Supreme Court Helps Verizon Wireless Thumb Nose at Customers Upset Over Unilateral Cell Fees

Thanks to a divided 5-4 decision by the U.S. Supreme Court, customers trying to seek relief from unilateral fees and surcharges suddenly showing up on their Verizon cell phone bills will have to pursue individual arbitration claims with the cell phone company instead of joining forces in a class arbitration claim.

That Supreme Court case, AT&T Mobility v. Concepcion, is turning out to benefit Verizon Wireless as much as AT&T, because the Supreme Court found merit in contracts obligating customers to seek individual arbitration to settle differences while forbidding customers from pursuing organized legal action.

Now the 3rd U.S. Circuit Court of Appeals in Philadelphia has reversed an earlier ruling, reinstating a 2008 decision by U.S. District Judge Freda Wolfson that delivered victory to Verizon Wireless.

At issue was Verizon’s decision in October 2005 to unilaterally impose an “administrative fee” of $0.40 and/or $0.70, as part of the monthly charges for each Verizon cell phone line.  Customers upset with the new fees felt they violated the principle that, as part of their two year contracts, Verizon would deliver a fixed-price service.  The cell phone company has since implemented a variety of fees and surcharges on customers that are pocketed by Verizon, regardless of the contract price.

All Verizon Wireless customers are obligated by contract to challenge any terms and conditions they disagree with through an arbitrator of Verizon’s choosing, at a place also chosen by the company.  That means Verizon could place an arbitrator on retention in a city potentially thousands of miles away, and demand the customer make their case there, to an arbitrator whose livelihood ultimately depends on retainer fees paid by the company.  Few consumers would make such a journey to protest a fee that amounts to less than $10 a year per line.

Lawyers Keith Litman and Robert Wachtel, representing Verizon customers, decided to try a different approach — a class action arbitration.  The two attorneys would represent potentially millions of impacted customers themselves, making any travel cost concerns incidental, and providing a seasoned challenge before arbitrators, who would also hear counter-arguments from Verizon’s own legal team.

Verizon’s attorneys argued such class action arbitration was specifically forbidden in the company’s contract with customers.  Normally, a judge might decide at that point a customer agreeing to those terms and conditions was effectively up the creek.  But a series of legal challenges in circuit courts opened the door to invalidating those terms.

Litman and Wachtel argued that because the New Jersey Supreme Court, in Muhammad v. County Bank of Rehoboth Beach, Del. (2006), has held that an arbitration provision in a consumer contract that precludes class arbitration of low-value claims is unconscionable under New Jersey law, similarly, the arbitration provision in Verizon’s contract is also unenforceable.

Unfortunately for the two attorneys representing consumers, the decision by the U.S. Supreme Court effectively overrode that case, leaving Verizon on top with Judge Wolfson’s 2008 decision.

Wolfson’s written ruling on the case seemed unimpressed with claims that Verizon’s fees were unconscionable:

In this case, Plaintiffs are customers who chose Verizon as their wireless provider at least four years ago and continue to use Verizon today. They signed the customer Agreement with the arbitration clause and agreed to subsequent terms of service as added by Verizon. Plaintiffs do not allege that they did not understand the Agreement that they voluntarily entered into nor do they allege fraud or misrepresentation. The parties agreed “to settle [their] disputes . . . only by arbitration,” and the “agreement doesn’t permit class arbitration.” Therefore, [federal law] requires this Court to uphold the arbitration provision within Plaintiffs’ service Agreement.

But Judge Wolfson did recognize the effective impact of her decision:

“The Court recognizes the many hardships visited upon plaintiffs, such as in this case, based upon this ruling. First, it creates the opportunity for a different result depending on whether the case is brought in federal or state court. Second, it is also clear that compelling individual arbitration in this case will be tantamount to ending the Plaintiffs’ pursuit of their claims, as there is very little possibility that these Plaintiffs or any other plaintiff will pursue individual arbitration for claims that amount only to several dollars in damages. While this outcome is harsh, this Court is bound by Third Circuit precedent.”

Lately, Verizon Wireless customers have been seeking other forms of relief when Verizon unilaterally changes or implements new fees or surcharges.  Many are invoking the “materially adverse” clause found in Verizon’s terms and conditions, which theoretically allows customers to exit their contracts penalty-free if they do not agree to the changes Verizon is imposing on customers.  Verizon Wireless appears to be increasingly aggressive in fighting these claims, too, refusing to allow customers to leave without stiff early termination fees.  That may become the subject of another lawsuit at some point in the future.

Phone Sabotage: Frontier & Verizon Customers in Upstate NY Face Service Outages

Frontier Communications’ landline customers in Lewis and Oneida counties faced long distance service outages, while just about everyone in northern Oneida County is without both landline and cell phone service after fiber lines serving cell towers and landline customers were cut Monday.

The New York State Police have launched a criminal investigation into the sabotage, while Verizon Communications implies the damage might have come as a result of a strike against the company that began last weekend.

The largest outage, which cut off cell service and landlines, originated in Deerfield, where cables were severed.

Several upstate communities are facing lengthy service outages from a variety of acts of vandalism, most from cable cuts and damage to junction boxes.

Verizon has rushed out news releases regarding the damage, offering a reward of up to $50,000 for information leading to the arrest and prosecution of individuals that intentionally damage Verizon cables or facilities or cause or attempt to cause physical injury to any Verizon employee or contractor.  Verizon urges anyone who witnesses sabotage of Verizon property or any suspicious activity to call 911 immediately, then call the Verizon Security Control Center at 1-800-997-3287.

Both sides of the dispute are now appealing to Congress to intervene, an action that may not bring immediate results.  Both the House and Senate are currently in their five-week summer recess.

Verizon Wireless Customers: 48 Hours Left to Secure Unlimited Data/Unlimited 4G Tethering Plans

At the end of business Wednesday, Verizon Wireless will end its unlimited data plans for new customers.  If you are an existing customer, you will be able to retain unlimited data for your smartphone indefinitely, but those considering an upgrade to 4G may want to consider doing so immediately, if you want to have an unlimited 4G tethering plan for your 4G-capable phone.

Verizon Wireless data pricing effective 7/7/2011

New Verizon Wireless Customers: You must buy and activate a 3G/4G-capable phone on Verizon’s network no later than 11:59pm Wednesday evening to qualify for the $29.99 unlimited data plan.  At this point, this means buying a phone from Verizon Wireless’ website or visiting a local store.  If you want the best possible price, we recommend calling Verizon Wireless and negotiating with them directly.  Verizon is often able to match prices from online retailers like Wirefly or Amazon, usually by throwing in service credits for your first month’s invoice.  New 4G customers can score an unlimited tethering add-on plan from Verizon for an additional $30 a month.  That means $29.99 for the data plan plus $30 for the tethering option, but if comes without any usage limits.  After July 6, all those new to tethering will only find one option: $20 for up to 2GB of tethering access.

Existing Verizon Wireless Customers: You will keep your current unlimited smartphone data plan indefinitely, perhaps even after upgrading your phone.  However, if you were interested in tethering on Verizon’s 4G network, consider upgrading to a 4G phone before Thursday to qualify for the $30 unlimited tethering plan, good only for 4G users with an existing tethering relationship with Verizon.  You must select the 4G tethering option before Thursday to qualify.  Call Verizon Wireless at 611 from your handset and make sure they take care of this for you to avoid complications.  An automatic update will be pushed to the Thunderbolt, Charge, and Revolution on July 7 to cut off the Hotspot free ride those customers had been enjoying up until now.  You will have to buy the service if you want to continue using it.  All 3G phones (iPhone, Droid X, etc.) will not see any pricing changes for 3G tethering – it is still $20 a month for up to 2GB of usage, no unlimited options for you.

Other pricing details:

  • Verizon customers opting for the $30 for 2GB plan will lose company discounts on their data plan.  You must select a higher-cost data plan if you want to keep any employer discount;
  • Verizon is now specifically prohibiting tethering any of their phones without a Verizon add-on tethering option.  This means third-party tethering apps you may have used before now violate your contract with them.

iPhone 5 Arrives in September: 4G/LTE Support Unlikely, But Will Sport Significant Improvements

Apple’s wildly popular iPhone series gets an upgrade in September as the Cupertino, Calif., company prepares to unveil iPhone 5.  Although the new model is not expected to support 4G/LTE networks, significant upgrades are in the works for the next series of phones:

  • iPhone 5 will use Apple’s new iOS 5, which means improved messaging and photo sharing;
  • An improved 8-megapixel camera, up from the current 5-megapixel one that got mixed reviews on iPhone 4;
  • The introduction of the A5 processor, currently used in iPad 2, to provide more power for apps and features;
  • An edge-to-edge screen and rounded glass.

The iPhone currently accounts for half of Apple’s revenue and has almost an 18% share of the smartphone market and dropping.

To counter Google’s increasing share of the smartphone market with its Android operating system, Apple also promises to deliver a stripped-down, less powerful budget-priced iPhone series for the developing world.  While prices have not been announced, the new budget phone is likely to be priced at least $100-200 less than western models.

With iPhone 5 also expected to include built-in support for either GSM or CDMA networks, Apple’s newest phone could be released simultaneously by both AT&T and Verizon.

Whether customers will be able to take their phones activated on one carrier to another is another matter, as is whether Sprint, T-Mobile, and smaller carriers will be allowed to sell it.

Even without support for 4G/LTE, iPhone 5 is still likely to generate considerable enthusiasm, especially among would-be Verizon customers waiting for the next version of the phone.  But by then, unlimited data plans will be a dream.  Bloomberg News and WFXT-TV in Boston discuss iPhone 5’s release, and a clip from CNBC’s ‘The Titans’ explains the marketing genius of Apple and its iPhone product line.  (2 minutes)

Updated: Verizon Empty Bank Account Syndrome: Company Blames “Glitch” in Debit Payment System

More than 200 Verizon customers in Pennsylvania found their checking accounts balance-challenged when Verizon accidentally withdrew as much as $400 from those already paid in full.

Stop the Cap! reader Chandalee in Pittsburgh sent word her family’s checking account saw a surprise withdrawal from Verizon amounting to hundreds of dollars which helpfully paid for another customer’s past due balance.

“I was outraged when I saw Verizon cleaned us out, and I only learned about it when my debit card was declined at the grocery store — an incredibly embarrassing situation,” Chandalee shares.  “If we didn’t have bank reform, our bank would have probably charged us another $300 in bounced debit transaction fees before we learned about what Verizon did.”

Chandalee logged into her bank’s website when she got home and discovered the surprise charge from Verizon.

“I called them on the phone, they hung up on me twice, then told me they didn’t know what I was talking about,” Chandalee says. “I told them I have nearly 400 reasons they were working my last nerve and if they didn’t want to see my face in theirs, they had better put back my money.”

Verizon accused Chandalee of being rude.

“They don’t know what rude is,” she retorts.  “I asked for a supervisor and the woman — Ms. Jefferson or something, tells me she is the supervisor, and I told her get someone who supervises her ass on the line real quick.”

Finally, someone noticed her account was already paid in full and they couldn’t find evidence of the extra withdrawal, leading to a new series of questions about whether she had a Verizon Wireless account and maybe she meant to call them instead.

“As if Verizon isn’t also Verizon Wireless… it sure looks like the same red “V” to me — besides I have Sprint,” Chandalee said.  “They don’t know who they are dealing with.”

After logging more than two hours on the phone with Verizon, the stalemate ended in a draw.  Verizon wanted copies of the bank statement showing the charges and Chandalee was speed dialing her bank to reverse them.

Last Thursday, the mystery was solved when WTAE-TV in Pittsburgh reported Chandalee wasn’t the only customer suffering from Verizon Empty Bank Account Syndrome.  It turned out a “system glitch” was responsible for payments being withdrawn from the “wrong accounts,” and Verizon promised a quick fix.  Chandalee wonders if the only way to get Verizon’s attention is to call the local TV station whenever the bill is wrong, because they sure didn’t listen to her when she called.  In the end, her bank reversed the charges and Chandalee told Verizon to delete all auto-debit information on her account.  “I will write these people my own check from now on,” she says.  “People need to watch their bank accounts so this doesn’t happen to them.”  (2 minutes)
