Net Neutrality: A Taste of Preferential Fast Lanes of Web Traffic in India

Unclear and unenforced Net Neutrality rules in India give a cautionary tale to U.S. internet users who could soon find Net Neutrality guarantees replaced in the U.S. with industry-written rules filled with loopholes or no Net Neutrality protections at all.

As India considers stronger enforcement of Net Neutrality protection, broadband providers have been merrily violating current Net Neutrality guidelines with fast lanes, sometimes advertised openly. Many of those ISPs are depending on obfuscation and grey areas to effectively give their preferred partners a leg up on the competition while claiming they are not giving them preferential treatment.

Medianama notes Ortel advertises two different internet speeds for its customers – one for regular internet traffic and the other for preferred partner websites cached by Ortel inside its network. The result is that preferred websites load 10-40 times faster than regular internet traffic.

Ortel’s vice president of broadband business, Jiji John, said Ortel is not violating Net Neutrality.

“Cache concept is totally based on the Internet user’s browsing. ISP does not control the contents and it has nothing to do with Net Neutrality,” John said in a statement.

Critics contend ISPs like Ortel may not control the contents of websites, but they do control which websites are cached and which are not.

Alliance Broadband, a West Bengal-based Internet provider, goes a step further and advertises higher speeds for Hotstar — a legal streaming platform, Google and popular movie, TV and software torrents, which arrive at speeds of 3-12Mbps faster than the rest of the internet. Alliance takes this further by establishing a reserved lane for each service, meaning regardless of what else one does with their internet connection, Hotstar content will arrive at 8Mbps, torrents at 12Mbps and the rest of the internet at 5Mbps concurrently. This means customers can get up to 25Mbps when combining traffic from the three sources, even if they are only subscribed to a much slower tier.

Which services are deemed “preferred” is up to the ISP. While Alliance may favor Google, Wishnet in West Bengal offers up preferential speeds for YouTube videos.

The ISPs claim these faster speeds are a result of “peering” those websites on its own internal network, reducing traffic slowdowns and delays. In some cases, the ISPs store the most popular content on its own servers, where it can be delivered to customers more rapidly. This alone does not violate Net Neutrality, but when an ISP reserves bandwidth for a preferred partner’s website or application, that can come at the expense of those websites that do not have this arrangement. Some ISPs have sought to devote extra bandwidth to those reserved lanes so it does not appear to impact on other traffic, but it still gives preferential treatment to some over others.

Remarkably, Indian ISPs frequently give preferential treatment to peer-to-peer services that routinely flout copyright laws while leaving legal streaming services other than Hotstar on the slow lane, encouraging copyright theft.

American ISPs have already volunteered not to block of directly impede the traffic of websites, but this may not go far enough to prevent the kinds of clever preferential runarounds ISPs can engineer where Net Neutrality is already in place, but isn’t well defined or enforced.

CenturyLink Buying Level 3 Communications for $24 Billion

centurylink(Reuters) – CenturyLink, Inc. said it would buy Level 3 Communications, Inc., in a deal valued at about $24 billion to expand its reach in the competitive market that provides communications services to business customers.

CenturyLink’s shares slumped 12.4 percent to $26.61 in afternoon trading on Monday, while shares of Level 3 surged 4.9 percent to $56.73.

The cash-and-stock deal, expected to close in the third quarter of 2017, comes as the companies struggle with a slowdown in their core operations and as they face telecommunications rivals like AT&T Inc., Comcast, and Verizon Communications Inc., who also offer internet and phone services to businesses.

CenturyLink aims to create a formidable enterprise telecom player as business clients seek more bandwidth and faster networks to move data traffic.

“We’ve become a much larger and more focused enterprise player,” CenturyLink Chief Executive Glen Post said in an interview after the deal was announced on Monday.

“Together with Level 3, we will have one of the most robust fiber network and high-speed data services companies in the world,” Post said separately in a statement.

Post, who has worked at CenturyLink since 1976, will lead the combined company, while Level 3 Chief Financial Officer Sunit Patel will be chief financial officer.

Analysts were concerned over the fact that CenturyLink will be using its shares to cover the purchase price, which they said would raise its debt-to-equity ratio.

“Our hangup on valuation stems from the fact that CenturyLink is using its shares to fund 60 percent of the purchase price,” Morningstar analyst Michael Hodel said in a research note.

The offer of about $66.50 per share represents a premium of 42 percent to Level 3’s close on Wednesday before reports surfaced on a potential pact between the two companies.

CenturyLink, which reported third-quarter earnings on Monday, forecast lower-than-expected fourth-quarter revenue of $4.28 billion-$4.34 billion, dragged by a decline in its wireline business. The company expects an adjusted profit of 53-59 cents per share for the quarter.

Analysts polled by Reuters expect revenue of $4.38 billion and earnings of 64 cents in the fourth quarter.

Monroe, La.-based CenturyLink, which provides telephone services mainly in rural areas, has been investing to grow its enterprise business and upgrade its networks in recent years. Level 3 has one of the most desirable global fiber networks and provides internet services to clients like Apple and Netflix.

Including debt, the deal is valued at about $34 billion and would result in cost savings of $975 million per year, CenturyLink executives said on a conference call with investors.

“These are two companies looking for scale and synergies in reaction to the struggles that both companies are facing in their core business to deliver on growth,” BTIG analyst Walter Piecyk said in an email.

CenturyLink, which operates more than 55 data centers in North America, Europe and Asia and provides broadband, voice, video, data and managed services, has been exploring a sale of some of its data center assets. That sale process is underway, CenturyLink executives said on the call.

Colorado-based Level 3 narrowly avoided bankruptcy in the early 2000s and was helped by got a cash infusion of $500 million in 2002 from investors including Warren Buffett. It purchased enterprise company TW Telecom in 2014 for $5.65 billion.

It’s unlikely that the CenturyLink-Level 3 deal would face regulatory hurdles, analysts said.

The global enterprise market is “so crowded with competition, with more and more new entrants building fiber every day that we see little cause for concern by regulators,” Drexel Hamilton analyst Barry Sine said in a research note.

The breakup fee is of a “normal size” and will be divulged when CenturyLink files its merger agreement with regulators shortly, Post said without providing details.

kcl-logoHow much you use the Internet is often a matter of how fast your broadband connection is, according to a new study.

King’s College London researchers found a clear correlation between bad broadband and low usage rates, as customers avoided high bandwidth apps like online video because they were frustrating or impossible to use. One analyst said the findings show rural areas are being “deprived of the full benefits of broadband.”

One of Britain’s most used apps is the BBC iPlayer, which streams live and on-demand programming from multiple BBC radio and television networks. It is a well-known bandwidth consumer, using a significant proportion of a customer’s broadband connection to deliver up to HD-quality video streams. The study found users in South Ayrshire, Ards, the Isle of Wight, the East Riding of Yorkshire, North Down and Midlothian were among the areas where people used iPlayer the least. It wasn’t because they didn’t want to. Those areas were identified by Ofcom, the British telecom regulator, as receiving some of the worst Internet speeds in the UK. Conversely, areas with robust broadband, including London, south Gloucestershire and Bristol, showed above average usage.

“It is clear that high-speed broadband is an important factor in the use of bandwidth-intensive applications such as BBC iPlayer,” said Dr. Nishanth Sastry, a senior lecturer at King’s College London and the lead researcher. “With technological advancements, it is likely that more services important to daily life will move online, yet there is a significant proportion of the population with inadequate broadband connections who won’t be able to access such services.”

Ian Watt, a telecommunications consultant with the analyst Ovum, said broadband speeds must get higher to assure users can watch HD video and simultaneously share their Internet connection with other members of the household.

“Recent Ovum research indicated a speed of 25Mbps was an appropriate target access speed to provide a high quality experience for video services,” Watt said. In the United States, 25Mbps is the current minimum speed to qualify as broadband, according to the most recent FCC definition.

The findings may also explain why U.S. broadband providers only capable of delivering relatively low-speed Internet access report lower average usage than those capable of providing service at or above 25Mbps. Those offering the fastest speeds are also the most likely to attract higher volumes of Internet traffic as customers take advantage of those speeds.

Cox Upgrading to Fiber-to-the-Node, DOCSIS 3.1 Broadband Platform

COX_RES_RGBCox Communications will push broadband speed upgrades as high as a gigabit to customers over an upgraded network heavy on fiber and much lighter on copper coaxial cable.

In an effort to stay competitive and reduce operational and maintenance costs, Cox will begin major upgrades of its cable plant, removing as much copper and as many signal amplifiers as possible to simplify upkeep and make future upgrades simpler.

Cox chief technology officer Kevin Hart told Light Reading he wants to push fiber optics deeper into Cox’s network, bringing optical fiber closer to the neighborhoods where customers live and work. This will allow Cox to reduce the number of customers sharing the same bandwidth. It also eases Cox’s forthcoming upgrade to DOCSIS 3.1 technology.

“We’re […] taking fiber deeper as a part of our multi-year network transformation plan, working towards a node-plus-zero architecture that allows us to take fiber to the home, and allows us to bring gigabit speeds on demand. And of course we’re aligning around DOCSIS 3.1,” Hart said.

Cox is planning its first rollout of DOCSIS 3.1, which gives cable companies to ability to offer gigabit download speeds, in the fourth quarter of this year. It will choose one of the smaller communities it serves as a test market. If all goes well, Cox will push DOCSIS 3.1 across all of its markets between 2017-2020, likely focusing on Phoenix and San Diego first.

Cox is evaluating DOCSIS 3.1 cable modems from a number of vendors, with Arris and Technicolor likely contenders.

Cox continues to support data caps and usage-based billing in some of its markets and has become one of the stingiest with data allowances:

Customers in Cleveland, Ohio are the unluckiest of all, because they also face an overlimit fee when they exceed their allowance: $10 for each additional 50GB block of data. Some customers in Cleveland’s downtown area have found a loophole around the data cap, however. If they access the Internet over Cox WiFi and Cable WiFi hotspots, it does not count against one’s allowance at this time.

AT&T Tells Customers $30 Extra for Unlimited Internet is Good News (for AT&T)

fat cat attAT&T has indirectly announced it will enforce hard data caps on its U-verse broadband service for the first time, imposing overlimit fees for customers that exceed their allowance unless they agree to pay $30 extra a month for a new unlimited add-on plan.

AT&T’s Consumer Blog announced effective May 23, AT&T was increasing the usage allowances on its DSL and U-verse broadband service and is introducing a new $30 unlimited option for broadband-only customers many actually had all along because AT&T never enforced its cap for U-verse.

Customers currently bundling video and data services from AT&T/DirecTV will get a break – the unlimited option will apply at no extra charge if you agree to a single, combined bill for all of your AT&T services. The decision to apply usage caps to broadband-only customers, often cord-cutters, while effectively exempting current U-verse TV/DirecTV video customers is sure to raise eyebrows.

AT&T originally told customers its usage caps were designed “to ensure it is providing a sustainable network to customers.”  But in a company FAQ, AT&T destroys its own argument for the need to cap anyone. “Will offering unlimited data negatively impact the AT&T network? No. AT&T will continue to actively manage the network to handle the increasing demand for data.”

AT&T’s need for data caps is also eroded by company claims only a small percentage of customers exceed them.

“Today, our home Internet customers use just over 100GB of data per month on average,” AT&T wrote. “So even with our smallest U-verse Internet data allowance of 300 GB the average customer has plenty of data to do more.”

At least for now.

A review of AT&T’s past average usage claims is revealing. In 2011, AT&T told Tom’s Hardware the average customer consumed about 18GB a month. In 2015, AT&T’s cached support site claimed average customers used around 35GB a month. As of this week, AT&T says average users now exceed 100GB a month. If AT&T decides not to regularly revisit allowances (AT&T took five years to revisit the subject this week, having introduced 150GB caps on DSL and 250GB on U-verse in 2011), customers are likely to face pressure to sign up for the $30 unlimited add-on or buy television service from AT&T to avoid overlimit charges that will top out at $200 in penalties for DSL customers, $100 for U-verse overlimit fees.

Beginning May 23, AT&T’s website will include a data usage meter to help avoid AT&T’s overlimit penalty: $10 for each 50GB increment one exceeds their allowance. AT&T claims only 4% of its customers will exceed their future data allowances. They wouldn’t say how many exceed the current ones.

Because U-verse customers have avoided AT&T’s usage caps in the past, the company is now reminding customers it will give several warnings before you experience bill shock:

  • In the first bill cycle when you reach 100% of your data allowance, AT&T will update you via email, but there will be no charges.
  • In the second bill cycle, AT&T will notify you via email at 65%, 90%, and 100%, and still without charges.
  • In the third bill cycle, and each bill cycle thereafter, you’ll receive reminder emails at 65% and 90%. At 100% AT&T will notify you and add an additional 50GB of data to your account for $10 each time you exceed the allowance. Customers will receive reminders about their data usage for the additional 50GB at 75% and 100%.

All usage — including uploads and downloads — counts towards the cap. There is just one exception. Wireless traffic from an AT&T MicroCell, designed to boost weak cell signals inside the home, is not included in AT&T’s Internet data usage allowance. To help ensure accurate billing, you have to register your AT&T MicroCell account and residential AT&T Internet account.

That last bit is a fairly transparent ploy to address a spike in cord cutting at AT&T — by forcing customers into signing up for television services they may not actually want if they want to avoid usage restrictions. Whether using arbitrary caps to force users to sign up for TV technically violates net neutrality (either the FCC’s rules or the concept in general) is something that’s likely to be hotly debated.

It’s also curious that just as AT&T indicates it’s backing away from U-Verse TV (which should technically free up more bandwidth on the AT&T network), it’s implementing caps on a network it originally stated didn’t need caps thanks to “greater capacity.” That’s because as with Comcast, caps really aren’t about capacity or financial necessity, they’re about protecting traditional TV revenue from Internet video. At the end of the day, AT&T’s just charging $30 a month (or more) for the same service, while trying to frame it as a net positive for consumers.
