<li>Search – search for programming by title or episode name and filter results by genre</li>
<li>Set-top box tuning – tap on a network logo or “watch on TV” button within the program description to tune compatible set-top boxes directly to the channel</li>
<li>DVR management – schedule one-time and series recordings on compatible DVRs directly from the interactive program guide. Tap on the “DVR” button to see a list of all upcoming recordings and make changes or cancel recordings</li>

<p>Time Warner wants customers to be so excited, it included a customer poll in its latest newsletter e-mailed to customers, with one notable possible impression left completely off the menu:</p>

<p>Customers who could not find a button to express concerns about the problems they&#8217;re experiencing with the app <a href="http://www.twcableuntangled.com/2012/01/twc-tv%E2%84%A2-app-now-available-for-iphone/" target="_blank">took to the company&#8217;s blog instead</a>.  Among the issues raised by subscribers:</p>
<ul>
<li>The app does not work on older generation Apple devices that do not support at least iOS v4.3;</li>
<li>Local channels and certain cable networks are not available for streaming;</li>
<li>Customers are limited to in-home viewing only;</li>
<li>The app does not work on jailbroken devices;</li>
<li>Certain Time Warner-provided set top boxes are reportedly not compatible with TWC TV, a problem that usually manifests as no access to the interactive program guide or DVR settings.</li>
</ul>
<p>The app is available at no charge from the <a href="http://www.timewarnercable.com/northeast/learn/apps/" target="_blank">iTunes or Android store</a>.  Android device owners can expect a live streaming-capable version of TWC TV in the near future.</p>

<p>The <em>New York Times</em> <a href="http://www.nytimes.com/2012/02/03/sports/baseball/steven-a-cohen-expected-to-buy-stake-in-mets.html?_r=1" target="_blank">reports</a> both Comcast and Time Warner Cable are preparing to funnel funds into the team through regional sports network SNY.</p>
<blockquote><p>Time Warner Cable and Comcast are nearing a plan to finance SNY’s purchase of four shares in the Mets, worth $80 million, said one person e with knowledge of the plan who was not authorized to speak publicly.</p>
<p>[...] That means they will have much-needed cash to pay off their substantial debts. But it would be a slightly quirky way of doing it. The deal would mean 16 percent of the Mets would be owned by SNY. The Mets’ parent company, Sterling Equities, owns 70 percent of the network.</p>
<p>[...] Lee Berke, the president of a media consulting company, said that Time Warner Cable and Comcast “don’t want to see the team stumble as it has been, because it directly impacts what they’re putting on TV. This is shaping up as a multiyear downswing for the Mets, and this is a way to keep them above water.”</p>
<p>[...] As for Time Warner Cable and Comcast, it was not immediately clear why they would not invest directly in the Mets. But the two companies clearly want to put money into Wilpon’s financially beleaguered hands (the club has lost some $120 million in the last two years), even if it has to be routed through SNY, to ensure that the team meets its $200 million goal.</p>
<p>[...] Together, Time Warner Cable and Comcast own about 30 percent of SNY. The network started carrying Mets games in 2006.</p></blockquote>
<p>That investment comes at the same time cable operators are increasingly vocal about sports programming costs.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2009/12/comcast.jpg"><img class="alignleft size-medium wp-image-6694" title="comcast" src="http://stopthecap.com/wp-content/uploads/2009/12/comcast-300x77.jpg" alt="" width="300" height="77" /></a>“ESPN, through &#8230; sheer muscle, has been able to say to us, ‘You will carry this service on the lowest level subscription you offer, and you will make all of them pay for it,’” Matt Polka, CEO of the American Cable Association, a trade group <a href="http://www.thedailybeast.com//content/newsweek/2012/01/15/espn-is-bigger-than-ever-and-that-might-not-be-a-good-thing.html" target="_blank">told</a> <em>Newsweek</em>. “My next-door neighbor is 74, a widow. She says to me, ‘Why do I have to get all that sports programming?’ She has no idea that in the course of a year, for just ESPN and ESPN2, she is sending a check to Disney for about $70. She would be apoplectic if she knew &#8230; Ultimately, there’s going to be a revolt over the cost. Or policymakers will get involved, because the costs of these things are so out of line with cost of living that someone’s going to put up a stop sign.”</p>
<p>Cable analysts continue to be astonished by an inflation rate in sports programming rates that rivals health care costs.</p>
<p>“Every time [there is] a huge increase we can’t believe it, and then there’s another huge increase,” says Laura Martin, an analyst with investment bank Needham &amp; Co. “The rapidly rising cost of sports, especially the new NFL contracts, increases the likelihood that sports will be forced by the government to be on a different tier within three years, by our estimates.”</p>
<p>Cable industry investment in sporting teams is now becoming a familiar headline.  In early January, the <em>Los Angeles Times</em> <a href="http://latimesblogs.latimes.com/dodgers/2012/01/time-warner-cable-interested-in-dodgers-bid.html" target="_blank">reported</a> Time Warner Cable was considering buying the Los Angeles Dodgers at a price that could exceed $2 billion.  It would compliment two new regional sports cable channels Time Warner plans to launch in southern California featuring the Los Angeles Lakers.</p>

<p><a href="http://stopthecap.com/wp-content/uploads/2010/11/timewarner-twc.jpg"><img class="size-full wp-image-14149 alignleft" title="timewarner twc" src="http://stopthecap.com/wp-content/uploads/2010/11/timewarner-twc.jpg" alt="" width="255" height="115" /></a>While a downturn economy continues to afflict middle and lower income America, it doesn&#8217;t seem to be doing much harm to Time Warner Cable&#8217;s profits.</p>
<p>America&#8217;s second largest cable operator saw profits jump more than $150 million higher to $564 million last quarter, compared to $392 million at the same time the year before.  Time Warner&#8217;s revenue grew by 4% to $5 billion in the fourth quarter alone.  In fact, the company is performing so well, executives announced they would return $3.3 billion in earnings to shareholders through share buybacks and dividend payouts, in addition to the forthcoming $4 billion share repurchase program.  Wall Street liked what they saw, boosting shares 7% after the company posted its quarterly and annual results on its website.</p>
<p>Time Warner&#8217;s biggest success story remains its broadband service, which consistently delivers the company new subscribers and has helped offset the loss of video subscribers, numbered at an additional 129,000 who &#8220;cut the cord&#8221; in the fourth quarter of 2011.</p>
<p>Time Warner Cable earned $1.148 billion in revenue from broadband in the last quarter, an increase of 8.6% over last year.  For 2011, the cable operator earned $4.476 billion selling residential Internet access, also representing an 8.6% growth rate over earnings across 2010.</p>
<p>The company attributed this to &#8220;growth in high-speed data subscribers and increases in average revenues per subscriber (due to both price increases and a greater percentage of subscribers purchasing higher-priced tiers of service).&#8221;</p>
<p>The increased costs incurred by Time Warner Cable to upgrade and expand their network and cable systems were well offset by the aforementioned price increases and subscriber upgrades.  The company increased capital expenditures to $942 million in the last quarter.  Results over the full year show just a 0.2% overall increase in capital investment, now at $2.937 billion.  System upgrades, Time Warner&#8217;s plans to move their systems to all-digital cable television, the ongoing rollout of DOCSIS 3.0, new home security and automation services, and investment in online video and data centers are included in these costs. But a more significant reason for the increase comes from the company&#8217;s ongoing expansion into business services, which requires wiring more office buildings for cable.</p>

<p>Time Warner Cable CEO Glenn Britt led off the conference call with investors with an explanation for the increased expenses.</p>
<p>&#8220;We plan to continue our aggressive growth in business services by expanding product offerings, growing our sales force, improving productivity and increasing our serviceable footprint. This means continued investment, both in people and in capital,&#8221; Britt said. &#8220;Projects include expansion of our content delivery network, which powers our IP video capability, our 2 international headends, completion of DOCSIS 3.0 deployment, and conversion to all-digital in more cities. We expect to be able to accomplish this while maintaining the capital spending of the last 2 years &#8212; that is, between $2.9 billion and $3 billion, which represents a continued decline in capital intensity.&#8221;</p>
<p>Nothing in Time Warner Cable&#8217;s financial disclosures provides any evidence to justify significant changes in their pricing model for broadband, which currently delivers flat rate, unlimited service to customers at different speed rates and price points.  In fact, the company&#8217;s investments in DOCSIS 3.0 upgrades, which can support faster broadband speeds and a more even customer experience, have already paid off with subscriber upgrades.</p>
<p>Robert D. Marcus, president and chief operating officer, noted subscribers are increasingly considering faster (and more profitable) broadband tiers.</p>
<p>&#8220;Once again, high-speed data net adds over-indexed to our higher-speed tiers,&#8221; Marcus noted. &#8220;Roughly 3/4 of residential broadband net adds were Turbo or higher. And DOCSIS 3.0 net adds accelerated for the eighth consecutive quarter to an all-time high of 54,000.&#8221;</p>
<p>Time Warner&#8217;s biggest challenges continue to be the current state of the economy, which has made subscribers much more sensitive to pricing and rate increases, and cord cutting traditional cable television service.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2012/02/sighome.png"><img class="size-full wp-image-23331 alignleft" title="sighome" src="http://stopthecap.com/wp-content/uploads/2012/02/sighome.png" alt="" width="300" height="58" /></a>&#8220;One group is extremely price-conscious, perhaps due in part to the ongoing economic malaise,&#8221; Britt said. &#8220;The other group is willing and able to pay for more features and service. We&#8217;re going to focus more attention on products and services that best meet each group&#8217;s needs rather than pursuing traditional one-size-fits-all solutions.&#8221;</p>
<p>That is clearly evident in the company&#8217;s bundled service options, including increasingly aggressive discounted pricing for new customers and for those threatening to leave and Time Warner&#8217;s super-premium Signature Home service, which delivers super-profits.  Average revenue from Signature Home customers averages $230 a month.  Traditional &#8220;triple play&#8221; customers who buy phone, Internet, and cable service only bring the cable company an average of $150 a month.</p>
<p>The company&#8217;s plans for 2012 do not include a specific statement about implementing an Internet Overcharging scheme like usage billing or usage caps.  But it is unlikely such an announcement would be made explicitly at an earnings announcement.  In the last quarter, <em>Stop the Cap!</em> <a href="http://stopthecap.com/2011/12/06/time-warner-cable-cfo-wants-to-introduce-usage-based-pricing-the-right-way/">reported</a> comments from chief financial officer Irene Esteves that the company was still very interested in the concept of selling broadband with usage pricing as a &#8220;wonderful hedge&#8221; against cord-cutting.</p>
<p>Esteves told a UBS conference she believes usage-based pricing for Time Warner Cable broadband will become a reality sooner or later.  Charging “heavy users” more would already be familiar to consumers used to paying higher prices for heavy use of other services, and she claimed light users would have the option of paying less.</p>
<p>But despite favorable reception to the idea of usage pricing by Wall Street, Esteves acknowledged the company’s past experiments in usage pricing didn’t go as planned, and she suggested the company will introduce usage pricing “the right way rather than quickly.”</p>

<p><strong>Time Warner Beats Up DSL</strong>: Time Warner Cable&#8217;s most lucrative source for new broadband customers comes at the expense of phone companies still relying on DSL to deliver broadband service.  As DSL speeds have failed to stay competitive with cable broadband, the cable operator has successfully lured price-sensitive DSL customers with attractive ongoing price promotions delivering a year of standard 10/1Mbps cable Internet access for $29.99 a month, often less expensive than the total price of DSL service that frequently delivers slower speeds.</li>
<li><strong>Stalled Verizon FiOS deployment</strong> has limited the amount of competition Time Warner faces from fiber optics to just 12% of the company&#8217;s service area.  Where competition does exist, especially in New York State, Time Warner has had to stay aggressive to retain customers with deeply-discounted retention deals to keep up with Verizon&#8217;s high value rebate gift cards and new customer offers.  AT&amp;T now provides U-verse competition in about 25% of Time Warner&#8217;s service area, but like satellite, AT&amp;T U-verse pricing is less heavily discounted.</li>
<li><strong>Retention pricing and new customer deals</strong> deliver lower prices than ever.  In November, Time Warner started selling a triple play offer for $89.99 a month that includes DVR service and now also includes deep discounts or free 90 day trials of premium movie channels. That is $10 less than the same time last year.</li>
<li><strong>Premium movie channels</strong> continue to take a major hit as subscribers try to reduce their bills, especially after Time Warner began increasing rates on those networks.  HBO now sells for as much as $15 a month in many areas.  Time Warner Cable hopes to &#8216;revitalize&#8217; premium movie channels with online video services like HBO and Max Go and promotional discounts.</li>
<li>Long-standing customers of Time Warner&#8217;s &#8220;triple play&#8221; package received a &#8220;thank-you gift&#8221; &#8212; <strong>free voice-mail</strong> in 2011, something that will continue in 2012.</li>
<li>Customers signing up for Time Warner&#8217;s premium-priced Wideband (50/5Mbps) service ($99/month) are being offered <strong>free phone service</strong> to sweeten the deal.</li>
</ul>
<p><em><strong>What to Expect in 2012</strong></em></p>
<ul>
<li>Time Warner is moving forward to create its own Regional Sports Network for southern California;</li>
<li>Los Angeles will continue to see large-scale expansion of Time Warner&#8217;s growing Wi-Fi network, available for free to premium broadband customers, with thousands of new access points on the way;</li>
<li>The cable company will introduce Wi-Fi service in other, yet-to-be-announced cities in 2012, with up to 10,000 access points planned.</li>
<li>Time Warner will be making its &#8220;digital phone&#8221; product more attractive with lower prices and more features, especially in product bundles, as consumers increasingly discard landlines;</li>
<li>Expect to see the end of analog cable television in a growing number of Time Warner Cable areas, requiring customers to use new equipment (initially provided free) to continue watching on older televisions and those without existing set top boxes.</li>
<li>Time Warner will continue to expand its &#8220;TV Everywhere&#8221; project to include live streaming TV on smartphones, video game consoles, computers, and more.  On-demand programming will be available as well sometime this year across all platforms.</li>
<li>A nationwide channel re-alignment will move subscribers to consistent channel numbers across the country, in part based on grouping them together into &#8220;genres.&#8221;  Many areas already have digital cable channels arranged this way, but now they will be consistent from coast-to-coast.</li>
<li>Time Warner will complete DOCSIS 3 deployment in all areas this year.</li>
<li>The company is moving to introduce 2-hour service call windows almost everywhere, and 1-hour windows and weekend appointments in some markets.  Several cities now allow customers to select specific times for service appointments.</li>
<li>Self-install kits will become increasingly available for different products, allowing customers to install equipment themselves;</li>
<li>Time Warner&#8217;s IntelligentHome home security, monitoring, and automation product will expand beyond its launch markets (Syracuse and Rochester, N.Y., Charlotte, N.C. and Los Angeles/Southern Calif.).  The product currently has customers in the thousands, considered relatively small.  But Time Warner has learned subscribers are using the service in surprising ways, which will let them adapt their marketing.  Among the most popular features: remotely watching your pets at home.</li>

<p>&#8220;I just could not believe it was a bargaining thing now,&#8221; said Florence&#8217;s son Randy. &#8220;Whatever happened to the part about where [Time Warner says] we made a mistake [and] we&#8217;ll make it right?&#8221;</p>
<p>Several weeks later, the cable company reneged on its earlier offer and refused to give Florence any credit at all.  WEWS-TV in Cleveland called Time Warner, who produced an invoice they say shows the cable company installed two boxes in her home, and she was not entitled to any refund.  Nichols claims she never used two boxes and was only billed for one.  The cable company records claim they picked up her &#8220;second box&#8221; in 2011.</p>
<p>Nichols is done talking with Time Warner, and is now taking her case to the Ohio State Attorney General and the Better Business Bureau.</p>

<p>Nichols wonders how many other customers are paying for phantom cable equipment and for services they don&#8217;t actually receive.  Cable customers are advised to scrutinize their bills carefully, paying careful attention to equipment rental charges and service fees.  Time Warner generally includes the first set top box in the price of certain cable television packages.  Extra boxes cost more.  DVR equipment can carry an equipment charge and a separate service charge, which can really add up.</p>
<p>The longer you wait to protest a potential billing error, the more difficult it will be to obtain a full refund, even if the problem was the company&#8217;s fault.</p>

<p>Rep. Marilyn Avila (R-Time Warner Cable), the North Carolina representative <a href="http://stopthecap.com/2011/02/17/another-year-another-anti-community-broadband-bill-in-north-carolina/">fronting for the state&#8217;s largest cable company</a>, sure can sing for her supper.</p>
<p>The representative who <a href="http://stopthecap.com/2011/03/08/broken-promises-rep-marilyn-avila-r-time-warner-says-one-thing-in-public-another-in-private/">shilled</a> for North Carolina&#8217;s notorious anti-community broadband legislation was the very special invited guest speaker for the cable industry lobbying association annual meeting, held last August in Asheville, according to <a href="http://stopthecap.com/wp-content/uploads/2012/01/Avila-speaks-to-her-cable-fans.pdf" target="_blank">newly-available lobbying disclosure forms</a> obtained by <em>Stop the Cap!</em></p>
<p>The North Carolina Cable Telecommunications Association reported they not only picked up Marilyn&#8217;s food and bar bill ($290 for the Aug. 6-8 event), they also covered her husband Alex, too.  Alex either ate and drank less than Marilyn, or chose cheaper items from the menu, because his food tab came to just $185.50.  The cable lobby also picked up the Avila&#8217;s $471 hotel bill, and handed Alex another $99 in walking-around money to go and entertain himself during the weekend event.  The total bill for the weekend, effectively covered by the state&#8217;s cable subscribers: $1,045.50.</p>
<p>That&#8217;s a small price to pay to reward a close friend who delivered on most of the cable industry&#8217;s wish-list for 2011.  Besides, the <a href="http://www.charlotteobserver.com/2011/12/07/2833562/time-warner-rates-increase.html" target="_blank">recent cable rate increases</a> visited on North Carolina cable subscribers will more than cover the expense.</p>
<p>Meanwhile, in a separate disclosure, <em>Stop the Cap!</em> has learned Time Warner Cable covered food and beverage costs for members of the North Carolina General Assembly and their staff who attended the Mardi Gras World celebration in New Orleans, sponsored by corporate front group the American Legislative Exchange Council.  ALEC lobbies state legislatures for new laws they claim are grassroots-backed, but are in reality the legislative wish-lists of giant corporate interests, including North Carolina&#8217;s largest cable company &#8212; Time Warner.</p>
<p>The <a href="http://stopthecap.com/wp-content/uploads/2012/01/Alec-event-filing.pdf" target="_blank">food and bar tab</a> totaled just over $130 for the festivities.</p>
<p>Time Warner Cable achieved victory in 2011 passing anti-community broadband legislation through the North Carolina General Assembly, in part <a href="http://www.wxii12.com/r/25615752/detail.html" target="_blank">thanks to new support from the Republican takeover </a>of the state legislature last year.</p>

<p>Time Warner Cable is back again for the third year offering $20,000 in &#8220;dollar-a-holler&#8221; money to write &#8220;research reports&#8221; that meet the cable operator&#8217;s wish-list of current topics of interest.  While the cable company raises rates on customers, some of the proceeds pay for the Time Warner Cable Research Program on Digital Communications, which they say &#8220;awards stipends designed to foster research dedicated to increasing understanding of the benefits and challenges facing digital technologies in the home, office, classroom and community.&#8221;</p>
<p>After <a href="http://stopthecap.com/2010/02/23/time-warner-cable-gets-into-dollar-a-holler-public-policy-game-will-pay-20k-for-essays-parroting-cable-agenda/">tearing through</a> some of the earlier &#8220;award-winning&#8221; reports and topics over the past three years, we find it more an exercise in <a href="http://stopthecap.com/2010/09/22/time-warner-cable-pays-20k-for-report-that-says-fiber-to-the-home-is-our-future/">wasted cheerleading money</a>, particularly when some of the authors <a href="http://stopthecap.com/2011/03/14/dollar-a-holler-industry-lobbyist-attacks-north-carolinas-community-networks/">happen to work for PR astroturf operations and other industry-connected/funded &#8220;think-tanks&#8221;</a> that take money for dubious research and public statements that amplify the paymaster&#8217;s agenda.</p>
<p>It&#8217;s not much of a stretch to figure out exactly what kind of submissions the cable company is looking for after reviewing the <a href="http://www.twcresearchprogram.com/pdf/research-announcement_2012.pdf" target="_blank">topic list</a>.  It&#8217;s a safe bet nothing we&#8217;d have to say to Time Warner would get them to cut us a check for $20K.  In case there is any doubt, we&#8217;ve provided a helpful &#8220;between-the-lines&#8221; analysis of what they are really looking for, should you wish to put pen to paper:</p>
<blockquote><p><em><strong>(1) The end-user experience for broadband services</strong></em><br />
In an increasingly competitive marketplace, more attention is being paid to the consumer experience. For service providers, it is essential to make it simpler and easier for customers to enjoy the benefits of broadband any time, any place, on any device. Key questions include identifying service characteristics consumers consider in evaluating broadband performance, the role of accessibility in design and engineering, how best to encourage innovation in services and business models, the role of pricing and packaging of services, and how best to meet the needs of diverse communities.</p></blockquote>
<p style="padding-left: 30px;"><em>(Between the lines: how can we justify Internet Overcharging customers with usage caps and usage billing and make it sound all-consumery and good-newsy?)</em></p>
<blockquote><p><em><strong>(3) Internet governance</strong></em><br />
Internet governance is still largely framed by the way the Internet existed when it first became a mass-market phenomenon in the late 1990s. But more users rely on advanced digital communications for a diverse set of uses today. Networks and devices are more varied and more powerful than expected, and the Internet now supports a vast range of business models and drives economic growth . In this environment, the role of government and other intermediaries in framing and addressing policy goals continues to change. Key questions include examining the need for new methods of collaboration in multi-stakeholder processes, examining the role of standard-setting, how to measure and assess the performance of the broadband Internet, developing metrics that are meaningful to a wide range of stakeholders (from industry and policymakers to consumers), how to develop new forms of governance that convene stakeholders to solve problems cooperatively, and how to develop guidelines that protect settled expectations as well as enable continuing entry and innovation.</p></blockquote>
<p style="padding-left: 30px;"><em><a href="http://stopthecap.com/wp-content/uploads/2012/01/research.png"><img class="alignright size-medium wp-image-23113" title="research" src="http://stopthecap.com/wp-content/uploads/2012/01/research-300x119.png" alt="" width="300" height="119" /></a>(Between the lines: This whole &#8220;open platform&#8221; free-for-all network the Internet was originally envisioned to be is so yesterday.  How can we convert it into a corporate-controlled playground by convincing legislators our &#8216;investments&#8217; in it should justify our ability to &#8220;coordinate&#8221; it ((a/k/a run, manage, and control)) as we see fit.)</em></p>
<blockquote><p><em><strong>(5) Video Convergence and Internet Video</strong></em><br />
Online video is growing rapidly, comprising an increasing proportion of Internet traffic even as workable business models continue to evolve. Internet video thus increasingly competes with more traditional video services, while at the same time placing extraordinary burdens on the broadband networks owned and operated by those competitors. This emerging development raises a host of issues for video competition and regulation as well as for broadband policy. Key questions include how to identify and respond to the challenges posed by Internet delivery of video, and identifying the marketplace, legal, and policy barriers that stand in the way of innovation in video service delivery.</p></blockquote>
<p style="padding-left: 30px;"><em>(Between the lines: Since we can&#8217;t blame peer to peer traffic for the Internet &#8216;exaflood&#8217; any longer, we&#8217;ve designated online video the new Frankenstein that threatens to run our broadband network into the ground.  How can we stop Internet video from cannibalizing our cable-TV service by limiting access (or charging a bountiful harvest of cash to those who dare to watch too much.) Bonus: Include tips on how we can obfuscate our tissue-paper-thin agenda to slap the caps on from being called out as an abuse of our market power.</em></p>

<p>While Bright House followed Time Warner Cable&#8217;s footsteps this week, introducing long-awaited access to HBO/Max GO for customers who subscribe to one or both premium movie channels, neither cable company is prepared to let you watch the online video service on every available device.</p>
<p>After Time Warner Cable introduced HBO GO, we found the service was not authorized to work on the Roku platform, and Time Warner Cable remains off the list of available providers.  When Bright House Networks introduced the service this week, we quickly learned they do not support the Roku platform either.</p>
<p>We obtained nearly identical statements from HBO blaming the respective cable operators for this missed opportunity:</p>

<p>Would-be customers of Time Warner Cable&#8217;s broadband service in Vienna, a small town in Oneida County, N.Y. are confused about why the cable company will not provide them with broadband service, even though cable company lines pass right over their respective driveways.</p>
<p>Pete Rauscher sees neighbors within a mile away happily using Time Warner&#8217;s Internet service, even though he cannot buy it for himself.</p>
<p>“I’d like to get the service…so do [my neighbors],” Rauscher <a href="http://www.9wsyr.com/news/local/story/Fight-for-high-speed-Internet-service/13SoelJGv0-xEAF657iczQ.cspx" target="_blank">told</a> WSYR-TV in Syracuse. “It isn’t right that somebody within a mile of us has the same cable service, but we don’t.”</p>

<p>The cable company says it would cost at least $17,000 to provide Rauscher with broadband service, an installation fee way out of his budget.</p>
<p>Parts of Oneida County are still without any broadband service, except for those lucky (and wealthy enough) to receive and pay for a wireless 3/4G broadband connection from Verizon Wireless.  That company charges $80 a month for up to 10GB of usage, much more expensive than what Time Warner would charge.  DSL is not provided in that section of Vienna.</p>
<p>Time Warner says it regularly re-evaluates expansion into currently unserved sections of its service area.  Two sections of nearby Camden now receive cable service from the company, partly thanks to new housing developments in the rural region.  But for now, the cable company remains resolute in not serving customers who do not meet its population density test.</p>

<p>Time Warner Cable has opened up access to HBO GO and Max GO to all customers who subscribe to the premium movie channels.  A brief beta test for Time Warner&#8217;s super-premium Signature Home customers concluded earlier this week and the service is now available to all.</p>

<p>The most cumbersome part of both services is the authentication process.  Graceful it is not.  Customers have to start their journey at either the <a href="http://www.hbogo.com">HBO</a> or <a href="http://www.maxgo.com/" target="_blank">Cinemax</a> &#8220;<em>TV Everywhere</em>&#8221; portal, select their cable operator, and then get prompted to authenticate their cable TV service.  Time Warner&#8217;s authentication process makes this especially confusing by notifying customers not to use their bill payment service account username and password.  Instead, customers are told to use login credentials for the cable company&#8217;s customer information and authentication portal &#8212; <em>My Services</em>.  It is easy to get confused which username and password to use.  If you do not have a &#8220;<em>My Services</em>&#8221; account, the registration process is even more tedious, because you have to wait for confirmation e-mail messages and hunt down a current cable bill, if you receive one in the mail at all.</p>
<p>Having registered for other<em> TV Everywhere</em> services from Time Warner Cable before, it was more than a little annoying going through the same process all over again for HBO.  HBO and Max GO also require the subscriber to choose a username and password on those sites as well, which means yet another account and password to remember.  After about 10 minutes of the irritating multi-step process, access was finally granted.</p>
<p>HBO Go currently has 230 movies available for instant viewing, a large number of which are hardly recent.  The 1953 version of <em>Titanic</em>, for example.  Really?  <em>Oh, God</em> with George Burns and John Denver, the 1979 please-edit-me snoozefest <em>Star Trek: The Motion Picture</em>, and all three <em>Back to the Future</em> movies seemed like a lot of dated filler material for a $15 a month premium movie channel.  Better offerings were found under the series, specials, and comedy categories which delivered a full library of a number of HBO productions, as well as current events shows like <em>Real Time with Bill Maher</em>.  (The latter only included a handful of episodes from the current season and some earlier editions.)</p>
<p>Our biggest trouble came when we tried playing from the menu of titles.  This is no Netflix.  We found picture quality often lacking, with plainly visible screen anomalies, and the stream was interrupted several times for buffering.  Either pent-up demand for HBO Go is causing Time Warner customers to pound the service during the business day, or HBO needs to beef up its server capacity. We did several speed tests and found our connection stable at 30/5Mbps, so this was not a Time Warner Cable broadband problem.</p>
<p>The best part about HBO and Cinemax GO is that it comes free with subscriptions to one or both channels.  We&#8217;d have a hard time justifying paying extra for the current online viewing experience.  It also remains ironic that Time Warner Cable executives continue to foster a desire to implement Internet Overcharging schemes like usage caps and/or consumption billing while encouraging customers to consume more bandwidth with online video services such as these.</p>
<p>Time Warner Cable partner Bright House Networks is anticipated to launch both services themselves shortly.</p>

<p>Republican FCC Commissioner Robert McDowell <a href="http://thehill.com/blogs/hillicon-valley/technology/203879-fcc-commissioner-questions-whether-comcast-misled-regulators" target="_blank">is questioning</a> whether Comcast misled the federal agency when the cable company acquired wireless spectrum it now says it had no intention of ever using.</p>
<p>McDowell was reacting to Comcast chief financial officer Michael Angelakis, who admitted this week his company really never had any interest in competing in the wireless space.</p>
<p>“Were they purchased under false pretenses?” McDowell asked.</p>
<p>Comcast has since sold their acquired spectrum to Verizon Wireless, which in Angelakis&#8217; view makes sense.</p>
<p>“We never really intended to build that spectrum, so therefore it’s a really good use of that spectrum,” Angelakis said.</p>
<p>That admission puts Comcast in a difficult position, because FCC rules mandate that companies acquiring scarce wireless spectrum make a good faith effort to use it.  In McDowell&#8217;s view, had Comcast never intended to put the frequencies to use, the FCC probably would have disallowed the acquisition.</p>
<p>Verizon Wireless also plans to pick up unused spectrum originally acquired by Time Warner Cable in a deal that would let both companies cross-promote cable and wireless products and avoid head-on competition.</p>
<p>Both Comcast and Time Warner Cable have warehoused unused spectrum for several years.  Neither company appeared serious about building competing wireless networks, and with the spectrum off the market, would-be competitors couldn&#8217;t launch service either.</p>
<p>Verizon agreed to pay $3.6 billion to acquire the cable industry-owned spectrum, which it intends to use to bolster its LTE 4G network.</p>
<p>The FCC is now seeking public input on whether it should approve the spectrum sale. The Justice Department is also considering its antitrust implications.</p>
