A California company with a novel approach for renting DVDs faces the prospect of a preliminary injunction against the service if a judge agrees the service is skirting copyright law.

Zediva promotes itself as a remote DVD rental service that avoids lengthy delays often imposed on online streaming and pay-per-view services.  The company allows customers to “rent” DVD titles the same they are released, remotely streaming the contents over a broadband connection.  Zediva says it literally has a bank of DVD players which customers can access and remotely control.  When a customer “rents” a DVD, a Zediva employee inserts the disc into a DVD player and gives each customer up to two weeks to watch the movie.  Because Zediva says only one customer can rent the physical DVD at a time, it is not skirting copyright or streaming laws. The service will even mail the DVD to a customer if they don’t want to watch it over their Internet connection.

Zediva argues it is using the Internet as a way to connect the DVD player to a renter’s television.  The company says it should not matter where the player is physically located, and because a customer can exclusively control the actual player during the rental period, it is not violating any laws.

Hollywood disagrees, and the Motion Picture Association of America promptly filed suit in April, claiming Zediva’s business model undermines its licensing agreements with online movie services.  The lawsuit claims Zediva is not paying movie streaming rights like other online movie services, and is not comparable to a traditional movie rental store because the company makes individual titles available for viewing by other parties as soon as four hours after a customer stops watching, even though they can return and watch the movie again for no additional charge for up to two weeks.

This week, the MPAA touted a potential new friend of the lawsuit — Cablevision, which filed its own amicus brief in the case drawing distinctions between its Remote DVR service and Zediva.  Cablevision is in trouble with some rights holders over its new Remote DVR, which records shows on equipment at the cable company’s offices and then streams the programming on-demand to subscribers’ TV sets.  Some contend Cablevision owes “per performance” license payments for every show watched over the service.  Cablevision has consistently argued to the contrary, suggesting the actual location of the storage system should not matter, so long as the recordings are made and watched by only a single customer.

But Cablevision’s brief shows the company has no interest in being connected to Zediva, arguing its Remote DVR service is not comparable to the pay-per-view business Zediva is running.

A judge is expected to hear the case early next week.

Bresnan’s Montana Customers Now Part of Cablevision’s Optimum West

Cable Montana is now Optimum West, Cablevision’s marketing name for the cable systems it acquired from Bresnan Communications.

Earlier today, customers in Billings, Laurel, Park City and Columbus were able to start using upgraded cable, phone, and broadband equipment on the updated cable system.  More than 2,200 Montanans were introduced to the Optimum name in a mailing sent to neighborhoods where service has been upgraded.  But all of the new equipment that comes with the service has created considerable confusion for long-standing Bresnan customers who have been using older Bresnan equipment for years.

The changes have been overwhelming for those used to Bresnan’s modest level of service for more than a decade.  Cablevision, best known for its Optimum service in suburban New York City, Connecticut, and New Jersey, has brought an enormous increase in programming, and improvements in broadband service, for many customers.

“All existing customers in Laurel, Park City and Columbus will be upgraded to Optimum TV by July 20, which will deliver many more channels, including access to more than 100 channels of free HD (high definition), thousands of titles of video on demand and other benefits like faster high-speed Internet and a better phone service with lower prices and more features than are available from any other provider,” says a Cablevision spokesperson.

When it works properly.

The Laurel Outlook reports some customers frustrated with the changeover have found themselves at local cable stores trying to sort out all the problems:

One Laurel customer installed his modem, but was not receiving service. A visit to the Laurel office did not provide answers to his satisfaction, so he drove to the Billings office on Monad Road, where he received two telephone numbers to call for tech support. He called one of the numbers, followed a menu, and was able to troubleshoot with a technician to get his Internet up and running.

A second customer installed her set-top box but was not receiving Optimum TV channels. She called the 1-800 number provided in the mailing packet, but technicians were unable to walk her through the necessary steps to receive service. Frustrated, she drove to the Laurel walk-in center on West First Street and made an appointment for a technician to come to her home. She discovered that not only must she program her television with the new Optimum channel numbers, she must also program the TV-top box with the correct numbers. After doing so, she was able to receive the new channels.

Many customers are likely going to need to reprogram their televisions more than once.  When the upgrades are complete, Cablevision says it plans to unify channel lineups across the area.

Rutlidge: One for us, none for you

Cablevision is upset paying for networks it doesn’t want, need, or desire to carry.  But broadcasters are demanding that the cable company pick up lesser-known, unwanted cable networks in return for the stations Cablevision craves.  Sound familiar?  It’s a variation on consumer cable a-la-carte: picking and paying only for the channels and networks you want.  It’s a concept Cablevision wants for themselves, but continues to deny to their customers.

Last week the cable company filed comments with the Federal Communications Commission proposing a ban on “channel bundling” by broadcasters as part of an effort to reform retransmission consent laws.  Cablevision argues they are forced to carry unwanted networks as a result of current agreements.  No agreement, no local stations on the cable dial.

Cablevision chiefly cites major broadcast network owners for pushing these bundled agreements.  The company’s suburban New York City cable system has to reach accommodations with local New York stations that are all owned and operated by the major American networks.  That’s why an agreement to renew WNBC-TV might include the required carriage of a hardly-known network like Sleuth, owned by the same company that owns WNBC: NBCUniversal.  In return for an extension of WABC-TV’s retransmission consent agreement, Cablevision might be asked to carry all of Disney’s lesser-known cable networks.  Disney owns ABC and WABC.

Ironically, the same cable company that refuses to allow a-la-carte themselves is selling their proposal as a boon to consumers:

Cablevision chief operating officer Tom Rutledge says the proposal will “protect consumers from the threat of broadcaster blackouts.” He adds, “consumers are the ones who are harmed when broadcasters pull or threaten to pull their networks from cable systems.”

Cablevision also wants broadcasters to publicly disclose the true asking price for their channels.  Cablevision itself will not disclose its wholesale programming costs for cable networks.

“Broadcasters should not be able to keep the prices they charge hidden or to discriminate between distributors in a given market,” Rutledge said. “Our simple reforms would end these practices.”

They would for broadcasters, but not for the cable company or consumers.

Mexican Cities Getting Multiple Fiber to the Home Providers While You Are Stuck With 3Mbps DSL

Telefonos de Mexico is known as Telmex, the country's largest telecommunications provider.

Mexico’s largest phone company Telefonos de Mexico SAB is not about to allow themselves to be outgunned by upstart competitors like mobile-phone carrier Grupo Iusacell SA, which is installing fiber to the home broadband service in up to 40 cities offering 100Mbps speeds.  Now they are working on a fiber to the home network of their own, planned to reach up to one million Mexicans by the end of this year.

Mexico’s broadband expansion is coming on all fronts.  Cablevision (no relation to the U.S. company with the same name) is delivering cable broadband service to an increasing number of cities.  But news that consumers will soon have the choice of not one, but two fiber to the home networks has the country buzzing with excitement.

“Fiber-to-the-home is the best technology that exists,” Martin Lara, an analyst at Corp. Actinver SAB in Mexico City told Bloomberg News. “It’s going to be good for the consumer.”

The broadband speeds in Mexico will rapidly exceed those in the United States if the two fiber providers end up in a speed and pricing war .  For now, Telefonos plans on offering packages of 10, 20 and 50Mbps to subscribers.  That may increase to 100Mbps if competitors make an issue about maximum available speeds.  That’s quite a change from traditional DSL packages from Telefonos, which range from 1-5Mbps in most areas.

Upstart Iusacell is Mexico's third largest cell phone provider, but it has big plans for fiber-to-the-home service.

Iusacell, mostly known for its cell phone service, is building its own quad-play of wired fiber broadband, television, and telephone service — wireless and wired.  It’s Totalplay package risks Telefonos’ decades of dominance in the Mexican telecommunications marketplace, so the phone company is investing to compete.  The company’s Telmex landline customers are switching to wireless just like customers in the United States and Canada, so developing an attractive multi-element package is critical to keeping customers.

Mexico’s telecommunications laws are different from those in the United States.  Mexico’s dominant phone company has traditionally been prohibited from offering video services to their customers — a policy designed to protect cable providers and other competitors from heavyweight competition.  Those policies are likely to be revisited as a result of competitive fiber initiatives.  Additionally, Mexican providers have not been required to wire entire communities as part of operating agreements, and many don’t.  Instead, most cable and fiber providers build in lucrative neighborhoods where higher income residents live, often leaving poorer neighborhoods unwired. Foreign investment is also common in Mexico, with American and British companies joining Mexican super-billionaire Carlos Slim in financing and/or building out the advanced networks.

Mexico’s decision to adopt the latest fiber technology straight to customer homes increases questions about why American providers are mostly unwilling to do the same.

Radio Shack Store in Montana Gives Away Free Gun With Every Satellite TV Purchase

A Radio Shack store in Hamilton, Montana has come up with a novel way to pitch satellite dishes to local residents — include a free gun with every purchase.

Actually, it’s not a promotion sanctioned by Radio Shack, and DISH Network has nothing to say about the promotion either.  It was the idea of store owner Steve Strand, who runs S&S Electronics, authorized to do business under the Radio Shack brand.

Strand says new DISH customers get their choice of either a Hi-Point 380c-p pistol or a Baikal MP-18 20 GA shotgun.  If guns are not your thing, Strand will give you a $50 gift card for the local Pizza Hut instead.

Strand’s store serves Missoula and the Bitterroot Valley — regions that are served by Bresnan Cable, now owned by Cablevision.  Stories about Bresnan on Stop the Cap! always elicit plenty of response… about how darn lousy the service is.  So satellite television, especially outside of Bresnan’s service area, is the only real option for many residents.

Giving away a gun with every purchase may raise eyebrows among many, but for most Montanans, it’s no big deal.  And when you call, S&S tells visitors to their promotional website there is never a need to press “1” for English.  “We are American and we speak English,” boasts the site.
