Alaskan Snow Job: GCI Selling Unlimited Broadband That Isn’t

An Alaskan Internet service provider is baffling its broadband customers with a blizzard of BS regarding just how unlimited its “unlimited” service plans really are.

A Stop the Cap! reader in The Last Frontier drops us a note to alert us of yet another provider trying to pull a fast one on its customers.

GCI markets cable-TV, telephone and broadband service in larger communities across many parts of the state.  Its broadband service, dubbed “Xtreme,” offer DSL-like speeds at a significant price premium over what users in the lower 48 pay for Internet access.

Since 2007, our reader writes, GCI offered customers a deal.  In return for letting the company provide all of your telecommunications needs — cable, phone, and Internet, GCI would provide you with unlimited broadband service.  The triple-play package was sold for at least $80 a month, and many customers agreed to the bundled route to avoid GCI’s restrictive, data-capped plans sold to its broadband-only customers.

GCI is now reneging on its end of the deal thanks to a creative redefinition of the word “unlimited.”  For the convenience of those who may be English-challenged, Stop the Cap! has provided the Merriam-Webster definition of the word “unlimited” above, which hasn’t changed much since its first use in the 15th century.

Broadband providers like GCI think they are clever enough to change all that.

Much to the chagrin of GCI’s bundled customers, the company unfairly slapped a “Fair Access Policy” on all of its unlimited customers on April 1st.  Customers started receiving usage warnings this spring, which came as quite a surprise for an “unlimited” service plan.  But the company insists it hasn’t limited its “unlimited” plans at all:

GCI offers some cable modem Internet service plans with “unlimited downloads”, meaning GCI does not bill customers additional fees for usage in a given month.

Actually, that isn’t the meaning of “unlimited” at all, no matter how much the company wishes it was.  Again, see the definition above.

In fact, even using GCI’s own definition, nonsensical as it is, it isn’t reality-based either.

Customers who exceed the arbitrary limits GCI determines as “fair,” could be subjected to higher pricing.  GCI’s website currently lists the overlimit fee starting at an impenetrable $0.005 per megabyte, which sounds pretty low until you realize it’s $5.00 per gigabyte, which is significantly higher than what most other naughty cappers charge.  On slower speed plans, GCI’s overlimit fee is a whopping $0.03 per megabyte — $30 per gigabyte.

What happens when you overuse your GCI unlimited Internet?  GCI will contact you to discuss your account and then ask you to agree to either reduce usage or pay additional fees for usage in a given month.

GCI loves to make its limits look mighty big by representing them in megabytes instead of the more commonly used gigabyte measurement.  They also include the usual comparisons: over 10,000 web pages, 250,000 e-mails, 1,000 pictures, etc.  On the lower speed plans, GCI avoids defining the far-smaller allowances for higher bandwidth services like near-DVD HD video streaming some Alaskan families may want to use during those cold and dark Alaskan winter evenings.

Here are the limits GCI assigns to its “unlimited” service plans:

That’s usage ranging from 40-100 gigabytes.  What this illustrates yet again is that Internet Overcharging schemes are ridiculously arbitrary.  A provider in rural Alaska defines “fair” use of its slowest speed “unlimited” broadband tier (3 Mbps/512 Kbps for $45 a month) at 40 gigabytes.  Meanwhile, Frontier Communications considers it fair to define its DSL service usage allowance at just 5 gigabytes per month.  Comcast says 250 gigabytes a month is fair.  AT&T’s wireless smartphone data plan now carries a 2 gigabyte limit AT&T claims is about right.

As is also commonly the case among Internet Overchargers, any unused allowances do not “roll over” to the next month.

GCI considers anyone exceeding these limits engaged in continuous high-volume data transfers, extensive use of streaming video and peer-to-peer file sharing programs, or using an unsecured wireless signal everyone in the neighborhood has hopped on to use.  But just backing up your family computer through an online backup service over a month could easily put you over these limits.  If a “mutually agreed on” solution cannot be reached to either limit your use or increase your price, GCI will show you the door.

Essentially, GCI hobbles its broadband service plans by imposing limits on services that could challenge some of its other products.  For standalone broadband customers, GCI builds in plenty of protection against customers potentially using its Internet service to bypass its cable and phone offerings, despite some recent speed and usage allowance increases.  How much online viewing will you feel safe doing on some of these Internet service plans:

Our reader in Alaska thinks the usage limits are unjustified considering GCI’s capacity, and its prices:

GCI has well over 600 Gigabits of capacity across two undersea fiber optic cables.
Since 2007, the only way to get an unlimited download option for the company’s various speed tiers was through its bundled packages.  With the new limit on “unlimited” downloads, GCI fraudulently misrepresents its service to Alaskans.

GCI is the poster child for the cable industry’s push for metered billing. I think you’re well aware that cable companies view metered billing as an anti-competitive solution to fend off emerging competition from online content providers like Hulu and Netflix Online. Time Warner backed down when confronted with the possibility of regulation for the entire industry. They will however try again if companies like GCI continue to have success over a long term. This is why it’s imperative that groups like Stop the Cap! fight beyond your region and get regulation passed to bar forced bundling and data transfer limits entirely. Content providers (video services) should be separate entities from network providers (ISPs). It’s the only way to keep rates low and businesses competitive. Thank you for keeping up the good fight.

Water Tower Fire Wipes Out WiMAX and Cell Phone Service on Madison, Wisconsin’s West Side

A water tower fire on Madison’s west side has wiped out WiMAX broadband service for at least 150 fixed wireless broadband customers, leaving them cut off for so long, provider TDS Telecom is canceling their service and assisting customers in switching providers.

A Madison utility manager said workers Friday were preparing to paint the 100,000-gallon tower in the 2700 block of Prairie Road when insulation around communications cables caught fire.  Smoke was visible from the empty water tower for miles, and several nearby homes had to be evacuated because of fears of a potential collapse.

City engineers have since deemed the tower safe, but the real impact will be several months of interrupted broadband and cell service from several area providers who depended on the tower as an antenna site.  The tower was particularly crucial to TDS Telecom, which depended on its strategic location to deliver its wireless broadband service in western Madison.  It will take several months to restore service.

“Based on our discussions with the City, we anticipate it could take a very long time to repair the damaged tower,” states DeAnne Boegli, TDS National Public Relations Manager. “Since this is the only viable tower location TDS can use to serve these homes, and because temporary solutions are not available, our customer’s best option is to select another facilities-based communications provider.”

TDS will assist all 147 impacted customers in changing their service without penalty and remove the equipment from customer homes at their request and convenience. The company is also providing the customers a month’s service credit.

“Unfortunately, this accident has left us with no reliable or timely restoration options. TDS understands communications services are critical to our customers and we want to get them transitioned as quickly as possible, even though it means they must select another provider,” said Boegli.

Affected cell phone companies are trying to establish temporary cell tower sites to improve service in the area while repairs get underway.

Charter Cable Says No to Usage-Based Billing & Caps, Increases Speeds

Charter Cable has made it clear — no metered billing and no enforcement of its “soft usage caps.”

“We have no plans to introduce metered billing,” Ketzer told Broadband Reports, adding no trials were forthcoming either.

But Charter Cable did say bandwidth consumption is a concern for the company, and a measurement tool to educate customers about their current usage was on the way.

“Right now we are gathering requirements to develop a resource so that customers can monitor and control their bandwidth resources,” said Ketzer. “This was something that our customers have been requesting and we want to meet that need.”

Separately, Charter also announced speed upgrades for many of its broadband customers.  Starting this morning, customers can briefly unplug their cable modems to reset them and enjoy some increased speeds at no additional cost.

The new speed increases impact three of their broadband plans.  Only “Lite” speeds remain unchanged:

  • Lite: Remains the same at “up to” 1 Mbps/128 kbps
  • Express: Increases from 5/1 Mbps to 8/1 Mbps
  • Plus: Increases from 10/2 Mbps to 16/2 Mbps
  • Max: Increases from 20/2 Mbps to 25/3 Mbps

Charter advises Max customers will need to exchange their current cable modem to receive the new speeds.  They come as a result of DOCSIS 3 upgrades, which requires a modem that supports that standard.

Some Charter customers can go even faster with the company’s Ultra60 plan delivering 60/5Mbps service for $139.99 a month.  Customer promotions, typically running six months, can cut the cost to $109.99 during the promotional period.

Increasing speeds and shelving Internet Overcharging schemes like usage limits and usage-based billing build customer loyalty and bring new customers, particularly at the expense of telephone company DSL plans, which cannot compete on speed.  Most DSL providers have stopped increasing speeds beyond the maximum 6-10 Mbps they have advertised for years.  Many barely deliver 3 Mbps.

AT&T, which provides service in many Charter markets, has raised the stakes for competition as it rolls out U-verse, an advanced type of DSL service that can support video, telephone, and faster broadband.  In Reno, where AT&T has conducted usage cap experiments for more than a year, the news that Charter won’t comes as welcome news.

Stop the Cap! reader David canceled AT&T service when he found out the company was testing a usage cap in Reno.

“When we found out they were limiting us (after we signed up), we not only canceled AT&T broadband, but also disconnected our two phone lines as well,” David writes.  “We won’t do business with a company that wants to limit our broadband use and we resented being guinea pigs in the first place.”

David adds a “retention specialist” offered to waive his participation in the trial, but he wasn’t interested and is not looking back.

“Unless you deliver a clear message these ripoffs are unacceptable in a way they understand – money – they will just come back for more once the ‘experiment’ is over,” he said.

David is happy with his Charter Cable service, and estimates AT&T’s experiment cost them nearly $200 a month in revenue they used to earn from his family.

“Their cost control program certainly worked — for me.  I’m saving more money with Charter than what I was paying AT&T,” he adds. “I wouldn’t have switched except for their usage cap.”

Charter itself has some broadband usage limits, but they are almost never enforced.

Charter currently defines “normal” residential usage at around 15 gigabytes per month.  Charter’s usage allowances appear in its “excessive use” clause in the Acceptable Use Policy:

Residential service usage will not exceed 100GB of bandwidth per month for Customers subscribing to Services of 15 Mbps or less per month and 250GB of bandwidth per month for Customers subscribing to Service over 15 Mbps and up to 25 Mbps. Charter reserves the right to revise usage limits or to implement additional usage limits. In the event residential usage exceeds the above-described limits Customer will be notified and required to either limit Customer’s bandwidth consumption to permitted levels/limits or subscribe to a Service with a higher monthly bandwidth limit if a higher limit subscription is available.

Since these limits have not been aggressively enforced, they are known as “soft usage caps.”  Most Internet Service Providers have provisions for such limits in their customer agreements, although they are usually only enforced only when a customer’s usage reaches into the stratosphere (often terabytes of usage are involved) or creates a problem for the provider.

Still, some customers dropped Charter Cable even over the defined “soft caps,” switching to competitors who had no such provisions in their usage policies.  Consumers hate Internet Overcharging schemes, and will readily change providers to avoid them.

Verizon’s Abdication of Rural Broadband — Plow Money Into Big City FiOS, Ignore or Sell Off Rural Customers

Verizon Communications has made its intentions clear — would-be broadband customers in its service area who are off the FiOS footprint can pound salt.  The Federal Communications Commission issues regular reports on broadband services and their adoption by consumers across the United States.  In the latest report, published this month, customers in Verizon’s current or former service areas who are not being served by Verizon FiOS are behind the broadband 8-ball, waiting for the arrival of DSL service from a company that has diverted most of its time, money, and attention on deploying its fiber-to-the-home service for the big city folks.

One might think the worst DSL availability in the country would be in rural states like Alaska, or territories like Guam, or income-challenged Mississippi.  No, the bottom of the barrel can be found in northern New England and the mid-Atlantic states — largely the current or former domain of Verizon:

A survey of the rest of the country calls out Verizon’s inattentiveness to DSL expansion in its remaining service areas not covered by FiOS.

For example: Alabama, Idaho, Montana, and Oklahoma all enjoy 80 percent DSL availability.  Utah and Nevada achieved 90 percent coverage.  Even mountainous Wyoming, the least populous state in the country, provides 78 percent of its state’s customers with the choice of getting DSL service.  Yet New York manages only one point higher among its telephone companies, largely because of enormous service gaps upstate.

What happened?  By 2002 Verizon began to realize their future depended on moving beyond providing landline service.  The company began to divert most of its resources to a grand plan to deliver fiber connections to residences in larger markets in its service areas.  While great news for those who live there, those that don’t discovered they’ve been left behind by Verizon.  Northern New England got flushed by Verizon altogether — sold to the revenue-challenged FairPoint Communications who assumed control of Verizon’s problems and managed to make them worse.

The argument that rural broadband is “too expensive” doesn’t fly when looking at DSL availability in the expansive mountain west or rural desert regions.  Compact states like Vermont, New Hampshire, and Maryland are far easier to wire than North Dakota, New Mexico or even Texas with its large rural areas (87, 87, and 81 percent coverage, respectively).  Verizon simply doesn’t realize the kind of Return on Investment it seeks from FiOS customers — a dollar amount investors want to see.

Of course, that’s the argument Frontier Communications, and FairPoint behind it, made to regulators in sweeping promises to deliver better broadband service.  FairPoint missed its targets and declared bankruptcy.  Frontier is still in the “promises, promises” stage of its deal to take over millions of rural customers currently served by Verizon.

Data Cap Daftness: Usage Allowances Increase Data Consumption As New Zealand Customers Get Their Money’s Worth

Some broadband customers in New Zealand are treating their monthly usage allowances as usage targets, dedicated to ringing every last penny of value out of the Internet Overcharging schemes.  That means bandwidth usage increases just because customers don’t want to leave their remaining allowance on the table at the start of a new month.

PC World New Zealand notes “caps are essentially stupid” because your allowance resets at the end of every billing cycle:

If I’m away for a month and use zero bytes, it costs just the same as if I’d used my full 20GB. This wouldn’t be so galling if some allowance were made for under-utilising my capacity. It doesn’t have to be a 1:1 thing or roll over from month to month, but some concession would be nice. Perhaps a 1:2 ratio that must be used within the next billing period; in this case an allowance to go up to 30GB in the next month seems reasonable.

That would also get around the other irritating thing about data caps, the punitive charges if you go a single byte over your limit. In the case of TelstraClear it’s $2.95 per GB or part thereof.

I have a 40GB cap which I regularly go over. Telscum charge $20/Gb so it hurts like hell. I tried [switching] to TelstraClear but after three months all I had from them was a bill for services I didn’t receive.

We have 20Gb shared between the three of us and it is rare to go over but we do try like you to use it all up simply because we have paid for it. There is a company in NZ that allows you to roll it over it is Trust power Kinect. A friend uses them and roughly every three months he reckons he can save a month. You do need to have your power and phone with them though and for us it would actually work out more expensive but for others it might not. I do think caps suck though and wish they could be scrapped as I think we would actually use less bandwidth.

I think this part of the world and UK is an exception when it comes to data caps. In Europe data caps are very rare (except in UK which is not typical for Europe in any aspects). Being from Sweden I was a bit surprised moving to NZ and discovered data caps as well as very slow and expensive Internet. Sweden is similar to NZ (e.g. size, population) so it’s a fair comparison. You are being ripped off!

I almost always go over my 80GB. I pay for going over at the $2.95 per GB. Most months I do about 100GB. So last year when I did 262GB in the month it cost quite a lot, total bill was over $500.  As a big data user I have no issues with paying more than little data users but bigger plans are needed. Looking at rates in other parts of the world I should be able to get a 250GB package for about $150 or $180, and that still leaves a good profit for the telco.  Don’t get me started on 3G data costs….
