Sen. John Thune (R-S.D.) slammed the Federal Communications Commission for its “unacceptable failure” to expand rural broadband service and close America’s rural-urban digital divide.

Thune’s comments were directed to FCC Chairman Ajit Pai, appearing Thursday before the Senate Commerce Committee the South Dakota Republican chairs. Thune complained rural broadband expansion has slowed in his rural state, something he blamed on the FCC’s “inaction.” Thune criticized the FCC’s cuts to the Universal Service Fund, implemented as part of an effort to reduce the FCC’s budget.

“The FCC’s failure to ensure sufficient and predictable funding jeopardizes the vitality of America’s rural communities, and makes it much, much harder for our witnesses and others like them to deploy broadband,” Thune said in his opening remarks. “This is simply unacceptable.”

Thune claims the FCC’s cuts have increased by almost 25%, and there has been no study undertaken to determine the impact those cuts have on rural broadband expansion.

“Rural Americans should never be left behind their urban counterparts,” Thune added.

Pai defended the FCC’s actions under the Trump Administration, claiming the Commission is allocating nearly $6 billion for Connect America Fund subsidies and additional money for rural wireless projects. Pai claimed the FCC is providing $340 million to bring 4G LTE service to tribal lands, with additional funds available when those rural broadband subsidies are exhausted. Most of the money is being paid to subsidize for-profit companies.

Pai also claimed his broadband policy reforms, such as repealing net neutrality and other deregulation will stimulate new private investment independent of the Commission. To help that expansion, Pai suggested the recently proposed rules to streamline new cell tower approvals and ease up on historic preservation and environmental reviews will speed rural rollouts.

But both Sen. Thune and Chairman Pai have steadfastly opposed municipal and public broadband expansion projects designed to close the rural broadband gap in areas where for-profit ISPs have refused to serve without subsidies.

Historical Truths: The Telecom Act of 1996 Sowed the Seeds of a Telecom Oligopoly

How exactly did America get stuck with a broadband monopoly in many areas, a duopoly in most others? It did not happen by accident. In this occasional series, “Historical Truths,” we will take you back to important moments in telecom public and regulatory policy that would later prove to be essential for the creation of today’s anti-competitive, overpriced marketplace for broadband internet service. By understanding the trickery and legislative shell games practiced by lobbyists and their elected partners in Congress, you will learn to recognize when the telecom industry and their friends are preparing to sell you another bill of goods.

By the end of the first term of the Clinton Administration, the president faced a major backlash from Republicans two years into the Gingrich Revolution. A well-funded chorus of voices in the business community, the Democratic Leadership Council — a business-friendly group of moderate Democrats, as well as commentators and pundits had the attention of the Beltway media, complaining in unison that the Democrats shifted too far to the left during the first term of the Clinton Administration, leaving it exposed in the forthcoming presidential election to another voter backlash like the one that installed the Gingrich revolutionaries in the House of Representatives and delivered a Republican takeover of the U.S. Senate in 1994.

With pressure over the growing lack of bipartisanship, and a presidential election ahead in the fall, the Clinton Administration was looking for ideas to prove it could work across the aisle and pass new laws that would deliver for ordinary Americans.

Revamping telecommunications policies would definitely touch every American with a phone line, computer, modem, and a television. Before 1996, America’s telecommunications regulation largely emanated from the Communications Act of 1934, which empowered the Federal Communications Commission to establish good order for the growing number of radio stations, telephone, and wire lines crisscrossing the country.

The 1934 Act’s legacy remains today, at least in part. It created the FCC, firmly established the concept of content regulation on the public airwaves, and established a single body to conduct federal oversight of the nation’s telephone monopoly controlled by AT&T.

Efforts to replace the 1934 Act began well before the Clinton Administration. In the early 1980s, Sen. Bob Packwood (R-Ore.) attempted to push for a legislative breakup of AT&T and a significant reduction in the oversight powers of the FCC. The bill met considerable opposition from AT&T, spending $2 million lobbying against the bill in 1981 and 1982. Alarm companies also heavily opposed the measure, terrified AT&T would enter their market and put them out of business. AT&T preferred a more orderly plan of divestiture being carefully negotiated in a settlement of a 1974 antitrust lawsuit by the Justice Department. A 1982 consent decree broke off AT&T’s control of local telephone lines by establishing seven Regional Bell Operating Companies independent of AT&T (NYNEX, Pacific Telesis, Ameritech, Bell Atlantic, Southwestern Bell Corporation, BellSouth, and US West). AT&T (technically an eighth Baby Bell) kept control of its nationwide long distance network.

Also in the 1980s, the cable television industry gained a much firmer foothold across the country, quickly gaining political power through well-financed lobbyists and close political ties to selected members of Congress (particularly Democrat Tim Wirth, who served in the House and later Senate representing the state of Colorado) that allowed them to push through a major amendment to the 1934 Act in 1984 deregulating the cable industry. The result was an early wave of industry consolidation as family owned cable companies were snapped up by a dozen or so growing operators. These buyouts were largely financed by dramatic rate increases passed on to consumers, resulting in cable bills tripling (or more) in some areas almost immediately. By the end of the 1980s, a major consumer backlash began, creating enormous energy for the eventual passage of the 1992 Cable Act, which re-regulated the industry and allowed the FCC to order immediate rate reductions.

The Progress and Freedom Foundation, with close ties to former House Speaker Newt Gingrich, closed its doors in 2010.

The biggest push for a near-complete revision of the 1934 Act came during the Gingrich Revolution. In 1995, the conservative Progress & Freedom Foundation — a group closely tied to then-Speaker Newt Gingrich (R-Ga.) floated a trial balloon calling for the elimination of an independent Federal Communications Commission, replaced by a stripped-down Office of Communications that would be run out of the White House and be controlled by the president. A small army of telecom industry-backed scholars also began proposing privatizing the public airwaves by selling off spectrum to companies to be owned as private property. The intense interest in the FCC by the group may have been the result of its veritable “who’s who” of telecom industry backers, including AT&T, BellSouth, Verizon, the National Cable & Telecommunications Association, cable companies like Comcast and Time Warner; cell phone companies like T-Mobile and Sprint; and broadcasters like Clear Channel Communications and Viacom.

The proposal outraged Democrats and liberal groups who called it a corporate-friendly sell-off and giveaway of the public airwaves. Then FCC Chairman Reed Hundt took the proposal very seriously, because at the time Gingrich lieutenant Tom DeLay’s (R-Tex.) secretive Project Relief group had 350 industry lobbyists, including some from BellSouth and Southwestern Bell literally drafting deregulation bills and a regulatory moratorium on behalf of the new Republican majority, coordinating campaign contributions for would-be supporters along the way. The proposal ultimately went nowhere, lost in a sea of the House Republicans’ constantly changing agendas, but did draw attention to the fact a wholesale revision of telecommunications policy would attract healthy campaign contributions from all corners of the industry — broadcasters, cable companies, phone companies, and the emerging wireless industry.

When it became known Congress was once again going to tackle telecommunications regulation, lobbyists immediately descended from their K Street perches in relentless waves, with checks in hand. There were two very important agendas in mind – deregulation, which would remove FCC rate regulation, service oversight, cross-competition prohibitions, and ownership caps, and ironically, protectionism. The cable and satellite companies had become increasingly fearful of the regional Baby Bells, which arrived in Congress in the early 1990s promoting the idea of entering the cable TV business. The cable industry feared phone companies would cross-subsidize the development of Telco TV by charging telephone ratepayers new fees to finance that entry. The cable industry had carefully developed a de facto monopoly over the prior decade of consolidation. Companies learned quickly direct head-to-head competition between two cable operators in the same market was bad for business.

The original premise of the 1996 Telecom Act was that it would eliminate regulations that discouraged competition. Promoters of the legislation asked why there should only be one phone or cable company in each city and why maintain regulations that kept cable and phone companies out of each others’ markets. Fears about market power and allowing domineering cable and phone companies to grow even larger were dismissed on the premise that a wide open marketplace, with regulations in place to protect consumers and competition would avoid creating telecom robber barons.

The checks handed out by industry lobbyists were bi-partisan. Democrats could crow the new rules would finally give consumers a new choice for cable TV or phone service, and help bring the “information superhighway” of the internet to schools, libraries, and other public institutions. Republicans proclaimed it a model example of free market deregulation, promoting competition, consumer choice, and lower prices.

At a high-brow bill signing ceremony held at the Library of Congress, both President Bill Clinton and Vice President Al Gore were on hand to “electronically sign” the bill into law. Both the president and vice-president emphasized the historical significance of the emerging internet, and its ability to connect information-have’s and have-not’s in an emerging digital divide. Missing from the discussion was an exploration of what industry lobbyists and their congressional allies were doing inserting specific language into the 1996 Telecom Act that would later haunt the bill’s legacy.

On hand to celebrate the bi-partisan bill’s signing were Speaker Gingrich, Sen. Larry Pressler (R-S.D.); Sen. Ernest F. Hollings (D-S.C.); Rep. Thomas J. Bliley Jr. (R-Va.); Rep. John Dingell (D-Mich.); and Ron Brown, the Secretary of Commerce. Pressler was among the soon-to-be-endangered moderate Republicans, Hollings was a holdout against the gradual wave of Republican takeovers in southern “red states,” and Dingell was a veteran lawmaker with close ties to the broadcasting industry.

Some of the bill’s industry backers were also there, some who would ironically see its signing as directly responsible for the eventual demise of their independent companies. John Hendricks of the Discovery Channel, Glenn Jones of Jones Intercable (acquired by Comcast in 1999), Jean Monty of Northern Telecom (later Nortel), Donald Newhouse of Advance Publications (eventual part owner of Bright House Networks and later Charter Communications), William O’Shea of Reuters Ltd. and Ray Smith of Bell Atlantic (today part of Verizon) were on hand. Also in the audience was Jack Valenti of the Motion Picture Association of America, representing Hollywood Studios.

Among the fatal flaws in the Telecom Act of 1996 were its various ‘competition tests,’ which were open to considerable interpretation and latitude at the FCC. The Republican supporters of the bill argued that the presence of an open and free marketplace would, by itself, induce competition among various entrants. They were generally unconcerned with the question of whether new competition would actually arrive. Their priority was lifting the protective levers of legacy regulation as soon as possible. Many Democrats assumed what appeared to be carefully drafted regulatory language would protect consumers by preventing the FCC from lifting protections too early in the competitive process. But lobbyists consistently outmaneuvered lawmakers, finding ways to insert loopholes and compromise language that introduced inconsistencies that could be dealt with and eliminated either by the FCC or the courts later.

For example, lawmakers insisted on unbundling telecommunications network elements, an arcane way of saying new competitors must be granted access to existing networks to be shared at wholesale rates. In practice, this meant if a phone company entered the internet service provider business, it must also make its network available for other ISPs as well. In some areas, competing local telephone companies also offered landline service over existing telephone lines, paying wholesale connection fees to the incumbent local phone company. As competition emerged, the incumbent company usually petitioned for a lifting of the regulations governing their business, claiming competition had arrived.

The first warning the 1996 Act was going awry came a year after the bill was signed into law. Phone companies started raising rates from $1.50-6 a month on average. AT&T was petitioning to hike rates $7 a month. Someone would have to pay to replace the scrapped subsidy system in a competitive market — subsidies that had been in place at the nation’s phone companies for decades. By charging higher rates for phone service in cities and for pricier long distance calls before the arrival of companies like MCI and Sprint, the phone companies used this revenue to subsidize their Universal Service obligations, keeping rural phone bills low and often below the real cost of providing service. To establish a truly competitive phone business, the subsidies had to be reformed or go, and that meant someone had to cover the difference.

“This game is called ‘shift and shaft,'” Sharon L. Nelson, the chairwoman of the Washington Utilities and Transportation Commission, said in 1997. “You shift the costs to the states and shaft the consumer.”

Gradually, consumers suddenly discovered their phone bill littered with a host of new charges, including the Subscriber Line Charge and various regulatory recovery fees and universal service cost recovery schemes. Phone companies also boosted rates on their unregulated Class phone features, like call waiting, caller ID, and three-way calling. The proceeds helped make up for the tens of billions in lost subsidies, but the end effect was that phone bills were still rising, despite promises of competitive, cheap phone service.

At a hearing of the Senate Commerce Committee later that year, several angry senators said they would never have voted in favor of the Telecommunications Act of 1996 if they had thought it would lead to higher rates. Sam Brownback, a Kansas Republican, was in the line of fire because of his rural constituents. Rates for those customers are subsidized more heavily than elsewhere because of the cost of extending service to them. Rates were threatening to skyrocket.

“We would be foolish to build up all these expectations about competition without saying to the American people, ‘We’re going to have to raise your phone bill,'” Brownback said.

But the rate hikes were just beginning. By the beginning of the George W. Bush administration, telecom lobbyists brought a thick agenda of action items to Michael Powell’s FCC. Despite promises of competition breaking out everywhere, that simply was not the case. Republicans quickly blamed the remaining regulatory protections still in place in noncompetitive markets for ‘deterring competition.’ But the companies knew the only thing better than deregulation was deregulation without competition.

Consolidation wave

The Republican-dominated FCC quickly began removing many of those protective regulations, claiming they were outdated and unnecessary. The very definition of competition was broadened, allowing the presence of virtually any company offering almost any service good enough to trip the deregulation levers. Later, even open access to networks by competitors was often limited to pre-existing networks, not the future next generation networks. Republicans argued those networks should be managed by their owners and not subject to “unbundling” requirements.

The weakened rules also sparked one of the country’s largest consolidation waves in history. Cable companies bought other cable companies and the Baby Bells gradually started putting themselves back together into what would eventually be AT&T, Verizon, and Qwest/CenturyLink. For good measure, phone companies even snapped up a handful of independent phone companies, most notably General Telephone and Electronics, better known as GTE by Verizon and Southern New England Telephone (SNET) by AT&T.

Prices rising as costs dropping.

The cable industry, under the premise it needed territories of scale to maximize potential ad insertion revenue from selling commercials on cable networks, gradually shrunk from at least a dozen well-known companies to two very large ones – Comcast and Charter, along with a few middle-sized powerhouses like Cox and Altice. Merger and acquisition deals faced little scrutiny during the Bush years of 2002-2009, usually approved with few conditions.

The result has been a rate-raising oligopoly for telecom services. In broadcasting, the consolidation wave started in radio, with entities like Clear Channel buying up hundreds of radio stations (and eventually putting the resulting giant iHeartMedia into bankruptcy) and Sinclair and similar companies acquiring masses of local television outlets. On many, local news and original programming was sacrificed, along with a significant number of employees at each station, in favor of inexpensive music, network or syndicated programming. Some stations that aired local news for 50 years ended that tradition or turned newsgathering over to a co-owned station in the same city.

Although telephone service eventually dropped in price with the advent of Voice over IP service, consumers’ cable TV and internet bills are skyrocketing at levels well in excess of inflation. Last year, the Washington Center for Equitable Growth demonstrated that the current consolidated, anti-competitive telecom marketplace results in rising prices for buyers and falling costs for providers.

Your oligopoly tax.

“In truly competitive markets, a significant part of cost reductions would be passed through to consumers,” the group wrote. “Based on a detailed analysis of profits—primarily EBITDA—we estimate that the resulting overcharges amount to more than $45 per month, or $540 per year, an aggregate of almost $60 billion, or about 25 percent of the total average consumer’s monthly bill.”

That is one expensive bill, paid by subscribers year after year with no relief in sight. Several Republicans are proposing to double down on deregulation even more after eliminating net neutrality, which could cause your internet bill to rise further. Several Republicans want to rewrite the 1996 Telecom Act once again, and lobbyists are already sharing their ideas to further curtail consumer protections, lift ownership caps, and promote additional consolidation.

Wireless Lobby Sues Utah Over 36¢ Surcharge Companies Can’t Easily Pass On to Customers

The wireless industry’s largest lobbying group, CTIA-The Wireless Association, filed suit in a Utah federal court Wednesday to stop the state from imposing a 36 cent surcharge wireless carriers like AT&T, Sprint, and Verizon Wireless cannot easily pass on to their customers.

The new fee, retroactively charged from the beginning of 2018, applies to all telephone lines other than prepaid wireless phones, and represents the chief funding mechanism for Utah’s Universal Public Telecommunications Service Support Fund, which supports providing service in high cost rural areas of Utah and the expenses attributed to Utah’s participation in the federal Telephone Lifeline program, which provides subsidized telephone service to the poor.

The CTIA is upset because its member companies will have to assess the surcharge on almost every customer with a landline or wireless postpaid phone in the state, including customers getting free wireless service through the federal Lifeline program. The CTIA argues that puts an unfair burden on companies, especially those asked to either eat the cost of the surcharge or attempt to collect 36¢ a month from Lifeline customers that currently do not receive bills from their providers.

The lobbying group called its options “a Hobson’s choice” between two bad ideas. Because wireless carriers don’t want to absorb the surcharge and pay for it out of current revenue, the alternatives are to either pass along the cost to customers or raise rates. CTIA’s complaint predominately focuses on what it calls the “absurd real world results” of wireless companies struggling to get paid back the 36¢ monthly surcharge:

Participants in these [Lifeline] programs are frequently members of “unbanked” communities, and even a monthly rate of $0.36 may prove an insurmountable obstacle to participation in the Lifeline program. Those without bank accounts or a credit card have no effective means to remit a surcharge of $0.36. If they choose to mail cash, they would have to spend more on postage than on the surcharge itself. Or they may need to purchase a money order, if such are available in increments of $0.36, and pay both the charges applicable to obtaining a money order and the cost of postage – all well in excess of the $0.36 due under the PSC Rule.

[…] The PSC Rule has a chilling effect on the introduction of service offers in the market today. Carriers that have an interest in introducing innovative service plans that have or are likely to have intrastate revenues near, at, or below $0.36 will have to determine whether to select a collection method illegally imposed on them under the PSC Rule or to not offer such service plans at all.

[…] Further, requiring the underlying wireless carrier to pay the required $0.36 per month UUSF surcharge in such third-party retail prepaid situations would not cure this discrimination, as the wireless carrier generally has no billing relationship with the end-user customer, and therefore no ability to pass the charge through to the end-user customer. Requiring wireless carriers to remit the UUSF surcharge in those situations, notwithstanding their inability to pass the surcharge through to the end-user customer, is equally discriminatory vis-à-vis service providers who can pass through the UUSF surcharge to customers.

The CTIA doesn’t dwell on the real world impact of its member companies, with revenues well into the billions of dollars, simply absorbing the 36¢ a month charged to their Utah customers as a cost of doing business. Instead, the lawsuit argues Utah cannot apply USF surcharges in a way that is “inconsistent with the requirements related to the federal universal service Lifeline program.”

CTIA argues the surcharge, when applied to Lifeline customers, unfairly increases rates for the most-needy. But the lobbying group was equally concerned the charges would not apply to competing prepaid wireless providers, because the Utah Public Service Commission lacks statutory authority to impose surcharges on those providers. The CTIA argues the surcharge is discriminatory and not competitively neutral, because the it allows third-party retailers of prepaid wireless telecommunications services like Tracfone to avoid the surcharge.

The CTIA is seeking a permanent injunction to stop the surcharges and has asked the court to order the defendants — essentially Utah’s taxpayers — to pay its court costs.

Senators Blast FCC’s Inaccurate Wireless Broadband Coverage Map

A bipartisan group of senators from some of America’s most rural and broadband-challenged states blasted the mapping skills of the Federal Communications Commission in a hearing Tuesday.

The senators were upset because the FCC’s Universal Service Fund will pay subsidies to extend wireless connectivity only in areas deemed to have inadequate or non-existent coverage. The FCC’s latest wireless coverage map is the determining factor whether communities get subsidies to expand service or not, and many in attendance at the Communications, Technology, Innovation, and the Internet subcommittee hearing quickly called it worthless.

Sen. Jerry Moran (R-Kan.) said the map’s “value is nil,” quickly followed by the Subcommittee chair Sen. Roger Wicker (R-Miss.) who added, “we might as well say it, Mr. Moran, that map is utterly worthless of giving us good information.”

“The simple answer is: it’s garbage in, garbage out,” said Steve Berry, CEO of the Competitive Carriers Association, which counts several small, rural cell phone companies as members.

The latest version of the map was heralded by the FCC as a significant improvement over the 2012 map used during the first round of funding. But critics like Berry claimed the map still relies entirely on carrier-provided data, much of it based on network capacity, and there is an incentive for existing wireless carriers to overestimate coverage because it assures funds won’t be given to potential competitors to strengthen their cellular networks.

The FCC claimed it gave carriers new benchmarks to meet in its latest map, including a request to only identify an area as covered if it achieves 80% certainty of coverage at 4G LTE speeds of 5 Mbps or more. To identify underserved zones, the FCC asked carriers not to identify areas that passed the first test as served if cell towers in that zone exceeded 30% of capacity. But Berry noted the FCC did not include a signal strength component, which means a carrier could report a significant area as getting adequate coverage based on the capacity of their network in a strong reception zone, even if customers nearby reported ‘no bars’ of signal strength or coverage that dropped completely once indoors.

Senators from Kansas, New Hampshire and Mississippi were astonished to see maps that claimed virtually 100% of all three states were fully covered with mobile broadband service. The senators rejected that assertion.

Sen. Maggie Hassan (D-N.H.) has devoted a section on her website to collecting reports from New Hampshire residents getting poor cell phone reception, and she has been a frequent critic of the FCC’s coverage maps which she has repeatedly called inaccurate.

In northern Mississippi, wireless coverage is so poor the Mississippi Public Service Commission launched an initiative to collect real-world data about reception through its “Zap the Gap” initiative. But the FCC’s latest map suggests the problem is solved in the most signal-challenged areas in the northern part of the state, with the exception of small pockets in the Holly Springs National Forest, the Enid Lake area, areas east of Coffeeville, parts of Belmont, and areas east of Smithville.

The four major national wireless carriers suggest there is no problem with wireless coverage in Mississippi either. AT&T claims to reach 98% of the state, Verizon Wireless 96.43%, T-Mobile 66.36%, and Sprint 30.92%. Regional carrier C Spire claims 4G LTE coverage that falls somewhere between T-Mobile and AT&T in reach.

Sen. Jon Tester (D-Mont.) told the subcommittee in his state, the FCC’s maps have little resemblance to reality, showing 4G LTE speeds in areas where no cellular reception exists at all.

“The FCC is wrong, they screwed up, we’re getting screwed because they screwed up, so how do we fix it?” Tester asked. “There has got to be a way to get the FCC’s attention on this issue. We’ve got to do better, folks, it’s not working.”

Mississippi’s program to report cellular coverage gaps.

Independent cell phone companies that specialize in serving areas the larger carriers ignore are hamstrung by the FCC and its maps, according to Mike Romano, senior vice president for policy for NTCA – The Rural Broadband Association — a trade group and lobbyist for smaller rural providers. Romano told the subcommittee if any cellular company reports coverage to even one household in a census block (which can cover a large geographic area in rural states), that entire block is ineligible for Connect America Fund subsidies.

The FCC, rural carriers complain, is relying on small wireless companies to serve as the map’s fact checkers and forces them to start a costly challenge procedure if they want to present evidence showing the map is wrong. Such proceedings are expensive and time-consuming, they argue. Even if successfully challenged, that does not win the companies a subsidy. It only opens the door to a competitive bidding process where challengers could face competing bids from larger companies that made no effort to challenge the map data.

A group of senators signed a joint letter to FCC Chairman Ajit Pai complaining about the accuracy issues surrounding the FCC’s wireless map:

Dear Chairman Pai:

We write this letter to express our serious concerns that the map released by the Federal Communications Commission last week showing presumptive eligible areas for Mobility Fund Phase II (MF II) support may not be an accurate depiction of areas in need of universal service support.  We understand that the map was developed based on a preliminary assessment from a one-time data collection effort that will be verified through a challenge process. However, we are concerned that the map misrepresents the existence of 4G LTE services in many areas.  As a result, the Commission’s proposed challenge process may not be robust enough to adequately address the shortcomings in the Commission’s assessment of geographic areas in need of support for this proceeding.

MF II is intended to provide $4.53 billion in support over 10 years to preserve and expand mobile coverage to rural areas. These resources will be made available to provide 4G LTE service where it is not economically viable today to deploy services through private sector means alone.  Having consistently traveled throughout rural areas in our states, it appears that there are significant gaps in mobile coverage beyond what is represented by the map’s initial presentation of “eligible areas.” To accurately target support to communities truly in need of broadband service, it is critical we collect standardized and accurate data.

For too long, millions of rural Americans have been living without consistent and reliable mobile broadband service.  Identifying rural areas as not eligible for support will exacerbate the digital divide, denying fundamental economic opportunities to these rural communities.  We strongly urge the Commission to accurately and consistently identify areas that do not have unsubsidized 4G LTE service and provide Congress with an update on final eligible areas before auctioning $4.53 billion of MF II support.

Verizon Wireless Pushes Customer to Upgrade Data Plan Before Closing His Account

Danny, who lives in eastern Hancock County, Me., was more than a little confused by his September Verizon Wireless bill.

“You haven’t had an overage yet, but you recently cut it close,” warned the wireless company. Verizon’s definition of “cutting it close” was using 7.3GB of data in June, 7GB in July, and 7.4GB in August. His data plan includes an allowance of 12GB a month, and he only used just over half of that. Despite that, Verizon Wireless recommended he “get on the right plan.” For Danny, who already spends nearly $250 a month with Verizon, that would mean an upgrade to “Beyond Unlimited,” which offers “unlimited” 4G LTE data (subject to throttling once you head north of 22GB of usage a month) and 15GB of hotspot usage. The added cost? Another $52.99 a month, taking Danny’s bill to $300 a month.

A $300 cell phone bill might be a subject of a story all on its own, but what really got Danny’s attention was a billing notice (and letter mailed separately to his home), telling him his family was being kicked off Verizon Wireless and his account would be closed Oct. 17. The reason? He was “using a significant amount of data while roaming off the Verizon Wireless network:”

The same company inviting him to spend $52 more on an unlimited data plan has now dis-invited him as a customer because it didn’t like how and where he used the existing data plan that came with his account.

“I checked all of my data usage for the past 12 months,” Danny tells Stop the Cap! “Data usage was anywhere from 3.5GB (for three lines), up to 8.5GB.  We have rollover data as part of our plan (previous month of unused data rolls over to the next month). One month we used 16GB (that was the month that we drove to Texas and back), but still never went over the data we had available.”

Danny’s family uses their phones primarily in eastern Hancock County, a well-recognized trouble spot for cell phone dead zones until Wireless Partners, an independent cell tower owner/operator, partnered with Verizon Wireless to construct new cell towers using spectrum acquired by Verizon. Many of the cell sites were specifically designed to reach Downeast Maine, home to a number of small communities — some drawing tourists in the summer and others not. Wireless Partners’ new towers concentrated improved coverage along the Route 1 corridor between Ellsworth and Calais, and the Route 9 corridor known to the locals as the Airline — from Calais to Aurora, communities mostly east of Bangor on roads that take visitors to communities like Bar Harbor, right on the coast, or all the way to the New Brunswick border.

Downeast Maine

In this part of Maine, customers have to choose their cellular provider carefully because no company offers solid coverage in every community in the region. Those living in more tourist-focused communities or cities on the coast or one of the offshore islands often select U.S. Cellular, a regional carrier that has accepted millions of federal dollars from the Universal Service Fund to expand service. U.S. Cellular has added towers in communities like Bangor, Lewiston-Auburn, Ellsworth and the Presque Isle-Houlton area. But in many smaller towns, U.S. Cellular reception often disappears. The other two providers — Verizon Wireless and AT&T — focus most of their attention on cities like Portland, Augusta and Bangor, and along I-95 and in popular tourist areas on the coast.

“Unlike in many other states, if you choose the wrong carrier in Maine, you get absolutely no reception at home and perhaps one bar, if you are lucky, while on the road going to work or doing errands,” said Mike Fastler, a lifelong resident. “More than anywhere else I know, people here talk to their neighbors about what cell company works for them, and in a lot of towns almost everyone relies on the same company because it is the only one that delivers good reception.”

Fastler says in large parts of Downeast Maine east of I-95, Verizon Wireless has recently been the most solid, primarily because its network has been supplemented with towers built by Wireless Partners, which has prioritized improving cell reception around the inland areas of Washington and Hancock counties. The customers most likely of being booted by Verizon Wireless are customers that live and/or work in these two counties.

Customers like Danny have no idea Verizon considers them roaming abusers because when using cell towers run by Wireless Partners, Verizon devices show reception as part of Verizon’s home LTE network. No roaming indicators appear at all. But Verizon must still pay Wireless Partners when their customers use the third-party company’s cell towers. Verizon’s interpretation of its customer agreement allows it to terminate customers found roaming excessively. The question is, is 7GB of usage on a cell tower network built to augment Verizon Wireless’ coverage area be defined as “excessive.”

Verizon thinks so, telling Ars Technica:

“These customers live outside of areas where Verizon operates our own network,” Verizon said. “Many of the affected consumer lines use a substantial amount of data while roaming on other providers’ networks and the roaming costs generated by these lines exceed what these consumers pay us each month.”

But Danny and many other affected readers tell us their usage is well below 10GB a month. Some customers received termination notices and use an average of only 3GB a month and live near a Wireless Partners tower.

“It seems highly unlikely Verizon Wireless is incurring costs that are exceeding customers’ bills,” adds Fastler, who is also scheduled to be canceled on Oct. 17. “I used 1.5GB in August and never came close to hitting 5GB on our account over the last two years and I am being shut off.”

Fastler tried to sign up as a new Verizon Wireless customer with his wife to escape the account closure, but Verizon Wireless’ crackdown is complete and the company has at least temporarily stopped accepting new customers in areas where its third-party cell tower operators provide service.

“Give them your zip code and if it is in an affected area the system kicks the order out and won’t accept it,” reports Fastler.

Jason Sulham, a spokesperson for Wireless Partners confirms Verizon’s order lockdown on Maine Public Radio in response to questions about just how many customers are being removed from Verizon’s network.

“Verizon is restricting any new customers in those areas, so when you talk about what that final number is, what they have indicated is a final number of current customers who have received a termination letter. However, that doesn’t take into account the number of people who are in that area that can’t even sign up as new customers for the service, which is certainly not what was part of the original intent of building this network,” Sulham says.

The crackdown on rural coverage will make life exceptionally difficult for affected customers. Maine is America’s most rural state, according to the 2010 U.S. Census, with more than 61% of the population living in communities of less than 2,500. Many of those communities are spread far apart, making cell towers difficult to place to reach the largest number of customers. Some communities have access to just one tower. Others are only partly serviced, requiring users to go outside, run up nearby hills, or take a short drive to get a single bar of reception. That is why Verizon’s news has hit this part of Maine so hard.

For many locals, Wireless Partners solved a problem Verizon itself wouldn’t solve, and stronger cell coverage came as a result. Now Verizon threatens to recreate the original problem, and by limiting access to its partner networks, it could throw those companies’ business plans into the air and make them financially untenable.
