A company is testing a solution to video subscription password abuse that will register each device authorized to access streaming video, while giving customers a Forever Login, ending the need to regularly re-enter usernames and passwords to watch.

Synacor is responding to growing concerns from some in the cable industry that subscription television password sharing is allowing unauthorized access to content viewers did not pay to view. The new system is an attempt to upgrade the authenticated TV Everywhere experience to reduce subscriber inconvenience while locking down the number of concurrent devices allowed to view online content.

Currently, when a customer accesses subscription-required content online, they are asked to select their TV provider and then enter their assigned username and password to verify they are a current subscriber to a video package that includes that network. Once authenticated, the network’s website controls how long user credentials are kept before they must be re-entered, as well as how many concurrent viewing sessions from multiple family members are permitted.

TV Everywhere services were originally designed to allow the subscriber and anyone else living within the home to be able to access networks like CNN, HBO, ESPN, and others on portable devices in-home and while on the go. But many customers also share their user credentials with extended family members and friends who do not live at the same address. Unauthorized third parties also occasionally obtain user credentials through brute force hacking and sell them on the black market. The subscriber usually only discovers a security problem with their account when they reach the concurrent viewing limit, which displays as an on-screen message stating the maximum number of viewers are already watching content through a subscription and at least one must disconnect before a new stream can be viewed.

Cable company executives hold a variety of opinions about the seriousness of password sharing. Altice and Comcast, and programmers like Time Warner, Inc., which owns HBO and Cinemax, have not shown much concern about the practice, but Charter/Spectrum executives have, and are leading the charge to lock down subscriber authentication.

Synacor’s new system introduces a new layer of cable company-defined limits on streaming: registering each device allowed to view content as well as checking how many people are attempting to stream content simultaneously.

Under the new system, a customer will be permitted to register a limited number of “trusted devices” allowed access to streamed video content. A cable company, for example, could limit subscribers to two smartphones, one tablet, and one smart/internet-enabled TV or Roku box. Even if the subscriber has other devices, they would have to unregister an existing device before being allowed to register a new one. Additionally, a cable operator could limit concurrent streams to two or three, either per network or per account, regardless of what networks are being watched. That would mean, in one example, a family of four would designate a maximum of five “trusted devices” and be allowed to watch up to three concurrent streams per account. “Bill” could watch ESPN on the bedroom television, “Mary” could watch a murder-mystery on the Hallmark Channel on her tablet on the patio, and “Dylan” could watch a movie on HBO on his phone at the same time. But if “Sara” decided to watch a show on Lifetime on her phone, the system would block the request.

In the past, it was likely all four family members could watch concurrent streams of their shows on virtually any device they like, and they could also share login credentials with “Jeff” — a family member at college, who in turn shared his username and password with the other people living in his dorm room — exactly the kind of thing Charter CEO Thomas Rutledge would like to stop.

Synacor claims its new system is still a positive for consumers because it allows user credentials to be stored in perpetuity, ending the need for frequent logins to re-verify and re-authenticate one’s account, regardless of where they are. Synacor’s executive director of identity services, John Kavanagh, suggests it is a win-win for companies and consumers.

“They wanted to deliver the same user experience benefit…and we brought the trust along with it with device registration,” Kavanagh said. “The end-user experience of home-based authentication really set a high bar. They wanted to take that high bar and extend it elsewhere.”

But many subscribers, especially those with larger families, are likely to balk at the new restrictions, especially if cable operators offer to ease them in return for additional fees. The process of registering devices is also likely to be seen as cumbersome by those not technically proficient, as well as those who own a large assortment of electronic devices.

Multichannel News reports a recent study from Hub Research and CTAM that monitors the TV Everywhere market surveyed 3,491 TV subscribers who watch at least five hours of television a week and discovered 28% claimed that password sharing with friends and family members was okay and permitted by their provider, although generally it is not. Another 33% believed password sharing was allowed for family members who have since moved out of the family home and live elsewhere. No provider authorizes such viewing.

The cable industry generally does not mind password sharing for family members who are traveling or attending school and live outside of the home in a dorm, or watching on a device that belongs to a friend. They do mind if that friend keeps the user credentials and watches programming without their own subscription.

Kavanagh claims the biggest concern is “commercial-level” black market sales of user credentials to third parties who have no relationship to the account owner.

“Once we’re able to register that device securely as part of the sign-in flow, we then connect that with a complete list of devices that have been used with a given subscription,” Kavanagh said. “We not only expose that master list to the end user for their own benefit on things that might be suspicious, but on the operator side, it gives them a depth of awareness they haven’t had before. It allows them to have a fine instrument to enforce their business rules and security policies.”

Both customers and cable operators can see who is currently accessing content using their account and cancel authorization for device(s) they no longer own, lost, or are being used by those who do not have an association with the account holder at all.

The new system is being introduced on an experimental basis to some current customers, starting with Service Electric Cablevision. It is likely similar rollouts will happen with Synacor’s other clients, which include:

  • Telco TV: AT&T, Cincinnati Bell, Verizon, Windstream, CenturyLink
  • Fiber/Cable TV: WOW!, Armstrong Cable, Atlantic Broadband, Cable One, Mediacom, GCI, Hotwire Communications, Charter/Spectrum, Grande Communications

Chicago Extends 9% Entertainment/Use Tax to Almost Everything You Do Online

handoutStarting Sept. 1, Chicago residents will be paying 9% more for everything from Netflix to income tax filing as city officials impose a recently reinterpreted entertainment/use tax on almost every online subscription content provider, even those peddling adult entertainment.

The Chicago Tribune reports the city’s Finance Department has vastly broadened the reach of Chicago’s amusement and personal property lease transaction taxes to apply the 9% tax to virtually any content that a customer borrows, leases, or subscribes to that is not purchased outright. Buying a CD on Amazon.com would not be subject to the tax but a Spotify subscription allowing you to listen to that same CD as long as your subscription is maintained will be taxed. Buying a digital copy of a movie will not be taxed, but watching it through a subscription service like Apple TV, Amazon, or Netflix will be.

Although some are dubbing it the “Netflix Tax,” it will also apply to cloud storage, paid television programming — including satellite, cable, telephone, and online-delivered content, financial and investment services, and almost anything else accessed online with a paid subscription. Even paying to host a website (or having someone manage it for you) will be subject to the tax.

The expanded tax is part of Mayor Rahm Emanuel’s strategy to deal with Chicago’s huge budget shortfall with fees, fines, and broadening taxes. The city predicts the expanded tax will capture up to $12 million a year from Chicago residents and businesses.

“In an environment in which technologies and emerging industries evolve quickly, the City periodically issues rulings that clarify the application of existing laws to these technologies and industries,” mayoral spokeswoman Elizabeth Langsdorf said in a statement issued Wednesday. “These two rulings are consistent with the City’s current tax laws and are not an expansion of the laws. These ensure that city taxation is uniformly and fairly applied and that businesses are given clear guidance on the applicability of the City’s tax laws to their operations, and they clarify that the amusement tax and personal property lease tax apply to digital services.”

Chicago_TheatreChicago residents have paid the amusement tax on movie tickets, local concerts and sports events since at least 1998. The city collects 5% on live theatrical, musical, and other live cultural performances held in an auditorium, theater, or other space whose maximum capacity (including balconies) is more than 750 persons. A 9% tax applies on all other events, but no tax is collected on religious, charitable, and not-for-profit organizations holding events for fund-raising purposes as long as they limit them to two events per year.

A Netflix spokeswoman confirmed that the company will pass the additional cost to subscribers but said no other details were available.

Critics of the tax contend it will be very easy to avoid through the use of payment services like PayPal, which allow customers to specify an out-of-state address — any out-of-state address, valid or not — in the payment details box, allowing residents to avoid the tax. Others are adding the addresses of out-of-state relatives to their credit cards and will use those addresses when placing orders for online content.

“Since they are not mailing you anything, it doesn’t really matter what address you use, as long as it is outside of the city of Chicago,” one anonymous commenter noted.

That is exactly what Michael Wynne, a partner and attorney in the Chicago office of the law firm Reed Smith, predicted would happen, noting Chicago is already replete with high taxes and fees and adding more of them would encourage tax dodging. He assumed businesses will also actively avoid the tax, either by moving their offices out of the Chicago city limits or more likely renting a post office box in the suburbs and using it as a billing address.

“Let’s say I sign up for streaming business data in the city but I have offices throughout the country,” Wynne told the newspaper. “I will definitely make sure my billing goes through a different office.”

Wynne believes many Chicago residents may not understand the 9% tax will apply to a lot more than just Netflix. He called the expansion staggering in its breadth in his analysis, excerpted below.

The Unamusing Amusement Tax: It Could Apply to Almost Anything

The Amusement Tax ruling will extend the tax to streaming services for music, movies, games, and the like, as well as satellite TV delivered to a customer located in Chicago. However, the ruling does not impose the Amusement Tax on the same content when it is permanently downloaded by a consumer. The Lease Transaction Tax ruling extends the tax to the online procurement of real estate listings, car prices, stock prices, economic statistics, and “similar information or data that has been compiled, entered and stored on the provider’s computer.” In addition, under the ruling, the Lease Transaction Tax will apply to the online procurement of “word processing, calculations, data processing, tax preparation” and “other applications available to a customer through access to a provider’s computer and its software.” In the ruling, the Department expressly notes that these “examples are sometimes referred to as cloud computing, cloud services, hosted environment, software as a service, platform as a service, or infrastructure as a service.”

reedThe Amusement Tax is imposed on patrons of every amusement within the city. “Amusement” is broadly defined, and it includes “any entertainment or recreational activity offered for public participation or on a membership or other basis,” and “any paid television programming, whether transmitted by wire, cable, fiber optics, laser, microwave, radio, satellite or similar means.”

The Amusement Tax ruling specifically taxes charges paid for the privilege of the following amusements delivered to a patron in the city: (1) “watching electronically delivered television shows, movies, or videos”; (2) “listening to electronically delivered music”; and (3) “participating in games, on-line or otherwise.” As a consequence, streaming a movie, listening to streaming music, or playing a game on a smartphone or tablet will now trigger a 9% tax on the subscription charge for those services if those activities are done at a location in Chicago. Furthermore, the ruling addresses “bundled” transactions, by providing that “unless it is clearly proven that at least 50% of the price” is not for the amusement, the entire charge, except for any separately stated non-amusement charges, is subject to the Amusement Tax. That suggests great care must be paid to invoicing services when including any item that might be construed to be an amusement. The ruling does not differentiate between news, current events, sports, movies, music or other types of television programming. As a consequence, an establishment that charges patrons for access to television programming of any sort, plus other goods and services (e.g., a bar that imposes an admission charge for a pay-per-view event that includes food and beverages) may have to navigate the bundling rules.

The ruling provides examples of when the tax applies, such as when performing legal research or similar on-line database searches, to obtain consumer credit reports, or “real estate listings and prices, car prices, stock prices, economic statistics, weather statistics, job listings, resumes, company profiles, consumer profiles, marketing data, and similar information or data that has been compiled, entered and stored on the provider’s computer.” In the ruling, the Department specifically identifies taxable leases of personal property to include “cloud computing, cloud services, hosted environment, software as a service, platform as a service, or infrastructure as a service.” This is quite an expansion for a concept evolved from taxing agreements for time-sharing on mainframe computers, and that has only been judicially tested once, involving legal research in the city on terminals provided by the legal search provider, in days that preceded the creation of the World Wide Web, and the expansion of fiber-optic networks that made possible the Internet networks relied on to deliver many of the services the ruling now targets. See, Meites v. City of Chicago, 184 Ill. App. 3d 887 (1989). The rulings represent a further evolution of the city’s approach under the Lease Transaction Tax to disregard contract terms and recharacterize transactions to fit its tax code definitions; it is doubtful that any consumer or provider of subscription Internet streaming services thinks they are contracting to lease tangible personal property.

Wynne says Chicago officials have expanded the scope of its tax ordinances to their absolute limit, if not further. He also fears Chicago could give other cities and states ideas for new taxes.

“If any state or local governments were wondering how to tax transactions occurring in the Cloud when legislative authority for such taxation is absent, the Department has just sketched a roadmap,” he wrote.

Wynne believes the time to stop these kinds of taxes is now, before they have a chance to spread, or worse, start being collected.

He writes there are strong arguments that Chicago’s creative reinterpretation of its 9% tax is illegal, running afoul of the Federal Telecommunications Act, the Internet Tax Freedom Act, and federal and Illinois constitutional limits on taxation. But while the rulings are likely to be challenged in court, Chicago officials still expect providers to start handing over the 9% tax proceeds beginning this fall. Those that don’t will run into Chicago’s tax penalty buzzsaw – 12% interest on delinquent taxes, a 25% penalty, and a lengthy bureaucratic process (bring your attorney) dealing with the city’s administrative hearings office.

Charter CEO: Net Neutrality No Deterrent to System Upgrades, Investment

Despite claims from Net Neutrality critics that increased oversight of the broadband business would lead to reduced investment and upgrades, Charter Communications CEO Thomas Rutledge said the new rules would have no effect on Charter’s investment plans.

Last week Rutledge sat down with FCC chairman Thomas Wheeler to discuss Charter’s proposed merger with Bright House Networks and Time Warner Cable. He was joined by Catherine Bohigian, Charter’s executive vice president for governmental affairs and FCC general counsel Jonathan Sallet and senior counselor Phil Verveer.

“Mr. Rutledge explained that the transactions will bring substantial consumer benefits, including providing a better Internet experience for watching on-line video, gaming, and using other data-hungry apps at more competitive prices, and that the mergers will not harm competition,” according to a one page filing with the FCC disclosing the meeting.

Despite repeated claims from pro-industry policy wonks that Net Neutrality and Title II oversight of cable broadband would cause operators to reconsider their investment plans, Rutledge made it clear Charter’s spending plans are unaffected.

“Mr. Rutledge agreed that the Commission’s decision to reclassify broadband Internet access under Title II has not altered Charter’s approach of investing significantly in its network to deliver cutting edge services including: the fastest entry-level broadband service (60 Mbps) with unlimited usage; out-of-home Wi-Fi hotspots; a state-of-the art, cloud-based user guide, allowing search and discovery across linear, video on demand and online content; open, non-proprietary downloadable security; and an innovative video app with hundreds of live and downloadable channels and the ability to display over-the-top content seamlessly on the television,” the disclosure continues.

Charter’s chief executive said the company supports Open Internet rules, including no throttles or blocks on lawful content and no paid prioritization. But he does worry about regulatory uncertainty while the FCC explores its expanded powers of oversight.

Justice Department Nearing Decision to Block Comcast-Time Warner Cable Merger

comcast twcStaff attorneys that have reviewed details of the Time Warner Cable/Comcast merger proposal are prepared to make a recommendation as early as next week that the Department of Justice should block the deal because it is anti-competitive and anti-consumer.

The staff in the Justice Department’s antitrust division have spent more than a year reviewing documents submitted by both cable companies to determine what impact the merger would have on the cable television and broadband landscape.

Bloomberg News today reported the attorneys did not like what they saw and believe the merger would harm consumers. For the first time, a cable company merger deal was reviewed not so much for its impact on cable television programming, but on broadband.

When the Federal Communications Commission redefined broadband as an Internet connection of at least 25Mbps, Comcast suddenly found itself the largest broadband provider in the country. If the merger with Time Warner Cable is approved, Comcast will have a 56.8 percent market share of U.S. broadband customers, far exceeding any other provider.

In upstate New York, Comcast would have more than a 75% market share — nearly 9o% if you just consider non-Verizon FiOS areas. In California, Comcast would control more than 80% of the market, not only picking up Time Warner Cable customers, but Charter customers in Southern California as well. 

Comcast and Time Warner Cable have argued competition is not affected because the two companies never compete with each other. But a de facto broadband monopoly could allow Comcast to raise rates at will and bring a return to usage-related billing. It would also discourage new competitors from entering the market – particularly those relying on broadband to deliver video services, and hand Comcast more leverage to force compensation from online content companies like Netflix.

  • Whether the combined entity would have too much control over nationwide broadband Internet delivery;
  • whether Comcast could use its financial influence to strike exclusive cable deals that could keep programming off other platforms;
  • whether Comcast could limit how programming is delivered through video streaming services (usage caps, etc.);
  • if Comcast complied with terms under a previous merger deal with NBCUniversal.

Renata Hesse, a deputy assistant attorney general for antitrust, will take the analysis and ultimately decide, along with the division’s top officials, whether to file a federal lawsuit to block the deal. Bloomberg reports lawyers at the Justice Department have contacted outside parties to collect evidence to strengthen their potential case against the merger.

Another clear sign the merger is not being received well inside the Justice Department and the Federal Communications Commission is a complete lack of negotiations with Comcast over possible concessions to make the deal less anti-competitive. That also happened with the AT&T/T-Mobile merger where negotiations to ease anticompetitive concerns never seriously got off the ground before the Justice Department sued to block the deal. The FCC quickly announced its own opposition later that same day.

A lawsuit does not necessarily kill the merger deal. Comcast could take its case to federal court to win approval over the objections of the Justice Department. The company might also counter-propose new concessions to address concerns raised by the lawsuit. 

After learning of today’s Bloomberg News story, spokespeople at both Comcast and Time Warner Cable are either confident or in denial:

“There is no basis for a lawsuit to block the transaction,” said Sena Fitzmaurice, a Comcast spokeswoman. The merger “will result in significant consumer benefits — faster broadband speeds, access to a superior video experience, and more competition in business services resulting in billions of dollars of cost savings.”

Time Warner Cable spokesman Bobby Amirshahi said “we have been working productively with both DOJ and FCC and believe that there is no basis for DOJ to block the deal.”

In 2006, AT&T CEO Ed Whitacre thought his company was at a disadvantage being stuck with “dumb pipes” while Google, Yahoo! (remember them?) and Vonage couldn’t count their earnings fast enough. While AT&T sold consumers plain DSL service, content was king on Wall Street and Whitacre groused it was unfair for bandwidth hogs to use “the pipes for free.” That one statement was the equivalent of throwing a lit match on a hillside in Malibu Canyon and a predictable firestorm over Net Neutrality ensued.

Nine years later, Net Neutrality is now official FCC policy, although the sour grape-eating Republicans will continue to throw Congressional hissyfits along the way. While they rely on tissue-thin evidence to back their assertion the FCC secretly colluded with the Obama Administration to stick it to AT&T and demand its repeal, the future of Net Neutrality will more likely be decided in a courtroom a year or two from now.

Back in 2006 AT&T primarily sold DSL service and was looking for cash to finance its then emerging U-verse platform. AT&T planned to follow cable’s lead, devoting most of the available bandwidth on its fiber to the neighborhood network to cable television programming. Broadband speeds were limited to just under 25Mbps — even less if a large household had multiple television sets in use.

But as the Great Recession arrived and wages stagnated, the cost of what used to be a “must-have” service for most Americans increasingly began to exceed the household budget and the day finally arrived when cable companies started losing more television customers than they were adding. Even worse, cable programming costs continue to spiral upwards and no major cable company can increase cable television rates fast enough to support the usual profit margin the industry counted on.

What Whitacre failed to realize nine years earlier is that broadband providers did not simply own “dumb pipes.” AT&T, Comcast, Verizon, Time Warner Cable, Charter and other providers actually occupy two gilded catbird seats, with AT&T and Verizon dominating the wireless Internet business and Comcast, Time Warner, and Charter dominating at-home viewing and wired broadband. Lawmakers who deregulated both industries predicted pitting AT&T against Comcast or Verizon against Time Warner Cable would create competition not seen since Coke vs. Pepsi. Consumers would benefit and world-class service would result.

Instead, Time Warner Cable now sells Verizon Wireless phone service. Verizon gave up on expanding its FiOS network and is selling off its DSL and FiOS business in pieces to focus on its best moneymaker, Verizon Wireless. Comcast in turn threw in the towel on any notion of offering competing cellular service and, in fact, sold its acquired wireless spectrum to Verizon.

The best way to make money is to avoid price wars with your competitors and the evidence shows there is growing peace in America’s Telecom Valley. Comcast can now raise your broadband bill because, for most, Verizon FiOS isn’t an option. AT&T U-verse does not have to hurry speed upgrades to customers if Time Warner Cable delivers no better than 50/5Mbps service in large parts of its service area. Google Fiber remains a minor threat, only available in a handful of cities. AT&T distributed more copies of its press release touting U-verse Gigapower — its gigabit Internet offering — than there are customers qualified to sign up.

Notice that we’ve drifted away from talking about cable television programming. So has the industry, now increasingly dependent on broadband rate increases to make up the difference in revenue they used to take home from their television packages.

But now that the biggest players have a predictable source of revenue, allowing disruptors to further challenge earnings isn’t something your local cable and phone company will allow for long. At the moment, those most likely to cause problems are the growing number of “over the top” streaming video services that do not require a cable television subscription to watch. But they do need broadband — Whitacre’s “dumb pipes” — to reach subscribers. To manage that, services like Apple, PlayStation Vue and Sling TV and their customers must deal with the gatekeepers — AT&T, Comcast, Time Warner Cable, Verizon and others.

What Whitacre thought was a disadvantage is now becoming the best thing in the world — manning a toll booth on the only two roads most Americans can use to access online content.

Today, Sony officially launched its Internet-TV service, “PlayStation Vue” in three cities (New York, Chicago and Philadelphia) with a base price of $49.99/month. In includes more than 50 cable networks and in the three launch cities — local network affiliates. In Chicago and Philadelphia, where Comcast provides cable service, potential customers will need to pay $50 a month for Vue and another $64.95 a month for 50Mbps broadband — the least expensive broadband-only tier that is suitable for high quality viewing. Your combined bill for both services is $114.94 a month. Comcast charges $99.99 a month for its double play – 220 TV channels and 50Mbps broadband — almost $15 a month less for its package, and it includes around 150 more channels than Vue.

But Comcast also has another weapon it is testing is several of its markets — the resumption of usage caps and overlimit fees on its broadband service. Comcast customers in most test markets are given 300GB a month, after which they face overlimit fees of $10 for each additional increment of 50GB. While web browsing and e-mail fit more than comfortably within those caps, watching HD video may not. That leaves a potential Vue customer with a major dilemma. Should they pay $15 a month more for service than they can pay Comcast for a better package -and- chew away their usage allowance using it?

Comcast has yet to figure out how to install a coin collector on top of your television set, so you can watch as much Comcast cable television as you’d like. But watching streaming video could get very expensive if it exceeds a future Comcast usage allowance.

Smaller video packages from providers like Sling TV or the forthcoming Apple streaming service might make more sense, but will still be subject to Comcast’s usage caps if/when they are reintroduced around the country, while Comcast’s own television service will not.

This is why cable and phone companies hold enormous power over their potential competitors, even if Net Neutrality is fiercely enforced. Usage caps and usage-based billing represent an end run around Net Neutrality and both are permitted. The FCC has consistently refused to engage on the issue of broadband usage caps, leaving providers with a useful weapon to deter customers from dropping their television package in favor of an online alternative.

With most Americans having a choice of only one or two “dumb pipes” over which they can reach these services, being an owner of those pipes and getting to set the rates and conditions to use them is a very comfortable (and profitable) place to be.
