Your Unlimited, Off-Contract Verizon Wireless Web Experience Will Be “Optimized” (Throttled) Oct. 1

throttleVerizon Wireless’ ongoing campaign to get rid of its grandfathered unlimited data customers continues this week with news the carrier will begin throttling speeds of off-contract customers still hanging on to their uncapped data plans starting Oct 1.

Verizon doesn’t call the enforcement of speed reductions a “throttle,” but rather “Network Optimization”:

Verizon Wireless strives to provide its customers with the best wireless experience when using our network. In 2011, Verizon Wireless launched Network Optimization, which slows the data speeds of its unlimited data subscribers with 3G devices who are in the top 5% of data users when they connect to a cell site experiencing high demand.

Effective October 1, Verizon Wireless will expand its existing Network Optimization policy to include its unlimited data subscribers using 4G LTE devices who have fulfilled their minimum contract term. Based on your plan and recent data usage, one or more lines on your account may experience a reduction in data speeds when connected to a cell site experiencing high demand. Customers on MORE Everything or other usage-based data plans are not subject to Network Optimization. Verizon Wireless customers on the company’s 3G network have been subject to speed throttling for several years if Verizon deems them a “heavy user,” but the company’s 4G LTE network avoided the speed noose until now. Customers who find themselves subjected to Verizon’s speed limiter report it is a very unpleasant experience.

610px-Verizon-Wireless-Logo_svg“My phone has been throttled and is now essentially unusable for the very things it is marketed for,” reports one customer sentenced by Verizon’s “Network Optimization.”  “I can send texts, emails, and view basic websites but any sort of streaming is now out of the question for the remainder of the billing cycle and possibly the next cycle as well.”

The throttle effectively limits speeds to well under 300kbps, and in most urban areas where cell tower usage is higher, punished customers have to live with speeds of around 50kbps — the same as dial-up.

Verizon’s logic and consistency about its “Network Optimization” faced customer scrutiny as well.

“This is not about equal opportunity bandwidth, it’s about Verizon realizing they can increase their revenue stream, otherwise, wouldn’t those tiered folks be getting throttled as well if they ‘abused’ and used ‘inordinate’ amounts of data?  Oh no, of course not, Verizon just bills them more.  This scenario is as ridiculous as charging $20/month for text messaging, which, by the way, is also data.”

What makes you speed-throttling-worthy? According to Droid Life, which broke the story, anyone using more than 4.7GB of data per month on a busy cell tower is likely to end up on a speed diet.

Verizon claims its “Network Optimization” is designed to protect the usage experience among all of its customers, and suggests the speed reductions will only occur when a heavy user is connected to a “high demand” cell site.

“Once you leave that site and attach to a new cell site without high demand, your speeds return to normal,” claims Verizon. “Other carriers often throttle you no matter what throughout the end of a billing cycle.”

But Verizon’s gesture isn’t as generous as it first suggests.

Once a customer is suspected of being a data hog and forced to endure Verizon’s speed throttle, they can stay in Verizon’s speed prison for up to 60 days after being sentenced. The result is dramatically reduced data speeds when a customer happens to travel through a busy cell site area, regardless of whether they are using a lot of data at the time or not.

Network congestion problems may be a result of too many customers connected to a single cell site at any one time, several customers concurrently engaged in high bandwidth traffic exchanges through a cell site, or Verizon’s inadequate capacity to meet even the reasonable needs of its wireless customers.

But regardless of the cause, only one group will be punished for their usage-excess: unlimited data plan customers who are now mostly off-contract (Verizon requires most customers signing a contract renewal that includes equipment discounts to migrate off their unlimited plan, which stopped being sold to new customers in June, 2012.)

Customers can get out of speed jail permanently simply by agreeing to give up their unlimited data plan. Then they can use (and abuse) Verizon’s limited wireless bandwidth, whether it slows every other customer down or not.

Comcast has announced it is considering testing an innovative new plan in several test markets offering “unlimited Internet access” to customers for a yet-to-be-determined price. Whoever heard of such a thing?

Comcast’s executive vice president David Cohen raised eyebrows last week when he predicted all Comcast customers nationwide would see usage-based billing for their Internet access within five years.

Such statements tend to muck up things like a $45 billion dollar merger with Time Warner Cable that both companies must prove is in the public interest. The buyer wants to limit your Internet usage and the seller got its fingers burned back in 2009 when it tried its own usage cap experiment and now advertises it has no data caps.

Telling Time Warner Cable customers it is in their best interest to lose unmetered Internet plans may be too tough to sell, so Cohen has spent much of this week backtracking and claiming he was “misunderstood:

To be clear, we have no plans to announce a new data usage policy.  In 2012, we suspended our 250 GB data cap in order to conduct a few pilot programs that were more customer friendly than a static cap.  Since then, we’ve had no data caps for any of our customers anywhere in the country.  We have been trialing a few flexible data consumption plans, including a plan that enables customers who wanted to use more data be given the option to pay more to do so, and a plan for those who use less data the option to save some money.  We decided to implement these trials to learn what our customers’ reaction is to what we think are reasonable data consumption plans.  We certainly have no interest in adopting any plans that our customers find unreasonable or disruptive to their Internet experience.

It’s important to note that we remain in trial mode only.   We’re now also looking at adding some unlimited data plans to our trials. We have always said that as the Internet, and our customers’ use of it, continues to evolve, so will Comcast and our policies.

Cohen makes a careful distinction between a strict usage limit and the kind of usage-based billing that will fill the company’s coffers with overlimit fees. But any usage allowance is a limit of how much you can use the Internet before something bad happens — either your access is shut off or your bill explodes.

comcasticStop the Cap! has talked with more than a dozen customers in Comcast’s test markets about their experiences with Comcast’s “data usage policy.” Although the company claims it is seeking customer reactions, it never asks whether those customers want usage limits or not, only what kind.

Giving customers “the option to pay more” is exactly the type of thinking that won Comcast the dubious distinction of being the worst company in America. No usage plan tested by Comcast actually offers savings to customers. It simply places an artificial, arbitrary usage allowance on the overpriced broadband service the company offers now.

At this point, Comcast is not offering any unlimited use trials, but we have learned the value they are likely to place on “unlimited” based on what certain customers have paid all along for that privilege. Ars Technica reports some avoided the 250GB cap by signing up for business class service. The cost? $133.79 a month for 50/10Mbps. If Google Fiber was in town, you’d pay $70 for unlimited 1,000/1,000Mbps service, and the search engine giant would still be making money.

Cohen claims nothing is set in stone, but considering Comcast’s “don’t care” attitude towards its customers, it is a safe bet they will do what is best for shareholders and ignore complaints from customers that often have nowhere else to go for 21st century broadband speeds.

Sprint Applying Speed Breaks to Top 5% of Wireless Data Users Accessing Congested Cell Sites

throttleEffective June 1st, all Sprint contract and prepaid customers, as well as those using Virgin Mobile USA and Boost will find their wireless data speeds throttled if Sprint finds they are among the top 5% of users on a congested cell site.

Text messages are being sent to all customers about Sprint’s new “fairness algorithm” that it will use as part of its data “prioritization management.”

“Beginning 6/1/14, to provide more customers with a high quality data experience during heavy usage times, Sprint/Virgin Mobile USA/Boost may manage prioritization of access to network resources in congested areas for customers within the top 5 percent of data users.”

Such text messages are unlikely to be understood by average customers who have no idea how much data they use, don’t understand what “prioritization of access” means, or what would make them a “top 5 percent” data user. What many do understand is that they were sold “unlimited use” plans that will be much harder to use if they are identified as a 5%‘r.

Fierce Wireless found answers to several unanswered questions:

  • Boost and Virgin customers exceeding 2.5GB of data use a month used to find their data speeds cut to 256kbps until the beginning of their next billing cycle. In March, Sprint announced it was further cutting speeds in the punishment zone to 128kbps for affected prepaid customers;
  • Sprint’s postpaid/prepaid customers are likely to find themselves throttled once they exceed 5GB of usage per month.

speedbumpSprint says the throttle will only be activated on “congested cell sites” and will impact WiMAX, 3G and LTE 4G networks owned by the company. Anyone who has used Sprint’s 3G network will discover most urban and suburban Sprint cell towers are frequently congested, judging by the low speeds many customers endure. Rural customers or those served on the edge of a suburban area may never find themselves throttled and Sprint promises once traffic clears, the throttle is shut off.

At the same time, once Sprint labels you a “heavy user,” they can leave you in the penalty box for up to 60 days because the network prioritization will also apply during the following month of service.

“Customers that continue to fall within the top 5 percent of data users will continue to be subject to prioritization,” Sprint said.

The approach “will enable us to provide more customers with a high quality data experience during heavy usage times,” Sprint said in a statement sent to FierceWirelessTech.

Other wireless carriers also have employed speed throttling to control their grandfathered “unlimited data” customers, Fierce Wireless notes:

During September 2011, Verizon Wireless implemented what it  termed a “network optimization” plan to limit the bandwidth for the operator’s top 5 percent of 3G smartphone users who are on a grandfathered unlimited data plan. (Ed. Note: However, because of FCC requirements, Verizon cannot throttle its 4G LTE customers.)

One month later, AT&T Mobility  instituted a similar plan, targeting the top 5 percent of users on unlimited plans in specific high-traffic locations. However, AT&T was forced to alter its approach in early 2012 after an outcry from users who were unprepared to have their speeds reduced, particularly in cases where some of them had only consumed 2 GB of data. AT&T’s revised policy slowed speeds of unlimited data users who exceeded specific data thresholds.

T-Mobile US also uses a form of prioritization, noting “certain T-Mobile plans may be prioritized” over service plans under its GoSmart Mobile prepaid brand.

Telecom Italia wants to learn from the master of higher priced phone service: AT&T

Telecom Italia (TI) has a big problem. While AT&T charges the average American $66 a month for mobile service, competition in Italy has forced wireless prices down to $18 a month for comparable service.

TI chief executive officer Marco Patuano wants the price cutting to end and traveled to the United States to learn from AT&T how it was able to raise prices and increase customer spending with usage-capped Internet, phone and television service. His self-described “innovation trip” brought him straight to the office of AT&T CEO Randall Stephenson.

TI is trying to end years of losses and sales declines precipitated by falling prices and a growing disinterest in traditional landline service. AT&T accomplished that by boosting investment in mobile services. AT&T charged high prices for unlimited data plans until demand for data grew to the point the company could earn much more metering Internet usage. As a result, AT&T has earned a staggering $100 billion over the past decade from boosted phone bills.

Patuano wants to find a way to follow in AT&T’s footsteps as TI’s share price has fallen more than 70 percent over the last six years. Fierce competition from Vodafone and VimpelCom have forced prices down across Italy. With prices so low, investors have shown little interest in providing funding for wholesale upgrades to 4G wireless service. In turn, that has kept Telecom Italia from offering faster data speeds which would allow them to raise prices for service.

In North America, high wireless prices and the relative lack of competition have brought considerably better financial returns for investors. That high rate of return has attracted investment allowing providers like AT&T and Verizon Wireless to spend billions on network upgrades that have, in turn, further increased revenue at both companies. Customers benefit from the faster speeds, but also pay for the privilege with some of the highest wireless prices in the world.

It’s a formula Patuano wants to bring to the Italian market, but he needs more investment to stabilize TI’s finances. TI was the government-owned phone company until it was privatized in 1997. Despite having a massive customer base, nimble wireless competitors have outflanked the phone company and the results have been falling sales, disconnected customers, and its $37 billion in debt reduced to junk status by investor rating services. The company sold its headquarters in Milan and got rid of its Argentine subsidiary, along with suspending shareholder dividends.

att_logo“The first target now for a phone carrier is upgrading networks and transform it to a platform for high-value services,” Patuano said. “This is exactly what AT&T did and what we are calling for.”

Patuano has seen AT&T defend its turf in the wireline business by scrapping its traditional landline/DSL-only service in larger markets in favor of a hybrid fiber-copper network dubbed U-verse. Patuano is now pondering whether TI could deliver a package of phone, broadband and television service over a broadband platform. The average AT&T U-verse customer spends $170 a month on U-verse, an amount much better than $18 a month. TI could do even better than AT&T because Italy lacks many cable television providers — Italians depend on satellite television for multichannel pay television.

AT&T and TI are no strangers to one another. In 2007, AT&T attempted to buy a stake in the Italian phone company but met with a storm of objections from Italian politicians. AT&T dropped the idea soon after.

oopsA website glitch by Verizon Wireless last weekend let customers with legacy unlimited data plans to upgrade to a new subsidized smartphone on a two-year contract and keep unlimited data.

This afternoon, Verizon Wireless representatives confirmed they will honor upgrades from customers that took advantage of the mistake, despite the fact Verizon’s CEO has gone out of his way to declare unlimited data service “unsustainable.”

Over the past weekend, there was a software issue involving some orders for customers seeking to upgrade their devices. A number of customers who were upgrading devices were able to maintain an unlimited monthly data feature while paying a subsidized price. Verizon Wireless will honor those orders that were approved this past weekend, allowing those customers to retain their unlimited plans for the duration of their contract and receive their new device. Verizon Wireless corrected this software issue today.  The company no longer offers unlimited data plans and customers who want to retain existing unlimited data plans, must pay full retail price for a replacement phone.

Last year, Verizon Wireless amended its policy for grandfathered unlimited customers denying them access to subsidized, discounted devices unless they switched to a usage-based plan. A website error allowed unlimited customers to bypass a usual restriction requiring them to abandon their unlimited plan to complete the upgrade order. Dozens of customers reported this morning they had received their new phones with unlimited data still intact. With the glitch fixed, customers attempting to upgrade will once again need to give up unlimited data in return for a device discount.

Verizon Wireless CEO Lowell McAdam said last week offering unlimited data service was “unsustainable” as a matter of physics. McAdam said carriers still offering unlimited data will be overwhelmed by excessive customer use, running wireless networks “out of gas.”

Sprint countered it has plenty of “runway” to continue selling unlimited data service, and even offers a “lifetime guarantee” of unlimited service on its wireless network.

unlimited for lifeAt least one Wall Street analyst agreed with Sprint.

“This Verizon comment simply makes no sense. When two different people look at the same thing you often get two completely different perspectives. That’s what is happening here. It does not mean either is right or wrong, just different,” said tech analyst Jeff Kagan. “Unlimited wireless data may not make sense for Verizon Wireless for a variety of reasons. Perhaps they want to have some control over how much wireless data is being used. Perhaps they want to increase their profitability. Whatever the reason, this is Verizon’s belief and they are not wrong, for Verizon. Sprint is a different story.”

Sprint’s chief financial officer Joe Euteneuer, speaking at a Goldman Sachs conference in New York on Thursday, said Sprint’s acquisition of 2.5GHz radio spectrum from Clearwire will give it a capacity edge once its 4G network build-out is done in mid-2014.

“We feel very good about our positioning having that spectrum . .. and our portfolio spectrum vs. the competition,” Euteneuer said. “So we’ll get leverage there.”

“Sprint’s unlimited plans are the right idea at the right time,” added Kagan. “They have plenty of capacity on the network. Sprint in fact has much more spectrum than Verizon. Sprint needs to hang on to their existing customer base and attract new users. If Sprint charged the same as Verizon or AT&T they would lose. So Sprint needs to attract attention. That’s what always happens in a market. The leaders and the followers take different marketing and positioning angles. And that’s exactly what is happening here.”
