maltaThe people of Malta will soon have a choice between a cable broadband provider offering 250/20Mbps service or a fiber to the home network now under construction that will be capable of delivering gigabit broadband across the island — all without usage limits or speed throttles.

Starting this month, for €96 per month ($128), customers of Melita can buy a triple play package of phone, broadband, and cable television that includes a free upgrade to 250/20Mbps.

“The FibrePower 250 product leverages the investments Melita has made in the past years and further strengthens the company’s position as Malta’s fastest service provider,” said Michael Darmanin, director of marketing and corporate services at Melita. “We are seeing an exponential growth in demand for higher speeds and capacity. This is driven by more people connected in the same household or business, more devices and more consumption of video over the Internet.”

Darmanin added the Maltese people want fast and unlimited broadband service, and they will deliver it, starting at Tigne Point (Midi) and Fort Cambridge in Sliema. The service will then gradually be rolled out in other Maltese communities.

Malta, in the Mediterranean Sea, has a population of around 450,000. The country has two major telecom companies: Melita which delivers cable service and GO, which delivers DSL service over the telephone network. Vodafone used to offer a now-discontinued WiMAX service across the island, which never had a significant market share.

250-MBPS-WITH-THE-XXL-HOME-ENT-PACKThe Maltese government made broadband expansion a national priority and set regulatory policies that would increase competition. But the government also insisted that telecom market improvements also benefit customers, and the country laid the foundation of its broadband policy on encouraging the development of a nationwide fiber to the home network.

The tradeoff: the government would deregulate the broadband marketplace and remove regulatory obstacles and unnecessary red tape governing pole usage and underground trenching, but in return providers must meet government objectives towards enhancing broadband speeds and price competition.

melitaAs a result, Melita has aggressively invested in cable broadband upgrades that have delivered broadband speeds faster than what most Americans and Canadians can buy from their cable providers. The cable operator plans to be among the earliest adopters of DOCSIS 3.1 which will support up to 10/1Gbps broadband speeds.

Not to be outdone, GO is rolling out its own fiber to the home network supporting interactive IPTV and faster broadband speeds. It will then be able to retire its DSL service, which now provides respectable Internet speeds up to 35Mbps.

Time Warner Cable Still Says No to Rural Communities Asking for Expanded Service

road closedAll Arcadia, N.Y. town supervisor Dick Colacino wanted was for Time Warner Cable to consider using some of their profits to expand their cable system by one or two roads a year to offer service where it has earlier refused to go.

Time Warner Cable’s response? No.

But Time Warner might turn that “no” into “yes” if customers offer to cover the cable company’s estimated cost of $22,000 per overhead mile to extend cable service down ignored rural roads. Underground wiring costs much more.

Every year, elected officials in just about every small town and village get an earful of complaints from bypassed residents who cannot get cable broadband service.

Arcadia (pop. 14,900) is a small community in Wayne County, east of Rochester. Time Warner Cable dominates western and central New York, with cable service from Albany west to Buffalo. In Wayne County alone, Time Warner is the only cable provider in the 23 largest municipalities. But the company has routinely skipped over potential service areas it considers not worth a wiring investment. That leaves bypassed residents with one choice for broadband — Verizon Communications, which has not expanded DSL service in the area for some time.

The New York Public Service Commission has mandated that cable service must be available to any area where 35 homes per mile are located within 150 feet of the road.

timewarner twcTime Warner representative Chris Mueller says the cable operator has already cut that benchmark to 20 miles per home, but areas remain that do not meet even that reduced standard. Without an appropriate return on investment within a certain time frame, Time Warner Cable won’t wire those areas for service.

Colacino told Mueller he was very unhappy with that decision and intended to pursue the matter at franchise renewal time, possibly in coordination with other communities that also have a number of bypassed residents. A community can negotiate for changes during franchise renewal talks, but in almost every case, the incumbent cable operator holds the strongest position, knowing a community looking for another provider will be unlikely to find one willing to serve.

Colacino has battled with the cable company since at least 2010 because of complaints from area residents and businesses who cannot get service.

That year, a Time Warner Cable government affairs representative offered Colacino a novel solution to the problem — agree to refund collected franchise fees to Time Warner Cable, after which the company would consider using the money to expand service to more roads in Arcadia.

The only problem with that solution is that it is illegal.

“You can’t do that,” town attorney David Saracino responded. “It’s an unconstitutional gift of public monies.”

Cox Lifting In-Home-Only Online Viewing Restrictions for Streamed TV in Oklahoma for Next 90 Days

coxIn response to the deadly tornadoes in Moore, Okla., Cox Communications today said it would lift viewing restrictions for dozens of networks for Cox Cable customers who want to watch cable programming online using Wi-Fi or mobile broadband.

Cox video subscribers in Oklahoma can download the Cox TV Connect app (iOS or Android) to view streamed programming either inside or outside the home for the next three months. The cable operator said it had reached emergency agreements with programmers to lift the usual restrictions preventing online viewing away from home.

“We hope to help those impacted by providing access to TV on some mobile and tablet devices while the area recovers in the weeks and months ahead,” Cox spokesman Todd Smith told FierceCable in an email.

Cox now offers around 90 channels on its TV Connect platform.

Tornado-ravaged customers in Moore will need a lot longer than three months to get cable service back in many areas completely devastated by the storm.

Cox parent Cox Enterprises announced Tuesday that it plans to give $1 million to support relief and recovery efforts in Oklahoma, including a $500,000 cash donation to the American Red Cross and $500,000 of “in-kind support,” including public service announcements.

Time Warner Cable Testing Customer Patience By Moving Every Channel Somewhere Else

new channelsTime Warner Cable customers in Central New York will be the first to test the cable company’s newest plan for a nationwide channel realignment that will move almost every cable channel into a new “theme-based” lineup.

Starting June 18, customers in Syracuse and suburbs, Auburn, Cortland, Fulton, Oswego and the Rome/Oneida/Camden/Sylvan Beach area will have to hunt for their favorite networks in a new lineup numbered from channels 1 to 1999. Two days later, customers in Jefferson and Lewis Counties, plus Boonville, Champlain, Malone, Massena, Ogdensburg and Potsdam will see their lineup changed. On June 25, the same will happen in Candor, Hamilton, Ilion, Old Forge, Ithaca, Utica and the Tri-Lakes area.

Channels 1-99, mostly received by analog television customers, will be unaffected for now.

twcTime Warner Cable has used a theme/genre-based channel lineup for several years, but new or renamed networks have occasionally turned up in unexpected places. The increasing prevalence of HD networks has also made a mess of things, with some markets featuring HD basic cable networks nestled between premium movie channels. The channel realignment is designed to “simplify” things.

Among the welcome changes: HD viewers will automatically receive the HD version of those networks and channels, if available. DVRs will automatically map scheduled recordings to their new channel numbers.

If the channel changes prove successful, which we assume means subscriber backlash is not judged too great, Time Warner Cable customers across the country will begin to see the same channel lineup changes in their areas beginning this August.

Here is a guide to the new lineup. Note the block dedicated to HD networks is gone:

  • 1-99: Remain unchanged and are watched mostly by analog viewers with or without a set-top box
  • 100s: Entertainment, Life and Style channels
  • 200-249: News and Information
  • 250-270: Children/Family

Court Rejects Class Action Lawsuit Over Comcast’s ‘Hidden’ Modem Fees

MoneyFail_RentModemA California federal judge has rejected a class action case against Comcast for allegedly hiding modem fees as high as $15 a month when signing up new customers.

In 2010, Athanassios Diacakis made several calls to Comcast inquiring about cable service as a new customer. Diacakis claims several Comcast representatives offered a bundle of broadband, television and phone service for $99 a month. When he asked Comcast about any other charges, company representatives eventually admitted there was a $25 installation fee, but never mentioned any modem rental fees.

After Comcast installed service, Diacakis began receiving Comcast bills that included a previously undisclosed monthly modem fee of $10 and an extra “lease charge” of $5 a month associated with his broadband service.

Diacakis alleged in his complaint charging $15 a month for cable modem equipment was “outside and in excess of the specifically quoted bundled service” package he ordered.

As Below Your Means points out, renting a cable modem may be harmful to your wallet.

The plaintiff sought class certification to force Comcast to refund some or all the modem fees charged customers from 2007 to the present. His first effort failed in January 2012 on grounds of insufficient evidence. His amended complaint was rejected May 3 on similar grounds.

United States District Judge Saundra Armstrong ruled Diacakis failed on two separate occasions to produce convincing proof Comcast was actively deceiving customers with undisclosed modem fees.

Comcast-LogoJudge Armstrong wrote that Diacakis should have come to court with evidence beyond the spoken promises of a handful of Comcast salespeople the plaintiff identified only by their first names. She was swayed by Comcast’s arguments:

As Comcast correctly points out, the only evidence offered by Plaintiff regarding Comcast’s alleged practices consists of his limited personal experience in speaking with “Heather,” “Steve” and another unidentified Comcast representative in August 2010. There is no evidence that Comcast has employed any policy, custom or practice of intentionally failing to inform potential Triple Play subscribers that they will be subject to separate modem fees. To the contrary, the record presented thus far shows that Comcast trains and instructs its employees to inform customers and potential customers about all applicable charges, including those for leased equipment.

[…] As noted, he has made no showing that the representations or omissions during those calls were made pursuant to a standardized script or marketing practice. Indeed, there is no evidence that anyone other than Plaintiff was allegedly misinformed about the modem fees.

Armstrong also faulted Diacakis for not independently locating, scrutinizing, and verifying Comcast’s print or television advertising before he filed a lawsuit seeking to represent every customer paying them:

Comcast argues that Plaintiff is not an adequate representative because there is no evidence that he or anyone else was misled by its marketing and advertisements for the Triple Play package. Plaintiff does not dispute that he lacks such evidence. In addition, Plaintiff admitted during his deposition that he did not review any advertisements before contacting Comcast in August 2010 about bundling his services. Since Plaintiff could not have been harmed by any allegedly misleading advertising, he cannot adequately represent a class member who claims to have been harmed by Comcast’s alleged marketing program.
