<p><strong>DirecTV&#8217;s Phantom Gift Cards: The Promised Rebate That You Qualify For, Until You Don&#8217;t</strong></p>
<p>Satellite TV companies are increasingly aggressive pitching discounts and rebates to win customers away from traditional cable TV or the phone company&#8217;s new IPTV service.  In addition to cheap teaser rates, many providers also sweeten the deal with high value rebate cards for customers signing multi-year service contracts.</p>
<p>Local resident Michael was attracted to DirecTV&#8217;s $200 Visa card rebate offer and signed up for satellite service.  Weeks later, with no rebate card in hand, he called the company to find out why, only to be told he did not qualify.  When Michael tried to cancel service because the company didn&#8217;t deliver what it promised, the customer service representative informed him he would owe $480 in early cancellation penalties.</p>

<p>DirecTV initially stonewalled KJRH when they called on Michael&#8217;s behalf, eventually claiming he was told he did not qualify for a rebate a week after signing up for service.  But when KJRH asked to hear a recording of the call DirecTV routinely makes when customers sign up for service, they changed their tune.</p>
<p>&#8220;The next day, we were told Michael had been given the wrong information about the promotion and he could cancel without that $480 penalty,&#8221; the Problem Solvers&#8217; team reports.</p>
<p>Michael says it is important to get everything in writing &#8212; including the names of representatives you speak with &#8212; because that can make all the difference when a company tries to squeeze out of its own promotional promises.  He&#8217;s now an ex-DirecTV customer for free, and decided to watch his favorite shows over local broadcast TV.</p>

<p><strong>Suddenlink: Suddenly Owe $400 in April for Service You Canceled In January</strong></p>
<p><a href="http://stopthecap.com/wp-content/uploads/2010/02/suddenlink-logo.gif"><img class="alignleft size-full wp-image-7734" title="suddenlink logo" src="http://stopthecap.com/wp-content/uploads/2010/02/suddenlink-logo.gif" alt="" width="190" height="60" /></a>Tulsa resident Lucille got the shock of her life this month when she opened a bill from Suddenlink charging her $400 for cable service she canceled in early January.</p>
<p>The past due bill came without warning and Lucille says she never received any phone call, bill, or letter notifying her charges were still accumulating on her account.</p>
<p>When she called Suddenlink, they told her that service was never discontinued, and she owed the money.</p>
<p>Lucille may have been born at night, but not last night.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2012/04/398.png"><img class="alignright size-full wp-image-25084" title="398" src="http://stopthecap.com/wp-content/uploads/2012/04/398.png" alt="" width="259" height="156" /></a>Angered by Suddenlink&#8217;s intransigence, she called KJRH for help.  The station went to the top &#8212; calling Suddenlink&#8217;s corporate headquarters.</p>
<p>In short order, a company representative researching the dispute found Lucille&#8217;s cancellation request, as well as the customer service representative who never processed it.</p>
<p>That representative will be attending Customer Service 101 re-training classes, and a company executive called Lucille directly to apologize.</p>
<p>Not only that, a local Tulsa Suddenlink worker arrived with a $100 refund check &#8212; the credit balance owed her for service she paid one month ahead to receive.</p>
<p>While both Lucille and Michael benefited from the threat of both companies being portrayed in a bad light on the evening news, an unknown, uncounted number of customers may not win similar satisfaction.</p>
<p>Many customers simply give up pursuing unpaid rebate promotions (or forget about them altogether), and DirecTV&#8217;s nearly $500 early termination fee is a strong incentive to grudgingly stay with the satellite provider until your contract runs out.  Lucille, 88 years old, was not going to be intimidated by Suddenlink&#8217;s insistence she owed the money (or the implications of being called a past due deadbeat &#8212; an especially scandalous notion for older Americans).</p>
<p>Both consumers did something else: they wrote down names, times, and dates of their communications with the companies.  That can go a long way to winning satisfaction. So can filing complaints with the Better Business Bureau, which can usually prompt a contact from a higher-level customer service representative more willing to give a complaining customer the benefit of the doubt.</p>

<p>Comcast and Time Warner Cable collectively picked up more than 1.5 million new customers in 2011, with most of the growth coming from dissatisfied DSL subscribers seeking better broadband speeds.</p>
<p>Leichtman Research Group, Inc. (LRG) found the eighteen largest cable and telephone providers in the US &#8212; representing about 93% of the market &#8212; acquired 3 million net additional high-speed Internet subscribers in 2011. Annual net broadband additions in 2011 were 88% of the total in 2010.</p>
<p>The top broadband providers now account for 78.6 million subscribers &#8212; with cable companies having over 44.3 million broadband subscribers, and telephone companies having over 34.3 million subscribers.</p>

<p>Despite AT&amp;T&#8217;s position as the second largest Internet Service Provider in the country, the company only picked up 117,000 new customers in 2011.  In contrast, Time Warner Cable, with 6 million fewer customers, added almost a half-million new broadband subscriptions last year.</p>
<p>Frontier Communications, which made broadband a primary target for expansion, has not seen considerable growth either.  The company only added just short of 38,000 new broadband customers last year, almost all getting DSL, often at speeds of 1-3Mbps.</p>
<p>Other key findings include:</p>
<ul>
<li>The top cable companies netted 75% of the broadband additions in 2011;</li>
<li>The top cable companies added 2.3 million broadband subscribers in 2011 &#8212; 98% of the total net additions for the top cable companies in 2010;</li>
<li>The top telephone providers added 750,000 broadband subs in 2011 &#8212; 68% of the total net additions for the top telephone companies in 2010;</li>
<li>In the fourth quarter of 2011, cable and telephone providers added 765,000 broadband subscribers &#8212; with cable companies accounting for 82% of the broadband additions in the quarter.</li>

<p>&#8220;Despite a high level of broadband penetration in the US, the top broadband providers added 88% as many subscribers in 2011 as in 2010,&#8221; said Bruce Leichtman, president and principal analyst for Leichtman Research Group, Inc. &#8220;At the end of 2011, the top broadband providers in the US cumulatively had over 78.6 million subscribers, an increase of nearly 25 million over the past five years.&#8221;</p>
<p>Americans are increasingly treating broadband as an essential &#8220;utility&#8221; service, as fundamental as electricity or clean water.</p>
<p>The majority of consumers who lack the service either consider it irrelevant in their lives (a factor that increases with the age of the surveyed respondent), cannot obtain service from their provider because of their location, or cannot afford the service.</p>

<p>At least one major national cable company plans to implement a usage-based billing system in the coming year, predicts Sanford Bernstein analyst Craig Moffett.  <em>Bloomberg News</em> <a href="http://www.bloomberg.com/news/2011-11-30/netflix-viewing-seen-swelling-u-s-cable-bills-next-year-tech.html" target="_blank">quotes</a> Moffett in a piece that thinly references Time Warner Cable as that operator, whose CEO <a href="http://stopthecap.com/2011/06/07/time-warners-glenn-britt-the-marie-antoinette-of-cable-rate-hikes-metered-internet-in-your-future/">strongly believes in further monetizing broadband usage</a>.</p>
<p>Moffett is among the chief cheerleaders hoping to see operators charge customers additional fees for their use of the Internet.</p>
<p>“In the end, it will be the best thing that ever happened to the cable industry,” Moffett said.</p>
<p>For customers, DISH Satellite chairman Charlie Ergen predicts it will lead to at least a $20 monthly surcharge for broadband users who watch online video, which could bring already sky-high broadband pricing to an unprecedented $70-80 a month, the same amount most cable operators now charge for standard digital cable-TV service.</p>
<p>The cable industry&#8217;s interest in being in the cable television business has waned recently as subscribers increasingly turn away from expensive cable packages.  Now companies that used to consider broadband a mildly-profitable add-0n increasingly see Internet access as the new mainstay (and profit center) of their business.</p>
<p>Time Warner Cable, for example, wasn&#8217;t even sure its entry in the broadband business in the late 90s would ever amount to much.  Fast forward a dozen years, and it is an entirely different story:</p>
<p>“We’re basically a broadband provider,” Peter Stern, chief strategy officer for New York-based Time Warner Cable, said Nov. 17 at the Future of Television conference in New York. “As a convenience for our customers, we package and distribute television and provide service around that.”</p>
<p><em>Bloomberg</em> reports the cable industry profit margin on broadband is nearly 95 percent, a testament to the lack of competitive pressure on Internet pricing.  The industry is going where the money is to make up for increasing challenges to their video business, which currently &#8220;only&#8221; brings them a 60 percent profit margin.</p>
<p>Suddenlink, already enjoying a 12 percent increase in broadband revenue in the last quarter alone, is <a href="http://stopthecap.com/2011/09/29/suddenlink-introducing-usage-capsinternet-overcharging-nationwide-1050gb-overlimit-fee/">implementing its own Internet Overcharging scheme</a>, charging $10 for every 50GB a customer exceeds their arbitrary usage allowance.  That, despite the fact CEO Jerry Kent admits Suddenlink&#8217;s broadband margins are double those earned from the cable company&#8217;s video business.</p>
<p>Complicit in the parade to Internet Overcharging is Federal Communications Commission chairman Julius Genachowski, who publicly supported usage-based pricing in public statements made last December.  Cable operators were fearful Genachowski might lump the pricing scheme in with the Net Neutrality debate.  Providers have since used Genachowski&#8217;s loophole in an end run around Net Neutrality.  If providers cannot keep high volume video traffic from competitors like Netflix off their networks, they can simply make using those services untenable on the consumer side by increasing broadband pricing, already far more expensive than in other parts of the world.</p>
<p>That is a lesson already learned in Canada, where phone and cable companies routinely limit usage and slap overlimit fees on consumers who cross the usage allowance line.  Canada&#8217;s broadband ranking has been deteriorating ever since.</p>

<p><em>Bloomberg</em> says such a pricing regime would discourage investment in online video products that currently are held responsible for some cable cord-cutting:</p>
<p>“It’s the reason why Apple or Google would inevitably be reticent about committing a significant amount of capital to an online video model,” Moffett told <em>Bloomberg</em>. “You can’t simply assume just because you can buy the content more cheaply, you can offer a product that’s cheaper to the end user.”</p>
<p>The only way around this might be video providers like Google getting into the broadband business themselves, something Google is experimenting with in Kansas City.  Google&#8217;s &#8220;Think Big With a Gig&#8221; project is partly designed to prove gigabit broadband delivered over a fiber network is practical and doesn&#8217;t have to be unaffordable for consumers.  It will also finally bring competitive pressure on a comfortable broadband duopoly, at least for residents in one city.</p>
<p>So far, video providers who depend on an Internet distribution model are not putting much money in the fight against usage-billing.  Instead, companies like Netflix are releasing occasional press releases that decry the practice.</p>
<p>“[Usage billing] is not in the consumer’s best interest as consumers deserve unfettered access to a robust Internet at reasonable rates,” Steve Swasey, a Netflix spokesman, said previously.</p>
<p>It is clear consumers despise usage pricing.  In every survey conducted, a majority of respondents <a href="http://gigaom.com/2008/09/29/no-surprise-survey-shows-us-consumers-hate-broadband-caps/" target="_blank">oppose limits on their broadband usage</a>, especially at today&#8217;s prices.  But that may not be enough to get companies like Time Warner Cable to back off.  The company has reportedly <a href="http://stopthecap.com/2011/06/17/time-warner-cable-installing-metering-technology-ceo-claims-company-not-sure-if-it-will-use-it/">been quietly testing usage meters</a> since last summer.  CEO Glenn Britt, with a considerable drumbeat of support from Wall Street analysts like Mr. Bernstein, has never shelved the concept of usage pricing, seeing it more lucrative than hard usage caps.  The company retreated from a 2009 plan to <a href="http://stopthecap.com/2009/04/09/another-statement-from-time-warner-sit-down-for-this-one/">charge up to $150 a month for flat rate access</a> after consumers rebelled over planned trials in Texas, North Carolina, and New York.</p>
<p>But without a solid message of opposition from consumers, and an about-face from an FCC chairman that should know better, they&#8217;ll be back looking for more money soon enough.</p>

<p>Allen&#8217;s chart points out that for large file transfers like movies, TV shows, and major software updates, consumers actually get more value on a per-GB basis burning those shows and software to a traditional or dual-layer (DL) DVD, and dropping them in the mailbox.</p>
<p>While prices for service may vary, so do Internet Overcharging schemes.  If a customer reaches their monthly limit one time too many, they <em><strong>will</strong></em> be relying on the post office to move files back and forth because companies like Comcast and Cox will terminate their service.  Other providers, like AT&amp;T and Suddenlink, are content to simply send the customer a bill with overlimit charges on it.</p>
<p>With a marketplace duopoly, ineffective government oversight, and ever-increasing prices, the U.S. Post Office may still be in the running after all, thanks to <em>Back to the Future</em>-pricing from your ISP.</p>

<p><em>Stop the Cap!</em> has learned Suddenlink will establish usage allowances nearly identical to AT&amp;T for their broadband customers, with a $10 overlimit fee for each 50GB customers manage to exceed their limits.</p>
<p>Suddenlink officials have declined to comment on <em>Stop the Cap!&#8217;</em>s report published yesterday.</p>
<p>The usage caps, which will first be implemented on customers in Amarillo, Tex., are as follows:</p>
<ul>
<li>150GB per month for customers subscribing to &#8220;lite&#8221; tiers of less than 10Mbps, similar to what AT&amp;T limits its DSL customers;</li>
<li>250GB per month for 10, 15, or 20Mbps customers, similar to AT&amp;T U-verse;</li>
<li>350GB per month for premium-priced 50 or 107Mbps service packages.</li>
</ul>
<p>Suddenlink says they expect less than 1% of their customers to exceed the monthly limits.  If they do, they will receive warnings three times before the overlimit fee is imposed.</p>
<p>&#8220;It could have been worse, but there doesn&#8217;t seem to be any justification for these limits other than the fact their biggest competitor in Texas &#8212; AT&amp;T &#8212; has them,&#8221; says Amarillo resident and <em>Stop the Cap!</em> reader Angel.</p>
<p>&#8220;It&#8217;s another example of what happens when you live in a country that allows broadband duopolies,&#8221; Angel says. &#8220;Just like with cell phones, as soon as AT&amp;T does something, their competitors follow suit and the customers are stuck paying more and more for less and less service.&#8221;</p>
<p>Angel says the first time he is billed an overlimit fee of any kind, he&#8217;ll downgrade his broadband service.</p>
<p>&#8220;Why pay for premium priced speed tiers when usage caps make them not worth the extra money?&#8221;</p>

Oct. 3rd, according to a company document obtained by <em>Stop the Cap!</em>  But the new usage cap and overlimit fee scheme will not be limited to Texas.  The company&#8217;s <a href="https://docs.google.com/document/d/186XJSq4PC1RBobEmYGYWHr3EG00x0MuMBoXU4NKhkbo/edit?hl=en_US" target="_blank">internal memo</a> notes the new limits will eventually be imposed on customers nationwide, and incredibly, the cable operator claims it will make their Internet service better:</p>
<blockquote><p>Early next month, October 2011, Suddenlink will notify residential (non-business) Internet customers in Amarillo, Texas, of a new usage allowance plan (AP) that is designed to further enhance their Internet experience.</p>
<p>This allowance plan will be introduced to other residential Internet customers, in other Suddenlink communities, in the following weeks and months.</p>
<p>An introductory letter will be mailed to Suddenlink residential Internet customers, when our allowance plan goes into effect in their community. The introductory letter to Amarillo customers will be mailed on or about October 3, 2011.</p>
<p>In addition to the introductory letter noted above, we will launch a new Web page on or about October 3, 2011, at <a href="http://suddenlink.com/allowanceplan" target="_blank">suddenlink.com/allowanceplan</a>.</p>
<p>This new page will provide additional information about the allowance plan in the form of frequently asked questions (FAQs).</p></blockquote>

<p>On the first instance of exceeding the limit, the customer&#8217;s Internet service will be suspended until the customer reads and agrees to a web notification message that includes an understanding that on the fourth instance of going over their usage cap, customers will be billed $10 for every 50GB increment that exceeds their allowance, whether it is by 1MB or 40GB.  That pricing is identical to AT&amp;T&#8217;s usage cap overlimit fee.</p>
<p>Amarillo residents already pay $55 a month for 15Mbps standalone broadband service from Suddenlink.</p>
<p><em>Stop the Cap!</em> reached out twice today to Suddenlink officials to get their reasons for implementing the usage allowance program, what the specific allowances might be, and when the usage caps will reach markets beyond Amarillo.  We have still not heard back from them as we &#8220;go to press&#8221; but will update the piece if and when we do receive their comments.</p>
<p>Suddenlink&#8217;s employees are being trained on how to handle the inevitable complaints when customers discover their bills have suddenly increased.  Their employee FAQ:</p>
<blockquote><p><em>Q. I only went over my allowance by 1 gigabyte, but I was still charged $10. I thought I would not be charged $10 until I was 50 gigabytes over my allowance. What happened?</em></p>
<p>Of the very few customers who go over their monthly allowance, we have found that most go over by a significant amount. Accordingly, to make this process as fair and simple as possible on all customers, we do not start charging until the third time someone goes over the allowance – and, once that happens, we automatically assign additional allowances to the account, in standard 50-gigabyte installments, at a standard price of $10 for each installment.</p>
<p>Customers can use all or some of that additional allowance, depending on their individual situations. What’s more, if they exceed the additional allowance of 50 gigabytes, another 50-gig allowance is automatically applied, again at the standard price of $10.</p>
<p>To help customers manage their Internet accounts, we have provided a way for them to monitor their monthly usage at Suddenlink.net.<br />
• If you’re already registered at Suddenlink.net, log on, go to “My Account,” and then click the link for “My Internet Usage Summary.”<br />
• If you’re not already registered at Suddenlink.net, visit that site, look toward the upper right corner for the log-in box and the link that reads “Don’t have an account? Sign up now!” Follow that link to a set of instructions on how to register your account, and then, when you’re finished, click the link for “My Internet Usage Summary.”</p>

<p>Finally, we offer some tips at <a href="http://suddenlink.com/allowanceplan" target="_blank">suddenlink.com/allowanceplan</a>, about ways to keep usage within the monthly allowances we’ve established.</p>
<p><em>Q. Can I have fewer than 50 gigabytes or less than $10.00 applied to my account the next time I go over?</em></p>
<p>Not at this time. The 50-gigabyte installments and $10 per installment charges have been standardized in all areas where we’ve rolled out this allowance plan, to make the process as fair and simple as possible on all customers.</p>
<p><em>Q. I don’t recall being notified that this was starting in my area. When did that happen?</em></p>
<p>We mailed letters announcing this change to all customers in your area several weeks before the allowance plan was put into place. I’m sorry if you missed that letter, but rest assured, very few customers – less than 1 out of every 100 – go over their allowance. And for the very few customers who do go over their allowances, charges are waived the first couple of times.</p>
<p><em>Q. What gives Suddenlink the right to do this?</em></p>
<p>We occasionally make changes to our Internet services, consistent with our Residential Services Agreement, which is published on our website. This allowance plan is one of those changes.</p>
<p>If asked: To view our Residential Services Agreement, go to Suddenlink.com, and look for a link near the bottom of the page titled, “Terms &amp; Policies.” Click on that link and then look for another link titled, “Residential Services Agreement.” Click on that link and then scroll down the page until you see the sections related to Internet service, such as Section 46.</p></blockquote>
<p>Suddenlink&#8217;s new Internet Overcharging website is not yet active, so we are unsure exactly what plan limits will be, but Suddenlink has been no stranger to usage caps.  The company <a href="http://stopthecap.com/2009/07/23/suddenly-caps-suddenlink-introduces-usage-measuring-tool-to-help-customers/">introduced a usage meter</a> in several markets in the summer of 2009, and <a href="http://stopthecap.com/2010/02/12/suddenlink-to-boost-internet-speeds-in-lubbock-and-midland-texas-new-362-mbps-tier-also-on-the-way/">used to claim usage limits were partly to handle traffic loads on a limited number of cable systems that were in the process of upgrading</a>.  Once the upgrades were complete, the caps were supposed to be relaxed or retired.</p>
<p>Then, Suddenlink president and CEO Jerry Kent appeared on CNBC last September to announce that <a href="http://stopthecap.com/2010/09/01/suddenlink-cable-ceo-people-dont-realize-the-days-of-cable-company-upgrades-are-basically-over/">people don&#8217;t realize the days of system upgrades are over and it was time to rake in the profits</a>:</p>
<p>“I think one of the things people don’t realize [relates to] the question of capital intensity and having to keep spending to keep up with capacity,” Kent said. “Those days are basically over, and you are seeing significant free cash flow generated from the cable operators as our capital expenditures continue to come down.”</p>
<p>Suddenlink&#8217;s journey to usage caps includes all the hallmarks <a href="http://stopthecap.com/2009/07/23/suddenly-caps-suddenlink-introduces-usage-measuring-tool-to-help-customers/">we foretold in an article published on <em>Stop the Cap!</em> in 2009</a>:</p>
<ol>
<li><em><strong>Establish a foundation for usage caps.</strong></em>  In their 2009 FAQ, Suddenlink <a href="http://stopthecap.com/2009/07/23/suddenly-caps-suddenlink-introduces-usage-measuring-tool-to-help-customers/">conflated broadband usage with electricity</a>:<em> &#8220;What is “Internet usage”?</em><em>  Much like electric usage is measured in kilowatts, and water usage is measured in gallons, Internet usage is measured in gigabytes (GB).&#8221;</em></li>
<li><em><strong>Establish a ‘pulled from the air’ number of gigabytes (which often conveniently later becomes your usage allowance) and then tell subscribers what they can do with that.</strong></em>  In Humboldt County, Calif., in March 2011, Suddenlink began telling &#8220;heavy users&#8221; what other customers were doing with what the company deemed a more appropriate, average amount of Internet service.  Suddenlink <a href="http://stopthecap.com/2011/03/03/suddenlink-the-good-the-bad-and-the-ugly-digital-conversion-usage-meters-more/">also told customers the Internet service they were providing was for &#8220;entertainment only.&#8221; </a></li>
<li><em><strong>Tell customers such tools are actually for their benefit.  </strong></em>See above.<strong><br />
</strong></li>
<li><em><strong>Lie to customers when a usage meter suddenly shows up or terms and conditions are quietly changed to support an Internet Overcharging scheme. </strong></em> In 2009, Suddenlink introduced a usage meter but tried to reassure customers, <a href="http://stopthecap.com/2009/07/23/suddenly-caps-suddenlink-introduces-usage-measuring-tool-to-help-customers/">telling them</a>: &#8220;<em><em>Does Suddenlink plan to set a maximum usage allowance for its Internet customers, like other companies are doing? Do you plan to charge extra if a customer’s usage is too high?  T</em></em><em><em>hose steps are not part of our current plan. Our only goal at this time is to help the few customers whose usage is well above (two to three times higher than) the typical range to identify the reasons for that high usage and take steps to protect and secure their computers and accounts.&#8221;</em></em></li>
</ol>

<p>Now usage caps will protect and enhance Suddenlink&#8217;s profits on Internet service.  Remarkably, Suddenlink put itself in the &#8220;predicament&#8221; of facing increased customer demand of the Internet through its own marketing.  The company&#8217;s website <a href="http://www.suddenlink.com/internet/" target="_blank">heavily promotes</a> its bandwidth-heavy Suddenlink2GO™ service to &#8220;watch TV online anytime, anywhere in the U.S. on any computer for FREE when you subscribe!&#8221;</p>
<p>But &#8220;free&#8221; becomes $10 for every 50GB if you watch too much.</p>
<p><em><strong>How to Get Unlimited Back</strong></em>: If you are a Suddenlink residential customer who does not want to face restricted-use Internet, you can avoid the limits by switching to Business Class service, which will not have caps.  Unfortunately, pricing information was not immediately available to us.  One customer in Lubbock <a href="http://www.dslreports.com/forum/r26356375-Rant-Suddenlinks-Bandwith-Limit-Policy" target="_blank">noted</a> he paid $69 a month for 6Mbps Business Class service and $107 a month for 107Mbps residential service, so expect to pay comparatively more for lower speed service.</p>

<p>The new <em>TV Everywhere</em> app, available for phones and tablets, comes free of charge.  Once authenticated as a legitimate pay television subscriber, users can watch hit series and some older shows from both networks.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2011/09/tbs.jpg"><img class="alignleft size-medium wp-image-20861" title="tbs" src="http://stopthecap.com/wp-content/uploads/2011/09/tbs-300x168.jpg" alt="" width="300" height="168" /></a>Once again, Time Warner customers are on the outside, looking in.  The nation&#8217;s second biggest cable operator has not been a <em>TV Everywhere</em> team player, preferring to launch its own live streaming iPad application and steering clear, so far, from on-demand, online viewing from most of its partner networks, including HBO.  Time Warner Cable executives have, in the past, alluded to licensing fees and user authentication complications for not launching <em>TV Everywhere</em> on-demand viewing for its customers, but the company has not explained why it has not signed on for Turner&#8217;s app.</p>
<p><em>TV Everywhere</em>, a concept on the drawing board for almost two years, is an attempt by the pay television industry to lock down online video programming for paying customers, in an effort to slow down &#8220;cord cutting&#8221; by consumers trying to save money on their cable TV bill.  The concept delivers unlimited access to popular cable programming, but only to those who already pay to subscribe.</p>
<p>Many <em>TV Everywhere</em> projects have been soft-launched without much publicity, but that is not true for Turner&#8217;s app.  The network has commissioned several clever advertisements featuring various network stars promoting the app, and now Turner wants to educate consumers about how to use it to watch shows online.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2011/09/TNT-Logo.gif"><img class="alignright size-medium wp-image-20863" title="TNT-Logo" src="http://stopthecap.com/wp-content/uploads/2011/09/TNT-Logo-300x298.gif" alt="" width="113" height="113" /></a>The most complicated part of the process is getting &#8220;authenticated&#8221; by the application for authorized viewing.  Some cable companies like Time Warner want customers to launch access to <em>TV Everywhere</em> programming from the cable company&#8217;s website, where customers have already been authenticated when they sign up for an online account.  Other companies are using customer account numbers, PIN codes, or passwords printed on monthly bills to let customers register directly for access.  When the application matches a customer account number or PIN code, the content becomes accessible.  It is typically a one-time-only hassle, but there have been cases where customers have had to grab a recent bill more than once to re-authenticate themselves.</p>
<p>Not every show will be made available for online viewing.  Many rerun off-network shows shown on TNT and TBS don&#8217;t currently include streaming rights.  So while users can watch past episodes of <em>Conan O&#8217;Brien</em>, they&#8217;re out of luck if they want to watch <em>Friends</em>.</p>

<p>In parts of Suddenlink&#8217;s service area, particularly in Texas, the company is moving most of its cable service to a digital platform.  This transition is designed to open up additional space for more HD channels, keep up with broadband demands, and open the door for additional on-demand programming.</p>
<p>In Nacogdoches, Suddenlink announced it was adopting an all-digital TV lineup.  Starting this week, the company is offering subscribers free digital adapters &#8212; also known as &#8220;DigitaLinks,&#8221; to enable continued viewing on analog television sets that do not have a set top box or digital tuning capability.  Every subscriber purchasing more than the broadcast basic package (that only includes local stations and a handful of cable networks) will either need a digital tuner-ready television, a set top box, or a DigitaLink device to continue watching.</p>
<p>What is good about this transition is that Suddenlink is not charging customers a monthly fee for the adapters, either now or in the future.  That contrasts with other cable companies like Comcast and Time Warner Cable that have handed customers a set top box or a digital adapter they will begin charging for after a year or two.</p>
<p>Suddenlink expects to invest nearly $120  million this year in Texas, and by the end of the year will have  invested nearly a half-billion dollars in the state since 2006.</p>
<p>Texas is extremely important to Suddenlink.  The third largest cable company in Texas serves about 450,000 households  and approximately 27,000  business customers in Amarillo,  Lubbock, Abilene, Bryan-College Station,  Midland, San Angelo,  Georgetown, Tyler, Victoria, Conroe, Kingwood and  Nacogdoches.</p>

<p>The company has also lit new fiber connections to handle data communications, primarily for business customers, and is upgrading its broadband service to fully support DOCSIS 3, which will deliver faster speeds and less congested service.</p>
<p>Customers in the state are also among the first to get access to a new and improved DVR box built on a TiVo software platform.  Suddenlink&#8217;s &#8220;Premiere DVR&#8221; service ($17/mo) is now available in Midland, Floydada, Plainview, Amarillo, Canyon, and Tulia.</p>

<p>Do you take your broadband service seriously, or is it simply another entertainment option in your home?  If you answered the latter, this story may not be so surprising.</p>
<p>In Humboldt County, Calif., broadband users started noticing their favorite web pages stopped updating on a regular basis.  At one point, a blogger in McKinleyville noticed he couldn&#8217;t manage to post comments on his own website.  But things got much worse when several web pages started reaching customers with other users&#8217; names (and occasionally e-mail addresses) already filled in on login screens and comment forms.</p>
<p>It seems Suddenlink started to cache web content in the far northern coastal county of California, meaning the first customer to visit a particular website triggered Suddenlink&#8217;s local servers to store a copy of the page, so that future customers headed to the same website received the locally-stored copy, not the actual live page.</p>
<p>But the caching software went haywire.</p>
<p>Web visitors began to receive mobile versions of web sites even though they were using home computers at the time.  Some were asked if they wanted to download a copy of a web page instead of viewing it.  And many others discovered websites were customized for earlier visitors.</p>
<p>While the caching problem was irritating, the privacy breaches Suddenlink enabled were disturbing, as was the initial total lack of response from Suddenlink officials when the problem first started in late January.</p>
<p>The <em>Journal</em> finally reached a representative who provided this explanation:</p>
<blockquote><p>Suddenlink Senior Vice President of Corporate Communications Pete  Abel knew that a cache system had recently been installed in Humboldt  County, but was unaware of the particular problems reported by users.  After speaking with the <em>Journal</em> and other Suddenlink employees, though, he released a statement explaining what appeared to have happened.</p>
<p>According  to the release, the cache system was installed in Humboldt County on  Thursday, Jan. 27 — the very day that users began experiencing problems —  and was intended as an interim solution to relatively low Internet  speeds in Humboldt County. The system, it said, was able to cache only  unsecure websites — those which, unlike almost all reputable banking or  commerce systems — do not encrypt communications. But the company  eventually discovered the problems that its customers had been reporting  and, having fruitlessly worked with its vendor to find a solution,  turned the system off on Monday.</p>
<p>“The good news is that secure Web site pages will not have been cached,” Abel said in a follow-up call to the <em>Journal</em>. “And I have been assured 100 ways from Sunday that never would have happened.”</p></blockquote>
<p>Andrew Jones, who runs a blog with his Suddenlink broadband account, tried to opt out of the web caching and received an interesting response, in writing, from a Suddenlink representative.  He was told he could not opt out of cached web pages with a residential account because, &#8220;<em><strong>the residential service is for entertainment only.</strong></em>&#8221;</p>
<p>Jones was told he would have to upgrade to a business account to escape the cache.</p>
<p>“If a small local radio station intermittently went off air for multiple  days, the radio host would be apologizing and explaining the  situation,” Jones wrote the <em>Journal</em>. “If a large utility  company experienced sporadic power outages, people could hear a  recording on a toll-free number to learn the cause and about ongoing  repairs. What does an Internet provider do when web access becomes  spotty and begins serving customers old copies of web pages? The company  gets back to you in a couple days and suggests you pay more if you  don’t like its recently degraded services.”</p>
<p><strong>The Ugly &#8212; Suddenlink&#8217;s New Usage Meter Suggests 43GB is An Appropriate Amount of Usage for Standard Internet, 87GB is Plenty for Their $60 Premium Package</strong></p>
<p>Although Suddenlink has not formally adopted an Internet Overcharging scheme of usage caps or metered billing, the company is sending automated e-mail messages to customers who exceed what they call &#8220;typical monthly usage for customers in your package.&#8221;  The e-mail tells customers they may be infected with a virus or someone else could be using your connection without your permission.  Boo!  For the uninitiated, this kind of message can bring fear that their computer has been invaded, either with malicious malware or the neighbor next door.</p>
<p>Customers have also received letters in the mail from the company telling them to check out their new &#8220;usage meter.&#8221;  Several <a href="http://www.dslreports.com/forum/r25551338-I-got-a-fancy-usage-graph-thing-now" target="_blank">have been sharing</a> how much they&#8217;ve racked up in usage during the month on <em>Broadband Reports</em>.  One customer managed 243GB while another looking at the company&#8217;s super premium 107/5Mbps package managed a whopping 786GB.</p>
<p>Although the wording of the message has strenuously avoided telling customers they are wrong for this amount of usage, the implication is clear to many: they are counting your gigabytes and identifying the outliers.  One customer called it Suddenlink&#8217;s &#8220;You&#8217;re actually using your connection, and we really wish you wouldn&#8217;t&#8221;-message.</p>

<p>&#8220;No one with an ounce of sense would pay for a 20/3Mbps connection and only  use 78 GB in a month.  Let&#8217;s hope they&#8217;re just making cute suggestions,  not easing us into a cap, because that just won&#8217;t fly,&#8221; wrote one West Virginia customer.</p>
<p>Another in Georgetown, Texas did the math and made it clear 43GB better not turn out to be a cap because it means customers can barely use the service they are paying for.</p>
<p>&#8220;It&#8217;s way too  low. I got 10Mbps [service] because of price/value and not because I use less than  43GB,&#8221; he writes. &#8220;[Even] if I downloaded at 1.25MB/s for 30 days  straight (1.25 * 2592000 seconds) I could [still] grab 3.164TB.&#8221;</p>

<p>Meanwhile, some controversy over the quality of Suddenlink&#8217;s service during the upgrade process had some residents in Cushing, Okla., up in arms at a recent city meeting.  Lorene Clyde complained Suddenlink&#8217;s &#8220;new and improved&#8221; service is worse than ever.</p>
<p>&#8220;I&#8217;m tired of paying for a service I&#8217;m not getting,&#8221; Clyde said.   &#8220;And the Suddenlink commercials &#8211; they are like rubbing salt in a  wound.&#8221;</p>
<p>KUSH-AM reporters <a href="http://1600kush.com/story.php?id=3807&amp;section=1" target="_blank">were on hand</a> to cover the event, noting Clyde was not the only one complaining.  The radio station noted that &#8220;the buzz around town echoes  her sentiments &#8211; from the &#8216;mildly irritated&#8217; to the &#8216;downright mad&#8217; &#8211;  citizens have been complaining.  Not only have they been complaining to  Suddenlink &#8211; as difficult as that may be (the call center is in Tyler,  Texas) &#8211; but to city leaders.&#8221;</p>
<p>What Clyde and others may not have realized is that Suddenlink officials were in attendance and were able to apologize for the problems, but a growing consensus among consumers and city leaders is that a broad-based refund for the poor service was warranted.</p>
<p>Commissioner  Joe Manning said while he appreciated the promise to figure out the  problem, it wasn&#8217;t good enough to just apologize and promise &#8211; that  subscribers&#8217; bills should be adjusted to reflect the poor service.</p>
<p>Commissioners  Carey Seigle and Tommy Johnson agreed with Manning.  Seigle pointed out  it would be &#8220;good P.R.&#8221; to give some sort of rebate across the board to  subscribers while Johnson complained that the original &#8220;upgrade&#8221; was  only going to take a few weeks and now 8 months later &#8211; things are not  better, but worse, noted the radio station.</p>
<p>Suddenlink officials on hand said they did not  have that kind of authority, but continued to promise things are going  to get better.  &#8220;I pledge to you,&#8221; one said, &#8220;We will find it  [the problem] and fix it.&#8221;</p>

<p>Suddenlink president and CEO Jerry Kent sends word that the days of cable companies spending capital on system upgrades are basically over.</p>
<p>Interviewed on CNBC, Kent was responding to concerns about the cable industry&#8217;s long history of leveraged buyouts &#8212; amassing enormous debt to launch buyouts of small and medium sized cable companies as the march towards industry consolidation continues.</p>
<p>Kent&#8217;s own cable system &#8212; Suddenlink, was built partly on purchased cable systems from Cox and Charter Cable.  In the changing economy, Wall Street now wants to see cable companies with plenty of free cash flow on hand as part of their balance sheets, not just potential revenue growth through increased numbers of households made possible through debt-ridden acquisitions.</p>
<p>Kent sees Suddenlink, and many other cable operators, performing better as they transition away from making investments in system upgrades to accommodate demand.</p>
<p>&#8220;I think one of the things people don&#8217;t realize [relates to] the question of capital intensity and having to keep spending to keep up with capacity,&#8221; Kent said. &#8220;Those days are basically over, and you are seeing significant free cash flow generated from the cable operators as our capital expenditures continue to come down.&#8221;</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2010/02/suddenlink-logo.gif"><img class="alignleft size-full wp-image-7734" title="suddenlink logo" src="http://stopthecap.com/wp-content/uploads/2010/02/suddenlink-logo.gif" alt="" width="190" height="60" /></a>Kent told CNBC Suddenlink had the fastest residential Internet service in the country &#8212; 107Mbps. (EPB in Chattanooga claims it offers 150Mbps residential service, although we don&#8217;t see much about it beyond a June press release on their website.)  Suddenlink&#8217;s speeds are one-way only, however.  The upstream speed for that tier of service is considerably slower &#8212; 5Mbps.  EPB offers the same upstream and downstream speeds.</p>
<p>Kent appeared on CNBC to discuss the &#8220;threat&#8221; to cable television company business models by online video.  Kent believes Suddenlink, and the cable industry more generally, is positioned to protect cable-TV profits with the <em>TV Everywhere</em> concept &#8212; offer online video of cable programming, but only to authenticated, current cable subscribers.  Those without cable subscriptions can&#8217;t watch.</p>
<p>Financial reports submitted by many of the nation&#8217;s cable operators confirm Kent&#8217;s claim that capital spending is being reduced.  Even among cable systems that claim they need to enact usage caps and other Internet Overcharging schemes to &#8220;invest in broadband upgrades,&#8221; the financial reports don&#8217;t lie &#8212; they are not using increased revenue for system upgrades.  They are instead retaining the revenue as free cash &#8211; available for other purposes, paying down debt, or returning it to shareholders through dividend payouts.</p>

<p>Although the days of frenzied buying and selling of cable systems is behind us, smaller cable operators are still in the market for system swaps and buyouts.</p>
<p>Some 8,200 Windjammer Cable customers in Greenwood, Miss. and surrounding areas are about to become Suddenlink customers.  For many residents in Greenwood, located north of Jackson, this will be their third cable provider in two years.</p>
<p>Originally owned by Adelphia, Greenwood&#8217;s cable system was acquired in 2008 by Time Warner Cable as part of a bankruptcy sale of Adelphia&#8217;s cable properties.  Time Warner Cable ponied up an estimated average $3,500 per subscriber to purchase Adelphia&#8217;s cable systems, even though many were badly in need of upgrades.</p>
<p>Time Warner merged many Adelphia systems in larger communities into its own operations, but sold most of the smaller, more rural systems deemed strategically unimportant to the company.  In total, more than 125 cable systems in 25 different states, many serving just a few hundred subscribers each, were dumped overboard at a loss of $45 million by Time Warner.  Greenwood, like 124 other communities, would now receive cable service from a company nobody ever heard of before &#8212; Windjammer Cable.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2010/05/windjammer-cable.jpg"><img class="alignleft size-full wp-image-10205" title="windjammer cable" src="http://stopthecap.com/wp-content/uploads/2010/05/windjammer-cable.jpg" alt="" width="333" height="73" /></a>Windjammer was created in 2008 to handle the 80,000 Adelphia customers Time Warner cast-off.  Owned by private equity firm MAST Capital Management, Windjammer is run by Jupiter,  Fla.-based small cable operator Communications Construction  Services, which is mostly known for providing cable service to more than 200 military bases across the country.</p>
<p>For Greenwood customers, the welcome letter from Time Warner Cable ended their cable relationship with Adelphia.  But it was a relationship never destined to last.</p>
<p>Just one year later, another welcome letter arrived, this time from Windjammer Cable:</p>

<p>As a way  to make the transition easy from one cable company to another, you will  see very little change in how you receive your cable and communications  services.</p>
<p>We will be updating your High Speed Internet, Digital  Phone, and E-mail services beginning in the early morning of January 12,  2009. This conversion may take up to 10 days. We will only be working on  your service between 1:00 am – 6:00 am local time. During this time,  you may experience slight service interruptions, so please be patient.</p>
<p>To  those of you who currently use the Time Warner Road Runner email  service, there will be changes to your email account. Please visit our  new website where you will find information about setting up a new  Windjammer email account. We encourage you to do this as soon as  possible. Your existing Road Runner email account will continue to work  the same for at least the next two months.</p>
<p>If you do not use the  Time Warner Road Runner email service, but use another service, like  Gmail, you will not need to make any changes.</p>
<p>If you are a Time  Warner Digital Phone customer, you should not notice any significant  changes to your phone services. If you use the voice mail service, you  will have to re-record your message. Instructions for doing this can  also be found on our website.<br />

<p>What Suddenlink paid to acquire the Windjammer system has not been disclosed.</p>
<p>Suddenlink has experience providing service in Mississippi &#8212; its nearest system is in Greenville, about 50 miles west of Greenwood.</p>
<p>Suddenlink is the nation’s seventh-largest cable operator, with  customers primarily located in Arkansas, Louisiana, North Carolina,  Oklahoma, Texas and West Virginia.</p>
