<p>Comcast and Time Warner Cable collectively picked up more than 1.5 million new customers in 2011, with most of the growth coming from dissatisfied DSL subscribers seeking better broadband speeds.</p>
<p>Leichtman Research Group, Inc. (LRG) found the eighteen largest cable and telephone providers in the US &#8212; representing about 93% of the market &#8212; acquired 3 million net additional high-speed Internet subscribers in 2011. Annual net broadband additions in 2011 were 88% of the total in 2010.</p>
<p>The top broadband providers now account for 78.6 million subscribers &#8212; with cable companies having over 44.3 million broadband subscribers, and telephone companies having over 34.3 million subscribers.</p>

<p>Despite AT&amp;T&#8217;s position as the second largest Internet Service Provider in the country, the company only picked up 117,000 new customers in 2011.  In contrast, Time Warner Cable, with 6 million fewer customers, added almost a half-million new broadband subscriptions last year.</p>
<p>Frontier Communications, which made broadband a primary target for expansion, has not seen considerable growth either.  The company only added just short of 38,000 new broadband customers last year, almost all getting DSL, often at speeds of 1-3Mbps.</p>
<p>Other key findings include:</p>
<ul>
<li>The top cable companies netted 75% of the broadband additions in 2011;</li>
<li>The top cable companies added 2.3 million broadband subscribers in 2011 &#8212; 98% of the total net additions for the top cable companies in 2010;</li>
<li>The top telephone providers added 750,000 broadband subs in 2011 &#8212; 68% of the total net additions for the top telephone companies in 2010;</li>
<li>In the fourth quarter of 2011, cable and telephone providers added 765,000 broadband subscribers &#8212; with cable companies accounting for 82% of the broadband additions in the quarter.</li>

<p>&#8220;Despite a high level of broadband penetration in the US, the top broadband providers added 88% as many subscribers in 2011 as in 2010,&#8221; said Bruce Leichtman, president and principal analyst for Leichtman Research Group, Inc. &#8220;At the end of 2011, the top broadband providers in the US cumulatively had over 78.6 million subscribers, an increase of nearly 25 million over the past five years.&#8221;</p>
<p>Americans are increasingly treating broadband as an essential &#8220;utility&#8221; service, as fundamental as electricity or clean water.</p>
<p>The majority of consumers who lack the service either consider it irrelevant in their lives (a factor that increases with the age of the surveyed respondent), cannot obtain service from their provider because of their location, or cannot afford the service.</p>

<p>Insight&#8217;s customers in Kentucky, Ohio, and Indiana won&#8217;t see changes immediately.  Time Warner says it will be &#8220;business as usual&#8221; as the company begins to manage its newest service areas.  Time Warner Cable spokesperson Mary Jo Green said the company plans no immediate channel or price changes, but some Insight subscribers are worried about the long term fate of the NFL Network, which has been a part of Insight&#8217;s cable lineup but has not been carried by any Time Warner Cable systems.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2011/08/twcGreen.jpg"><img class="alignleft size-full wp-image-20218" title="twcGreen" src="http://stopthecap.com/wp-content/uploads/2011/08/twcGreen.jpg" alt="" width="149" height="88" /></a>Time Warner says its engineering staff will be examining the current state of Insight&#8217;s infrastructure &#8212; a key factor in determining what services already familiar to Time Warner customers can be extended to Insight customers.  Most of them involve the cable television operation.  Features like &#8220;Look Back&#8221; and &#8220;Start Over&#8221; have not been available on Insight&#8217;s cable systems.  Insight broadband offers tiers of 10, 20, 30, and 50Mbps &#8212; same as Time Warner.  The phone service is similar as well.</p>
<p>Kentucky will become one of Time Warner&#8217;s largest service areas as the company absorbs Insight.  Time Warner and Insight traditionally operated as neighbors in different parts of the state. Insight served most of the city of Henderson while Time Warner Cable covered most of Henderson&#8217;s suburbs.</p>
<p>Time Warner Cable&#8217;s acquisition of Insight adds more than 760,000 customers, including 550,000 broadband, 670,000 cable, and 290,000 phone subscribers across three states.</p>

<p>That&#8217;s $1 billion less than asked by seller-owner Carlyle Group, which has been shopping the tenth largest cable operator around for months.</p>
<p>For many Insight subscribers, it means another new owner.  Most of Insight&#8217;s customers have been cobbled together from other cable systems, including Tele-Communications, Inc., AT&amp;T Cable, Comcast, and even a few former Time Warner service areas.  For the past several years, Insight has been run under the ownership of equity investment firm Carlyle Group, which has treated it as an investment, waiting to be sold off to the highest bidder.  In 2007, Carlyle found no buyers willing to meet their asking price, and it appeared this year&#8217;s negotiations were headed in the same direction, as Time Warner Cable (among others) <a href="http://stopthecap.com/2011/04/14/cable-flipping-insight-communications-on-sales-block-time-warner-cable-says-price-too-high/">dismissed the $4 billion asking price as overpriced</a>.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2011/08/twcGreen.jpg"><img class="alignleft size-full wp-image-20218" title="twcGreen" src="http://stopthecap.com/wp-content/uploads/2011/08/twcGreen.jpg" alt="" width="149" height="88" /></a>But this year, Carlyle apparently was unwilling to hold on to their investment, and according to an insider, quickly called Time Warner Cable after other potential bidders including WideOpen West, Mediacom Communications, Cablevision and Charter Cable dropped out.  Time Warner Cable repeated their offer of an all-cash purchase of $3 billion, and Carlyle accepted.</p>
<p>With the acquisition, Insight&#8217;s brand will eventually be dropped in favor of Time Warner Cable, who expects to realize $100 million in &#8220;cost savings&#8221; from bulk programming purchase deals and cost cutting measures.  Time Warner Cable also gets to realize tax benefits when it inherits Insight&#8217;s heavy net losses of $300 million, which will reduce the larger cable operator&#8217;s tax liabilities.</p>
<p>For customers, programming lineup changes are unlikely, and Insight already is aggressively deploying DOCSIS 3 for its broadband customers.  Time Warner is likely to realign Insight&#8217;s broadband packages closer to standard Road Runner packages.  Insight currently sells 10/1, 20/1.5, 30/3, and 50/5Mbps service.  Time Warner Cable routinely sells 10/1, 15/1, 30/5, and 50/5Mbps service in most DOCSIS 3-enabled service areas.</p>
<p>Time Warner&#8217;s acquisition of Insight bolsters its <a href="http://stopthecap.com/2011/06/14/time-warner-cable-acquires-newwave-communications-systems-in-tenn-ky/">earlier purchase</a> this year of cable properties in Kentucky and Tennessee formerly owned by another midwestern cable operator &#8212; NewWave Communications.</p>

<p>The Federal Communications Commission today released <strong><a href="http://www.fcc.gov/measuring-broadband-america#read" target="_blank">MEASURING BROADBAND AMERICA</a>, </strong>the first nationwide performance study of residential wireline broadband service in the United States.  The study examined service offerings from 13 of the largest wireline broadband providers using automated, direct measurements of broadband performance delivered to the homes of thousands of volunteers during March 2011.</p>
<p>Among the key findings:</p>
<p><em><strong>Providers are being more honest about their advertised speeds</strong></em>: Actual speeds are moving closer to the speeds promised by those providers.  Back in 2009, the FCC found a greater disparity between advertised and delivered speeds.  But the Commission also found that certain providers are more likely to deliver than others, and certain broadband technologies are simply more reliable and consistent.</p>
<p><em><strong>Fiber-to-the-Home service was the runaway winner</strong></em>, consistently delivering even better speeds than advertised (114%).  Cable broadband delivered 93% of advertised speeds, while DSL only managed to deliver 82 percent of what providers promise.  Fiber broadband speeds are consistent, with just a 0.4 percent decline in speeds during peak usage periods.</p>
<p><em><strong>Cable companies are still overselling their networks.</strong></em>  The FCC found during peak usage periods (7-11pm), 7.3 percent of cable-based services suffered from speed decreases &#8212; generally a sign a provider has piled too many customers onto an overburdened network.  One clear clue of overselling: the FCC found upload speeds largely unaffected.</p>
<p><em><strong>DSL has capacity and speed issues.</strong></em>  DSL also experienced speed drops, with 5.5 percent of customers witnessing significant speed deterioration, which could come from an overshared D-SLAM, where multiple DSL customers connect with equipment that relays their traffic back to the central office, or from insufficient connectivity to the Internet backbone.</p>

<p><em><strong>Some providers are much better than others.  </strong></em>The FCC found some remarkable variability in the performance of different ISPs.  Let&#8217;s break several down:</p>
<ul>
<li><strong>Verizon&#8217;s FiOS was the clear winner</strong> among the major providers tested, winning top performance marks across the board.  Few providers came close;</li>
<li><strong>Comcast had the most consistently reliable speeds</strong> among cable broadband providers.  <strong>Cox beat them at times</strong>, but only during hours when few customers were using their network;</li>
<li><strong>AT&amp;T U-verse</strong> was competitive with most cable broadband packages, but is <strong>already being outclassed</strong> by cable companies offering DOCSIS 3-based premium speed tiers;</li>
<li><strong>Cablevision has a seriously oversold broadband network.</strong>  Their results were disastrous, scoring the worst of all providers for consistent service during peak usage periods.  Their performance was simply unacceptable, incapable of delivering barely more than half of promised speeds during the 10pm-12am window.</li>
<li>It was strictly <strong>middle-of-the-road performance for Time Warner Cable, Insight, and CenturyLink</strong>.  They aren&#8217;t bad, but they could be better.</li>
<li><strong>Mediacom continued its tradition of being a mediocre cable provider</strong>, delivering consistently below-average results for their customers during peak usage periods.  They are not performing necessary upgrades to keep up with user demand.</li>
<li><strong>Most major DSL providers &#8212; AT&amp;T, Frontier, and Qwest &#8212; promise little and deliver as much</strong>.  Their ho-hum advertised speeds combined with unimpressive scores for time of day performance variability should make all of these the consumers&#8217; last choice for broadband service if other options are available.</li>
</ul>
<p><em><strong></strong></em>Some conclusions the FCC wants consumers to ponder:</p>
<ol>
<li><strong>For basic web-browsing and Voice-Over-IP, any provider should be adequate.</strong>  Shop on price. Consumers should not overspend for faster tiers of service they will simply not benefit from all that much.  Web pages loaded at similar speeds regardless of the speed tier chosen.</li>
<li><strong>Video streaming</strong> benefits from consistent speeds and network reliability.  <strong>Fiber and cable broadband usually deliver faster speeds</strong> that can ensure reliable high quality video streaming.  DSL may or may not be able to keep up with our HD video future.</li>
<li><strong>Temporary speed-boost technology provided by some cable operators is a useful gimmick.</strong>  It can help render web pages and complete small file downloads faster.  It can&#8217;t beat fiber&#8217;s consistently faster speeds, but can deliver a noticeable improvement over DSL.</li>
</ol>
<p><a href="http://stopthecap.com/wp-content/uploads/2011/08/speedchart2.jpg"><img class="aligncenter size-full wp-image-19936" title="speedchart2" src="http://stopthecap.com/wp-content/uploads/2011/08/speedchart2.jpg" alt="" width="527" height="1070" /></a>More than 78,000 consumers volunteered to participate in the study and a total of approximately 9,000 consumers were selected as potential participants and were supplied with specially configured routers. The data in the report is based on a statistically selected subset of those consumers—approximately 6,800 individuals—and the measurements taken in their homes during March 2011. The participants in the volunteer consumer panel were recruited with the goal of covering ISPs within the U.S. across all broadband technologies, although only results from three major technologies—DSL, cable, and fiber-to-the-home—are reflected in the report.</p>

<p>The most logical buyer, Time Warner Cable, has been engaged in on-again, off-again talks with Charter about Los Angeles for sometime, according to several sources in the cable investment community.  Charter proposed a swap, trading its Los Angeles system to Time Warner if they could acquire Time Warner&#8217;s subscribers in Wisconsin.</p>
<p>Time Warner Cable currently serves 560,000 subscribers in Green Bay, Milwaukee and Appleton.  Charter serves much of the rest of the state.  Thankfully for many Wisconsin customers, Time Warner Cable told Charter they were not interested.  Time Warner gets significantly higher customer ratings than Charter does.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2010/11/twc.png"><img class="alignleft size-full wp-image-13822" title="twc" src="http://stopthecap.com/wp-content/uploads/2010/11/twc.png" alt="" width="133" height="53" /></a>Now that Goldman Sachs and Citibank will be running an auction, Time Warner Cable could still ultimately acquire the Charter systems in Los Angeles, if they are willing to pony up an estimated $2 billion asking price.  If Time Warner won&#8217;t bid that high, speculation is that Comcast, Cox, or Cablevision will.</p>
<p>A surprise bonus for buyers are rumors Charter will throw in its cable system in Fort Worth, Tex.  That move would also seem to benefit a Time Warner Cable takeover, considering the nation&#8217;s second largest cable operator already has an enormous presence in the Dallas/Fort Worth Metroplex.  But <em>Multichannel News</em> <a href="http://www.multichannel.com/article/467253-Charter_Readying_L_A_System_For_Sale_.php" target="_blank">points out</a> that part of Texas brings bad memories for Time Warner, when it had to effectively commit to an expensive rebuild of the nearby ailing system acquired from bankrupt Adelphia Cable in 2006.</p>
<p>Time Warner Cable is still rumored to be the logical buyer of Insight Cable&#8217;s systems, also for sale, in Indiana, Kentucky, and Ohio, although the cable company is still balking at an asking price of up to $4 billion.</p>

<p>But a few independent holdouts remain.  Bresnan Communications, the 17th largest cable company was sold last year to Cablevision Industries (8th largest).  Now Insight Communications, the 9th largest operator, is up for sale by its private equity owners Carlyle Group, MidOcean Partners and Crestview Partners.</p>
<p>Insight serves just over 760,000 customers in Kentucky, Indiana and Ohio.  Originally, the company operated as Insight Midwest, a partnership between co-owners Comcast and Insight.  When the partnership between the two companies ended, Comcast took most of Insight&#8217;s customers in Indiana and Illinois and converted them to Comcast service.  The remainder have been served by Insight.</p>
<p>The deal to sell Insight is being managed by Bank of   America-Merrill Lynch and UBS AG and is being pitched to much larger cable operators with a price tag of $3.5 billion to $4   billion.</p>
<p>That&#8217;s too rich for Time Warner Cable&#8217;s blood.  The nation&#8217;s second largest cable operator was interested in acquiring Insight, but not at those prices.  Another potential buyer could be Comcast, which has a significant part of the midwestern market, especially in Illinois.</p>
<p>Insight has been on the sales block before &#8212; the last time in 2007 when Carlyle Group found no buyer interested in the systems at their asking price.</p>

<p>Louisville cable viewers channel flipping up and down the dial found nothing but frozen pictures, a captured moment in time from 2:53am this morning.  What they found next when calling Insight was nothing but hours of busy signals.  Some customers in southern Indiana found some channels worked fine while others did not.  In all, the outage impacted at least some channels across most of Insight&#8217;s service area in Kentuckiana.</p>

<p>Insight initially blamed the problem on a router failure that developed during routine overnight maintenance.  A backup router also failed at the same time.  Company officials originally anticipated service would be restored by six this morning, but that did not come to pass.</p>
<p>Because the equipment failure had never been seen before by Insight technicians, it took nearly nine hours to finally resolve the problem.  Local television stations were deluged with calls from viewers wondering what happened to their favorite shows, and Insight&#8217;s dropped ball was topic number one on most local talk radio programs today.</p>
<p>Insight subscribers were especially upset that they couldn&#8217;t reach the cable company for answers.  Customer service lines were left jammed through much of the day.</p>
<p>Insight spokesman Jason Keller apologized for the outage.</p>

<p>&#8220;Everything that we have has a  redundancy built into it. This is no different, but unfortunately on  this particular morning with this particular piece of equipment, both  the main equipment and the backup did not function properly,&#8221; Keller  said, calling the outage &#8220;highly unusual.&#8221;</p>
<p>Keller called today&#8217;s outage the largest that he has seen during the company&#8217;s 10 years of service in Louisville.</p>
<p>By 10:00am, Louisville customers had their HD channels back, with the remaining analog channels restored by 1:30 this afternoon.</p>
<p>Despite the severity of the outage and its widespread impact, Insight Communications is refusing to issue blanket refunds to affected customers.  Instead, individual customers have to call or contact the company and request a refund, which they characterize as an amount under $1.00.</p>
<p>Customers can cost Insight more than that just by availing themselves of that option, and registering their displeasure over today&#8217;s long-lasting outage.</p>

<p>Most television newscasts in the Louisville area treated today&#8217;s outage as their top news story, with several issuing periodic updates throughout the morning into the afternoon about the service problems.</p>

<p>AT&amp;T will compete head-on with incumbent cable operator Insight Communications, which has been the only cable provider in Jefferson County for at least a decade.</p>
<p>AT&amp;T promises customers packages starting at $49 a month, as well as digital video recorder set top boxes that can record up to four shows at the same time, and display the recorded programming on any AT&amp;T-wired television in the house.  AT&amp;T also promises residents significant savings when they choose AT&amp;T for video, telephone, and broadband service, and will even include a &#8220;quad-play&#8221; bundle including AT&amp;T Wireless mobile phone service, resulting in one bill for all AT&amp;T services.</p>
<p>AT&amp;T&#8217;s U-verse system is an advanced form of DSL, using a hybrid network of fiber optic cables wired into neighborhoods that interface with ordinary copper telephone wiring that already exists in most Louisville homes.  The technology reduces the costs of wiring every home with fiber optics, but can still offer advanced services &#8220;beyond what cable can offer,&#8221; according to AT&amp;T.</p>
<p>Consumers across Louisville welcomed the competition.</p>
<p>Tabitha Rhodes told the Louisville <em>Courier-Journal</em> the lack of competition was bothersome.  &#8220;It is like there is only one shoe store in town,&#8221; she said.  &#8220;I want 20 shoe stores.&#8221;</p>
<p>Rhodes&#8217; husband, Tate, said he hopes AT&amp;T&#8217;s competition will force Insight to become a more reliable cable company.  Rhodes said their cable service has experienced dropped channels, poor quality pictures, and even pesky neighborhood squirrels that gnawed through the cable line serving his street.</p>
<blockquote><p>The U-verse service also ties in with an Apple iPhone application, which when run on AT&amp;T&#8217;s wireless network allows customers to program their television recording remotely.</p>
<p>Insight customer Rhonda Petr, 44, said she now pays $15 per month for digital video recorder service for each of two television sets in her home, in addition to a bundled monthly subscription for premium cable, phone and Internet service.</p>
<p>Petr said she liked the idea of DVR service without “nickel and dime” charges for each TV set.</p></blockquote>
<p>Insight Communications dismissed AT&amp;T&#8217;s U-verse as little more than smoke and mirrors, according to company spokesman Jason Keller.</p>
<blockquote><p>“Insight has been Louisville&#8217;s technology leader for more than a decade,” company spokesman Jason Keller said Friday.</p>
<p>“One more competitor… won&#8217;t change that,” Keller said.</p></blockquote>
<p>Insight&#8217;s system in Louisville is the largest in the company&#8217;s nationwide portfolio.  Company officials point to investments Insight has made in the Louisville area to introduce additional services, including &#8220;a broadband service that is faster than what AT&amp;T is offering.&#8221;</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2009/09/keller.jpg"><img class="alignleft size-full wp-image-4308" title="keller" src="http://stopthecap.com/wp-content/uploads/2009/09/keller.jpg" alt="keller" width="176" height="167" /></a>Insight offers 20Mbps service for $17 less than what AT&amp;T charges for 18Mbps, according to one reader.</p>
<p>Insight claims that AT&amp;T is relying on the same old wiring that has been around &#8220;since the days of Alexander Graham Bell&#8221; to deliver service, and Insight has a &#8220;technological advantage in broadband width.&#8221;</p>
<p>The question on everyone&#8217;s mind is, how much will consumers save?</p>
<p>As the <em>Courier-Journal</em> notes, both are primarily competing on services, not on price:</p>
<blockquote><p>Both Insight and AT&amp;T offer bundled packages combining telephone, television and Internet starting at about $100 per month.The two compete chiefly on features. For instance, Insight offers faster Internet access, while AT&amp;T is promoting U-Verse&#8217;s features that link television, home phone service, wireless phone service, and Internet together.</p></blockquote>
<p>Rob Enderle, a technology consultant and president of the Enderle Group based in San Jose, Calif., told the newspaper the big savings are found in new customer promotional offers, which he calls &#8220;low teaser rates.&#8221;  In many Verizon FiOS TV areas that compete with cable, promotional new customer offers also often include long-term contracts lasting 12-24 months.</p>
<p>Incumbent cable companies often launch pre-emptive marketing blitzes to sell their customers on &#8220;price protection agreements&#8221; just before a competitor comes to town.</p>
<p>“They will try to lock up as many customers as they can,” Enderle told the newspaper.</p>
<p>In Louisville, Insight may have managed to accomplish that with their one-year &#8220;price protection agreement&#8221; they have managed to sell  many of their customers.  The marketing for such agreements promises no price increases for the term of the contract, something that might sound attractive to price-sensitive cable subscribers facing relentless annual rate hikes.</p>
<p>AT&amp;T has no such contract requirements in Louisville, although the company has used them in other markets to lock in customers taking advantage of promotional offers.</p>
<p>Once those promotional offers expire, the two companies will end up charging roughly the same prices for the various packages they offer.  Customers can choose which provider gives them the channels and services they want, as well as which offers better quality service.  The elusive savings, once the promotions expire, are still hard to find.</p>
<p>One Louisville reader called both companies to compare:</p>
<blockquote><p>Just did a comparison on the different packages AT&amp;T would offer: slower Internet, any additional DVR boxes would be $15/mo (same as Insight), HD channels would be $10/mo (free with Insight), and they would offer no more channels than Insight and both offer garbage as far as programs go. Yeah, I think Insight needs some competition in order to provide its customers with better pricing and better quality, but slower Internet and having to pay to access HD channels is BS. AT&amp;T better come up with something better.</p></blockquote>
