One of the core principles of Net Neutrality is that all Internet traffic is treated equally — nothing favored, nothing penalized.

AT&T does not seem interested in following that principle, as our regular reader James found out when reviewing the terms and conditions of AT&T’s Internet Overcharging scheme that limits DSL customers to 150GB of usage per month and 250GB for U-verse customers.

AT&T Wireless customers with the company’s 3G MicroCell that covers for AT&T’s network shortcomings are given special treatment if they also subscribe to the company’s wired broadband services: use of the MicroCell is exempt from the wired usage cap.

The MicroCell creates a mini “cell-tower” within the home for wireless devices that do not receive adequate indoor reception, powered by your home or office broadband connection. Customers with smartphones or other wireless devices can use the MicroCell to browse web pages, use apps, make and receive calls, or send and receive text messages without ever worrying about exceeding their DSL or U-verse broadband usage allowance. Want to access that content on your home computer? That does count against your cap.

“So data from another AT&T service which is sent over the same Internet connection as any other data traffic is excluded from the cap?  That sounds like a clear Net Neutrality violation to me,” says James.

“I have an AT&T 3G MicroCell. Since that utilizes my home broadband network to boost my wireless data signal, does that mean my wireless usage also counts against my wired broadband monthly data plan?

No, the wireless traffic from your AT&T 3G MicroCell does not count toward your monthly home broadband plan. Please register your AT&T 3G MicroCell account and your residential AT&T Internet account at www.att.com/internet-usage-MicroCell to help ensure accurate Internet usage billing. If you have broadband service with another provider, you do not need to register your account.”

The usage cap “free pass” does not extend to your wireless service plan, however. Despite using your home broadband connection, the use of the MicroCell still consumes monthly plan minutes and megabytes, unless you purchase extra add-ons. AT&T would argue it already charged you for your wireless usage, so it would not be fair to charge you again through your home broadband plan. But if you are not an AT&T broadband customer, that is exactly what happens if your local cable operator also has usage billing.

AT&T’s logic for implementing usage caps in the first place:

AT&T has experienced a dramatic increase in the amount of data that is sent and received over its wireline broadband networks. This dramatic increase is driven primarily by a small fraction of our customers. In fact, the top 2% of customers use about 20% of the total capacity on our network. A single high-traffic user can utilize the same amount of data capacity as 19 typical households. Lopsided usage patterns can cause congestion at certain points in the network, which can slow Internet speeds and interfere with other customers’ access to and use of the network.

Customers that blow through their allowance receive one warning and then a higher bill: a $10 overlimit penalty will apply and extends your usage allowance by 50GB. AT&T’s cost per gigabyte is estimated to be in the pennies.

A New York assemblyman is telling his upstate constituents to stop wasting money on Time Warner Cable’s monthly broadband modem equipment fee and buy your own device.

“I want consumers to know that they do not have to waste their hard-earned money on a product which was considered free for years,” said Assemblyman Kevin Cahill (D-Kingston) in a statement to members of his district. “Over the course of a year or two, depending on the model, the purchase of a new modem will pay for itself. Additionally, the models for purchase have more features than leased modems, like faster speeds and the capability to handle unlimited wireless devices.”

Time Warner expects less than three percent of its customers will take Cahill’s advice and avoid the $3.95 monthly fee, which opens a new, lucrative revenue stream for a cable operator that already enjoys up to 95 percent gross margin on its broadband service.

Cahill complained the 1996 U.S. Telecom Act prohibits the state’s Public Service Commission from intervening, but reminded customers there is a joint New York-New Jersey class action lawsuit against the cable operator over how the modem fee was implemented.

As of Jan. 14, Time Warner Cable has approved the following modems-for-purchase that can be activated for use with its broadband service, with our recommendations in red:

Time Warner’s “Conversations” Website Goes One-Way; Customer Comments Gone

A one-way street or Avoidant personality disorder?

Back in July we noticed Time Warner Cable’s Conversations website, engaged in two-way conversations with customers, began a “dialogue” on the issue of its new 5GB usage-capped “Internet Essentials” plan first unveiled in several Texas cities.

The company provided its view that broadband innovation required pricing flexibility with new usage-based broadband plans to offer customers “more choice” and a $5 discount on service if they agreed to limit monthly usage to 5GB or less.

Despite sharing our two cents (and several of our readers tried to add their own as well), we noted none of these views ever appeared online.

This week we checked back and discovered the dialogue had decidedly turned one-way: namely from Time Warner Cable to you. The company deleted the few views that were published on cable television programming costs and removed its comment section altogether.

Our reader Kevin even tried to be generous in his comments to the company last summer, but to no avail.

“I basically told them if usage meter billing is inevitable, then give us no less than 300 GB a month, at a rate of $40 a month,” he wrote. “Seeing how 1 GB of bandwidth and data costs you less than $1 to generate to me, this is more than fair. Doubt they will even read it since it isn’t a ‘wow this is awesome, OMG i luv you so much for this new plan TWC’-message.”

They might have read it, but elected to avoid the uncomfortable notion of sharing the actual costs to provide broadband service to customers. It is not the first time, either.

train wreckThe nation’s largest broadband stimulus grant recipient has turned a $126.3 million taxpayer funded broadband expansion program into an “orchestrated train wreck,” charged West Virginia Delegate Nancy Guthrie (D-Kanawha) on Monday.

West Virginia Homeland Security Director Jimmy Gianato defended his management of the project before a joint state House-Senate technology committee just learning it had been scaled back, dropping more than 400 sites that were slated to have fiber broadband upgrades Gianato claimed they already had.

Gianato defended the project, noting the original grant proposal was held up by the Commerce Secretary as one of the best-written proposals in the country.

Lawmakers did not criticize how the proposal was written. Instead, they questioned how the project was administered and how the money was spent.

“We’ve done everything the grant said we would do,” Gianato countered.

Many of the questions surrounded the decision to purchase 1,064 Cisco routers in 2010, which cost taxpayers $22,600 each, and were rejected by more than a few intended recipients. Several hundred routers ended up in storage, unused.

Still murky is why project managers only considered a single, expensive Cisco-brand router recommended by Verizon-employed consultants and ultimately purchased directly from Verizon.

Gianato claimed the federal government tied his hands requiring West Virginia’s broadband project be “shovel-ready.”

“All of the equipment was bought off contracts that had been competitively bid,” he told the conference.

But project managers and consultants can custom-tailor specifications that make it impossible for vendors to specify anything other than the Cisco router Verizon conveniently happened to sell.

Several members appeared unmoved by statements defending the decision to deploy identical, expensive routers to every West Virginia anchor institution, despite the fact they were designed to serve a minimum of 500 concurrent users and often ended up in rural community libraries with less than five public terminals.

Gale Given, the state’s chief technology officer, supported Gianato.

“The team determined that capacity should be provided to permit these community anchor institutions to deploy the applications that were required to meet future needs, not their current needs,” Given wrote in a letter to state lawmakers. “It would be a mistake to determine in advance that entities with low bandwidth requirements today will not have high bandwidth requirements in the future. To have shortchanged our smaller, more rural areas would have gone against the entire intent of the program.”

But now West Virginia taxpayers will be on the hook to cover the costs of making the new equipment compatible with existing equipment in certain state facilities.

At least 70 State Police detachments will begin using the once-rejected routers once the state spends $90,000 for new modules to update the agency’s voicemail system, which is not compatible with the routers.

State libraries also won a break from Frontier Communications, who agreed to supply fiber broadband service to 170 mostly small, rural libraries that could not afford the fiber upgrade. Frontier has agreed to supply the fiber service for the same price libraries pay for their existing service.

comcastComcast customers in New Hampshire are facing a rate hike for cable, broadband and phone service on Jan. 22.

Basic cable rates are going up nearly 6 percent, from $23.02 to $24.60 per month, but expanded basic customers will enjoy a slight decrease from $46.11 to $45.35.

Most customers signed to a Comcast bundle will see slightly larger increases — around $5 a month — for triple play packages. Comcast blamed the rate increase on increased technology expenses, bringing faster Internet service to customers, improved customer service, and more on-demand online viewing.

Customers on price-lock agreements, promotional plans, or other contracts are unaffected until those agreements expire.

Local officials around New Hampshire say their hands are tied. Cable operators enjoy almost complete power setting their own rates as they see fit. The largest competitors for Comcast in New Hampshire are satellite dish providers, and those rates are increasing as well.
