Renting? You May Lose “Free” Spectrum Cable TV Over Contract Disputes

Charter Communications is asking owners of apartment complexes, nursing homes, independent living/assisted care residences, and hotel and motel owners to sign new agreements allowing Spectrum to lock owners into a 10-year contract that includes a provision allowing retroactive rate increases and a requirement to turn over personal information on every resident to the cable company.

A number of apartment complexes bundle “free cable TV” into the lease as a selling point for renters. Others pay a discounted rate that is part of a resident’s monthly rent payment or service fee. These agreements are part of the murky world of “bulk service contracts” for cable service, and disputes between a property owner and Spectrum can cause the loss of cable service for every resident without warning.

Most of the disputes involve apartment complexes, assisted-living facilities, and hotels/motels formerly served by Time Warner Cable. Most are still under relatively short-term contracts with Time Warner Cable, which was acquired in 2016 by Charter Communications. Good Shepherd Fairview Nursing Home in Binghamton, N.Y. and Good Shepherd Communities, a senior living center in Endwell, N.Y., are good examples.

Mike Keenan has been involved in long-term senior care for 30 years, and over that time he has negotiated hundreds of contracts. But as WICZ in Binghamton reports, nothing prepared him for dealing with Spectrum and Charter Communications.

Charter is using its ongoing digital conversion program as a tool to force “bulk contract” holders to sign new agreements with Charter Communications, often replacing still-valid contracts with Time Warner Cable. Many are not happy about the new terms Charter is offering, particularly one that locks them in with Spectrum service for the next decade and another that allows the cable company to raise rates retroactively.

Those unwilling to sign new contracts have been threatened with service being shut off, usually as digital conversion and TV signal encryption reaches their area, which requires new equipment to keep watching. Those complex owners that still refuse to sign are required to share each tenant’s personal details and address with the cable company.

“Spectrum had taken the position that even though we had a contract in force until December 2018 that we needed to sign a new contract immediately,” said Keenan, president and CEO of Good Shepherd Communities. “If not, they threatened that we would lose service at our Good Shepherd Fairview in Binghamton location and our Good Shepherd Villages at our Endwell location.”

Charter was true to its word. Efforts to negotiate obtaining digital adapters or set-top boxes under the old Time Warner Cable contract failed and with no warning, all 161 nursing home residents at Good Shepherd Fairview lost their cable television on Feb. 27. Two weeks later, 264 residents at Good Shepherd Village — the senior living center — also lost their television and internet service.

The loss was devastating to residents, especially at the nursing home.

“Many of the residents are frail, some of them may be bedridden and their TV means everything to them,” Keenan said.

Keenan’s contract with Time Warner Cable was still valid, and its terms made it clear as long as Good Shepherd kept their payments current, they were owed service that Charter ultimately took away from hundreds of residents.

Apartment complex owners around the country are reviewing new contracts from Charter Communications and many are dropping “free cable TV” after decades of offering the service as an amenity included in the rent. Many who are ending their contracts believe a growing number of tenants neither need or want traditional cable service.

The deal-breaker for many is Charter’s insistence on offering a bulk discount only if the entire building signs up for service, which means owners will have to pay out-of-pocket for Spectrum service in vacant units or in apartments where the tenant has service with another provider.

“Let’s say you’re paying for Spectrum” – the brand name for Charter’s service – “for 100 percent of the units,” attorney Tara Snow, a partner at Novitt, Sahr & Snow, told Habitat. “You may have 90 or 95 percent of the apartments signing up, but you always have some units that don’t.”

That leaves someone on the hook, either tenants or the property owner, to pay for cable service that nobody is watching. Under Time Warner Cable just a few years ago, the cable company would pay a co-op, condo association, or apartment owner an upfront cash bonus and ongoing “revenue-share fees” for getting a majority of residents — but not all — to sign up for service. It also allowed the company to market holdouts door to door.

No such luck with Charter, which wants to be paid for every unit no matter who is at home. For property owners staying loyal to Spectrum, some are absorbing the extra costs while others pass them on to tenants as part of their rent or monthly maintenance/service surcharges. A few are trying cost sharing arrangements that divide up the total bill equally among all tenants. But as younger renters move in and increasingly show no interest in cable television, the dwindling number who have cable are paying more and more to cover those that don’t.

“People are cord-cutting,” says Brian Scally, vice president of Garthchester Realty, a management firm. “Most people who still want cable want to select their own cable/internet/telephone provider.”

Of the 64 properties he manages, Scally told Habitat fewer than a dozen have signed up for a bulk rate, and those deals were signed years ago.

“I haven’t brought anybody new to bulk rate,” he says.

The other deal breaker for many is Spectrum’s 10-year contract, which locks owners in with a cable company a lot of tenants despise.

As a result, a growing number of apartment complexes and condos are terminating their bulk cable contracts as they expire, and have no intention of renewing under Charter’s draconian terms. Affected tenants are informed the “free” cable television they were receiving is ending and they should make individual arrangements with Spectrum to maintain service going forward.

Hotel and motel owners are also finding fault with Charter Communications, and some are taking their disputes to the Federal Communications Commission.

Yvonne Peach, who owns the Historic Coronado Motor Hotel in Yuma, Ariz., says dealing with Charter has been a nightmare since the merger.

After Charter converted commercial Time Warner Cable and Bright House customers to Spectrum plans and pricing, she lost service to all of her motel rooms for more than a week.

“When they did the change over we didn’t have any cable TV in the hotel for 12 days,” Peach told KYMA-TV.

Spectrum advised her best solution would be to install leased set-top boxes in the hotel’s 126 rooms, a solution she claims caused even more problems. It seems Spectrum’s equipment doesn’t appreciate Yuma’s southwest Arizona heat, and the boxes regularly fail when air conditioning is switched off in unoccupied rooms.

“We’ve had over 100 of them replaced probably in the last I don’t how many months,” she said. “It’s a box that if the room isn’t rented every night it becomes deactivated.”

Those paying to stay in the motel are not happy to reach their rooms and find the television isn’t working either.

“We’ve lost thousands of dollars with people that would move out because of no TV in their room,” Peach said. “It comes and it will say dial an 800 number or something. But you know the guest. They are paying a certain amount for the room and they’re not going to call.”

Spectrum ignores her complaints, she claims, transferring her from call center to call center in search of a solution. She finally took her complaint to the FCC, something she does not think should be required after paying the company $1,600 a month for cable television.

In response, Spectrum blamed the lack of air conditioning for its box failures, in addition to the “relocation of the digital adapters by hotel staff, which are dedicated to a particular room on the account.”

In other words, if you move equipment between hotel rooms, Spectrum claims that equipment will deauthorize. Spectrum effectively wants motel guests placed in rooms where their cable equipment is still functioning, preferably where air conditioning is left running.

“If you’ve been driving all day and you get in your pajamas and you’re ready for bed and you’re watching TV and the TV doesn’t work, do you want to move to another room without complaining? No, nobody does,” said Peach.

In upstate New York, heat isn’t a significant problem, but having a bulk account representative in Rochester, 2.5 hours away by car from Binghamton is. The representative did not understand Binghamton and Endwell are two different communities about seven miles apart.

“This whole thing could have been avoided,” Keenan said. He called the New York Public Service Commission to complain and within a day multiple Spectrum trucks arrived loaded with set-top boxes — one per residence, potentially finally resolving the dispute, but not the bad feelings that emerged as a result.

“Time Warner Cable was saying ‘we need our customers,’” Keenan said. “The experience I have had with Spectrum is Spectrum is saying ‘you need me.’”

Watching HDTV Over-the-Air? Your TV Set Will Be Obsolete Sooner Than You Think

atsc-3-0If you cut the cord and are watching all of your HD programming over-the-air, we have some bad news. Your current television set will soon be obsolete.

TV stations across the country are making plans to switch to the next generation of digital television — ATSC 3.0, and it isn’t compatible with millions of television sets and adapter boxes still in daily use across the United States.

The other night I talked with a station engineer who reminded me that consumers are going to have a nasty surprise when local stations start disappearing from existing sets starting a few years from now. Consumer electronics stores will continue to slash prices to clear current television inventory without telling buyers they will eventually need an adapter or rely on cable or satellite television to keep that set working after ATSC 3.0 is fully implemented.

Broadcasters have already started to budget for replacement equipment, necessary to support the new standard. For them, it opens the door to significant new revenue streams and a better quality TV picture. For you, it could mean a bill for a new set, an adapter, or a paid subscription to keep your favorite shows.

At present, over-the-air digital stations in the United States use ATSC 1.0, developed more than 20 years ago. Despite the standard, it took until February 2009 for most television stations to discontinue their analog television broadcasts. To ease the transition, Congress mandated a DTV Converter Box Coupon Program, which subsidized the cost of digital adapters for every household in the country still using an analog-only television set. No such luck this time around. Consumers relying on over-the-air broadcasts will either have to replace their current sets or purchase adapters or dongles out-of-pocket to keep watching.

atsc-glueTo avoid a firestorm from the public, some station owners are thinking about a stop-gap measure that would launch a “digital bouquet” of participating local stations using lower bit rate Standard Definition on a single legacy ATSC 1.0 transmitter for at least a year or two until consumers upgrade their existing equipment. Then, one by one, existing HD stations would switch to ATSC 3.0 and effectively disappear from the dial of sets made before 2016. The good news is you would still have access to free television. The bad news is the picture will be significantly degraded.

Television stations are highly motivated to push for ATSC 3.0 as quickly as possible because it allows them to further monetize the spectrum the FCC allows them to use for free. For the first time, local stations will also be able to charge consumers directly to access broadcast television channels on portable devices like tablets and smartphones. ATSC 3.0 is based on Internet Protocol, allowing stations to blend broadcast and internet content. One of the unique changes ATSC 3.0 will allow is geographical or viewer-targeted commercials. A viewer in the suburbs could theoretically get a different commercial than another living in the city while watching the same station.

Television shows, transmitted in much higher-quality 4K, will also be accompanied by improved high quality audio and will integrate with online content that will run along with the show a viewer is watching. Theoretically, a viewer can lose over the air reception and have their internet connection seamlessly continue to stream the station in fringe reception areas. But viewers will likely be charged for that privilege.

ATSC 3.0 is also considerably more efficient than the current standard, which allows stations to add more digital sub-channels to their lineup, and deliver them in higher quality. That is a very important consideration as the FCC auctions away much of the current UHF television dial to mobile phone companies looking for boost wireless data capacity. ATSC 3.0 likely won’t be on the scene in a major way until after the FCC repacks current UHF stations closer together on the reduced number of UHF channels still left.

Some stations are expected to lease sub-channel space to third parties, which could start another avalanche of religious and home shopping channels, which often pay for coverage. If you have an Ion TV affiliate in your area, you already have an idea of what that looks like. In addition to a primary Ion TV channel, the broadcaster multiplexes 6 sub-channels – Qubo, Ion Life, The Worship Network, Ion Shop, QVC, and Home Shopping Network.

Currently, many major commercial stations support one or two sub-channels, often used for networks like Bounce, Antenna TV, MeTV, local weather and news, and shopping. But with an abundance of extra bandwidth, stations could add ethnic channels, time-shifted network shows, and a plethora of additional channels. That’s good news for cord-cutters looking for more over-the-air entertainment, but it will require an investment in a new set or an adapter to participate.

Cox Customers Pushed Into New Set-Top Boxes Or Else They Lose Channels

COX_RES_RGBCox Communications is requiring cable customers to add a cable box to their television set(s) or they will start losing channels as the company continues its nationwide effort to digitally encrypt all of its television services.

Customers in Las Vegas are the latest to be pushed to add a digital adapter, dubbed a “minibox” by Sept. 27 or they will start losing channels. By Nov. 9, all cable channels are expected to be encrypted and on Dec. 6, local stations will also be encrypted and viewable only with a cable box or similar equipment.

Cox calls the move a customer-pleasing “upgrade.”

“It will enable us to implement more advanced services down the road,” Cox spokesman Juergen Barbusca told the Las Vegas Review-Journal. “We deployed home automation in the last couple of years and home security. We are trying to get as much bandwidth out of your cable potential as possible and one way to do that is to go completely digital.”

cox-miniboxCox customers with a basic Starter package of more than 40 channels at $24.99 a month will get two miniboxes free for two years. Those with the second tier Essential package ($75.99) with more than 90 channels will get two miniboxes free for one year. You read that right. If you pay Cox more, you get free boxes for half the time lower-paying customers do. Each additional box is $2.99 a month. A traditional HD-capable set-top box from Cox rents for $8.50 a month.

Cox’s miniboxes are more advanced that traditional digital adapters provided by some other cable companies, supporting service like Music Choice, HDTV, parental controls and an on-screen program guide.

Customers are generally okay with getting the boxes for free, but are convinced it will cause their cable bills to rise in the years ahead.

“I’m not happy with that. That’s more money and I’m only getting basic service. I’m already at $146 a month for cable, internet and phone,” Cox customer Monique Patton said. “Not everybody can afford that. It’s too expensive now. They’re not giving us what they should for our money.”

FCC Chairman Announces Compromise Set-Top Box Reform; Free ‘Apps’ for One and All

explorer 8000[Editor’s Note: Federal Communications Commission chairman Thomas Wheeler today released a compromise proposal hoping to get the cost of set-top box equipment down for millions of Americans forced to lease equipment to watch cable television.

Wheeler originally proposed requiring an open standard for set-top box equipment that would open the market to competition by allowing manufacturers to directly sell equipment to consumers and compete for their business. Cable operators, programmers, and various special interest groups that depend on financial contributions from those operators immediately launched an unprecedented pushback claiming set-top box reform was racist, anti-minority, promoted copyright theft, and was illegal and unconstitutional. Small cable operators claimed they might be driven out of business, and programmers claimed companies like Google might fundamentally change the channel lineup on new equipment that would leave them in a disadvantaged position.

In fact, the hundreds of millions of dollars in annual revenue earned by cable operators charging the same price for equipment fresh out of the box or handed down in beat up condition to the fifth customer in eight years was more likely the driving factor.

Mr. Wheeler capitulated and released a more modest proposal promising cable operators would be forced to offer free “apps” for devices like Roku and Apple TV. But cable operators will likely own and manage those apps and have direct control of authentication methods and anti-piracy measures that are likely to be proprietary. Still, apps like TWC TV which covers Time Warner Cable’s lineup on devices like Roku have allowed consumers to ditch expensive set-top equipment and irritating Digital Adapters that don’t function well and have almost tripled in price since their introduction. Making sure these apps provide comparable functionality with set-top boxes and are released to a variety of devices will be key to whether Wheeler’s proposal, delivered in full below courtesy of the Los Angeles Times, has a measurable impact on cable bills.]

FCC chairman: Here are the new proposed rules for set-top boxes

There’s never been a better time to watch television in America. We have more options than ever, and, with so much competition for eyeballs, studios and artists keep raising the bar for quality content. But when it comes to the set-top-box that delivers our pay-TV subscriptions, we have essentially no options, creating headaches and costing us serious money in rental fees. That makes no sense, which is why I’m sharing a proposal with my fellow commissioners at the Federal Communications Commission to change the system.

Ninety-nine percent of pay-TV subscribers currently lease set-top boxes from their cable, satellite or telecommunications provider, paying an average of $231 a year for the privilege, according to a recent analysis. The collective tab is $20 billion annually in rental fees. In a recent study, 84% of consumers felt their cable bill was too high. What they may not realize is that every bill includes an add-on fee for their set-top boxes. We keep paying these charges even after the cost of the box has been recovered because we have no meaningful alternative.

Pay-TV providers will be required to provide apps — free of charge — that consumers can download to the device of their choosing.
Earlier this year, the FCC launched a process to unlock the set-top-box marketplace. We were motivated by the desire to give consumers relief, but we were also mandated to take action by Congress and the law, which says that consumers should be able to choose their preferred device to access pay-TV programming.
Over the past seven months, the Commission conducted an open proceeding where we heard from pay-TV providers, programmers, device and software manufacturers, consumers groups, and, most important, the American people. We listened.

Now, I am proposing rules that would end the set-top-box stranglehold. If adopted, consumers will no longer have to rent a set-top box, month after month. Instead, pay-TV providers will be required to provide apps – free of charge– that consumers can download to the device of their choosing to access all the programming and features they already paid for.

appletvIf you want to watch Comcast’s content through your Apple TV or Roku, you can. If you want to watch DirectTV’s offerings through your Xbox, you can. If you want to pipe Verizon’s service directly to your smart TV, you can. And if you want to watch your current pay-TV package on your current set-top box, you can do that, too. The choice is yours. No longer will you be forced to rent set-top boxes from your pay-TV provider.

One of the biggest benefits consumers will see is integrated search. The rules would require all pay-TV providers to enable the ability for consumers to search for pay-TV content alongside other sources of content. Just type in the name of a movie, and a list will come up with all the places it is scheduled for broadcast and where it can be streamed (like Amazon Prime or Hulu).

Integrated search also means expanded access to programming created by independent and diverse voices on the same platform as your pay-TV providers. Consumers will more easily find content even if it’s not on the pay-TV service to which they subscribe.

These rules will open the door for innovation, spurring new apps and devices, giving consumers even more choice and user control.

While our primary focus during this proceeding was to promote consumer choice and fulfill our congressional mandate, we recognize that protecting the legitimate copyright interests of content creators is also key to serving the public interest. To ensure that all copyright and licensing agreements will remain intact, the delivery of pay-TV programming will continue to be overseen by pay-TV providers from end-to-end. The proposed rules also maintain important protections regarding emergency alerting, accessibility and privacy.

Large pay-TV providers, which serve more than 90% of subscribers, will have two years to fully implement the new requirements.  Medium-sized providers will have an additional two years to comply, and the smallest providers would be exempt.

This is a golden era for watching television and video. By empowering consumers to access their content on their terms, it’s about to get cheaper — and even better.

Time Warner Cable Begins Maxx Upgrades for Wisconsin

twc maxxTime Warner Cable Maxx upgrades are on the way for customers in several Wisconsin cities, bringing all-digital cable television service later this year in preparation of boosting broadband speeds up to 300Mbps.

The company has begun notifying customers in the Fox Cities – including Green Bay, Appleton and Oshkosh as well as in southeast Wisconsin, including Milwaukee, Kenosha, Waukesha and Racine that analog television service will be switched off in the next several months.

“Going all-digital brings the benefit of better picture and sound immediately, and will enable us to offer customers faster Internet speeds and additional services in the future,” said Jack Herbert, regional vice president of Time Warner Cable.

The transition to an all-digital network will require video customers without TWC digital equipment (customers who plug their cable line directly into the TV, VCR or similar device) to order a TWC digital adapter.

TWC will offer existing TV customers one or more digital adapters at no charge through at least October 6, 2017. To qualify, customers must order their digital adapters by January 29, 2017. After this free period, each adapter will be billed at the prevailing price, now around $3 a month. Customers can visit www.TWC.com/digitaladapter to place an order or call toll-free 1-844-841-5085 to request equipment. Digital Adapters are also available at most Time Warner Cable stores.

After the free equipment period ends, Stop the Cap! recommends customers return the digital adapters and consider purchasing an online video console such as a Roku device, which supports the Time Warner Cable lineup without recurring equipment rental charges.

Customers can expect free broadband speed upgrades after the digital conversion is complete, with faster Internet access likely available late this year or in early 2017.
