Cloud Storage Hype Meets Internet Overcharging Realities As ISPs Feel Threatened (Again)

This week, the tech community has been buzzing over new entrants in the world of cloud computing.  Apple’s iCloud in particular has sparked enormous media coverage as the company plans to encourage customers to access all of their favorite content over their broadband connection.  Apple is also moving towards online distribution of many of its software products, including the forthcoming OS X Lion operating system, suggesting consumers can pass up traditional physical media like CD-ROMs or DVDs.

Cloud storage theoretically allows you to store your entire music, video and photo collection online for easy access from any device.  Watching the 20-somethings buzz about 100GB+ secure file lockers and the end of traditional file storage as we know it has been amusing, but these people need to get their heads out of the clouds.  Unless they become politically involved in America’s broadband debate, it is not going to happen the way they hope it will.

Tech entrepreneur?  Meet broadband provider reality check: the Internet Overcharging usage cap and “excessive use” pricing scheme.

While Steve Jobs was introducing iCloud, broadband providers and their industry friends have been ruminating over the impact all of this new traffic will have on their broadband networks.  In an homage to former AT&T CEO Ed Whitacre’s “you can’t use my pipes for free,” the drumbeat for implementing “control measures” for cloud computing and video traffic has been amplified several times over by certain providers, Wall Street analysts, and their trade press and equipment supplier lackeys.

One alarmed provider pondered the impact of iCloud in terms of their past experience with iTunes, which also spiked traffic when it was first released.  Others balk at the notion of consumers using broadband platforms to move entire libraries of content back and forth, especially on wireless networks.  The only sigh of relief detected?  Apple won’t start iCloud with video content — just music, at least at first.

The enemies list

The biggest targets — the companies that get a lot of pushback from providers for using “their networks” to earn millions for themselves are Google, Netflix, Amazon and Apple.  Each of them are rapidly moving into the online entertainment business, threatening to provoke more cable TV cord-cutting.  Netflix is now responsible for 30 percent of online traffic during primetime hours, a fact that some use as an accusation — as if Netflix should be held to account for its own success. Amazon has opened its own cloud based music storage and is also increasingly getting into online video content streaming.  Apple has a novel approach at handling its forthcoming iCloud music feature which should save hours in uploading, but the company is also moving towards online distribution of a growing proportion of its software, including the huge bug fixes and upgrades that will easily exceed a gigabyte if you own several Apple products.

Google is a frequent Washington target and honestly delivers the only truly effective corporate pushback to anti-consumer broadband pricing some providers have contemplated.  In fact, Google is putting its money where its mouth is building a gigabit network larger providers repeatedly scoff at as unnecessary, too costly, and too complicated.

While millions in venture capital funds new online innovations, only a miniscule amount of money is being spent to counter the lobbying major providers are doing in Washington to redefine the broadband revolution in their terms, complete with usage pricing that bears no relation to cost, arbitrary usage limits, and ongoing lack of true competition.

Online innovation is grand, but allowing providers to strangle it with Internet Overcharging schemes guarantees to end the party real fast.

Individually, none of the new cloud services are likely to blow out usage caps in excess of 100GB, but in combination they certainly could.  Anyone using online file backup, cloud storage of video and large music collections, uses Netflix or other online streaming services, and spends lots of time on the web will easily approach the limits some providers have established.  That doesn’t even include large software updates.  Unless you have an unlimited usage plan on the wireless side, don’t even think about using most of these services with AT&T’s 2GB monthly wireless usage cap.

In the handful of countries with ubiquitous Internet Overcharging, little of this will pose a problem — companies won’t launch cloud computing services in markets where usage caps will effectively keep customers from using them.

That is why it is critical for some of America’s largest technology companies to get on board the fight against Internet Overcharging, and demand Washington recognize broadband as a utility service that should be wide open and usage cap free.  The evidence is right in front of you.  Time Warner Cable CEO Glenn Britt recognizes the fact broadband is an essential part of our lives today, which is why he is confident enough to keep raising the price and charging even more in the future.  It’s not about “network congestion,” “building the next generation of broadband,” or “pricing fairness.”  Stop the Cap! started at ground zero for Time Warner Cable’s 2009 version of “pricing fairness” — $150 a month for an unlimited use broadband account that likely cost major providers less than $10 a month to provide.  It’s about pure, naked profiteering, unchecked by free market competition in today’s broadband duopoly.

Unless a company like Google can vastly expand its own broadband rollouts, it is increasingly apparent to me (and many others), we may have to move towards an entirely different model for broadband in the United States — one built on the premise of the Interstate Highway System.  One advanced, publicly-owned fiber network open to all providers on which telecommunications services can travel to homes and businesses from coast to coast.

Nobody says private companies shouldn’t be able to compete, but every day more evidence arrives they will never be inclined to deliver the next generation of service that other countries around the world are starting to take for granted.  They will instead protect their current business models at all costs, even if that means throwing America’s broadband innovation revolution under the bus.

Broadcasters Successfully Shutters Ivi TV With Court Injunction

The same judge responsible for cutting the legs out from under FilmOn has ruled ivi must cease retransmitting network affiliate stations that make up the bulk of its service.

In a widely-expected ruling, the Hon. Naomi Rice Buchwald, U.S. district judge for the Southern District of New York proved to be a sympathetic judge to the interests of America’s largest broadcasting companies by mirroring an earlier decision blocking virtual online cable systems from retransmitting broadcast television programming online.

According to the court’s ruling, ivi doesn’t qualify as a cable system because, in part, it’s too new of a concept.  Buchwald ruled that the definition of a cable system was written in 1976, before the Internet was around to redefine it.  Under the Copyright Act, any cable system can rebroadcast TV signals so long as they pay copyright fees.  This “compulsory license” gives cable systems the right to carry broadcast stations, but only to cable operations subject to oversight by the Federal Communications Commission.

But since the FCC does not regulate Internet video, ivi doesn’t qualify for this provision of the Act, according to Judge Buchwald.

“First, a service providing Internet retransmissions cannot qualify as a cable system,” the ruling said. “Second, the compulsory license for cable systems is intended for localized retransmission services, and cannot be utilized by a service which retransmits broadcast signals nationwide. Third, the rules and regulations of the FCC, even if found not to be binding on a service such as ivi, are integral to the statutory licensing scheme established in 1976.”

Buchwald issued a similar ruling against FilmOn, another virtual online cable system.  Broadcasters sought the same venue to hear their latest case against ivi in hopes the judge would rule similarly, and she did.

As a result, ivi closed down its streaming service this morning pending a planned appeal:

FilmOn, the controversial online video service has quietly pulled most major British networks from their streaming service, creating a significant, and unexplained, gap in their service.

The company’s constantly-changing lineup has been a major source of frustration for many would-be subscribers.  What you see today may not be what you can still see tomorrow, and the loss of nearly 10 networks from the company’s $10 monthly service will no doubt anger paying customers.

No explanation was given about the sudden departure of the channels.

FilmOn has also been devoting time and attention to promoting new viewing options for iPad users and other owners of portable viewing devices.

But potential subscribers still face a very confusing assortment of packages which are not easily found on the website, and are not well explained — in many cases no description of what comes included with different packages is provided.

FilmOn continues to face lawsuits from broadcasters upset about being included on the service without their permission.

Netflix to Broadband Industry: Please Don’t Kill Us With Usage Caps

Last week, Netflix CEO Reed Hastings was showered with questions from Wall Street during the company’s third quarter-results conference call.  At the top of the agenda — the company’s shifting business model away from DVD rentals-by-mail gradually towards instant on-demand streaming over broadband networks.

At issue is how Netflix can survive a broadband industry that controls the pipeline Netflix increasingly depends on for its continued existence.

Hastings tried to assuage his cable competitors by telling investors the company is hardly a threat to cable-owned movie channels and basic cable.  But he admits ultimately the company will be in a real mess if Internet Overcharging schemes like usage caps and speed throttles limit the amount of content customers can affordably access:

“We have some vulnerability depending on capped usage and what happens. Comcast has a cap, but it’s 250 gigabytes and so most users feel that they have an unlimited experience, and it gives us plenty of room to deliver a high-def stream. On the other hand, AT&T Mobile data on an iPad is now capped at two gigabytes, [and that’s] not enough room to deliver hours and hours of high-def.  We are definitely sensitive [to the issue] in the long term [whether] the industry ends up at 250 gigabytes or two at the other extreme.”

There is some limited evidence Netflix’s success in Canada is already being tempered by usage limits near-universally imposed in the country.  Rogers, a major cable company in eastern Canada, even reduced usage caps for certain tiers of service around the same time Netflix announced its imminent arrival north of the border.

Barry McCarthy, Chief Financial Officer notes fewer Canadians are converting their free trials of Netflix’s streaming service into paid subscriptions.

“We anticipate we are seeing slightly lower conversion rates in Canada than we see in the U.S.,” McCarthy told investors.

As Netflix moves towards higher quality video streams, the amount of data consumed increases as well.  In Canada, that eats into broadband usage allowances, and fast. As soon as customers start receiving warnings they are nearing their monthly usage limit, or receive a broadband bill with overlimit fees, Netflix is likely to lose that customer.

Cable and phone companies in Canada are already warning customers that online video is a major culprit of exhausted usage allowances.  Both are also happy to remind their customers they are happy to sell them access to unlimited video — through cable or telco TV subscriptions.  Rogers owns a major chain of video rental stores as well.

What can Netflix do about usage capped broadband?  Not much, admits Hastings.

“There is a not a lot of improvement in compression techniques. But what we can do is just deliver a lower bit stream, a lower quality video experience. So, for example, not too high-def. So, that’s one possible way to partially mitigate that impact,” Hastings said.

Netflix will soon face increasing competition, especially from the cable industry’s TV Everywhere projects, and they won’t deliver a lower quality video experience.

Time Warner Cable and Comcast this month both formally introduced their respective video on demand services.

Comcast’s Xfinity online service arrives after months of beta testing.   Comcast customers can watch video selections from nearly 90 movie and television partners, including programming from HBO, Viacom, and Paramount.  Ultimately, the online video service is expected to deliver access to dozens of cable channels and individual programs from studios and networks at no charge to those who subscribe to a cable television package.

Time Warner Cable took a more modest approach last week by introducing ESPN Networks to its cable subscribers who register with the cable company’s MyServices website.  The new customer portal allows subscribers to review and pay their cable bill, add new services (but not cancel existing ones), remotely program DVR boxes, and also verifies subscriber status for future cable subscriber-only online video programming.

Netflix may soon find itself at the mercy of the cable and telephone companies which deliver broadband access to the majority of Americans.  Not only is it difficult to convince customers to pay a monthly fee for programming the cable industry may eventually give away for free, it may be downright impossible for Netflix to survive if those providers decide to squeeze the customer’s pipeline to unlimited Netflix content.

ESPN Finally Launching Online for Time Warner Cable Subscribers Oct. 25th

After weeks of delays, Time Warner Cable says it will finally open access to ESPN’s multi-channel streaming service Monday, Oct. 25th.  The service will be available to Time Warner Cable subscribers, and is free of charge.

ESPN’s streaming service was included in a deal signed in early September between the cable company and Disney-ABC, which owns the sports network.

Time Warner Cable has been working with ESPN’s website technical staff to build and test the online verification system that is the foundation of Time Warner Cable’s implementation of TV Everywhere.  The cable company plans to offer a library of on-demand video and live streams of many cable channels free of charge, but only to authenticated, current customers.

It is all part of an effort by the cable industry to stop cable customers from canceling their cable-TV subscriptions.  An increasing amount of online content produced by cable networks is expected to eventually be placed behind the TV Everywhere system.  Existing cable subscribers will get access to streamed live channels and on demand programming for free, but non-subscribers will be locked out.  Cable networks can decide how much of their programming will be a part of the project, but cable industry insiders predict there will be increasing pressure on them to keep most of their shows off the open Internet.

While the channels will be free-to-stream for subscribers now, several cable networks are exploring whether to charge cable companies extra programming fees for online viewing rights.  If that becomes popular, online viewing options may eventually carry monthly fees of their own.

ESPN says most of its online streaming will contain no advertising until the network builds enough viewers to justify selling ads targeting online audiences.

Verizon Inc. reached a similar agreement with Disney in October for its FiOS TV service. The originally planned launch date for Verizon customers was Jan. 18th, but if authentication tests with Time Warner Cable are successful, FiOS customers may get access much sooner.
