The Page family has used Clearwire for years to get Internet service in their rural home near Lynden, Wash. The service was affordable and more than adequate for the occasional web browsing and e-mail Page’s parents rely on. After learning the service was being discontinued, Page called Clearwire customer service to learn what other options were available.

“They claim they will essentially match your current level of Clearwire service on the Sprint network,” Page told Stop the Cap! “Although Clearwire originally advertised unlimited service, the representative was not willing to match that through Sprint. Instead, they built a recommended usage plan based on reviewing actual use over the last several months.”

Page was offered a 30GB plan adequate for his parents, but the quoted price of $110 a month was more than twice the price of Clearwire. The family also had to pay $200 for a replacement modem compatible with Sprint’s LTE network to replace the Clearwire WiMAX modem that isn’t.

“No consideration for Clearwire customers, no special promotions, no loyalty discounts, nothing for customers like us who have been with Clearwire for almost five years,” Page complained. “When Alltel was sold off and their network was changed, customers were given a free replacement phone as a courtesy, but Sprint seems to care less about us.”

Sprint acquired Clearwire in 2013 mostly for its massive spectrum holdings in the 2.5GHz band. After the deal closed, Sprint fired 75% of Clearwire’s workforce and began planning the end of Clearwire’s legacy WiMAX network, also familiar to first generation 4G Sprint customers who used it before the launch of LTE service.

Clearwire’s higher frequency spectrum never penetrated buildings well and did not reach as far as wireless signals on lower frequencies, which meant Clearwire was required to build a large cellular network to deliver reasonable service. Sprint inherited 17,000 Clearwire-enabled cell sites in the deal, many deemed redundant. A Sprint filing with the Securities & Exchange Commission indicated Sprint was shutting down no fewer than 6,000 of those sites by the end of this year, with the remaining transitioned to TD-LTE service as part of the Sprint Spark project.

The change will allow Sprint to better monetize its 2.5GHz spectrum by selling usage-based plans and more expensive home wireless broadband service. It’s the second major wireless technology shutdown organized by Sprint. In 2013, Sprint shut off the last 800MHz iDEN Nextel cell site inherited from its acquisition of Nextel. Sprint now provides LTE 4G service over the frequencies formerly used by Nextel.

Page was not happy with Clearwire’s alternative through Sprint, and remarkably the representative then suggested his family should sign up for Comcast service instead.

“I was floored to hear a representative working on behalf of Sprint recommend Comcast,” Page said.

It isn’t the first time Clearwire has done this:

Unfortunately, the Page home is not serviced by Comcast and DSL from CenturyLink is not an option either. Page and his immediate neighbors are instead joining a group “family plan” on a wireless carrier and will share a Wi-Fi hotspot that can reach three homes. It technically violates the terms and conditions of most family plans to share a connection in this way but it is the only affordable choice the families have for now.

Those rural Clearwire customers who cannot subscribe to cable or DSL broadband might also explore some options from Wireless ‘n WiFi, which sells high limit 3G/4G LTE plans that work on Sprint’s 3G and 4G networks.

Their current plan offers up to 60GB of usage per month, up to 30GB of which can come from using Sprint’s 3G network. The service costs a still steep $109.99 a month (including all taxes and fees) and comes with additional startup costs:

Some lighter users report reasonably priced service is available from FreedomPop, as long as you are careful to avoid over 10GB of usage per month ($59.99) and you turn off revenue generators like automatic top-off and other various extras they pitch (including data rollover if you find you use up most of your monthly allowance anyway).

Still Paying After All These Years: Verizon Raised NY Landline Rates for Phantom FiOS

Verizon's FiOS expansion is still dead.

Verizon customers in New York are paying artificially higher telephone rates justified to encourage Verizon investment in FiOS fiber to the home upgrades most New York State communities will never receive.

Starting in 2006, the New York Public Service Commission granted Verizon rate increases for residential flat-rate and message-rate telephone service and a 2009 $1.95 monthly increase for certain residence local exchange access lines to encourage Verizon’s investments to expand FiOS fiber to the home Internet across New York State.

“We are always concerned about the impacts on ratepayers of any rate increase, especially in times of economic stress,” said then-Commission chairman Garry Brown in June 2009. “Nevertheless, there are certain increases in Verizon’s costs that have to be recognized. This is especially important given the magnitude of the company’s capital investment program, including its massive deployment of fiber optics in New York. We encourage Verizon to make appropriate investments in New York, and these minor rate increases will allow those investments to continue.”

After Verizon announced it was suspending further expansion of its FiOS project a year later, the company continued to pocket the extra revenue despite reneging on the investments the PSC considered an important justification for the rate increases.

“The commission allowed Verizon rate increases in 2006 and 2008 based, in significant part, upon the assumption that the revenue from the higher rates would lead Verizon to invest in fiber optic lines, presumably for the benefit of wireline customers,” argues a coalition of state legislators, consumer groups, and unions. “Serious questions exist regarding the extent to which funds may instead have been used to build out the network for the benefit of wireless customers. Publicly available reports, while fragmentary, suggest that Verizon may have included construction costs for significant benefit of its wireless affiliate to be included in the costs of the Verizon New York wireline company, thus adding to its costs and tax losses.”

shellAlmost a decade later, Verizon is still receiving the extra revenue while some public officials complain Verizon is not meeting its commitments even in cities where Verizon has introduced FiOS service.

Last week New York City Mayor Bill de Blasio ordered all future city contracts with Verizon be reviewed and authorized by City Hall. City officials complain Verizon promised in 2008 it would make FiOS available to every city resident no later than mid-2014. A year later, the service is still not available in some areas.

Verizon has blamed access issues and uncooperative landlords for most of the delays, but city officials are not happy with Verizon’s explanations.

“They [Verizon] have to demonstrate to us that they are good corporate actors if they want us to use our discretion in ways that benefit them,” the mayor’s counsel, Maya Wiley, told the New York Post.

Meanwhile, upstate New York residents now indefinitely bypassed by Verizon FiOS want a refund for the rate increases that were supposed to inspire Verizon to keep expanding fiber optics.

“Verizon has made at least $250 from me and every other upstate customer for nine years of broken promises,” said Penn Yan resident Mary Scavino. “Not only don’t they offer us fiber optics, we cannot even qualify for DSL service from them. If you can’t get Time Warner Cable in the Finger Lakes, you often don’t have broadband at all. It is them or nothing. Where did our money go?”

Fred, a Stop the Cap! reader in the city of Syracuse, thinks the PSC should immediately revoke the rate increases and force Verizon to refund the money to customers who will not get upgraded service.

“It’s not like Verizon cannot make money in a city like Syracuse,” writes Fred. “It’s clear the CEO thinks even more money can be made off Verizon Wireless customers off the backs of landline customers, and the PSC continues to look the other way while they do it.”

Verizon claims it has lost money on its copper wireline network for years, something the PSC seems to accept in its 2009 press release announcing rate increases:

The rate increases will generate much needed additional short-term revenues as the company faces the dual financial pressures created by competitive access line losses and the significant capital it is committing to its New York network. For 2008, Verizon reported an overall intrastate return of negative 6.7 percent and a return on common equity of negative 48.66 percent. The current trend in the market is toward bundled service offerings, and Verizon believes the proposed price changes to its message rate residential service will encourage the migration of customers towards higher-value service bundles.

That migration costs New York ratepayers even more for telephone service. Verizon’s website prompts customers seeking new landline service to bundle a package of long distance discounts and calling features that costs in excess of $50 a month before taxes, fees, and surcharges. Bundling broadband costs even more. Verizon does not tell customers ordering online they qualify for a bare bones landline with no calling features and pay-per-call billing for less than half the cost of Verizon’s recommended bundle.

More than three dozen New York State legislators also question whether Verizon’s “losses” are actually the result of Verizon’s purposeful “misallocation of costs” — moving expenses to the landline business even if they were incurred to benefit Verizon’s more profitable wireless division.

“The result has been massive cost increases for consumers, especially for the garden-variety dial tone service at the bottom of the technological ladder,” argues their 2014 petition. “For example, in New York City […] since 2006 the price of residential ‘dial tone’ service (one line item on the bill) went up 84%, while other services, such as inside wire maintenance, went up 132%.”

The petitioners claim there is evidence to dispute Verizon’s assertion its legacy copper network is as big of a money loser as the company suggests, thanks to “cooking the books” with accounting tricks. The petitioners want the PSC to order a review of Verizon’s books to be certain consumers are not being defrauded or manipulated.

From 2009-2013, Verizon New York reported losses of over $11 billion dollars, with an income tax benefit to Verizon Communications of $5 billion, and significant tax revenue losses for state, city and federal governments. Verizon New York has apparently paid no state, city or federal income tax for the last five years or more.

If Verizon is using accounting tricks to inflate the cost of legacy landline service while reducing costs to its wireless service, it could prove a win-win for Verizon and a lose-lose to ratepayers. Verizon could use its “losses” to argue for greater rate increases for landline customers while further reducing its tax obligations. On the wireless side, Verizon would enjoy praise from Wall Street analysts and shareholders pleased by the company’s apparently effective cost controls.

The best evidence of these techniques in action are the statements of company officials which suggest wireless costs are being paid by wireline customers.

Verizon’s chief financial officer, Fran Shammo, indicated to investors that Verizon wireline construction budgets are charged for expenses related to wireless service.

“The fact of the matter is wireline capital — and I won’t get the number but it’s pretty substantial — is being spent on the wireline side of the house to support the wireless growth,” Shammo told investors at Verizon at Goldman Sachs Communacopia Conference, Sept. 20, 2012. “So the IP backbone, the data transmission, fiber to the cell, that is all on the wireline books but it’s all being built for the wireless company.”

“It seems to me Verizon Wireless, already considered the Cadillac of wireless companies, doesn’t need a hidden subsidy from Verizon paid for by ratepayers all over the state,” Fred argues. “It seems very curious to me Verizon pioneered a large regional fiber optic upgrade that just a few years later it considers too costly to continue expanding, even as AT&T, Google, Comcast, and other companies are now entering the fiber business. A Public Service Commission that wants better broadband for New Yorkers ought to get to the bottom of this because it just doesn’t look right.”

Media General Yanks 16 Of Its TV Stations Off Mediacom Cable Systems Nationwide

media generalMediacom subscribers in 15 cities lost 16 Media General-owned over the air stations from the cable lineup in a retransmission consent dispute just as a Major League Baseball All-Star Game to be shown on some of them was about to get underway.

Most of the stations are in smaller cities served by Mediacom and include:

logo_mediacom_mainMediacom claims Media General was seeking excessive compensation to renew its carriage agreement with the television stations. Customers were told in a letter signed by Tom Curtis that some stations were demanding more than double the old rate to renew the contract.

“Not only was Media General demanding more than double the money, the price they set for KWQC [in Davenport, Iowa] was significantly more than any other broadcast station we carry,” Curtis wrote. “If we agreed to Media General’s demands, KWQC would have become the most expensive broadcast channel in all of the 1,500 communities that Mediacom serves across 22 states. Further, other broadcasters would follow and begin demanding to be paid the same as Media General, driving up costs for other channels on your lineup.”

This is the second time in four years customers have lost the stations. When LIN Media owned several of the outlets in 2011, it refused cable carriage for more than a month over a similar dispute.

Verizon: Take Our Phone Service Or You Get No DSL Broadband from Us

verizon-protestVerizon will not let you cancel their landline phone service unless you are also ready to lose DSL broadband as well.

It is one more way Verizon is trying to stem landline losses in areas where they offer less than stellar DSL service on lines the company has long since stopped upgrading.

“Verizon hasn’t offered standalone High Speed Internet (DSL) service for more than three years,” Verizon spokesman Harry Mitchell told USA Today in an e-mail. “So, if a customer with HSI and voice service wants to disconnect his voice service, we will disconnect the voice service and the HSI service.”

Verizon claims this practice benefits customers by helping the company “competitively price service.”

Dropping landline service while keeping broadband has allowed some phone customers to save $20 a month or more by turning off their landline and moving to cheaper broadband-delivered telephone service. But not if their phone company happens to be Verizon.

For now, the best option customers have is to downgrade their landline service to the cheapest “message unit” plan available, which charges 7-9c for each outgoing call and has no calling features. But you will have to call Verizon to do it — Verizon hides the fact it even offers economy landline service on its website.

In contrast, AT&T, Frontier, CenturyLink, Windstream, and FairPoint all allow customers to choose broadband-only service.

Suddenlink Introduces Gigabit Broadband Service and Slaps 550GB Usage Cap On It

SuddenlinkLogoSuddenlink’s Operating GigaSpeed has reached parts of Texas, Missouri and North Carolina — the first areas to get 1,000/50Mbps service from the cable company. But customers are not happy to learn it is accompanied by a 550GB usage cap.

The first markets qualified for gigabit service include:

  • Bryan-College Station, Texas;
  • Nixa, Mo.;
  • Greenville and Rocky Mount, N.C.

Customers learning about the faster speeds tell Stop the Cap! they are deeply disappointed Suddenlink has kept a cap on the premium-priced speed tier.

greenville“Here in Greenville they are charging $110 a month for the service, $5 for a cable modem or $10 for a Wi-Fi router, and a $35 mandatory technician visit fee which sounded reasonable until they mentioned there was a 550GB data allowance on the service,” said Stop the Cap! reader J.J. Wallace. “That killed it for me. That is nothing short of outrageous to charge that kind of money and place a ridiculously low cap on it. It’s funny the local newspaper and Suddenlink’s press releases never bother to mention the usage cap.”

Wallace says he avoids usage caps by subscribing to Business Class service, which carries no usage allowance but forces him to a slower speed tier to keep things affordable. A 50/8Mbps business plan costs around $80 a month with modem rental and Suddenlink does not mind selling it to residential customers who refuse to deal with a usage cap.

“That is just about the most affordable plan they have that is tolerable,” Wallace writes. “If you want gigabit speeds on a business account, that will run you at least $575 a month plus equipment fees.”

“Suddenlink is no Google Fiber,” adds Pitt County resident Jennifer Davis. “Google is coming to the Triangle and Charlotte and can easily sell gigabit service for $40 less with absolutely no usage cap or equipment fees. Suddenlink wants another shake of our pocketbooks to grab even more money from us. You can’t even buy your own modem for gigabit service. You have to rent theirs. My area of the county is stuck with Suddenlink like a punishment. As a small business owner who depends on the Internet I am tired of being jerked around by these people.”

Some Suddenlink customers have managed to score better deals for broadband by threatening to leave Suddenlink for the phone company, often CenturyLink, AT&T, or Windstream.

gig city“If you impress on them they are charging too much, they will often find a promotion for you, but so far I’ve had no luck getting them to waive the caps unless you switch to business service,” said Wallace. “They always act like you are the first person to complain about usage caps, but if you read their social media pages, there are many others very upset to find they’ve lost unlimited use service after Suddenlink introduced speed upgrades. Most of my friends would rather have unlimited than faster service you can’t use.”

As for speed upgrades, the communities now qualified for gigabit service will find some changes as Suddenlink adjusts their Internet tiers:

  • Internet 50: 50/5Mbps is the new base speed with a 250GB cap
  • Internet 100: 100/10Mbps comes with a 350GB cap (current 75Mbps customers upgraded to this tier)
  • Internet 200: 200/20Mbps comes with a 450GB cap (current 100Mbps customers upgraded to this tier)
  • Internet 1 Gig: 1,000/50Mbps comes with a 550GB cap
  • Overlimit Fee: $10 per 50GB of usage, not pro-rated

Suddenlink is pushing existing DOCSIS 3.0 technology to its practical limit offering gigabit service. The latest DOCSIS 3.0 chipsets in newer model cable modems can bond up to 32 downstream channels, enough to support up to 1.2Gbps. To make room for gigabit speeds, Suddenlink needs to migrate its cable television offering to an all-digital format in the cities where it offers the fastest service. It also needs to retire any remaining legacy DOCSIS 2 modems still in use.

Operation GigaSpeed will offer gigabit broadband to all Suddenlink customers in the markets where the service is offered. The company considers that an advantage over Google Fiber and AT&T U-verse with GigaPower, which is only available in certain neighborhoods.

DOCSIS 3.1, expected to make gigabit speeds available more widely on cable systems, is expected to begin market trials as early as later this year with an expectation it will begin to see wider deployment in 2016.
