Opelika Residents Vote to Put City In Broadband Business; “It’s a Terrible Day for Charter”

Opelika residents who cast votes in Tuesday’s special referendum on cable competition delivered a decisive “yes” to city officials seeking to build a fiber to the home cable and broadband system in the city.

Although the turnout was just 18 percent, 62 percent of residents voting voted for the system’s construction, 38 percent said “no.”

For most of the supporters of the project, it was about delivering a resounding message to Charter Cable that their days of endless rate increases and sub-standard service in eastern Alabama were over.

Opelika mayor Gary Fuller was excited by the outcome of the vote.

“It’s a great day for Opelika. It’s a great day for our future. It’s a terrible day for Charter,” he told a crowd waiting to hear the mayor’s reaction to the results of the special referendum.

Fuller has been complaining about the lack of cable and broadband competition in Opelika for years, noting residents regularly complain about Charter Cable’s prices and service.

Part of the drive to look for alternatives may have come from watching a cable overbuilder, Knology, installing a $20 million fiber network down the road in nearby Auburn.

While Knology does compete with existing cable providers in many cities, it often takes years for the company to deliver service to every residence, if ever.  In fact, Knology is most commonly found in multi-dwelling units like apartment buildings, condos, and new housing developments where construction costs are lower.  Fuller proposes to build a network that will serve everyone.  The city will negotiate with companies like Knology to use the new fiber network to provide service to residents.

“I believe that this is the most amazing thing that any of us as elected officials will ever do during our service in the city of Opelika, because of what it will mean to our future especially with high speed Internet that will be a calling card for high paying jobs in new industries for Opelika,” Fuller said.

Charter Cable fought hard to stop the network, but wasn’t always accurate along the way.

Skip James, Charter Communications government relations director, claimed other municipal networks were financial failures.

“It has been repeatedly demonstrated that when cities or municipal-owned power companies enter the video/data/phone business, it usually ends up costing the taxpayers at least twice as much as the consultant had suggested,” James said. “It also has resulted in many municipalities selling off the networks at significant losses or walking away from further operation of the network.

“After the initial system cost, the city has to stay abreast with the competition and changes in the marketplace by investing more money in costly upgrades. This is a high risk of taxpayer money, since the taxpayers are generally not aware that they have the ultimate responsibility for payment and/or default on the huge bonds to build and upgrade the system.”

Of course, many municipal systems are up, running, and profitable for the communities they serve.  Construction delays and costly lawsuits from incumbent providers can delay such projects and boost costs, but since Opelika’s system will be built with revenue bonds, which are paid back through generated revenue, taxpayers cannot be left responsible for payments or defaults.

James could not understand why the city would want such a network when Charter was already serving the community.

“Our communications system is in front of almost every house and business in the city of Opelika,” James said. “Why would the city want to risk so much taxpayer dollars and go into this much debt when a network already exists that can provide services the customers want at a much lesser cost?”

Opelika residents who wanted an alternative to Charter may have just voted their answer.

City officials will seek bids for construction work in the near future.  Operations will be run by Alabama Light and Power.

There were a total of 2,819 ballots cast. Here’s how they broke down according to ward:

  • Ward 1: 211 yes, 54 no
  • Ward 2: 236 yes, 86 no
  • Ward 3: 368 yes, 333 no
  • Ward 4: 443 yes, 228 no
  • Ward 5: 492 yes, 368 no
  • Absentee ballots: 14 yes, 7 no

Charter Communications, the cable success story that wasn’t, wants consumers in Opelika, Alabama to believe their cable system is better by the last mile than any fiber-to-the-home system around.

Residents of Opelika are voting today on a referendum to allow the city to finance the construction of a true fiber to the home network for residents and businesses across the area.  They are up against cable industry opposition and a small group of vocal citizens who oppose the project on political grounds.

Charter Cable, still dusting itself off from bankruptcy reorganization, told Fierce Telecom that their hybrid coaxial-fiber cable system was actually better than an all-fiber network.

What’s most interesting here is Charter’s stance that their HFC network, which would also include fiber, is more resilient than an all-fiber last mile network. “This delivery system keeps the cost down for residential customers while supplying direct fiber optic connections to businesses requiring the maximum bandwidth available nationally,” said Skip James, government relations director for Charter Communications. “If a coaxial cable is damaged by traffic accidents or excavation procedures, it can be repaired rather quickly, whereas a damaged fiber optic cable will take hours or days to repair, depending on the scenario.”

Of course, since cable systems also frequently suffer from fiber outages caused by these same problems, the argument doesn’t seem especially persuasive.  Anyone in Opelika who has suffered an extended outage from Charter Cable can attest to that.  Karl Bode at Broadband Reports reminds us it’s also quite a flip-flop for the cable industry:

Obviously fiber cuts can happen with cable networks too, and this kind of argument is an about face for cable operators, who are usually busy trying to convince people that fiber and cable are largely indistinguishable.

Opelika’s network capabilities will be readily apparent once consumers realize a fiber to the home system can easily deliver the same upstream and downstream speeds, something Charter Cable can never offer on its network.  Fiber is also near-infinitely upgradeable, while cable systems are forced to take away analog channels from customers to make room for services that are already provided on most true fiber networks.

Although never the cheapest provider in Chattanooga, municipally-owned EPB Fiber continues its track record as the city’s fastest Internet service provider, and has increased its value to residents with a free doubling of Internet speeds.

The speed upgrade arrives the same week AT&T mailers began showing up in Chattanooga residents’ mailboxes announcing U-verse was now available in the neighborhood.

AT&T joins Comcast in some areas, Charter in others — and EPB as the third competitor for cable, phone and broadband service in this part of southeastern Tennessee.

EPB Fiber to the Home Broadband Speeds

  • 15/15Mbps service is now 30/30Mbps for $57.98 per month
  • 20/20Mbps service is now 50/50Mbps for $69.99 per month
  • 50/50Mbps service is now 100/100Mbps for $174.99 per month

A 150Mbps residential speed tier is also due anytime now.

Although EPB is already well known to Chattanooga residents as their local power company, the introduction of fiber optic telecommunications service has helped broaden the company’s reach.  EPB claims to be signing up around 500 residents a week for service.  The company does not use temporary pricing promotions to attract new customers — customers all get service for the same price.  But the attractiveness of the service, especially its speed, has made EPB popular with Internet enthusiasts.

John Appling in East Lake was shocked at just how fast EPB began installation of his fiber to the home service — within hours after the company placed a door-hanger tag announcing fiber service was now available on his street.

I called 30 minutes after the door tag was hung and to my delight was able to talk with a lady that was very nice, courteous and spoke perfect English. She took all my information and told me the day and time the installers would arrive to finish installing for the TV, internet and phone service inside my home, and that a crew would come by to install the boxes on the side of my home.

I left shortly after that call and returned a couple of hours later from grocery shopping. EPB contractors had already been to my home and installed the boxes on the side of the house. Yes, super fast service.

The day the installers came to complete the inside installation, they were on time, courteous and knew just what needed to be done to complete the install. One of the men even told me of a problem with my A/C heating unit duct work underneath my home which needed to be looked about soon. The men cleaned all the areas they worked in, made sure all my services worked correctly and asked if I had any questions they could answer before they left. Both men did a fantastic job and worked quickly to complete the work.

The pictures on our TVs never looked so great, the audio sounds wonderful also. Our telephone service is perfect and works just like anyone’s phone should. I enjoy the internet service most of all. I got the Fi-Internet 20. It is so fast and works great.

I have had to call twice this week to get the support group to help me with my internet connections and both times I have gotten a person who really helped me with my problems. They spoke perfect English, knew where I lived and what services I had from EPB. It is so nice to talk with our hometown folks and know they wanted to help myself in getting all I pay for in their services.

I just read where I was one of the first of 5,000 people to have their services installed in my home. Believe me, I am so thankful that EPB has the TV, internet and phone services. I have seen so many ads from their competitors with special prices for this or that. I am just glad to have the services of EPB services myself.

Google Launches ‘Google Fiber for Communities’ Website to Advocate for Fiber Broadband

Google today launched a new website which could become a major advocacy center to promote fiber broadband service across America.

Google Fiber for Communities opened with a thank you message for the enormous number of submissions it received for its experimental 1Gbps fiber broadband network.  Google expects to announce the winning application(s) for its experimental  network sometime this year.

But in the meantime, Google also acknowledges what big telecom companies keep trying to downplay and dismiss — “people across the country are hungry for better and faster broadband access.”  That is… better and faster service than their current provider is willing to supply.

The new website provides hints as to its greater purpose:

  1. The name itself.  Notice “communities” is plural.
  2. The site intends to mobilize for fiber networks across the country, starting with lobbying for pending federal legislation that would require installation of fiber conduit as part of federal transportation projects.
  3. The site’s links heavily promotes municipal broadband advocates and organizations, including the National Association of Counties, the National Association of Telecommunications Officers and Advisors, the Fiber to the Home Council, the Baller Herbst Community Broadband Page, the Broadband Properties Municipal Fiber Portal, and Muni Networks.  Outside of the Fiber to the Home Council, which has some big telecom company members and isn’t above advocating for their interests, the rest of the list suggests Google advocates that communities do for themselves what their local phone and cable companies won’t do — deliver world class broadband service at non-duopoly prices.

Stop the Cap! shares many of these goals with Google, as we are strong advocates for community fiber-based broadband, and believe additional competition is highly needed in America’s broadband marketplace to break up an anti-consumer duopoly that delivers slow broadband service (or none at all) at the highest prices companies can get away with.  Thanks to Stop the Cap! reader Jerry here in Rochester for sending word.

Verizon Upset About NY Bill Requiring Phone Deals Share 40 Percent of Proceeds With Ratepayers

When phone companies like Verizon decide to throw their rural customers under the bus by selling them off, shareholders and executives rake in windfall bonuses, sometimes in the millions.  Now a New York assemblyman and a state senator want ratepayers to get a 40 percent cut of the action.

Assemblyman Richard Brodsky (D-Westchester), is the primary sponsor of Assembly Bill A02208 — An Act Requiring the Public Service Commission to Conduct an In-Depth Public Interest Analysis of Proposed Mergers by Telephone Corporations and Other Telecommunications Services Providers.  A companion New York Senate Bill, S7263, was introduced by Sen. Brian X. Foley (D-Blue Point/Long Island).

The legislation would compel phone companies engaged in the practice of mergers, acquisitions, and sales to share 40 percent of the proceeds with New York’s landline phone customers.

The legislation came as a result of watching Verizon systematically sell off parts of its phone empire to third party companies like FairPoint Communications, Hawaiian Telcom, and Frontier Communications.  More than five million customers have been switched away from Verizon to other companies, most of which have gone bankrupt as a direct result of the sales.

Both Brodsky and Foley don’t want to see New York residents face similar consequences.  They are particularly concerned about Verizon’s upstate operations, particularly in rural areas outside of cities like Buffalo, Binghamton, Rochester, Syracuse, Albany, and northern New York.  In the upstate region, Verizon has constructed fiber to the home service under its FiOS brand in urban and suburban regions where it operates, but has made few changes in the countryside.  As Verizon customers from Washington to North Carolina suddenly find themselves served by Frontier, why couldn’t the same thing happen in communities like Sodus in Wayne County, Penn Yan in Yates County, or just about anywhere in northern New York?

Verizon’s business plan has evolved over the last ten years.  Company president Ivan Seidenberg previously declared the landline business dead, and the company has turned its attention to delivering fiber-based video, phone and broadband services to the major population centers within its service areas.  Because rural customers cost too much to serve with similar packages of services, Verizon has begun selling them off to independent phone companies that still see revenue from copper wire landline service.

Verizon claims it has no plans to sell any of its operations in New York, but Brodsky and Foley want insurance that if they change their mind, no ratepayers in New York will face what happened in northern New England or Hawaii when the companies taking control ended up in Bankruptcy Court.

“It’s a ratepayer protection bill for upstate New York,” Brodsky said.

Brodsky said if Verizon were to sell operations, consumers will not be left with inferior service.

Forcing companies to share proceeds of sales to ratepayers who ultimately indirectly bankroll most of these deals is not unprecedented in New York.  Electric and gas utilities are often required to send refunds or issue credits when they sell assets.  Ratepayers of Rochester Gas & Electric received several compensation checks after the sale of the Ginna nuclear power plant in Ontario, New York to Constellation Energy Group in 2004.

Verizon could also be compelled to reinvest proceeds earmarked for consumers in the company’s infrastructure, such as paying for broadband improvements or upgrading lines.

The legislation would only impact companies earning more than $200 million in gross annual revenue from New Yorkers.  Currently, that means the legislation would only impact Verizon and Frontier Communications.

Not surprisingly, Verizon is vehemently against the proposed legislation and is fighting tooth and nail to kill it in Albany.

Foley

Jim Gerace, president of Verizon’s New York region, told the Albany Times-Union the Brodsky legislation was bad for Verizon and anti-business in general.  Gerace predicted companies would not want to do business in New York because they’d fear similar profit-sharing legislation could eventually target them.

“I’m convinced this is going to have a chilling effect on all businesses,” Gerace said. “They’re sending a very dangerous message to all businesses. It just compounds the state’s woes.”

But the Public Service Commission is intrigued by the legislation and is reviewing it.  If enacted, it could make a mass sell-off of rural landlines untenable in New York.

A02208 passed the Assembly by a wide margin — 103-34 and is now awaiting final action in the Senate.  It narrowly passed the Senate Rules Committee June 16th by a 13-10 vote.

If you want to see the bill passed, consider contacting your New York State senator and asking them to support the immediate passage of S7263.  Let them know you do not want phone deals to be cut at your expense, leaving you with a second-class provider.  If Verizon wants to sell off your community, they owe consumers a piece of the action.  It’s time that phone mergers, acquisitions and sell-offs actually benefit the consumers that ultimately pay for them and live with the results.
