<p>Beyond that, St. Helena is mostly known as an out-of-the-way tourist destination and potential point of contact for ships traversing the South Atlantic between South America and southern Africa.  St. Helena&#8217;s residents live with three television stations, two radio stations, two newspapers, and a single satellite connection to the Internet providing one 10/3Mbps circuit shared by all 4,000 residents.</p>
<p>Signing up for &#8220;broadband&#8221; is an expensive ordeal.  Individual residents can purchase strictly usage-limited DSL Internet service at prices ranging from $31 a month for 128/64kbps service (limited to 300MB per month) to $190 for 384/128kbps service, with a 3.3GB monthly allowance.  Overlimit fees start at around $0.15 per megabyte.</p>

<p>Local residents find life without the modern day definition of broadband service a major hindrance, especially for education.  Students have left St. Helena for the United Kingdom to pursue studies.  Economically, self-sustained employment is next to impossible on the island.</p>
<p>&#8220;I&#8217;m an IT engineer and I would love to return to my island to start an IT business, but because of the slow, expensive and unreliable Internet connection this is simply impossible,&#8221; said Jonathan Clingham, an IT infrastructure engineer now working in Wiltshire, England.</p>
<p>Now a <a href="http://www.connectsthelena.org/" target="_blank">grass-roots campaign</a> has been launched to help convince several telecommunications companies financing a new underseas fiber cable project laid between Brazil, Angola, and South Africa to reroute the cable slightly through the island of St. Helena, opening the door to modern broadband for the island.</p>
<p>The group is calling on supporters to help draw attention to the project, arrange for the British government to help underwrite the expense of an extra 50 kilometers of cable needed to reach St. Helena, and providing assistance to lease a circuit on the new cable:</p>

<p style="padding-left: 30px;"><span style="font-family: book antiqua,palatino;">Dear Senator McConnell and Members of the Senate Judiciary Committee:</span></p>
<p style="padding-left: 30px;"><span style="font-family: book antiqua,palatino;">We, the private-sector companies and trade associations listed below, urge you to <strong>oppose H.3508 </strong>because these bills, on top of South Carolina’s existing barrier to public communications initiatives, codified in SC Code §§ 58-9-2600 <em>et seq</em>., will harm both the public and private sectors, stifle economic growth, prevent the creation or retention of thousands of jobs, hamper work force development and diminish the quality of life in South Carolina. In particular, these bills will hurt the private sector in several ways: by curtailing public-private partnerships, stifling private companies that sell equipment and services to public broadband providers, and impairing educational and occupational opportunities that contribute to a skilled workforce from which businesses across the state will benefit.</span></p>

<p style="padding-left: 30px;"><span style="font-family: book antiqua,palatino;">The United States continues to suffer through difficult economic times.  The private sector alone cannot lift the United States out of this crisis.  As a result, federal and state efforts are taking place across the Nation to deploy both private and public broadband infrastructure to stimulate and support economic development and jobs, especially in economically distressed areas.  For example, in South Carolina, Orangeburg and Oconee Counties have received broadband stimulus awards to bring much-needed broadband services and capabilities to communities that the private sector has chosen not to serve adequately.  H.3508, together with SC Code §§ 58-9-2600 <em>et seq.</em>, would impose burdensome financial and regulatory requirements that will prevent public broadband providers from building the sorely needed advanced broadband infrastructure that will stimulate local businesses development, foster work force retraining, and boost employment in these economically depressed areas.</span></p>
<p style="padding-left: 30px;"><span style="font-family: book antiqua,palatino;">Consistent with these expressions of national unity, public entities across America, including South Carolina, are ready, willing, and able to do their share to bring affordable high-capacity broadband connectivity to all Americans. Enactment or retention of direct or effective barriers to community broadband, such as H.3508 and SC Code §§ 58-9-2600 <em>et seq</em>., would be counterproductive to the achievement of these goals.  These measures are also inconsistent with our country’s National Broadband Plan, which recommends that no new barriers be enacted and that existing barriers be removed.</span></p>
<p style="padding-left: 30px;"><span style="font-family: book antiqua,palatino;">We support strong, fair and open competition to ensure that users can enjoy the widest range of choices and opportunities.  H.3508 is a step in the wrong direction.  South Carolina should be removing barriers to public broadband initiatives rather than establishing new ones, so that high technology companies can spread and prosper into all the communities in this beautiful state.  <strong>Please oppose H.3508, repeal SC Code § 58‑9‑2600 <em>et seq</em>., and reject any future measures that could significantly impair municipal broadband deployments or public-private partnerships in South Carolina</strong>.</span></p>
<p><em>Stop the Cap!</em> <a href="http://stopthecap.com/2012/01/17/call-to-action-at-get-on-the-phones/">earlier noted</a> this legislation is heavily sponsored by AT&amp;T and other telecommunications companies already operating in South Carolina.  Several months ago, we reported on South Carolina&#8217;s woeful broadband: <a href="http://stopthecap.com/2011/08/04/south-carolina-americas-broadband-corridor-of-shame/">A Corridor of Shame</a>, with large sections of the state without anything close to &#8220;broadband&#8221; service, even as state legislators in 2009 leased away the state&#8217;s <a>publicly owned Educational Broadband Service</a>-spectrum to private companies like Clearwire that don&#8217;t appear to be delivering any service in South Carolina.</p>

<p><a href="http://stopthecap.com/wp-content/uploads/2012/01/connectedtn.png"><img class="alignright size-full wp-image-23320" title="connectedtn" src="http://stopthecap.com/wp-content/uploads/2012/01/connectedtn.png" alt="" width="267" height="66" /></a>A group whose national umbrella organization has <a href="http://stopthecap.com/2010/07/21/texas-broadband-mapgate-ag-commissioner-under-fire-for-financial-ties-to-connected-nations-backers/" target="_blank">close connections</a> to the nation&#8217;s largest phone companies <a href="http://www.connectedtn.org/blog/post/connected-tennessee-releases-updated-broadband-availability-estimates" target="_blank">estimates</a> 5.3% of residents in the state of Tennessee now have access to world-class fiber broadband at speeds up to 1Gbps, but no thanks to AT&amp;T or Comcast.</p>
<p>As part of updated broadband availability estimates, the group noted that only a fraction of the state gets access to the community-0wned Chattanooga-based utility that provides fiber to the home service, EPB.</p>
<p>Key findings from this update include:</p>
<ul>
<li>95.2% of Tennessee households have access to fixed broadband service of at least 768 Kbps downstream and 200 Kbps upstream (excluding mobile and satellite services).</li>
<li>93% of Tennessee households have access to fixed broadband service of at least 3 Mbps downstream and 768 Kbps upstream (excluding mobile and satellite services).</li>
<li>4.8% of Tennessee households remain unserved by any fixed broadband provider, representing approximately 120,000 unserved households that do not have access to a fixed wireless or wired broadband service offering (excluding mobile and satellite services).</li>
<li>Across rural areas of Tennessee, the percentage of unserved households by any fixed broadband service is 8.4%, representing approximately 110,000 unserved rural Tennessee households.</li>
<li>5.3% of Tennessee households now have access to broadband service of at least 1 Gbps, marking the first time in Tennessee.</li>
</ul>
<p><a href="http://stopthecap.com/wp-content/uploads/2009/12/comcast.jpg"><img class=" wp-image-6694 alignleft" title="comcast" src="http://stopthecap.com/wp-content/uploads/2009/12/comcast-300x77.jpg" alt="" width="180" height="46" /></a>Most households receiving the slowest speeds get them from phone-company marketed DSL service and some fixed wireless ISPs operating in the state.</p>
<p>In Chattanooga, consumers have a choice between AT&amp;T U-verse in selected neighborhoods, Comcast Cable, or EPB Fiber.  Recently, Christopher Mitchell at <em>Community Broadband Networks</em> <a href="http://www.muninetworks.org/content/chattanooga-epb-customers-rave-comcast-customers-livid" target="_blank">alerted</a> us that <em>The Chattanoogan</em> newspaper shared <a href="http://chattanoogan.com/articles/article_217860.asp" target="_blank">the difference</a> between Comcast and EPB customer service:</p>
<blockquote><p>You&#8217;ve got to be kidding me, Comcast! Several days ago our On Demand stopped working with a message to contact customer service and report that error seven occurred.</p>
<p>My husband called and after being given the self-help/troubleshoot option over the phone selected and requested a signal to be re-sent to the box. The box had already been unplugged, the appropriate amount of time waited, and the box plugged back in. No luck. The box was sent the refresh signal&#8230;it didn&#8217;t work; surprise.</p>
<p>So, he called back and spoke with someone who wanted to re-send the signal again and if that didn&#8217;t work then a technician would be needed.</p>
<p>[...]</p>
<p>I called Comcast this morning to schedule the technician to be told that it was going to cost me $30 for them to come out regardless of the problem. Let&#8217;s see, Comcast&#8217;s DVR box that they own and I rent shot trouble and I have to pay them another $30; I asked at least twice &#8211; &#8220;if Comcast&#8217;s equipment is the problem, I still have to pay $30?&#8221; &#8220;Yes, mam&#8221;.</p>
<p>They should bring out a replacement DVR for me, adjust my account for the days we&#8217;ve been without the On Demand plus an amount plus or minus $30 for the time we&#8217;ve had to take to mess around with this; not counting the time that will have to be arranged to be taken to have their technician come out.</p>
<p>Since I&#8217;m going to have to arrange to take more time, maybe we&#8217;ll just have someone else come out and put in something other than Comcast and they can have their broken DVR and all their other stupid little additional cable boxes returned to them.</p>

<p>The community-owned broadband alternative, EPB Fiber</p>
<blockquote><p>We experienced the same “customer service” issues with Comcast. We finally cancelled our service when the tornado came through our neighborhood and we were forced to move for six months. When we finally moved back home we became EPB customers.</p>
<p>We have had one instance where we needed to contact customer service, and the problem was fixed quickly and easily by the most polite customer service rep I’ve ever dealt with.</p>
<p>Comcast came by recently to offer us a “substantial savings” if we’d make the switch back to them. My question was, why now? I was a customer for years and treated poorly as rates increased exponentially. Now the offer the discount? No thanks.</p>
<p>For the $5 extra per month that we pay for EPB, we receive better features, prompt and polite customer service, and an all around trouble free experience. Thanks EPB!</p>

Fuhr, Jr., who produced a dollar-a-holler &#8220;research report&#8221; on behalf of corporate-backed astroturf group the Coalition for the New Economy (which lists the Heartland Institute&#8217;s Florida chapter as a member), the two dismiss Chattanooga&#8217;s award-winning EPB Fiber Network as providing lesser service than private competitors AT&amp;T (also a member of the Coalition) and Comcast, in part because EPB &#8220;only sells customers a gig.&#8221;</p>

<blockquote><p>Walker: The government broadband services are always one step behind private industry and I&#8217;m thinking in Chattanooga, the law [sic] that they have the fastest download speeds of all government broadband in the United States, but they only offer 1Gbps service.</p>
<p>Fuhr: Well, one of the issues there is, well, the supply is there but they kind of have the feeling that if you build it, they will come.  Well, they haven&#8217;t come.  I mean they are charging $350 a month for that service and very few people are willing to subscribe.  People are, for the most part, happy with slower speeds.  Who really needs a gigabyte (sic) and the market shows that people don&#8217;t really need that.</p></blockquote>
<p>Dr. Fuhr apparently does not know the difference between a &#8220;gigabyte&#8221; and a &#8220;gigabit,&#8221; so I am not sure how seriously we are supposed to take this &#8220;broadband expert.&#8221;  He also does nothing to challenge Walker&#8217;s wholly-inaccurate declaration that EPB only sells customers $350 1Gbps broadband.</p>
<p>In fact, most of Heartland Institute&#8217;s views about EPB broadband are a big bucket of wrong:</p>
<ol>
<li>EPB Fiber offers the fastest fiber broadband in the United States.  It is &#8220;private industry&#8221; providers Comcast and AT&amp;T who are more than one step behind, and they refuse to sell faster service and upgrade their networks to the speeds seen in Asia and Europe that Chattanooga&#8217;s EPB customers can have today.</li>
<li>There is no &#8220;law&#8221; involved in the delivery of broadband by EPB.  In fact, EPB fought off attempts by incumbent operators to sue the municipally-owned provider out of the broadband business, and some of those same companies are backing the &#8220;Coalition for the New Economy&#8221; in their efforts to curtail community broadband with new laws that would make networks like EPB next to impossible to provide.</li>
<li>EPB does not only offer 1Gbps service.  Consumers and businesses are free to choose between several different speed tiers.  As any commercial entity will tell, you 1Gbps at just $350 a month is a steal compared to the prices AT&amp;T and Comcast would charge.</li>
<li>When EPB built their fiber network, private businesses did come.  In addition to media reports documenting expansion in Chattanooga from one Knoxville business, Amazon.com has announced hundreds of millions of dollars in new investments building and expanding distribution centers in and around Chattanooga, in part because EPB Fiber was available for their use.</li>
<li>People are not happy with the slow speeds some providers force them to accept.  It is no surprise, however, that industry-funded astroturf groups would repeat the usual provider line that people &#8220;don&#8217;t need&#8221; fast broadband that they have no plans to deliver anyway.</li>

<p>In his State of the Union address last night to Congress, President Barack Obama complained that America&#8217;s digital infrastructure is inadequate to allow entrepreneurs and small businesses to successfully market their goods and services over the Internet.</p>
<blockquote><p>&#8220;So much of America needs to be rebuilt. We&#8217;ve got crumbling roads and bridges, a power grid that wastes too much energy, an incomplete high-speed broadband network that prevents a small-business owner in rural America from selling her products all over the world.</p>
<p>During the Great Depression, America built the Hoover Dam and the Golden Gate Bridge. After World War II, we connected our states with a system of highways. Democratic and Republican administrations invested in great projects that benefited everybody, from the workers who built them to the businesses that still use them today.</p>
<p>In the next few weeks, I will sign an executive order clearing away the red tape that slows down too many construction projects. But you need to fund these projects. Take the money we&#8217;re no longer spending at war, use half of it to pay down our debt, and use the rest to do some nation-building right here at home.&#8221;</p></blockquote>
<p>President Obama also touched on the problem of online piracy and imported counterfeit goods.  Last week, controversy over online piracy legislation including the Stop Online Piracy Act (SOPA) and the Protect IP Act (PIPA), brought consumer opposition to both, temporarily shelving the measures.  But the president acknowledged the problem was not going away.</p>
<p>&#8220;It&#8217;s not right when another country lets our movies, music, and software be pirated,&#8221; he said. &#8220;Tonight, I&#8217;m announcing the creation of a Trade Enforcement Unit (TEU) that will be charged with investigating unfair trading practices in countries like China. There will be more inspections to prevent counterfeit or unsafe goods from crossing our borders.&#8221;</p>

<p>Republicans fired back at the president over his rural broadband remarks, accusing the administration and the Federal Communications Commission of supporting pre-conditions on forthcoming spectrum auctions.  One House committee chairman tasked with broadband issues said the FCC was supporting policies that could reduce auction proceeds by reserving certain frequencies for up-and-coming wireless competitors or restrict how much spectrum a current market leader like AT&amp;T or Verizon Wireless could acquire.</p>
<p>&#8220;The President said we have an incomplete high-speed broadband network, but his Federal Communications Commission is protecting its turf instead of joining us to free up airwaves to build the next generation communications networks,&#8221; said House Energy &amp; Commerce Committee chairman Rep. Fred Upton (R-Mich.).</p>
<p>FCC chairman Julius Genachowski has had little regard for the House Republican-backed proposal that could potentially tie the FCC&#8217;s hands to set rules for spectrum auctions.  House Republicans also oppose setting aside certain spectrum for free, unlicensed high-power Wi-Fi use, preferring to auction as much spectrum as possible.</p>
<p>Earlier this month, Upton blasted the FCC chairman for opposing a &#8220;winner take all&#8221; auction approach:</p>
<blockquote><p>&#8220;Bluster aside, it sounds like we have a federal agency more concerned about preserving its own power than offering serious improvements as we prepare to finalize this legislation. We worked with the FCC&#8217;s auction experts to give the agency the legitimate flexibility it needs to design the mechanics of the auction. It&#8217;s time to stop the FCC from engaging in political mischief that will hurt competition and steal money from the taxpayer&#8217;s coffers. Don&#8217;t take our word for it – look at the 2008 auction. The FCC imposed conditions on the C and D blocks that ultimately prevented the D-block from selling and pushed smaller carriers out of the auction. Taxpayers lost somewhere in the neighborhood of $5 billion, and spectrum remains sidelined. And speaking of protecting taxpayers, it&#8217;s time for the FCC and others to be honest about how taxpayers would be affected by their plans to give away valuable spectrum to favored constituencies. Our goal is to strike the right balance by keeping plenty of opportunity for unlicensed use without forcing taxpayers to forfeit any return on a resource that everyone agrees is worth billions.&#8221;</p></blockquote>

<p>Frontier Communications&#8217; DSL service to some residents in Sardinia, Ohio has been progressively slowing down to the point Speedtest.net rated one man&#8217;s connection an &#8220;F-Minus.&#8221;</p>
<p>Larry Meeker&#8217;s broadband service from Frontier achieved speeds of just 190kbps &#8212; about four as fast as traditional dial-up Internet service.  Upload speeds reached just 1kbps.  When Meeker called Frontier Communications to complain about the lousy broadband speeds, he reports Frontier didn&#8217;t seem in any hurry to improve his service.</p>
<p>WKRC-TV TroubleShooter Howard Ain reports Frontier had done little for Meeker initially, saying &#8220;it will cost a lot of money for the company to upgrade&#8221; the broadband facilities in inherited from an acquisition from Verizon Communications.</p>
<p>Frontier changed its mind when Ain indicated the company&#8217;s broadband woes were about to be a feature item on WKRC&#8217;s 6pm local news.  Meeker also told the station he was preparing to file a complaint with Ohio&#8217;s public utility regulator.  Just a few days before the report aired, Frontier called Meeker to tell him improved service was on the way.</p>
<p>Meeker reports it used to take 10-15 seconds to load even basic web pages over Frontier&#8217;s DSL service.  But after the company began work on Meeker&#8217;s connection, pages are loading much faster, usually after 1-3 seconds.</p>
<p>The Sardinia man noted the best way to get action out of Frontier might be to call the media to get the company to do the right thing.</p>
<p>&#8220;I&#8217;m very happy that it is so easy to contact Channel 12 news and Howard Ain and know that somebody is at least going to call you and if there is a problem they are going to check it out and investigate it,&#8221; Meeker told the station.</p>
<p>A spokesman for Frontier Communications blamed the old owner &#8212; Verizon Communications, for inadequate broadband facilities in place to serve Sardinia and surrounding areas. The company says it is spending $90 million on upgrades because people are using the Internet a lot more in the area.  New circuits bringing additional capacity are anticipated to begin service by the second week of February.</p>

<p>Rep. Marilyn Avila (R-Time Warner Cable), the North Carolina representative <a href="http://stopthecap.com/2011/02/17/another-year-another-anti-community-broadband-bill-in-north-carolina/">fronting for the state&#8217;s largest cable company</a>, sure can sing for her supper.</p>
<p>The representative who <a href="http://stopthecap.com/2011/03/08/broken-promises-rep-marilyn-avila-r-time-warner-says-one-thing-in-public-another-in-private/">shilled</a> for North Carolina&#8217;s notorious anti-community broadband legislation was the very special invited guest speaker for the cable industry lobbying association annual meeting, held last August in Asheville, according to <a href="http://stopthecap.com/wp-content/uploads/2012/01/Avila-speaks-to-her-cable-fans.pdf" target="_blank">newly-available lobbying disclosure forms</a> obtained by <em>Stop the Cap!</em></p>
<p>The North Carolina Cable Telecommunications Association reported they not only picked up Marilyn&#8217;s food and bar bill ($290 for the Aug. 6-8 event), they also covered her husband Alex, too.  Alex either ate and drank less than Marilyn, or chose cheaper items from the menu, because his food tab came to just $185.50.  The cable lobby also picked up the Avila&#8217;s $471 hotel bill, and handed Alex another $99 in walking-around money to go and entertain himself during the weekend event.  The total bill for the weekend, effectively covered by the state&#8217;s cable subscribers: $1,045.50.</p>
<p>That&#8217;s a small price to pay to reward a close friend who delivered on most of the cable industry&#8217;s wish-list for 2011.  Besides, the <a href="http://www.charlotteobserver.com/2011/12/07/2833562/time-warner-rates-increase.html" target="_blank">recent cable rate increases</a> visited on North Carolina cable subscribers will more than cover the expense.</p>
<p>Meanwhile, in a separate disclosure, <em>Stop the Cap!</em> has learned Time Warner Cable covered food and beverage costs for members of the North Carolina General Assembly and their staff who attended the Mardi Gras World celebration in New Orleans, sponsored by corporate front group the American Legislative Exchange Council.  ALEC lobbies state legislatures for new laws they claim are grassroots-backed, but are in reality the legislative wish-lists of giant corporate interests, including North Carolina&#8217;s largest cable company &#8212; Time Warner.</p>
<p>The <a href="http://stopthecap.com/wp-content/uploads/2012/01/Alec-event-filing.pdf" target="_blank">food and bar tab</a> totaled just over $130 for the festivities.</p>
<p>Time Warner Cable achieved victory in 2011 passing anti-community broadband legislation through the North Carolina General Assembly, in part <a href="http://www.wxii12.com/r/25615752/detail.html" target="_blank">thanks to new support from the Republican takeover </a>of the state legislature last year.</p>

<p>For customers in Olney, DuQuoin, Pickneyville, Mt. Carmel and Benton, Ill., cable system upgrades will soon allow NewWave to provide cap-free 50/5Mbps speeds to homes and businesses.  The upgrades are long overdue.  NewWave often copes with customer criticism regarding the deteriorating cable systems it inherited from other providers.  Customers have previously accused the company of <a href="http://www.nicholasoverstreet.com/2010/03/new-wave-communications-the-worst-isp-in-america/" target="_blank">overselling their broadband service</a> and for <a href="http://www.facebook.com/pages/New-Wave-Communications-Sucks/170175423022982" target="_blank">service outages</a>.  Upgrades generally quiet the complaints.</p>
<p>NewWave Communications, headquartered in Sikeston, Mo. serves over 80,000 customers in the midwest and southeast United States, specializing in smaller communities larger providers typically ignore.  Comcast has spent most of its money and attention in larger cities in Indiana and northern Illinois, and although the company sometimes provide a range of services in more rural communities, upgrades typically came much later.</p>
<p>NewWave&#8217;s plan for success involves bringing advanced services to its mid-sized city service areas with the hope it will attract more service bundling and a bigger revenue stream.  NewWave will offer triple play packages of phone, cable, and broadband service and is introducing digital video recorders to a larger share of its customers.</p>
<p>The company has shown no signs of fearing the word &#8220;unlimited,&#8221; touting it in their literature for phone and broadband service.</p>

<p>Time Warner Cable is back again for the third year offering $20,000 in &#8220;dollar-a-holler&#8221; money to write &#8220;research reports&#8221; that meet the cable operator&#8217;s wish-list of current topics of interest.  While the cable company raises rates on customers, some of the proceeds pay for the Time Warner Cable Research Program on Digital Communications, which they say &#8220;awards stipends designed to foster research dedicated to increasing understanding of the benefits and challenges facing digital technologies in the home, office, classroom and community.&#8221;</p>
<p>After <a href="http://stopthecap.com/2010/02/23/time-warner-cable-gets-into-dollar-a-holler-public-policy-game-will-pay-20k-for-essays-parroting-cable-agenda/">tearing through</a> some of the earlier &#8220;award-winning&#8221; reports and topics over the past three years, we find it more an exercise in <a href="http://stopthecap.com/2010/09/22/time-warner-cable-pays-20k-for-report-that-says-fiber-to-the-home-is-our-future/">wasted cheerleading money</a>, particularly when some of the authors <a href="http://stopthecap.com/2011/03/14/dollar-a-holler-industry-lobbyist-attacks-north-carolinas-community-networks/">happen to work for PR astroturf operations and other industry-connected/funded &#8220;think-tanks&#8221;</a> that take money for dubious research and public statements that amplify the paymaster&#8217;s agenda.</p>
<p>It&#8217;s not much of a stretch to figure out exactly what kind of submissions the cable company is looking for after reviewing the <a href="http://www.twcresearchprogram.com/pdf/research-announcement_2012.pdf" target="_blank">topic list</a>.  It&#8217;s a safe bet nothing we&#8217;d have to say to Time Warner would get them to cut us a check for $20K.  In case there is any doubt, we&#8217;ve provided a helpful &#8220;between-the-lines&#8221; analysis of what they are really looking for, should you wish to put pen to paper:</p>
<blockquote><p><em><strong>(1) The end-user experience for broadband services</strong></em><br />
In an increasingly competitive marketplace, more attention is being paid to the consumer experience. For service providers, it is essential to make it simpler and easier for customers to enjoy the benefits of broadband any time, any place, on any device. Key questions include identifying service characteristics consumers consider in evaluating broadband performance, the role of accessibility in design and engineering, how best to encourage innovation in services and business models, the role of pricing and packaging of services, and how best to meet the needs of diverse communities.</p></blockquote>
<p style="padding-left: 30px;"><em>(Between the lines: how can we justify Internet Overcharging customers with usage caps and usage billing and make it sound all-consumery and good-newsy?)</em></p>
<blockquote><p><em><strong>(3) Internet governance</strong></em><br />
Internet governance is still largely framed by the way the Internet existed when it first became a mass-market phenomenon in the late 1990s. But more users rely on advanced digital communications for a diverse set of uses today. Networks and devices are more varied and more powerful than expected, and the Internet now supports a vast range of business models and drives economic growth . In this environment, the role of government and other intermediaries in framing and addressing policy goals continues to change. Key questions include examining the need for new methods of collaboration in multi-stakeholder processes, examining the role of standard-setting, how to measure and assess the performance of the broadband Internet, developing metrics that are meaningful to a wide range of stakeholders (from industry and policymakers to consumers), how to develop new forms of governance that convene stakeholders to solve problems cooperatively, and how to develop guidelines that protect settled expectations as well as enable continuing entry and innovation.</p></blockquote>

Online video is growing rapidly, comprising an increasing proportion of Internet traffic even as workable business models continue to evolve. Internet video thus increasingly competes with more traditional video services, while at the same time placing extraordinary burdens on the broadband networks owned and operated by those competitors. This emerging development raises a host of issues for video competition and regulation as well as for broadband policy. Key questions include how to identify and respond to the challenges posed by Internet delivery of video, and identifying the marketplace, legal, and policy barriers that stand in the way of innovation in video service delivery.</p></blockquote>
<p style="padding-left: 30px;"><em>(Between the lines: Since we can&#8217;t blame peer to peer traffic for the Internet &#8216;exaflood&#8217; any longer, we&#8217;ve designated online video the new Frankenstein that threatens to run our broadband network into the ground.  How can we stop Internet video from cannibalizing our cable-TV service by limiting access (or charging a bountiful harvest of cash to those who dare to watch too much.) Bonus: Include tips on how we can obfuscate our tissue-paper-thin agenda to slap the caps on from being called out as an abuse of our market power.</em></p>

<p>S&amp;N Communications laid off the workers indefinitely Jan. 9, telling them the phone company had not paid the contractor.</p>
<p>Frontier Communications issued a statement indicating the &#8220;contractual relationship between Frontier Communications and S&amp;N Communications has ended.  Both parties consider such contractual arrangements to be confidential.&#8221;  It had no comment about S&amp;N&#8217;s claim Frontier had an outstanding balance.</p>
<p>Frontier has experienced several challenges providing phone and broadband service in West Virginia.  A plague of <a href="http://www.herald-dispatch.com/news/briefs/x109182701/Two-arrested-in-Frontier-copper-thefts" target="_blank">copper thefts</a>, poor service, and a <a href="http://www.dailymail.com/Business/201201120075" target="_blank">broadband service interruption</a> last Thursday affecting 9,000 residents have all presented problems for Frontier&#8217;s customers. On Sunday, <a href="http://www.wtrf.com/story/16527686/hundreds-of-frontier-customers-without-service" target="_blank">a squirrel chewed through a fiber line</a> that disrupted service for hundreds of customers in Brooke and Ohio counties, also knocking out service for Brooke County&#8217;s 911 center and sheriff&#8217;s office.</p>
