Consumer Revolt May Force Harper Government to Reverse CRTC Decision on Overcharging

Prime Minister Harper's government is facing an open revolt by Canadian consumers over Internet Overcharging.

A full-scale revolt among consumers across Canada has brought the issue of Internet Overcharging to the highest levels of government.

A spokesman for Prime Minister Stephen Harper said the government is very concerned about a decision from the Canadian Radio-television and Telecommunications Commission that has effectively forced the end of unlimited use broadband plans across the country.

Both the Liberal and NDP parties have made a point of protesting the CRTC decision, which happened under the Conservative Party’s watch.  Harper’s Industry Minister Tony Clement stepped up his remarks this morning which hint the government is prepared to quash last week’s decision by the CRTC, which has already forced price increases for broadband service across the country.

“The decision on its face has some pretty severe impacts,” Clement told reporters in Ottawa after NDP and Liberal critics in the House of Commons repeatedly pounded the government on the issue of so-called “usage-based billing.”

“I indicated the impacts on consumers, on small business operators, on creators, on innovators. So that’s why I have to work through a process, cross my T’s, doc my I’s. When you’re dealing with a legal process, that’s what you have to do. But I will be doing that very, very quickly, and getting back to the prime minister and my colleagues very, very quickly,” said Clement.

As of this morning, more than 286,000 Canadians have signed a petition protesting the Internet Overcharging schemes.

The protest movement has now been joined by small and medium-sized business groups who fear the impact new Internet pricing will have on their businesses.

Richard Truscott, with the Canadian Federation of Independent Business, normally a group that prefers less government action, said his members are demanding a stop to the pricing schemes before they get started.

“The vast majority of small businesses rely on reasonably-priced Internet service to conduct their operations,” he said. “Generally this is the sort of thing that hits the most innovative sector with higher costs.”

Most cable and phone companies are lobbying Ottawa politicians to keep the new usage-based billing schemes, and several are pretending the protest movement doesn’t exist.

AgenceQMI, a cable-company owned wire service, is also coming under fire for misrepresenting Clement’s positions on the pricing schemes in a news report issued yesterday.  The wire service claimed Clement supported the CRTC’s position, something Clement adamantly denied this morning.

The National Post, a self-described conservative newspaper, this morning published an editorial supporting usage-based pricing, claiming a handful of users were creating a problem that light users should not pay to solve.  But many readers leaving comments on the article strongly disagreed, claiming the newspaper is out of touch.

Although the regime of usage caps, speed throttles, and overlimit fees have been in place with most major providers for at least two years, the culmination of several events in the last six months have brought the issue to the boiling point:

  1. The arrival of Netflix video streaming, which provides unlimited access for a flat monthly fee;
  2. The ongoing limbo dance among several providers who are reducing usage allowances when competitive threats arrive;
  3. The increase in providers now enforcing usage limits by billing consumers overlimit fees that spike broadband bills;
  4. Recent examples of bill shock, which have left some consumers with thousands of dollars in Internet charges.

Kevin Brennan, a graphic designer who works from home and downloads large files from clients, was first hit with extra charges in November, which cost him $34 above his usual Shaw bill.

“I’d never been contacted about going over before,” he told the Calgary Herald, adding he was also over in December. “Thirty-four dollars doesn’t seem like much, but over the course of a year it adds up.

“What concerns me, outside my own business, is the lack of innovation people will be able to do. And it makes Shaw a monopoly. . . . if you watch TV or the Internet, you pay more to them.”

Shaw reduced its usage allowance for customers like Brennan late last year from 75 to 60GB on its most popular broadband plan.  It also now enforces a $2/GB overlimit fee.

John Lawford, counsel for the Public Interest Advocacy Centre, told the Herald the concern isn’t just that smaller companies can no longer offer unlimited plans, which reduces competition.

“The phone and Internet and cable companies of the world are playing it both ways. They’re saying, ‘Well, there’s these big data hogs that are using too much, we’ve got to punish them to keep the price down.’ On the other hand they’re buying media companies so they have stuff to shove down the wires, which doesn’t count toward your cap,” Lawford said. “That’s anti-competitive.”

Most Canadian media companies are now tightly integrated with large telecommunications companies.  CTV, Canada’s largest commercial network, is now owned by Bell, the country’s biggest phone company.  Rogers, Shaw, and Videotron — the largest cable companies in Canada own cable and broadcast stations, newspapers, and magazines.  They also control cellphone companies, Wi-Fi networks, and have interests in satellite providers as well.

When a competitor like Netflix arrives to challenge the companies’ pay television interests, turning down consumers’ broadband usage allowances discourages cord-cutting.

The CRTC’s decision to allow Bell to charge usage-based pricing for wholesale accounts was the final death blow to unlimited Internet according to several independent service providers, because virtually all of them rely on Bell — a company that received taxpayer subsidies to build its broadband network — for access to the Internet.

TekSavvy, a company that used to offer unlimited use plans, can do so no more.  In a statement to customers, TekSavvy laid blame on regulators for being forced to increase prices.

“From March 1 on, users of the up to 5Mbps packages in Ontario can expect a usage cap of 25Gb (60Gb in Quebec), substantially down from the 200Gb or unlimited deals TekSavvy was able to offer before the CRTC’s decision to impose usage based billing,” read a statement sent to customers.

TekSavvy spokeswoman Katie do Forno said the CRTC decision is a disaster for Canadian broadband in the new digital economy.

“This will result in unjustifiably high prices and a reduction in innovation,” said do Forno. “I think it’s going to change behavior about how people use the Internet.”

The company underlines the point by including “before and after” pricing schedules on its website, an unprecedented move.  Shaw, western Canada’s largest cable company, was heavily criticized for trying to hide their reduction in usage allowances.

Ottawa residents are planning direct action to protest the decision this Saturday.  Shawn Pepin is organizing the protest rally.

“What they’re doing right now looks like a cash-grab scheme, and people aren’t going to take it,” he said.

Shaw Sneakiness: Company Lowers Usage Limits, Hopes Nobody Noticed

Shaw sets the bar lower.

Shaw Cable, western Canada’s largest cable company, has quietly lowered usage caps on virtually all of their broadband plans, while “forgetting” to change the date on their Terms of Service:

  • Lite was 13GB, now increased to 15GB ($2/GB overages)
  • High Speed was 75GB, now decreased to 60GB ($2/GB overages)
  • Xtreme was 125GB, now decreased to 100GB ($1/GB overages)
  • Warp was 250GB, now decreased to 175GB ($1/GB overages)
  • Nitro was 500GB, now decreased to 350GB ($1/GB overages)

Shaw’s terms of service page documents changes implemented by the cable company and includes the revision date, changed whenever the terms change.  Not this time.  Blogger “Thewunderbar” documented Shaw left the revision date on the document unchanged, suggesting the cable company hadn’t made any adjustments to their service since July, 2010.  After publishing his piece, Shaw quietly updated their website to reflect the correct date.

Cable and phone companies in Canada have established a unique, unchecked duopoly.  They are systematically increasing prices while decreasing the amount of service provided to Canadian consumers.  Shaw’s decrease in usage limits comes with no corresponding price cut for Internet service.

At a time when Netflix streaming is attempting to make inroads into Canadian homes, broadband providers who also have interests in pay television (cable, phone or satellite) are working overtime to make sure no consumer believes they can safely cancel their cable-TV service and watch everything online.

Over the past four years, Canadian ISPs have embarked on a wide range of Internet Overcharging schemes:

  • The elimination of flat rate, unlimited broadband service;
  • The introduction of low usage allowances designed to trip up an increasing number of consumers leading to,
  • The introduction of stinging overlimit fees for customers exceeding usage limits, at prices marked up from 500-5000 percent above wholesale;
  • The introduction of speed throttles which artificially slow your broadband experience to speeds sometimes just above dial-up;
  • The ongoing limbo dance of usage caps that decrease in size over time, exposing more consumers to overlimit fees, making them think twice about everything they do online.

Nobody has successfully monetized the broadband experience like Canadian ISPs have.  Even as their costs to deliver the service continue to rocket downwards, companies keep on increasing prices, exposing Canadian consumers to unwarranted bill shock from unjustified overlimit fees.  What does it cost Shaw per gigabyte?  An estimated 1-3 cents.  What do they charge you?  Up to $2.

It’s nothing short of a rip-off, and Stop the Cap! urges Canadian consumers to contact their member of Parliament and demand immediate action to ban these innovation-killing, job-retarding, unjustified overcharging schemes.

Virgin Mobile Gives Up on Unlimited Wireless Broadband: Will Adopt 5GB Cap Feb. 15

Your unlimited experience is about to hit a roadblock.

Sometimes being popular isn’t the best thing in the world.

When Virgin Mobile introduced an unlimited, prepaid wireless broadband plan in August, it created a small media frenzy and shocked an industry that assumed usage-capped wireless broadband was the only way to survive the incredible demand for wireless data.

The company’s introduction of a $40 monthly unlimited-use broadband plan, with no term contract and month-to-month billing was a dream come true for casual vacationers and business travelers who don’t need a two year contract for pricey broadband-on-the-go from one of the major carriers.

When the company unveiled the unlimited broadband plan, as Stop the Cap! reported last summer, the demand was so great it brought the company’s network to its knees.  The prepaid provider, a division of Sprint, has struggled ever since to keep up with customer demand.  This week they announced they were throwing in the towel, quietly notifying would-be customers in the fine print of Radio Shack ads effective with all renewals after Feb. 15, a monthly limit of 5GB would be enforced on its Broadband2Go service.  Several of our readers noticed, including Greg, Sam, Jenny, and others.

“Customers who use BB2Go for typical email, internet surfing and reasonable downloading will likely not be impacted/notice any difference,” Virgin Mobile’s Corinne Nosal told PC Magazine by email.

But those who manage to consume just over 200MB daily will notice when the network speed throttle kicks in for those who “use too much.”  Speeds will be slashed to as low as 256kbps.  If you can’t live with that speed, you can pony up an additional $40 to “renew your account” (even if your month isn’t up yet) and the speed throttle will be removed, until you hit 5GB of usage again.

“So much for Virgin Mobile — 5GB means the service is no better or worse than the other players in the market, and considering the problems Virgin has had with reliable service, I’ll probably go back to using Cricket,” writes our Buffalo reader Lance.

Virgin Mobile relies on Sprint’s 3G network which already gets quite a workout from existing Sprint customers, as well as those using Clearwire (and several “private label” wireless broadband services).  Cricket owns and manages their own network, exclusively for the use of its own customers.

“Cricket will also throttle you if you hit 5GB, but you rarely run into overwhelmed cell tower sites like you do with Sprint’s network,” Lance says.

PC Magazine’s Sascha Segan notes the new usage limits makes using Virgin Mobile broadband a difficult proposition if you love multimedia:

The problem comes if you like video or downloads. Streaming Netflix at 1000kbps (if you can get that speed on the Virgin/Sprint 3G network), you use up about 450MB per hour. Some Windows updates can be up to 200MB alone. Want a TV show from your favorite legal downloading Web site? That’ll be 350MB, thanks.

While there are some small wireless ISPs in some parts of the country, Virgin’s abandonment of truly unlimited high-speed data leaves Sprint 4G/Clear as the only remaining major player willing to take on the wired-Internet oligopoly with an unlimited high-speed, wireless solution.

Cable Stocks Soar, Rationing Broadband With ‘Usage-Based Billing Coming Quickly,” Predicts Analyst

Comcast’s stock price soared today as Wall Street was cheered by news America’s largest cable operator would likely face little regulatory restraint from consumer protection policies designed to keep broadband providers from meddling with Internet traffic.  But investors were also excited by the green light signaled by Federal Communications Commission chairman Julius Genachowski that launching Internet Overcharging schemes like “usage-based” billing, speed throttles and hard usage caps on broadband consumers was also acceptable marketplace behavior.

Craig Moffett, a Wall Street analyst with Sanford Bernstein said Genachowski’s remarks left the marketplace with little doubt it can get away with price increases and new limits on broadband consumption.

“The FCC here is expressly acknowledging the need to ration broadband, and that’s a really big deal,” said Moffett, appearing on CNBC this afternoon.  “I think you are going to start to see usage-based pricing plans from the broadband providers pretty quickly.”

Moffett also acknowledged his firm’s own research showing consumers despise such pricing schemes and admits the impact on America’s broadband landscape is likely to include a dramatic shift in how customers use their Internet accounts.

“When customers think they are going to be charged when they click on that link and watch a movie, they are going to be inclined to watch fewer movies,” Moffett said.  “You can’t expect linear progression of online video because there are going to be feedback loops like usage-based pricing that are going to limit usage.”

Moffett says cable operators are benefiting from Chairman Genachowski’s new approach because it opens the door to repricing wired broadband accounts to limit broadband consumption.  Since most analysts guessed regulators would allow usage-based pricing to remain on wireless broadband, the unexpected green light for similar rationing plans on cable broadband, DSL, and other wired services was welcome news, at least for providers and Wall Street.

Consumers that don’t deliver a resounding negative response to elected officials, the FCC, and the White House better start thinking twice about clicking that YouTube video, because that few minutes could cost plenty if providers slap higher prices and limits on broadband service in the coming year.

ComedyMonday at The Chuckle Hut — AT&T: “Our Customers Like Usage-Based Billing”

AT&T Mobility thinks it has a winning strategy when it took away unlimited data plans, forcing new customers to choose high-priced, usage-limited alternatives.  But a new survey from Wall Street research firm Sanford Bernstein found AT&T customers will grab, claw, and scream to keep the peace of mind that comes from having the choice of an unlimited use plan.

Sanford Bernstein’s study found a large number of customers willing to abandon any carrier that takes unlimited data away from them.  About a third of the more than 800 people responding said AT&T’s move toward usage-based billing left them with a bad impression of the wireless carrier.  That’s particularly bad for AT&T, which already scores as America’s lowest-rated wireless company according to Consumer Reports.

AT&T mitigated some of the potential damage by letting existing customers keep their unlimited data plans when they ceased selling the unlimited option this past June.  New customers are forced to choose between two limited-use plans — $15 for 200MB or $25 for 2GB of usage (a tethering option is also available.)  Existing customers will only face that hard choice if or when they change phones, presumably in the next year or two.

Had they not grandfathered in existing customers, Sanford Bernstein’s research suggests a large proportion of customers forced to give up unlimited data would quit AT&T even if it meant buying a new phone and paying a higher bill just to get the unlimited data option back.  When AT&T eventually forces these customers’ hands, Sanford Bernstein predicts trouble.

According to the study, more than 58 percent of the lowest data users said they would dump AT&T overboard and switch to another provider with an unlimited plan. For heavier users, more than two-thirds are prepared to take their business elsewhere.

But even with overwhelming evidence like that, AT&T and some Wall Street analysts think Internet Overcharging schemes do customers a favor.

“Customers generally have strongly negative perceptions about Usage-Based Pricing, and these are often not correlated with self-interest,” Bernstein analyst Craig Moffett said in a research note analyzing the findings of the survey conducted this past summer. “It is fashionable to argue that loyalty to carriers is dead (except perhaps to Verizon Wireless, whose service level is perceived to be markedly higher than that of its competitors). The new conventional wisdom is that carrier loyalty has been replaced with loyalty to the device. But high inclination to switch carriers and phones to maintain an unlimited plan suggest that perhaps the plan itself is more important than either one.”

The Wall Street firm’s research is hardly news to consumers, who have repeatedly expressed loathing contempt for Internet Overcharging schemes like so-called “usage-based billing,” “data caps,” and speed throttles that kick in when carriers decide customers have used the service enough.

Consumers are willing to pay a higher price just knowing they will never face dreaded “bill shock” — a wireless company bill filled with hefty overlimit fees charged for excessive data usage.  They also have no interest in being penalized by arbitrary usage limits that punish offenders with speed throttles that reduce wireless speeds to dial-up or lower.

AT&T was the first major carrier to throw down the gauntlet and force customers into choosing between a “budget plan” that is easy to exceed at just 200MB of usage per month or an inadequate, overpriced 2GB tier that costs just five dollars less than the now-abandoned unlimited use plan.

Wall Street firms like Sanford Bernstein worry their investor clients may be exposed to a revenue massacre when competing carriers like Verizon Wireless, which retains an unlimited plan for now, unveils its own version of the popular Apple iPhone.  The result could be a massive stampede of departing customers headed for top-rated Verizon Wireless, even if it means paying early termination fees.

AT&T spokesman Mark Siegel sees things very differently however, telling CNET News AT&T’s new limited option plans deliver more choice and flexibility for data-hungry users.

“We have found that our customers in fact like usage-based billing,” he said. “They appreciate having choices in data plans. This is probably because a majority of customers can reduce their costs through our plans.”

If true, Siegel could prove that contention by revealing how many of AT&T’s grandfathered-in unlimited data customers were willing to give up that plan and downgrade to one of the new limited use plans.  Siegel declined.

Moffett told CNET News his firm’s study found large numbers of existing customers using just a few hundred megabytes of usage per month who want to pay for an unlimited pricing plan, if only as insurance.  For many, they recognize the smartphone-oriented explosion of data applications will only grow their usage further in the days ahead, and what may be a tolerable usage limit today will be downright paltry tomorrow.

Underusing an unlimited data plan represents fat profits for AT&T, but doesn’t solve the problem of getting price-resistant customers to upgrade their older phones.  AT&T believes cheaper, limited use plans may do the trick.  But the company also decided to eliminate the unlimited use option, fearing some customers could cannibalize profits by downgrading currently underutilized unlimited service, knowing they could always return to an unlimited data plan when use justified it.

Verizon Wireless Sees the Light And Throws a “Sale” on Its Unlimited Data Plan, But for How Long?

Meanwhile, Verizon Wireless has settled on a more aggressive strategy to win many of its month-by-month customers back to two year service agreements with smartphone upgrades tied to an “unlimited data plan sale” that reminds would-be customers they still offer unlimited data, and gives many the chance to pay $10 less per month for it.

Customers either upgrading a current device to a smartphone on a family plan or adding a new line of service with a smartphone on a family plan will get $10 per month credit for each new smartphone line, for up to 24 months.  Although the plan was originally designed to promote “free extra lines” by crediting back Verizon’s $9.99 charge for each additional line of service, in many markets Verizon salespeople are now spinning the credit as a “sale on the unlimited data plan” instead.

Even primary line customers on a family plan can upgrade to a smartphone and get the credit.

But customers with expired contracts on legacy plans no longer sold by Verizon will have to give those up and start a new Family SharePlan starting at $69.99 per month for 700 shared minutes.  For those on popular retired plans like America’s Choice Family SharePlan, that represents a $10 rate hike for the exact same number of minutes and a loss of features including deducting mobile web use from available minutes instead of charging $1.99 per megabyte for access.

The unlimited data plan will effectively cost $20 a month for each smartphone on the account, and customers who want to use text messaging or other messaging features are likely going to need another add-on plan to cover that, starting at $5 a month.  And then the junk fees and government mandated charges further increase the bill:

  • Tolls, taxes, surcharges and other fees, such as E911 and gross receipt charges, vary by market and as of November 1, 2010, add between 5% and 39% to your monthly bill and are in addition to your monthly access fees and airtime charges.
  • Monthly Federal Universal Service Charge on interstate & international telecom charges (varies quarterly based on FCC rate) is 12.9% per line.
  • The Verizon Wireless monthly Regulatory Charge (subject to change) is 13¢ per line.
  • Monthly Administrative Charge (subject to change) is 83¢ per line.

Still, Verizon’s $10 sale may be enough to convince some customers avoiding smartphone upgrades to take the plunge.  Those doing so until the end of today through Verizon’s website can get free activation of their new phones.

Verizon hopes the offer will push a number of its legacy plan customers to abandon their old plans and grab a new smartphone at a subsidized price, putting those customers back on two year contracts.  The offer expires January 7, 2011 (and the $10 credits stop after 24 months).  The sale is only good on the unlimited data plan.
