Three important Republican lawmakers have announced their support of Comcast’s $45 billion acquisition of Time Warner Cable, claiming the combined entity will not affect competition in the cable or broadband market.

Sens. Rand Paul of Kentucky, Lindsay Graham of South Carolina, and Rep. Blake Farenthold of Texas told Newsmax TV’s Steve Malzberg the cable merger does not seem to be a monopoly.

“One of the good things about the Internet … is there’s such of diversity of opinion and so many places to get opinion that all the old-fashioned rules on merger and acquisitions in media really have become outdated,” Paul said. “[There are] so many places to look for a viewpoint … [so] I’m just not much on having the government get involved. Most of the time the government gets involved because another competitor doesn’t like it and that competitor is usually an enormous competitor…. So for the most part, I would let [these] mergers occur.”

South Carolina’s Lindsay Graham agreed with Paul. Despite the fact South Carolina is now dominated by Comcast and Time Warner Cable, turning the two companies into one does not pose any problem for Graham.

“There’s no competition between Time Warner and Comcast in a cable market, so you’re not creating a monopoly,” Graham said. “There’s competition with satellite, with phone companies, with all kind of things.”

Farenthold expressed concern about “left-leaning” Comcast, owner of NBC and MSNBC, getting larger but cannot oppose the merger on those grounds alone.

“You can’t not approve a merger because you don’t like the companies’ politics. That’s just not right,” Farenthold told Newsmax. “The issue is, is it going to create a monopoly? Well, Time Warner and Comcast don’t compete in any markets or maybe very few markets.”

comcast stormComcast is dumping a blizzard of cash on Capitol Hill in a late winter storm of lobbying to win approval of its $45 billion buyout of Time Warner Cable.

Politico reports Comcast’s money is bipartisan, with generous checks going into the campaign coffers of Texas Republican Ted Cruz and Illinois Democrat Dick Durbin. In fact, the news site reports Comcast has donated to almost every member of Congress who has a hand in regulating the cable company.

In fact, the only three members of the Senate Judiciary Committee that have not received a contribution from Comcast are Sens. Al Franken (D-Minn.), Mazie Hirono (D-Hawaii), and Jeff Sessions (R-Ala.)

That Franken did not receive any Comcast cash comes as no surprise after the senator sent his supporters e-mails blistering the merger.

“Comcast reportedly has an army of over 100 lobbyists ready to swarm Capitol Hill and whose goal is to push this through,” Franken wrote. “Their top priority is Comcast’s bottom line — not whether this deal will be good for consumers. There’s also a pretty cozy relationship between Comcast and the regulators that will evaluate this deal, which I find troubling.”

When Politico asked members of Congress whether the generous contributions from the cable giant would influence their thinking about the merger deal, none had any comment.

On the opposite side of the Capitol, the House Judiciary Committee is readying another hearing on Comcast — and many of its members also are familiar with the company’s financial support. Chairman Bob Goodlatte (R-Va.), for example, has received $15,000 this cycle from Comcast, some for his leadership PAC and the rest for his personal campaign.

The House Energy and Commerce Committee and its Senate counterpart so far haven’t scheduled their own reviews of the new Comcast-Time Warner Cable deal. But both panels do regulate Comcast by way of their broad jurisdiction over Internet, cable and telephone issues, and they have been canvassed almost entirely by Comcast contributions. The company has given to 50 of 54 of the House committee’s Democrats and Republicans, donating either to their reelection campaigns or their leadership PACs, according to a POLITICO analysis of campaign finance data from Jan. 1, 2013 to Jan. 31, 2014. And Comcast has donated in some way to 20 of 24 lawmakers on the Senate Commerce, Science and Transportation Committee.

There has been a total of $12,500 in checks for Walden, the leader of the telecom subcommittee, to both his personal coffers and leadership PAC. Comcast also has given $2,500 to Rep. Frank Pallone (D-N.J.), a contender to lead Democrats on the full Energy and Commerce panel following the retirement this year of California Rep. Henry Waxman — another recipient of Comcast support.

Albert Foer, president of the American Antitrust Institute, which opposes the merger, says Comcast’s contributions began long before the merger deal, but that is a well-considered strategy.

It’s “proactive giving,” said Miller, “so that when a corporation needs access in a time of trouble, investigation or oversight, they have already built the quote-unquote relationships they need to soften or make their arguments to a sympathetic audience.”

Sen. Al Franken (D-Minn.) has turned over much of his campaign website to expressing concern about the merger of Time Warner Cable and Comcast.

Franken has maintained a comparatively low profile since arriving in the U.S. Senate and rarely grants interviews to reporters outside of Minnesota, but after the announced $45 billion merger deal between the two largest cable companies in the country, he started making exceptions.

Franken has repeatedly tangled with Comcast, the dominant cable operator in his home state, since being elected. He favors Net Neutrality/Open Internet policies, strongly opposed Comcast’s purchase of NBCUniversal, and believes cable rates are too high and service quality is too low.

Although the senator claims he remains undecided about the merger, his public comments suggest he is likely going to oppose the deal.

“We need more competition, not less,” said Franken, who mocked Comcast’s claim that the two cable companies never compete with each other. “This is going exactly in the wrong direction. Consumers, I am very concerned, are going to pay higher bills and get even worse service and less choice.”

Although the merger will leave the combined company serving nearly one in three households, Comcast says it plans to keep its total nationwide broadband market share under 30%. But Franken points out Comcast isn’t just a cable company. It also owns a major television network and has ownership interests in nearly three dozen cable networks and television stations around the country — many in America’s largest cities.

Franken mass e-mailed his campaign supporters to express concern about the current state of the cable and broadband business and asked consumers what they thought about their cable company. More than 60,000 have shared their mostly negative views so far.

competitionThat may prove to be smart politics for Franken, seen as a polarizing figure in the left-right divide. The near-universal loathing among consumers for both Comcast and Time Warner Cable threaten to rise above traditional partisan politics. Republican lawmakers have kept largely quiet about the merger deal, and some are even openly questioning it. Franken may tapped into a re-election issue that voters across Minnesota are likely to support — especially older Republican-leaning independents.

Franken claims his survey is trying to level the playing field by getting consumers involved in the issue. For Washington regulators accustomed to only hearing from company lobbyists and various third party groups often financially tied to merger advocates, it could be a game-changer.

Comcast’s connections in Washington are legendary. Former Republican FCC commissioner Meredith Attwell Baker wasted no time taking a job as a senior Comcast lobbyist shortly after voting in favor of Comcast’s buyout of NBCUniversal. Former Republican FCC chairman Michael Powell today heads the National Cable and Telecommunications Association (NCTA), the cable industry’s largest lobbying group and supporter of the merger.

The merger deal’s regulatory review will be conducted by current FCC chairman Thomas Wheeler, a past president of the NCTA and former cable and wireless industry lobbyist. Bill Baer is in charge of the Antitrust Division that will examine the merger at the U.S. Department of Justice. His last job was leading the law firm that represented NBC in support of the Comcast-NBCUniversal merger.

France and Germany are pondering the launch of an alternative Internet to keep European data from passing through the United States, subject to eavesdropping from U.S. intelligence including the National Security Agency.

German chancellor Angela Merkel, whose own cell phone was reportedly monitored by U.S. security officials, suggests the new Euronet could avoid U.S. networks and servers and keep sensitive e-mail and other communications away from American eavesdropping.

Speaking on her weekly podcast on Saturday, Merkel said Germany had been in discussion with France over the idea, and an official at French President François Hollande’s office confirmed to the Reuters news agency that the idea of a European communications network was a positive development and Paris agreed with Merkel’s proposal.

Merkel is also upset that Internet giants like Facebook and Google could base much of their operations in countries were data protection laws are lax, even while carrying out business in countries where data privacy laws are strong.

“We’ve got to do more for data protection in Europe, there’s no doubt about it,” Merkel said. “Above all, we’ll talk about European providers that offer security for our citizens, so that one shouldn’t have to send e-mails and other information across the Atlantic. Rather, one could build up a communication network inside Europe.”

However, it is unclear whether a European communications network would be effective in stopping the NSA and other surveillance organizations from accessing private data.

In an interview with German broadcaster ARD earlier this year, former American contractor Edward Snowden said that attempts to create a walled-off version of the Internet would do little to stop the NSA.

“The NSA goes where the data is,” Snowden said. “If the NSA can pull text messages out of telecommunication networks in China, they can probably manage to get Facebook messages out of Germany.”

Snowden’s revelations have created serious tension between the United States and its European allies over data privacy. Last week, lawmakers in the European Parliament threatened to scuttle a trade pact over the issue.

AT&T Deregulation Wallops Californians In Their Wallets; Rates Up 222%, Despite Competition Claims

special reportStop the Cap! reader Steve L. has heard enough of AT&T’s promises that deregulation would bring more competition and better deals to Californians.

The Carlsbad resident is staring at the fruits of AT&T’s labor — winning deregulation of phone rates in 2006: a  basic phone bill that has increased from $5.70 a month before deregulation to $21.25 effective Jan. 2, 2014. That represents a 272 percent increase for basic measured (pay-per-minute) local telephone service. As if that was not enough, AT&T is also raising the per-minute rate for semi-local calls for the second time in two years. Earlier this year, AT&T slashed customers’ calling allowances by 25 percent, reducing the 225 minutes a month of toll-free calling down to 168 minutes in January.

Customers living in large, spread out cities in California are accustomed to Zone Usage Measurement (ZUM) charges for calls placed to numbers more than 12 miles from the local telephone exchange. But they may get bill shock after noticing how much the per-minute rates have increased:

  • ZUM 1/2 (12-15 miles): Calls have doubled in price over the last 36 months. Prior to 2013, calls cost three cents per minute. AT&T raised prices to four cents in January and will raise them again to six cents per minute on Jan. 1;
  • ZUM 3 (15-16 miles): Calling prices have increased from five cents a minute in 2012 to six cents a minute in 2013 and will be seven cents per minute in 2014.

attcarlsbad“After surcharges, fees, and taxes, my bill will be nearly $30 per month for measured rate service, representing a near doubling of cost in just a 22-month period,” Steve writes. “I have no other choice than AT&T for a true powered landline, but I am rejecting this latest increase and plan to test and move to a VoIP system.”

The constant parade of rate increases from the state’s largest local telephone company began shortly after the California Public Utilities Commission (CPUC) unanimously approved sweeping deregulation of telephone rates in August 2006. Then Republican Commissioner Rachelle Chong was the driving force behind the effort, reports the San Francisco Chronicle.

Chong embraced AT&T’s attitude about telecommunications deregulation, promising consumers would not face abusive rate hikes or bad service. Under the old system, AT&T telephone rates were capped in California. AT&T had to approach the CPUC and justify any proposed increases. Without solid evidence, the company’s rate increase requests were rejected. Under deregulation, AT&T was permitted to set rates at-will.

“By the end of the 2010, these rate caps will no longer be necessary,” Chong promised as the new rules were being phased in. “The market will be so competitive it will discipline prices.”

att_logoAT&T’s rates have shot up as much as 222 percent for the average Californian’s measured rate phone service. Some customers, including our reader, found rates nearly three times higher than they were before deregulation. In the last few years, AT&T has increased prices on landline service and calling features even more dramatically across the state:

  • AT&T Flat-Rate landline service jumped 115 percent since 2006, from $10.69 to $23 a month;
  • Call Waiting, a popular phone feature, is up nearly 180 percent;
  • Anonymous Call Rejection fees have almost quadrupled;
  • Lifeline Service for California’s most disadvantaged is up 28 percent.

“My belief is that AT&T is essentially harvesting,” Dane Jasper, chief executive of Sonic.net, a competing broadband Internet service in Santa Rosa that tosses in domestic phone service for free, told the newspaper. “They jack up the rate by a pretty egregious amount … because if people leave, well, where are they going? AT&T mobile phone service in at least half the cases. So they’re happy to have them leave or happy to have them stay.”

rate hikesAT&T defends the increases by suggesting rates were artificially restrained by rate regulators under the old system, and the new higher prices reflect economic reality and the deregulated marketplace. But AT&T’s rate increases have blown past other service providers in the state. Verizon’s flat rate service only increased 18 percent since deregulation. Independent providers SureWest and Frontier Communications have only raised prices by about six percent.

With these kinds of rate increases, customers like Steve are making hard choices about whether to keep or ditch their landline service. Ironically, AT&T’s argument to decommission traditional landline service is based on the premise customers are abandoning landline service. AT&T advocates moving customers to its deregulated U-verse platform in urban areas and switch rural customers to wireless-only service.

Chong paid a personal price for her erroneous predictions of consumer savings. In December 2009, the Democratically controlled State Senate refused to hold hearings on Chong’s reappointment to the CPUC, ending her term. AT&T and Verizon strongly backed Chong and lobbied hard for her confirmation. AT&T even turned out its notorious “dollar-a-holler” sock puppet brigade of non-profit groups that showered the legislature with letters supporting her reappointment, without bothering to disclose AT&T had made substantial direct or indirect contributions to the groups in the past.

Murray Bass, head of a small nonprofit in Northern California, initially wrote lawmakers saying Chong was a strong voice for low-income seniors. But in an interview, he admitted he’d endorsed her at the suggestion of executives at AT&T, which had given his group money.

“There’s an essential conflict of interest when a regulated — or supposedly regulated — entity is intervening on behalf of a regulator that’s friendly to them,” said Mark Toney, executive director of the Utility Reform Network, a group that opposed Chong.
