The Return of Court TV: Law and Order Networks Struggle to Gain Carriage

In the era of cord-cutting, getting a new, independently owned cable network on cable lineups can be an exercise in futility.

With most new channel additions coming as part of renewal agreements with major cable network owners or sports teams, launching a new 24-hour cable network and getting it on the lineup has never been so difficult. That isn’t stopping a relaunch of Court TV — a well-known former cable network that literally burned its logo into some television sets that were reliably tuned to coverage of the murder trial of O.J. Simpson, which ran from January-October, 1995.

“Court TV was a top-20 cable network and at the height of its popularity when the network was taken off the air in 2008,” said Jonathan Katz, CEO of Katz Networks. “Today, while consumer interest in the real-life drama of true-crime programming is at an all-time high, there is no dedicated daily court coverage on television. We expect the new Court TV to fill that void on cable, satellite, over-the-air and over-the-top.”

Katz Networks, a division of E.W. Scripps Co., has acquired the rights to the Court TV name and other intellectual property from its old owner, Time Warner (Entertainment). That includes over 100,000 hours of pre-recorded programming and trial coverage in the Court TV archives. The new venture has hired Vinnie Politan, a former Court TV presenter, as its lead anchor. The new Court TV has also hired back some of its old employees who either left the network or transitioned to its replacement – Tru TV.

The new Court TV will run 24 hours a day, everyday, and is expected to concentrate on live coverage of high-profile trials.

The thought of bringing back Court TV has not been enough to attract much attention from the cable industry. When the network launches in May 2019, it is expected to achieve coverage in 25% of cable homes at best. Most viewers will be able to watch Court TV as a digital subchannel offered by a local over-the-air station. Katz already specializes in running digital sub-networks, including Bounce (African-American targeted channel) and Laff (comedy).

Tribune Broadcasting will carry Court TV in 22 markets, including New York; Los Angeles; Chicago; Philadelphia; Dallas-Fort Worth; Houston; Miami-Fort Lauderdale; Denver; St. Louis; Seattle-Tacoma, Washington; and Sacramento, Calif.

Eight Scripps markets will carry Court TV, including Tampa, Fla.; Detroit; Cleveland; Cincinnati; Las Vegas; Tulsa, Okla.; Green Bay, Wis. and Tucson, Ariz.

Entravision Communications’ 10 Court TV markets include Boston; Orlando, Fla. and Wichita, Kan.

Univision Communications will carry the network in San Antonio; Albuquerque, N.M. and Bakersfield, Calif.

Citadel Communications will air Court TV in Providence, R.I.

Court TV already has at least one minor competitor. Dan Abrams, a former well-known Court TV personality who now hosts the popular A&E show Live PD, also runs the Law & Crime Trial Network, which relies primarily on live video streaming online to attract viewers. While the network has garnered little attention since it began streaming multiple feeds of live trial coverage over its website, YouTube, and Facebook Live, it did attract A+E Networks, which announced its involvement in the project in March, 2018.

Like Court TV, Abrams’ Law & Crime depends on live trial coverage during the day and analysis and documentary-style programming at night. So far, it is free to watch. Its future may be overshadowed by the higher profile return of Court TV, however, unless A+E bundles it into its suite of networks offered to cable and satellite providers.

Net Neutrality… Violated: Nearly Every U.S. Wireless Operator is Throttling You

Nearly every wireless provider in the United States is intentionally slowing down your data service, detrimentally affecting smartphone apps and video streaming.

That is the conclusion of researchers at Northeastern University, University of Massachusetts — Amherst and Stony Brook University, studying the results of more than 100,000 Wehe app users that have run 719,417 tests in 135 countries verifying net neutrality compliance, before and after the open internet rules were repealed in the U.S. earlier this year.

The raw data collected from the app is used as part of a validated, peer-reviewed method of determining which ISPs are throttling their customers’ connections and what services are being targeted.

Nearly Every Mobile Provider Is Throttling Your Speed, Even on “Unlimited” Plans

The researchers concluded that nearly every wireless provider is throttling at least one streaming video service, some reducing speeds the most for customers on budget priced plans while higher value customers are throttled less. No ISP consistently throttled all online video, setting up an unfair playing field for companies that benefit from not being throttled against those that are. Few customers noticed much difference in the performance of streaming video  after the repeal of net neutrality in the U.S., largely because the wireless companies involved — AT&T, Verizon, T-Mobile, Sprint and others — were already quietly throttling video.

“Our data shows that all of the U.S. Cellular ISPs that throttled after June 11th were already throttling prior to this date,” the researchers wrote. “In short, it appears that U.S. Cellular ISPs were ignoring the [former FCC Chairman Thomas] Wheeler FCC rules pertaining to ‘no throttling’ while those rules were still in effect.”

Summary of Detected Throttling

For each ISP, the researchers included tests only where a user’s set of tests indicated differentiation (speed throttling of specific apps or services) for at least one app and did not detect differentiation for at least one other app. This helps to filter out many false positives. As a result, the number of tests in this table is substantially lower than the total number of tests Wehe users ran. The researchers sorted the Cellular ISPs based on the number of tests from users of each ISP. If they did not detect differentiation, researchers used the entry “Not detected.” The researchers claim that offers enough evidence that throttling is not happening. In some cases researchers do not have enough tests to confirm whether there is throttling, indicated by “No data.”

Sprint’s Skype Throttle

The researchers found that video was not the only service impacted by speed throttles. Sprint (and its subsidiary, prepaid provider Boost), for example, is actively throttling Skype.

“This is interesting because Skype’s telephony service directly competes with the telephony service provided by Sprint,” the researchers wrote. But curiously, the throttle almost entirely impacts Android phone users, while iOS devices have less than a 4% chance of being speed throttled. But isolating the exact trigger for throttling remains elusive, the researchers claim.

“While we have strong evidence of Skype throttling from our users’ tests, we could not reproduce this throttling with a data plan that we purchased from Sprint earlier this year,” the researchers admit. “This is likely because it affects only certain subscription plans, but not the one that we purchased.”

When asked to comment, Sprint said: “Sprint does not single out Skype or any individual content provider in this way.” The test results indicate otherwise, suggest the researchers.

T-Mobile’s “Boosting” Throttle Can Mess Up Streaming Video

Some providers, like T-Mobile, attempt to sell their throttled speeds as pro-consumer. In return for reduced definition video, customers are free to watch more online content over their portable devices without it counting against a data cap. But T-Mobile’s video throttle is unique among providers as it initially allows a short burst of regular speed to buffer the first few seconds of a streamed video before quickly throttling video playback speed. Many video players do not expect to see initial robust speeds quickly and severely throttled. Consumers report video playback is often interrupted, sometimes several times, as the player gradually adapts to the low-speed, throttled connection. Consumers receive lower quality video as a consequence.

T-Mobile Plays Favorites

Through extensive testing, research found throttling begins after a certain number of bytes have been transferred, and it is not based strictly on time; below is a list of the detected byte limits for the “boosted” (i.e., unthrottled video streaming) period.

More concerning to the researchers is their finding that video apps are treated differently by T-Mobile.

“T-Mobile throttles YouTube without giving it a boosting period, while T-Mobile does not throttle Vimeo at all,” the researchers report. “Such behavior highlights the risks of content-based filtering: there is fundamentally no way to treat all video services the same (because not all video services can be identified), and any additional content-specific policies — such as boosting — can lead to unfair advantages for some providers, and poor network performance for others.”

The team of researchers had just one conclusion after reviewing the available data.

“Net neutrality violations are rampant, and have been since we launched Wehe,” the researchers report. “Further, the implementation of such throttling practices creates an unlevel playing field for video streaming providers while also imposing engineering challenges related to efficiently handling a variety of throttling rates and other behavior like boosting. Last, we find that video streaming is not the only type of application affected, as there is evidence of Skype throttling in our data. Taken together, our findings indicate that the openness and fairness properties that led to the Internet’s success are at risk in the U.S.”

The team “strongly encourages” policymakers to rely on fact-based data to make informed decisions about internet regulations, implying that provider-supplied data about net neutrality policies may not reveal the full impact of speed throttles and other traffic favoritism that is common where net neutrality protections do not exist.

Fixed Wireless Not a Good Solution for Rural Areas; Usage Demand Outstrips Capacity

Australia is learning a costly lesson finding ways to extend broadband service to rural areas in the country, choosing fixed wireless and satellite networks that will ultimately cost more than extending fiber optic broadband to rural customers.

Australia’s National Broadband Network (NBN) is tasked with supplying virtually all of Australia with internet access, using fiber/wired broadband in urban and suburban areas and fixed wireless and satellite internet access in the country’s most remote locations.

But just a few years after debuting satellite broadband and fixed LTE 4G wireless service in many parts of the country, demand has quickly begun to overwhelm capacity, forcing costly upgrades and punitive measures against so-called “heavy superusers.” The NBN has also scrapped plans to introduce higher-speed fixed wireless services, fearing it will only create additional demands on a network that was not envisioned to manage heavy broadband usage from video streaming.

NBN CEO Bill Morrow has elected to place most of the blame on his customers, specifically “superusers” that he characterized as “online gamers” who spend hours during the day and peak usage periods consuming large parts of the fixed wireless network’s available capacity.

“In the fixed wireless, there’s a large portion [of end users] that are using terabytes of data,” Morrow said. “We’re evaluating a form of fair use policy to say, ‘We would groom these extreme users.’ Now the grooming could be that, during the busy period of the day when these heavy users are impacting the majority, that they actually get throttled back to where they’re taking down what everybody else is taking down.”

Under the current NBN fair use policy, monthly downloads per household are capped at 400 GB, with maximum usage during peak usage periods limited to 150 GB a month, which is already significantly less than what most average American households consume each month. With expensive and unexpected early upgrades to more than 3,100 cell towers to manage rapidly growing usage, the cost of service is starting to rise substantially, even as usage limits and speed reductions make these networks less useful for consumers.

In areas where the NBN extends a fiber optic network, the fixed wholesale price for a 50/20 Mbps connection is $32.00 (U.S.) per month. (A 100/40 Mbps connection costs $46.25). For fixed wireless, prices are rising. A 50/20 Mbps fixed wireless connection (with usage cap) will now cost $46.25 a month.

Morrow took heat from members of Parliament over his claim that online gamers were chiefly responsible for slowing down the NBN’s fixed wireless network.

“With great respect to everything you said over the last 15 minutes, you have been saying to us the problem here is gamers,” said MP Stephen Jones (Whitlam).

Morrow clarified that online gamers were not the principal cause of congestion. The main issue is concurrency, which drags down network speeds when multiple family members unexpectedly use an internet connection at the same time. The worst congestion results when several family members launch internet video streams at the same time. Online video not only leads average users’ traffic, it can also quickly outstrip available cell tower capacity. High quality video streaming can quickly impact 4G LTE service during peak usage periods, driving speeds down for all users. The NBN now considers these newly revealed capacity constraints a limit on the feasibility of using wireless technology like LTE to supply internet access.

The current mitigation strategy includes limiting video bandwidth, discouraging video streaming with usage caps or speed throttles, capacity upgrades at cell towers, and public education requesting responsible usage during peak usage times. With capacity issues becoming more serious, Morrow canceled plans to upgrade fixed wireless to 100 Mbps speeds because of costs. The proposed upgrades would have cost “exponentially” more than wired internet access.

The concept of supplying fixed wireless or satellite internet access to rural areas may have made sense a decade ago, but there are growing questions about the suitability of this technology based on growth in consumer usage patterns, which increasingly includes streaming video. The cost to provide a sufficiently robust wireless network could easily rival or even outpace the costs of extending traditional fiber optic wired service to many rural properties currently considered cost prohibitive to serve. In Australia, fixed wireless and satellite has delivered sub-standard access for rural consumers, and requires the imposition of “fair usage” caps and speed throttles that inconvenience customers. For now, Morrow believes that is still the best solution, given that Australia’s national broadband plan relies heavily on wireless access in rural communities.

“[The benefit of a fair usage policy is] big enough to where if we did groom them during the busy time of the day, it would be a substantial [speed] lift for people,” he said. “I don’t think there’s a silver bullet in any of this – this is going to require us to think through a number of different areas.”

Charter’s SpectrumU on Campus Gets Little Interest from Students

Charter Communications has been quietly testing a streaming video lineup of services on selected college campuses in its service area — so quiet very few students know or care about the service.

In Rochester, N.Y., Charter this year introduced SpectrumU at two suburban colleges – St. John Fisher and Nazareth College. The 50+ channel service at St. John Fisher includes five local network stations, but not the low-powered MyNetworkTV or secondary CW affiliate that are found on the traditional local cable lineup. According to Nazareth’s channel list, SpectrumU at the college comes from Spectrum Enterprise’s Fiber Connect service and lists six network affiliates on the lineup imported from Buffalo, a city 70 miles away. The service is accessible around each campus on the schools’ Wi-Fi networks.

Charter wants participating colleges to set aside a 1Gbps connection to manage Wi-Fi streaming for every 5,000 students on campus. Stop the Cap! found anecdotal evidence Charter may be dramatically overestimating how many students actually use the service. A recent visit to both campuses and guest participation in online college forums found almost zero interest in SpectrumU at either college. Students, it seems, have mostly moved on from linear, live television and do much of their viewing on-demand from other streaming services and apps.

Charter Communications kept publicity and expectations low for the service, setting the monthly subscription price for SpectrumU at $0.00. No password or authentication is required to use the service, and logging into the campus network is simple at schools like Nazareth, where the Wi-Fi password GoldenFlyers was easy to come by on and off campus. While driving around, we could easily access SpectrumU from Wi-Fi on streets surrounding St. John Fisher, although Nazareth’s wireless network was tougher to reach on a tree-lined campus set further back from the main road.

Charter dictates the terms and availability of the service, which requires participating schools to subscribe to Charter Spectrum’s Enterprise Fiber Connect service, which supports campus internet and video services. Schools must offer:

  • Charter Clear QAM or fiber video services
  • Charter fiber internet services (preferred)
  • 1Gbps dedicated bandwidth per 5,000 students (~500 concurrent users) recommended
  • Wi-Fi network utilizes WPA or WPA2 encryption
  • Public IP addresses/ranges for whitelisting
  • PAT IPs are supported
  • IP requirements: IPv4: /24 – IPv6: /48
  • AP’s consistent with current fifth generation Wi-Fi technology, 802.11ac (no older than fourth generation 802.11n)

SpectrumU is designed to work exclusively over Wi-Fi, and only with portable smartphones and tablets:

  • iPhone, iPad, or iPod touch running iOS 8 or above
  • All major Android smartphones and tablets running Android 4.2 or above
  • Kindle Fire Phone, all Kindle Fire models except for the 1st generation model

There is no support for streaming set-top boxes like Roku or Apple TV and SpectrumU works differently from the QAM cable TV service available in many dorm rooms. Casting isn’t supported either. The Android version of the app only attracted 69 mixed reviews as of the date of this article.

Charter seems convinced SpectrumU will soon replace traditional internet video streaming, telling campus managers that the service will have “minimal impact if the school’s internet service is robust today, as SpectrumU usage will replace usage of other streaming apps.”

Students doubt it.

“I have never heard of SpectrumU and don’t care,” said Cody, a student we ran into in the parking lot at Nazareth. “I have Amazon Prime and Netflix and I’m good with that.”

Hobart and William Smith Colleges in Geneva, N.Y., are also an early adopter of SpectrumU.

Zephyr, a freshman at St. John Fisher who lives on campus said she doesn’t know anything about the service either, although a roommate in her friend’s dorm room brought their QAM-equipped television to school and can watch the campus TV lineup on it.

“Her boyfriend is a Buffalo Bills fan so he watches the games on her TV, but we really don’t watch it ourselves,” she told us. “Everyone has their own phone or tablet and most people are sharing  passwords from home to watch HBO, Hulu, or Amazon stuff.”

Dylan’s password trading brings him access to Hulu, Amazon, Netflix, CBS, and Sling TV. Even with SpectrumU available for free with no password required, he doesn’t care, preferring to watch on-demand content on his tablet or the PlayStation he brought to school.

“I don’t know anyone who watches Spectrum TV and their company sucks anyway,” said Dylan. “I hate ads and I pretty much only binge watch stuff now, so this is useless for me.”

A few students told us they did bring televisions to campus to watch live television, but many just use an antenna. Nazareth and St. John Fisher are only a short distance from Pinnacle Hill, the location for most Rochester television transmitters, and reception is easy.

“Televisions are what our parents watch,” Serena at Nazareth told us. “I don’t know anyone my age with cable.”

Stop the Cap! tested the Android version of the app at both colleges. It reminds us of Spectrum’s streaming TV app, only less capable. The app does not support DVR-type recording, pause and rewind, or on-demand services — things college students would probably look for the most. We experienced occasional buffering watching CNN in a parking lot, but note Wi-Fi signal strength was not ideal. We also found, despite warnings in student handbooks, a number of student-run hotspots and wireless access points. At one dorm at St. John Fisher, we found over 60 Wi-Fi signals competing with the college’s own wireless network.

Cable companies believe by offering cable services to college students, they will get hooked on those services and subscribe after they leave college. But evidence suggests those under 30 are increasingly unlikely to pay for a cable television subscription and are dubbed “cable-nevers” for having no interest in subscription television. They are, however, avid users of streaming services like Netflix and Hulu.

online-videoThe average American broadband-equipped household now uses 190GB a month, more than 95% of which is online video, according to a new report from iGR Research.

The detailed 125-page study of broadband speeds and usage, priced at $1,950, included some surprising changes in usage patterns.

In the past, as consumers upgraded their broadband plan to get faster speeds, their corresponding usage also increased. But iGR Research found that trend is no longer true as speed increases accelerate.

Iain Gillott, president of iGR Research, noted households with higher-speed connections don’t necessarily consume more data than those with lower-speed connections. Once broadband speeds achieve a rate fast enough to support high quality online video, further speed increases don’t always result in substantially higher consumption.

Gillott pointed out his own family recently upgraded to a 200Mbps connection and found little change in their monthly usage. That could be a problem for internet providers that cap customer usage while blaming increased demand.

“If we download a movie, it used to take 20 minutes to get HD. Now it takes three,” Gillott told Telecompetitor. “But it doesn’t mean we use any more data; it’s just that it took longer.”

Gillott noted customers upgrading from a slow speed DSL connection are another matter. Because DSL may only be able to support one or two concurrent video streams, many customers intentionally limited their simultaneous use of the internet to maintain usability. But once speeds increase to manage online video demands, usage often increases.

The report, U.S. Home Broadband and Wi-Fi Usage Forecast, 2015-2020, does forecast advancements in online video are likely to drive usage substantially higher than the current broadband allowances offered by many providers. The growth in 4K video alone could spike usage to as much as 500GB a month.

“What drives usage is more high-definition [content],” commented Gillott. “It doubles the amount of data used.”

Online video is driving almost all the usage growth in the United States. Gillott points to a cultural change in how television programming is being viewed in the United States. In short, fewer people are sharing time together watching the same show. Today, many people watch their own shows on their own devices.

“TV has become a personal activity,” said Gillott. “If you have four people in a household now, that means four times the data going in.”
