber builds to as many [cell] towers in our service area as economically feasible.” In the third quarter alone, more than 1,000 cell towers received fiber upgrades for a total of 3,300 so far this year. The company hopes to reach 4,000-4,500 cell towers by New Year’s Eve.

The reason why CenturyLink chases wireless business while allowing rural and income-challenged service areas to go without broadband is a simple matter of economics. Cell phone companies sign lucrative, multi-year contracts for fiber connectivity to cell towers to support forthcoming 4G service. In contrast, CenturyLink was surprised to find an astounding 94 percent of families with children in Northampton are qualified for the company’s special Lifeline Program which delivers slow speed, discounted broadband service for families on public assistance.

For CenturyLink’s more urban and prosperous service areas, the news for broadband service improvements is better.

As CenturyLink continues to extend its middle mile fiber network, broadband speeds are gradually improving.

Over 70 percent of CenturyLink customers can receive at least 6Mbps DSL service, more than 57% can receive at least 10Mbps and 29% can access the Internet at 20Mbps speeds or better, according to Post.

But the more urban and prosperous a service area is, the greater the chance a cable competitor has successfully poached many of CenturyLink’s DSL customers with the promise of better speed.

Post said he recognizes the company must do better to remain competitive.

“We’re shooting for 20-25Mbps for a very large percentage of our areas,” Post said. “But with [pair] bonding, we can virtually double the broadband capacity and speeds in our markets. We’re already doing bonding in a number of markets today. So where we have 20Mbps, we could have 40Mbps.”

CenturyLink’s fiber to the neighborhood network, essential where it plans to roll out Prism TV, can also support faster broadband speeds if a customer wants broadband alone and does not care about television service.

Nationwide, the company added 10,000 Prism TV subscribers in the third quarter and has a total customer base of around 104,000 subscribers. But that represents a penetration rate of just over 10%, hardly noticed by still-dominant cable operators.

CenturyLink executives were asked to comment on AT&T’s strategic plan to transform their landline network announced last week in New York. Post found little in common between CenturyLink and AT&T’s vision for the future and does not think the company has to respond to AT&T’s attempt to redefine rural America as wireless territory.

“We don’t see that as a major investment for us or a major risk at this point.”

Frontier Boosting Speeds in Select Areas; Premium Customers Win No Modem Rental Fee

Frontier Communications customers in selected communities will be able to receive faster Internet speeds by the end of the year because of network upgrades.

In late July, Frontier president and chief operating officer Daniel J. McCarthy announced the company was refocusing investment on improving the broadband experience for its customers, mostly serviced by ADSL.

Frontier’s rural customers primarily receive broadband service at real-world speeds of 768kbps-3Mbps. At least 74% of those customers will be able to sign up for speeds of 6Mbps by the end of the year. In more urban areas, 51% of customers will be able to sign up for 12Mbps, 42% for 20Mbps. Business customers in selected areas can qualify for speeds up to 40Mbps.

The upgrades will not come for free, however. Customers will pay more for higher speeds.

Frontier Max (3Mbps in rural areas, 6Mbps in urban areas) starts at $34.99 per month. Customers can move up to the next speed tier for an additional $10 per month. For example, a Frontier Max customer can move up to Ultra service (10-12Mbps) for $44.99, or Frontier Ultimate (20-25Mbps) for $55.99 per month. Once customers upgrade to a premium speed level, the modem rental fee (up to $6.99 a month) is reportedly eliminated.

Frontier’s upgrades are based on adopting more advanced forms of DSL technology. Most Frontier customers currently receive ADSL service — one of the oldest and slowest forms of DSL. Frontier is managing to boost speeds by bonding multiple DSL connections together, switching to ADSL 2+, or upgrading to VDSL technology. The company is also broadening its fiber middle mile network, which can reduce the length of copper wiring between the company’s central offices and customer homes, improving potential speeds.

Customers who do not change their level of service may still receive some benefits from area upgrades, as actual speeds come closer to matching those advertised by the company.

In some areas, customers will receive telemarketing calls announcing newly available speed options. But customers can also call 1-800-921-81o1 to find out what is currently available.

Be sure to ask about all terms and conditions, including installation/upgrade fees, modem rental fee (if any), contract terms, and whether any additional services are required (Frontier may attempt to sell an added-cost online backup service, home networking equipment, or technical support services you may not need).
