After Seeing Broadband-a-Plenty in Longmont, Fort Collins, Colorado Wants Public Broadband Too

Residents of Fort Collins, Colo., that have an excuse to take an hour’s drive south on U.S. Route 87 to visit Longmont and experience the Internet over the community’s public broadband service can’t believe their eyes. It’s so fast… and cheap. Back home it is a choice between Comcast and CenturyLink, and neither will win any popularity contests. While large parts of Colorado have gotten some upgrades out of Comcast, Fort Collins is one of the communities that typically gets the cable company’s attention last.

The city of Longmont took control of its digital destiny after years of anemic and expensive service from Comcast and CenturyLink. Longmont Power & Communications’ NextLight Internet service delivers gigabit fiber to the home service to the community of 90,000. The service was funded with a $40.3 million bond the city issued in 2014, to be paid back by NextLight customers, not taxpayers, over time. It remains a work in progress, but is expected to start construction to reach the last parts of Longmont by next spring.

Instead of spending to upgrade their networks to compete, the incumbents demagogued the public project and Comcast spent $300,000 of its subscribers’ money in a campaign to kill the service before it even got started. Perhaps they had a right to be worried considering NextLight customers pay $49.95 a month for unlimited 1,000/1,000Mbps service. NextLight offers 20 times the download speed and 100 times the upload speed of Comcast’s Blast! package for nearly $30 less a month.

 

After NextLight was rated America’s fastest performing Internet service by Ookla in May, residents in Fort Collins began to wonder why they were still putting up with poor service from Comcast and lousy DSL from CenturyLink.

At the same time, city officials were doing their best to leverage some modest improvements from Comcast in return for a renewed franchise agreement. All they got was a vague commitment permitting the city to monitor Comcast’s notorious customer service and two HD channels set aside for Public, Educational, and Government use, along with a $20,000 grant to help the public access channel with online streaming.

The Coloradoan urged Fort Collins officials to think big and establish public fiber optic broadband in the city.

To manage this, they will have to overcome a 2005 state law backed by Comcast and Qwest (now CenturyLink) that bans municipal telecommunications services. A local vote or federal waiver can sidestep a law that was always designed to restrict competition and make life easier for the two telecom giants.

The newspaper opines that Fort Collins is in no way ready for the digital economy of the 21st century relying on Comcast and CenturyLink.

The cable company’s attention is focused on bigger cities in the state and CenturyLink remains hobbled by its copper legacy infrastructure. While some upgrades have been forthcoming, both Comcast and CenturyLink are also testing usage caps or usage-based billing — just another way to raise the price of the service. And speaking of service, neither Comcast or CenturyLink are answerable to the communities they serve – a community owned broadband alternative would be.

As the Coloradoan writes:

We’ve got to lay the groundwork now. Society took huge steps forward when automobiles replaced the horse and carriage. And no, installing municipal broadband isn’t adopting a new mode of transportation, but it is symbolic of laying an entirely new road.

Look at it another way. The city provides needed services such as water and electricity. Internet access is a needed service.

One thing Fort Collins doesn’t absolutely need Comcast or CenturyLink. But nobody is asking them to leave. They have a choice to use their massive buying power and resources to upgrade their networks to compete. But Fort Collins residents should not have to wait for that day to come when there is a better alternative in their grasp today: public broadband.

President Barack Obama will be in Cedar Falls, Iowa today to announce steps his administration plans to take to improve broadband in the United States, including a call to end laws that restrict community broadband development that limits competition.

“Today, too few Americans have affordable and competitive broadband choices, but some communities around the country are choosing to change that dynamic,” says a statement issued by the White House. “As a result – as outlined in a new report being issued today – cities like Lafayette, Chattanooga, and Kansas City, have broadband that is nearly one hundred times faster than the national average, yet still available at a competitive price. By welcoming new competition or building next-generation networks, these communities are pioneers in broadband that works, and today in Cedar Falls, Iowa, the President is highlighting their remarkable success stories and providing municipal leadership and entrepreneurs new tools to help replicate this success across the nation.

The report, produced by the National Economic Council and Council of Economic Advisers, finds no evidence to support industry contentions that community-owned broadband duplicates existing broadband services and wastes taxpayer dollars. It also challenges cable and phone industry-backed groups claiming publicly owned broadband networks are business failures.

It cites the success of Chattanooga’s EPB Fiber service, operated by the local municipal utility. Not only is EPB successful financially, but it has introduced Chattanooga residents to the kind of competition sorely lacking in most cities for telecom services.

cedar falls“EPB’s efforts have encouraged other telecom firms to improve their own service,” states the report. “In 2008, for example, Comcast responded to the threat of EPB’s entrance into the market by investing $15 million in the area to launch the Xfinity service – offering the service in Chattanooga before it was available in Atlanta. More recently, Comcast has started offering low-cost introductory offers and gift cards to consumers to incentivize service switching. Despite these improvements, on an equivalent service basis, EPB’s costs remain significantly lower.”

In Wilson, N.C., Time Warner Cable customers pay significantly less for cable and broadband service than other North Carolina customers because of the presence of Greenlight, the community-owned fiber to the home provider. TWC customers in Wilson pay stabilized prices for service while residents in the nearby Research Triangle pay as much as 52 percent more for basic Internet service, according to the report. Greenlight’s competition has brought gigabit broadband to the community as well as lower prices for customers who decide to remain with Time Warner. The combined savings is estimated at more than $1 million annually for Wilson residents.

Those who believe municipal broadband is a waste of taxpayer dollars should consider the story of Lafayette, La.’s LUS Fiber. In addition to bringing superior broadband service to a city dominated by a cable operator that used to treat the market as an afterthought, the presence of LUS’ fiber to the home network has forced Cox Cable to improve service, offer significant customer retention deals to departing customers and defer rate increases. The investment in community broadband has saved residents an estimated $4 million from rate hikes that went ahead in other Cox cities, with an estimated total savings of between $90 and $100 million for Lafayette-area broadband customers over LUS’ first 10 years of service.

Taxpayer-supported institutions like local government, law enforcement, and schools have also seen dramatic savings by switching to municipal solutions. In Scott County, Minn. the local government’s annual bond payment for constructing their own broadband network is $35,000 less than what the county used to pay private companies for a much slower network. Area schools that formerly paid private sector telecom companies $58 per megabit of Internet speed now pay $6.83 — a savings of nearly 90 percent. Schools also received dramatic speed increases from 100 to 300Mbps. They paid less for more service — from $5,800 a month before to $2,049 a month today. Those payments go straight back to the county government instead of into the hands of out-of-state investment bankers and shareholders. On the state level, Minnesota’s public institutional network is saving taxpayers almost $1 million a year.

With the broadband profit gravy train for big cable and phone companies grinding to a halt in competitive areas, several of these companies have spent millions lobbying state governments to outlaw public broadband services. They have succeeded in 19 states, primarily with the assistance of the corporate-funded American Legislative Exchange Council (ALEC), which appeals to primarily Republican lawmakers with claims government broadband is unfairly competing with the private sector. In fact, private providers have not been driven out of communities where they face municipal competition, but they have been forced to lower prices and improve service for customers.

Today the president will call for a new effort to support local self-determination for broadband by strongly opposing industry-backed, anti-competitive deterrents and bans on community-owned networks. The president will also sign a letter addressed to FCC chairman Thomas Wheeler encouraging him to move forward with a federal ban on state broadband laws that restrict broadband development.

He will also announce additional funding for rural broadband expansion and take steps to bring local leaders together to explore how the development of community broadband initiatives in their cities and towns can make a major difference in the 21st century digital economy. The president recognizes that most Americans lack sufficiently competitive choices for broadband service and often have just one choice — the cable company — for broadband speeds greater than 25Mbps. That means many Americans are seeing their broadband speeds lag while their monthly bills continue to grow.

Community-owned broadband may be the only alternative many cities have for better broadband as would-be competitors are scared off by high construction costs and an inability to secure cable television programming at competitive prices for their customers.

Big Cable, Telcos Spent $42 Million In 2013-2014 Lobbying for Deregulation, Against Net Neutrality

AT&T, Comcast, Verizon, Time Warner Cable and the cable industry’s chief lobbying group spent $42.8 million during the 2013-2014 election cycle to weigh in on issues including burying Net Neutrality, outlawing community broadband competition, winning tax breaks for themselves, and avoiding consumer protection regulations.

A Common Cause analysis of data from the Center for Responsive Politics and the Institute for Money in State Politics shows that the usual suspects poured money into political coffers on the state and federal level to influence lawmakers.

On the federal level, murky party committees received the largest individual checks: a total of $862,223 for House and Senate Republicans and $552,605 for Democrats. Individual members of Congress also received their own contributions, including Republican House Speaker John Boehner ($98,175 from Comcast) and Democratic Senator Mark Pryor ($88,650 from Comcast, TWC, and National Cable and Telecom. Assn.) Pryor will need to spend his contributions quickly. He was de-elected by Arkansas voters last Tuesday.

Net Neutrality is a major topic on the minds of the cable and telco companies, as is ongoing deregulation and decommissioning rural landline service, and pushback on revelations AT&T and Verizon were only too happy to turn over your phone records to the federal government.

In the states, the bigger the issues coming up in the legislature, the bigger the campaign checks. In Florida, AT&T is the state’s single largest source of political donations, giving $1.53 million to state lawmakers in the past year and another $660,000 to Gov. Rick Scott (R) and his appointed heads of state agencies. AT&T is lobbying for eliminating Florida’s telecommunications tax, win the right to place cell towers wherever they wish without much interference from local officials, and further deregulation. Most of AT&T’s money goes into the hands of the state’s Republicans.

In New York and California, Democrats got a major chunk of money from Comcast and Time Warner Cable — New York Governor Andrew Cuomo received $60,800 each from both Comcast and Time Warner Cable (totaling $121,600). California Governor Jerry Brown received $54,400 from Time Warner Cable and $27,200 from Comcast. Both states are reviewing the merger of the two companies this year. AT&T and Verizon are also major donors – AT&T wants to dismantle the rural telephone network in California and Verizon is trying to convince the New York legislature to approve its own rural landline replacement – Voice Link. It also wants reduced scrutiny of its landline performance in New York and more access to New York City buildings where it faces resistance from property owners who want compensation from Verizon to install FiOS.

Free Speed Upgrades, 3000th Customer for North Carolina’s Community-Owned Fibrant

fibrant speedSalisbury’s community-owned fiber network has tripled its subscriber base in three years, signing up its 3,000th customer in the community of 33,000 and is already turning a profit.

Fibrant, despite facing intense opposition from corporate-backed, conservative special interest groups with financial ties to its competitors and a state law passed at the behest of Time Warner Cable that limits its future growth opportunities, has proven very successful delivering improved Internet access to a community that received the back of Time Warner’s hand when it requested service upgrades.

Salisbury invested $33 million to install more than 250 miles of fiber in and around the community and began hooking up customers to its all-fiber network in late 2010. By the following summer, 1,200 customers signed up. Today, Fibrant serves more than 3,000 homes in the community.

WCNC-TV in Charlotte reports Fibrant is likely to break even this year after losing $4.1 million the year before — a loss Fibrant attributes to normal start-up costs faced by almost every new business.

Dale Gibson has been thrilled to be a Fibrant customer since the beginning and is even happier now that Fibrant offers gigabit speeds.

“Generally, when an Internet service provider gives a speed, it represents bandwidth, or a theoretical ‘best effort’ speed, not the ‘throughput,’ or actual speed,” Gibson told the Salisbury Post. “My speed tests are consistently above 900Mbps.”

In 2013, Fibrant raised the speed of its entry-level broadband package to 20/20Mbps for no extra charge. In the coming week, Fibrant’s basic broadband customers will be getting another free upgrade to 50/50Mbps.

Customers who want even faster speeds are also getting them for no extra charge:

  • 30/30Mbps customers will see their speed raised to 75/75Mbps;
  • 50/50Mbps customers get a free speed increase to 100/100Mbps;
  • 100/100Mbps customers get the best upgrade of all: 1,000/1,000Mbps service at no extra cost.

Fibrant’s competitions cannot come close. AT&T U-verse still tops out at around 24Mbps in this part of North Carolina and caps its customers to 250GB of usage a month. Time Warner Cable’s best speed remains 50/5Mbps at a price higher than what Fibrant charges for 100/100Mbps.

Fibrant has also improved its video packages, with new features like a whole house DVR, more channels, and more HD. Customers who don’t want networks shoveled at them can buy a basic cable TV package from Fibrant for $37 a month. Those who want more can upgrade to several different packages offering a maximum of over 450 TV channels and 50 music channels.

Customers in nearby communities who want the kind of competition Fibrant delivers will have to wait a long time to get it. Time Warner Cable, with the support of the Republican state legislature, successfully introduced and eventually passed the cable company-drafted measure to essentially ban community broadband in the state. FCC chairman Thomas Wheeler promised to consider eliminating these state corporate protectionism laws, provoking a hostile response in the Republican-dominated House of Representatives.

Rep. Marsha Blackburn, a Tennessee Republican with heavy backing from telecommunications giants AT&T and Comcast, introduced a measure for the benefit of large phone and cable companies that would override any effort by the FCC to increase competition by eliminating anti-competitive restrictions on public broadband.

“Blackburn’s positions line up very well with the cable and telephone companies that give a lot of money to her campaigns,” said Christopher Mitchell from the Institute for Local Self-Reliance. “In this case, Blackburn is doing what it takes to benefit the cable and telephone companies rather than the United States, which needs more choices, faster speeds, and lower prices. The argument that Blackburn puts forth [for passage of her measure] is not coherent. It’s just politics.”

Republicans in the House responded anyway, passing her measure 223-200. Just two Democrats voted in favor. The bill is not expected to pass the Senate and would almost certainly face a presidential veto.

New York Democrat Jose Serrano relished the ideological irony of House Republicans forced to twist their positions to accommodate AT&T.

“Whatever happened to localism or local control?,” asked Serrano. “This amendment means the federal government will tell every local citizen, mayor, and county council member that they may not act in their own best interests. Any such amendment is an attack on the rights of individual citizens speaking through their local leaders to determine if their broadband needs are being met.”

As community-owned providers in North Carolina found out, Big Telecom money often speaks louder than ideological consistency.

Los Angeles cable subscribers are paying $30-50 a year in extra franchise fees the city government has no idea what to do with, allowing a bank account dedicated to housing the unspent funds to reach $35 million and counting. A new audit by the Office of the City Controller found no misappropriation or ethical lapses by the city government, but it did criticize the lack of long-term planning regarding how franchise revenue should be used, as well as lax auditing of expenses that were paid from the fund. Los Angeles City Controller Ron Galperin added the city’s lack of consistent auditing of the five major cable operators servicing greater Los Angeles may be allowing cable operators to charge customers franchise fees the companies are keeping for themselves. A 2006 law passed at the behest of Verizon and AT&T allowing statewide video franchise agreements in California isn’t helping either.

For decades, communities have been able to demand up to a 5% franchise fee from cable and phone companies offering video services in their areas in return for access to public rights-of-way and other public property. Most cities, including Los Angeles, have requested the maximum allowed – 5% of the provider’s gross annual revenue earned within the city. Cable operators retaliated by recouping the franchise fee by billing cable customers for it on a separate line on monthly cable bills.

In Los Angeles, 60% of all franchise fees ($31 million) paid are transferred to the city’s all-purpose General Fund, used for all types of city expenses. The remaining 40 percent ($12.4 million) is supposed to be earmarked for a Telecommunications Fund, but the city often raids that account as well. Time Warner Cable subscribers account for 85% of Los Angeles’ cable franchise revenue, AT&T U-verse contributes another 10% with other operators paying considerably less. Last year, Charter Cable wrote a check for less than $5,000, primarily because only a tiny part of the city of Los Angeles is served by Charter today.

So where is the excess money still in the account coming from?

The Unintended Consequences of Statewide Video Franchising

Eight years ago, Governor Arnold Schwarzenegger signed AB 2987:  the “Digital Infrastructure and Video Competition Act of 2006” (DIVCA). In reality, DIVCA was just another statewide video franchise bill heavily pushed by the state’s dominant phone companies — AT&T and Verizon — to let them begin offering video services without having to sign franchise agreements with thousands of local governments across the state.

verizon attAT&T and Verizon sold the legislation to the public as a red-tape cutter to bring Verizon FiOS and AT&T U-verse to millions of Californians without unnecessary bureaucratic delay.

But lobbyists from both phone companies, as well as several cable companies, were successful in inserting their own amendments into the law that undercut their arguments for passing the legislation:

  • As local franchise agreements expired, companies took their franchise renewal business direct to the state, cutting off local oversight. Communities could no longer require operators to expand into rural areas or impose fines for sub-standard service;
  • Cable companies won the right to toss Public, Educational, and Government Access (PEG) channels out of their buildings. Many communities assigned responsibility for housing and operating PEG channels as part of their franchise agreement. DIVCA rendered those agreements void and unenforceable;
  • Cable companies no longer had to offer institutional broadband networks for free or at a discount to local governments, schools and libraries, and many existing networks were closed down as soon as the local franchise agreement expired and communities balked at the new prices charged by telecom companies.

But perhaps the most controversial amendment was language that gets AT&T and Verizon out of meeting obligations to build out their fiber networks where they choose not to built them, while still compelling smaller independent telephone companies to offer service to every customer within their telephone service area within a reasonable amount of time.

So instead of promoting a rush towards video competition, both AT&T and Verizon won concessions that let them cherry pick — on their own schedule — customers for AT&T U-verse and Verizon FiOS:

  • Verizon is in compliance with DIVCA as long as 25% of the households where service is available are low-income and within 5 years, Verizon increases that to at least 40%;
  • AT&T stays out of trouble with DIVCA by providing video service to 35% of low-income households where service is available. Within five years, AT&T must reach at least 50%.

One of the biggest victims of DIVCA are PEG channels which lost the sponsorship of the cable companies that used to underwrite them as part of their franchise agreements. American Community Television reported in California, Illinois and Indiana, where statewide video franchising laws were passed, cable operators that operated PEG channels closed the doors, sometimes with only 30 days notice. Even in states where PEG funding remained, channels have been exiled to Channel Siberia (eg. Channel 1,512) or are under constant threat of losing their channel if they don’t meet an operator’s arbitrary quality of programming criteria.

Time Warner Cable has moved PEG channels to digital service in a majority of their service areas, requiring many customers to have an added-cost cable box to watch.

To help Californian PEG services cope, a state law permitted cities to collect an extra 1% of gross revenue from cable operators to keep funding these channels. But if a city already collects a full 5% franchise fee, any money collected from PEG channels must only be spent on their operations — no raiding of funds allowed. If the local government thinks there are bigger priorities than supporting public, educational, and government access, the future of PEG channels is questionable.

How to Spend the Untouchable Proceeds

With Los Angeles-area cable companies collecting and sending on the proceeds of the 1% PEG surcharge to city coffers, the money has been more or less just piling up over the last seven years, unspent.

As of the end of June last year, the city had squirreled away about $22 million collected from cable TV customers stashed in a non interest-bearing account. PEG operations across the United States are not known for being profligate spenders, relying on budgets that would be insufficient to keep the lights on at a typical local public television station. So some question whether Los Angeles’ Public Access, Educational Access, and Government Access networks need $22 million to continue operations.

The city has decided the Government Access channel — the one that airs council meetings and other political functions — does need a new home.  So the city is spending $20 million to completely renovate one of the oldest buildings in Los Angeles, the long-vacant three-story Merced Theater near Olvera Street.

When complete, the state-of-the-art digital facilities of Cityview Channel 35 may rival those of some commercial television stations in Los Angeles. The building will house a small performance venue on the first floor, a studio with space for a 70-person live audience, and plenty of office space on the third floor. What it evidently won’t have room for is the Public Access and Educational Access channels that make up the rest of the PEG trio. The new facility is for the exclusive use of Channel 35.

Local residents are happy someone is finally doing something with the theater, which has been empty and unused for at least 30 years. The project could also make Los Angeles’ Government Access channel one of the most capable in the country, producing high quality programming well beyond the ubiquitous city council meetings.

“Space for a live audience of about 70 people will allow us to engage the public with debates, town halls and other events that we weren’t able to do,” Mark Wolf, executive officer at the city Information Technology Agency, which oversees Channel 35, told Downtown News. “The venue also gives us a full upgrade to digital technology, as we’ve been operating in an analog environment.”

Downtown News partly misled its readers when it suggested cable providers are footing the bill for the renovated home of Channel 35. Although money from the city’s general fund won’t be used for the project, the money did originate from cable subscribers who have paid higher cable bills since 2007 because the city elected to collect a 1% PEG franchise fee.

Even after spending $20 million on the Merced Theater, the money from Time Warner Cable, Cox, AT&T, Verizon, and Charter cable TV subscribers will keep rolling in. The audit found that by the time the new Merced Theater facility opens in 2016, the city will again have between $21-25 million in unspent PEG funds.

Galperin thinks throwing more money at traditional PEG operations would be a mistake, particularly when younger audiences are not even subscribing to cable television.

“We’re in a new era,” Galperin said. “The old rules that envisioned everybody getting their programming from cable are changing before our very eyes. We are in a totally different era in terms of how people get their information, so much of viewership is on the Internet now, not necessarily on cable.”

Because PEG funds can only be spent on PEG operations, as a starting point, funds could be spent to build up what is now an anemic, barely functioning website for Channel 35. Although the channel does stream online, it is intermittent in our experience. Channel 35 might also partner with local public broadcasting and minority-interest channels in co-production ventures. It should also develop a robust on-demand library of its content for site visitors because that is increasingly how Americans choose to watch television.

Galperin suggested other uses including a public Wi-Fi network and city Internet sites for programming and other information, but these may stray outside of the boundaries of what is permissible under current California and federal law.

Of course, there is one other alternative – rescind the PEG fee altogether until there is a legitimate need to collect the money from already overburdened cable subscribers.
