<p>Ebenezer Scrooge could successfully serve as the CEO of any large telecommunications company these days, and the <em>New York Times</em> knows a Christmas tale of woe when it sees one.  That is why the venerable newspaper <a href="http://www.nytimes.com/2011/12/25/opinion/sunday/verizons-worrisome-cable-deals.html?_r=2&amp;scp=2&amp;sq=verizon%20fios&amp;st=cse" target="_blank">printed</a> a Christmas Eve editorial blasting Verizon&#8217;s new &#8220;<a href="http://stopthecap.com/2011/12/07/cable-companies-consumers-may-pay-the-price/">non-aggression treaty</a>&#8221; with America&#8217;s largest cable companies that puts coal in the stocking for any Verizon customer waiting for FiOS fiber-to-the-home service.  The newspaper believes the days of FiOS are numbered:</p>
<blockquote><p>Verizon — Verizon Wireless’s main shareholder — relieved itself of the need to expand FiOS, its high-speed, fiber optic network, beyond the 18 million homes it set out to reach six years ago, a rollout that cost $23 billion. For the other 114 million homes in the country, it can simply bundle its wireless service with the cable and wireline broadband services of its partners. The agreement between Verizon and the cable carriers includes a joint venture to develop technology to integrate the wireline and wireless platforms.</p>
<p>Verizon’s cable deals squashed hopes that cable carriers’ purchases of wireless spectrum would lead to more competition against the dominant players, AT&amp;T and Verizon Wireless. And it puts in doubt whether FiOS will ever be a serious competitor to cable, reducing the likelihood that video transmitted over broadband could break up cable’s regional oligopolies.</p>
<p>[...] Verizon’s deals suggest a future in which cable carriers will get uncontested control of high-speed broadband into the home while AT&amp;T and Verizon will get uncontested control over wireless. For consumers with expensive wireless plans, pricey bundles of cable channels and costly, slow broadband, this does not look like good news.</p></blockquote>
<p><a href="http://stopthecap.com/wp-content/uploads/2011/12/coal.jpg"><img class="alignleft size-full wp-image-22749" title="Christmas Stocking with chunks of coal laying on a green textured background" src="http://stopthecap.com/wp-content/uploads/2011/12/coal.jpg" alt="" width="300" height="166" /></a>Verizon&#8217;s economic future lies in the lucrative world of wireless.  Its FiOS network was an expensive gamble to reinvent its antiquated telephone network to drive customers to keep their landlines and spent a hundred dollars more on video entertainment and super fast broadband.  Wall Street hated the price and loathed the potential for costly competition that would force earnings down through aggressive price-cutting.  In some markets, Verizon FiOS has forced Comcast, Cablevision, and Time Warner Cable to be a little more generous with broadband speed and lighten up a little on the annual rate increases.</p>
<p>But convincing cable customers to switch remains a difficult proposition even when Verizon offers the superior service.  Verizon has not achieved the level of penetration it expected in many markets.  In short, people just don&#8217;t want to wait around for installers.  Besides, cable companies slash prices for customers threatening to depart.</p>
<p>Verizon&#8217;s deal with Time Warner and Comcast delivers Verizon Wireless desirable spectrum.  But the agreement to cross-market and cross-bundle product lines smacks of collusion, and is exactly the kind of turf protection that has kept cable companies from competing head-to-head with each other for more than three decades.  Is it more lucrative for Verizon to build out its FiOS network to compete or simply refer people to Time Warner or Cablevision for cable TV.  So long as cable doesn&#8217;t offer a competing wireless product, Verizon seems to think there is little harm done.</p>
<p>But for consumers, the absence of competition brings rate increases, reduced innovation, and declining customer service.</p>
<p>The one thing the telecom marketplace needs less of is the &#8220;take it or leave it&#8221; attitude that earned the scorn of cable customers everywhere.</p>

<p>The unexpected and sudden departure of two senior executives at Bethpage, N.Y.-based Cablevision has pushed the rumor mill into overdrive the cable company is about to be sold or taken private.</p>
<p>John Bickham, president of cable communications and chief operating officer Tom Rutledge will both be spending more quality time with their respective families after departing Cablevision.  Last Thursday&#8217;s announcement that Rutledge would resign caused Cablevision&#8217;s stock price to drop by nearly 14% during trading Friday.</p>
<p>The inevitable conclusion on Wall Street: Cablevision is about to be sold or taken private.</p>
<p>Major shareholders and investment firms have criticized Cablevision over the years for being &#8220;too successful&#8221; signing customers to fixed price double or triple-play packages that provide a full suite of products and services, but deliver few growth opportunities shareholders demand. With heavy competition from Verizon FiOS in most of their service areas, Cablevision&#8217;s ability to simply raise rates is limited, especially when customers bounce between promotional offers from the phone and cable companies.</p>
<p>Rutledge&#8217;s departure, in particular, has been seen as a major negative on Wall Street because he was responsible for many of Cablevision&#8217;s most innovative products, including streamed video, his advocacy for boosting broadband speeds, and the company&#8217;s aggressive move into home security.</p>
<p>Craig Moffett, a Wall Street analyst from Sanford Bernstein, thinks Comcast and Time Warner Cable are set to divide the spoils in a shared buyout &#8212; Comcast grabbing northern New Jersey and Connecticut and Time Warner Cable assuming control of Cablevision&#8217;s systems in New York.  But other analysts don&#8217;t think that scenario is so likely, especially when considering the Dolan family&#8217;s long history in the cable business.</p>
<p>ISI Group Inc. analyst Vijay Jayant <a href="http://www.lightreading.com/document.asp?doc_id=215722&amp;site=lr_cable&amp;" target="_blank">told</a> <em>Light Reading Cable</em> he believes the more likely scenario would have the Dolan family buying out shareholders and taking the cable company private.</p>
<p>Time Warner Cable has repeatedly informed shareholders the company will not engage in bidding wars or overpay to win new acquisitions, and the Dolan family&#8217;s selling price for Cablevision is likely far higher than Time Warner would be willing to pay.  Comcast might have a political problem assuming control of more cable systems after its recent merger with NBC-Universal.  Shareholders may also rebel, as they did in a 2007 effort to take Cablevision private.  Investors felt they were offered too low a price to compensate them for their shares.</p>
<p>Moffett believes Cablevision&#8217;s days of high earnings and rapid growth are behind them, because just about everyone who wants cable service already has it, either from Verizon FiOS or Cablevision.</p>
<p>&#8220;No, we don&#8217;t think [Cablevision] can grow. And, no, we don&#8217;t think the rest of cable is doomed to the same fate,&#8221; Bernstein&#8217;s Moffett wrote in a report in late November. &#8220;The cause of [Cablevision's] growth decline is straightforward: it has been so successful in achieving high product penetrations that growing further is quite challenging.&#8221;</p>

<p>The northeastern United States got more than its fair share of severe storms these past few months.  Remnants of Hurricane Irene caused severe flooding, heavy rainstorms that followed didn&#8217;t help.  But one of the worst of all was the Halloween Nor&#8217;easter that left serious wind damage in some areas, heavy snowfall in others, leaving customers without power, phone, cable, and broadband service for days, if not weeks.</p>
<p>Telecommunications companies including Cablevision, Charter Communications, Comcast, Cox Communications, Dish Network, Time Warner Cable, and Metrocast Communications of Connecticut are under fire across the region for not providing automatic service credits for impacted customers.  Charter and Comcast are both facing a class action lawsuit filed last week by a Massachusetts law firm that accuses the cable operators of &#8220;gouging&#8221; their customers by not automatically crediting affected subscribers for lost service.</p>
<p>Jeffrey Morneau of Springfield, Mass. law firm Connor, Morneau &amp; Olin says up to 1.2 million Charter and Comcast customers were without service, but the companies will only provide credits on a case-by-case basis, and only if customers request them within a short time after the outage occurred.</p>
<p>“If you pay for a service and you don’t get it, the company can’t keep your money,” Morneau said.</p>
<p><em>Stop the Cap!</em> readers in Massachusetts and New Hampshire report Comcast will grant reasonable service credit requests, assuming you get through to ask for them.</p>
<p>&#8220;Hold times are epic,&#8221; reports Tom Turlin, a Comcast customer in Massachusetts.  &#8220;I managed to get my credit by using their web contact form instead.&#8221;</p>
<p>Most providers require consumers to request credits for outages within 30-60 days of the service interruption, and time is running out for Nor&#8217;easter credits.</p>
<p>&#8220;Most people think they will only get 50 cents back so why bother, but actually with today&#8217;s huge cable bills, credits can be substantial,&#8221; Turlin says. &#8220;I received almost $15 back on my bill.&#8221;</p>
<p>Only AT&amp;T, Connecticut&#8217;s largest phone company, agreed to automatically credit customers the company determined were without service for at least 24 hours.  Customers who don&#8217;t receive credit automatically can appeal to the company for credit they believe they are entitled to receive.</p>
<p>Here&#8217;s how different companies are responding:</p>
<p style="padding-left: 30px;"><strong>AT&amp;T</strong>: &#8220;We will give U-verse TV customers in Connecticut who experience a service outage for longer than 24 hours a pro-rated credit,&#8221; AT&amp;T said. &#8220;In addition, we will voluntarily give similar credits for U-verse Voice and U-verse High Speed Internet service customers who experienced a service outage for longer than 24 hours. Customers are not required to take any action: the credits will be applied automatically on the customer bill for impacted customers within the next several billing cycles.&#8221;</p>
<p style="padding-left: 30px;"><strong>Cablevision</strong>: &#8220;While state law provides for consumer credits for qualifying outages for cable service only, Cablevision has been providing a credit to customers on an individualized basis for all their services,&#8221; Cablevision said. &#8220;Customers will be credited when they notify us that they had a service outage. We are extending our normal period to request refunds to 45 days from the date of the storm.&#8221;</p>
<p style="padding-left: 30px;"><strong>Charter</strong>: Customers must call or visit the cable company offices in person to request service credit.  &#8220;We are providing credit to customers for the entire time they were without service, from the time they lost power to the time their Charter services were fully restored, and we are providing credit for all services,&#8221; Charter said.</p>
<p style="padding-left: 30px;"><strong>Comcast</strong>: &#8220;In order to receive a credit, a customer must contact Comcast and identify the time period during which they did not have access to Comcast services,&#8221; Comcast said.</p>
<p style="padding-left: 30px;"><strong>Cox</strong>: &#8220;We need our customers to call us after their service is restored to report that they were without Cox services, and for how long,&#8221; Cox said. &#8220;We then credit their accounts from the time of the service outage until service was actually restored.&#8221;</p>
<p style="padding-left: 30px;"><strong>DISH Network</strong>: The satellite provider is waiving service and equipment fees for consumers who need their equipment realigned, reinstalled or repaired due to the storm. &#8220;DISH subscribers who indicated that they were without service due to the storm were provided a credit for their time without service,&#8221; DISH said. &#8220;In addition, DISH subscribers who needed to suspend their service due to storm damage were allowed to do so at no charge.&#8221;</p>
<p style="padding-left: 30px;"><strong>MetroCast Communications of Connecticut</strong>: It will provide customers with a refund on their next invoice after contacting the company. &#8220;The credit equals a prorated amount of the affected customer&#8217;s monthly charges for all MetroCast services, calculated based on the number of days during which such services were interrupted, and are included in the customer&#8217;s next invoice,&#8221; MetroCast said.</p>
<p style="padding-left: 30px;"><strong>Time Warner Cable</strong>: Customers must contact the cable company online, by e-mail or phone and request credit for the number of days they were without service.  Most service credit requests that can be verified are granted within hours, and will appear on the next billing statement.</p>

<p>Among telecommunications providers, the consumer magazine is slamming <strong>Verizon Wireless</strong> for its <strong><em>gouge-you-now, tell-you-about-it-later</em></strong> &#8220;early warning system&#8221; that is <em>supposed</em> to notify customers before they exceed their arbitrary data plan limits.  Verizon can&#8217;t let a little customer service get in the way of making a ton of money on extortionist overlimit fees for customers who dare to use too much:</p>
<blockquote><p><strong></strong>The company tells the Federal Communications Commission that it voluntarily provides ample warning to customers who seem about to exceed their monthly allotment of minutes, messages, or data, so a mandatory rule that would make it issue such alerts isn&#8217;t necessary. But we caught Verizon doing &#8212; and admitting to &#8212; something else. Two staffers who are Verizon customers recently were notified only after they went over their allotment, at which time the company tried to upsell them to a pricier plan. When contacted by our reporter, a company spokesman acknowledged that its voluntary alert system isn&#8217;t always reliable. But it now looks like better protection from “bill shock” is on its way. Under a mid-October deal with the FCC, members of CTIA &#8211; The Wireless Association, a trade group representing 97 percent of wireless carriers, agreed to begin issuing alerts of impending overages. Full implementation of the alert system could take until April 2013.</p></blockquote>
<p>That represents at least a year-long <em>Money Party</em> for Big Red, which began enforcing its idea of an &#8220;appropriate amount&#8221; of usage earlier this year.  Green, silver and gold are not just for the holidays at VZW.</p>
<p><strong>SiriusXM</strong>&#8216;s customer service <em>don&#8217;t-care-bears</em> also come in for a spanking. On top of hold times that can rival a typical workday, customers who don&#8217;t trust the satellite radio company with their credit card number pay a price for their wariness &#8211; a $2 monthly bill fee:</p>
<blockquote><p>If a subscriber wants to receive a bill in the mail and pay by check (the old-fashioned way), he or she will get socked with a $2 surcharge every month. The penalty can be avoided if the customer gives Sirius credit-card information and elects to be billed electronically on a recurring basis.</p></blockquote>
<p>While AT&amp;T breathes a sigh of relief they are not on the naughty list this year, <strong>Cablevision</strong> is pleasantly surprised to find themselves with a nice stocking stuffer courtesy of <em>CR</em>.</p>

<p>The bulk of Cablevision&#8217;s assets are located in several boroughs of New York, Long Island, New Jersey and Connecticut.  Virtually all of their service areas, outside of the acquisition of Bresnan Cable in the mountain west, are adjacent to Time Warner, making an acquisition by the nation&#8217;s second largest cable operator a natural fit.</p>
<p>This isn&#8217;t the first time rumors of a Cablevision sale have been floated.  The Dolan family has run the cable operator for decades, with family patriarch Charles Dolan still controlling a sizable interest in the company.  <em>Barron&#8217;s</em> notes the senior Dolan is currently in his 80s.  Son James, current president and CEO of Cablevision, seems more interested in his leadership role at Madison Square Garden, spun-off from Cablevision last year.</p>
<p>&#8220;I think the Dolans have positioned the company for a sale,&#8221; Mark Boyar, who heads Boyar Asset Management, <a href="http://online.barrons.com/article/SB50001424052748704760604577011812860533098.html?mod=BOL_hpp_mag" target="_blank">told</a> <em>Barron&#8217;s</em>.</p>
<p>Boyar points to Cablevision&#8217;s ongoing efforts to minimize their involvement in side businesses, such as MSG and cable networks like AMC, spun away from Cablevision on June 30.</p>
<p>Buyers like transactions to be simple and straightforward, and Cablevision&#8217;s operations increasingly meet both standards.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2010/01/cablevision.jpg"><img class="alignleft size-full wp-image-7031" title="cablevision" src="http://stopthecap.com/wp-content/uploads/2010/01/cablevision.jpg" alt="" width="200" height="34" /></a>On its own, Cablevision&#8217;s growth opportunities come mostly from rate increases, which subscribers routinely complain about.  The company already enjoys the highest penetration rate among major cable operators and the highest average monthly revenue per subscriber &#8212; $150 a month vs. $113 for Time Warner Cable.  With a depressed economy and fierce competition from Verizon FiOS, growing the business (and the stock price) has become increasingly difficult in a maturing industry unlikely to attract new subscribers.</p>
<p>Among the only prospects for subscriber growth on the horizon comes from satellite TV subscribers.  But that alone may not be enough to keep investors satisfied, much less excited.  A sale could bring shareholders a massive return on their investment, particularly if a bidding war breaks out between likely buyers Time Warner Cable and Comcast.  Shareholders ultimately own the company, and should the Dolan family lose their love affair with cable, Cablevision and their subscribers will likely find themselves on the auction block.</p>

<p style="text-align: left;">Not even 17,000 new broadband customers could erase the damaging losses incurred by Cablevision cord-cutting, some of it as a result of the cable operator&#8217;s damaging retransmission consent disputes that deprived viewers of popular local broadcast outlets and cable channels.  The company lost so much subscriber goodwill, company executives admitted they pared back an anticipated rate increase just to protect themselves from further customer defections.</p>

<p style="text-align: left;">Cablevision, like Time Warner Cable before it, won&#8217;t admit that cable cord-cutting is responsible for what one investment bank fears could be the start of an &#8220;ex-growth&#8221; era in cable television.  Instead, Cablevision executives continue to blame the poor economy for subscription losses, as well as aggressive pricing competition from their biggest rival &#8212; Verizon FiOS.  Adding pressure is the relentless demand for higher programming fees, which directly translates into relentless annual rate increases for cable television service.</p>
<p style="text-align: left;">&#8220;With regard to programming [costs, they are] an issue and it is an expensive part of our business.  It is the single biggest cost item we have,&#8221; said Gregg G. Seibert, Cablevision&#8217;s chief financial officer and executive vice-president. &#8220;And the fact that retransmission consent became necessary from the eyes of broadcasters, particularly after the 2008 recession, has been flowing through our business, and there was a large step up [in fees]. I think that the overall rate of programming [costs] going forward will moderate to some extent naturally.&#8221;</p>
<p style="text-align: left;">Seibert called the aggressive retransmission consent fee disputes between broadcasters and cable operators evidence of the collapse of the traditional &#8220;free TV&#8221; business model.  Because ad revenues are down, broadcasters are increasingly dependent on fees charged to cable operators for permission to include their stations on the cable dial.  That means cable subscribers are increasingly subsidizing the broadcast television business.</p>

<p style="text-align: left;">Seibert&#8217;s revelation came too late to stop some of the nation&#8217;s most visible retransmission consent battles between Cablevision and network-owned New York-area television stations and cable networks.  When Cablevision blacked out a local station showing coverage of the World Series during the last dispute, fed up customers decided to take their cable business to Verizon or a satellite TV provider.</p>
<p style="text-align: left;">Cablevision has been trying to lick their wounds ever since, launching increasingly aggressive pricing promotions and &#8220;free gift&#8221; offers to keep existing customers while trying to win back old ones.</p>
<p>&#8220;We’ve recently introduced an offer that includes a new Apple iPod Touch primarily for win back situations,&#8221; said Thomas M. Rutledge, chief operating officer.  &#8220;Selling for the Triple Play package of video, data, and voice is now at 74% and roughly half of this selling is for our new Ultimate Triple Play, which includes a new higher-priced Boost Plus [broadband] service and a wireless router.&#8221;</p>
<p>Cablevision achieves triple-play signups by heavily discounting the package for new and returning customers.  It also hopes to succeed with a &#8216;more for less&#8217; pricing strategy, delivering new features and services without necessarily charging extra for all of them.  With discounts, free gifts, and additional services, Cablevision is getting some of their old customers back.</p>

<p>&#8220;As of September 30, our win back total is more than 45% of customers who once tried Verizon FiOS,&#8221; Rutledge claims.</p>
<p>Rutledge noted Cablevision&#8217;s participation in the industry&#8217;s <em>TV Everywhere</em> online video initiative has grown even stronger with the recent agreement to provide Cablevision cable-TV customers free access to Turner-owned cable network programming.</p>
<p>Seibert admits the more competitive business environment and high profile programming disputes in suburban New York City are impacting profits.</p>
<p>&#8220;We had a few significant items in the quarter affecting our results including higher programing costs and higher sales in marketing as we continue to aggressively promote our products and services while revenue growth was essentially flat,&#8221; Seibert said.</p>
<p>Those challenges are creating a sense of unease on Wall Street regarding the cable business&#8217; core product: cable television and the increasingly aggressive pricing promotions necessary to keep customers from disconnecting service.</p>
<p style="text-align: left;">&#8220;There is growing concern among the investor community about [the] whole [cable] industry going to ex-growth,&#8221; said Jason Bazinet from Citigroup.</p>

<p>&#8220;Programming costs are rising faster than video revenues,&#8221; Sanford C. Bernstein, an analyst for Craig Moffett, <a href="http://online.wsj.com/article/SB10001424052970203687504577003794244798950.html" target="_blank">told</a> the<em> Wall Street Journal</em>. &#8220;Unless there&#8217;s growth somewhere else in the business model, you&#8217;ve got the worst of all worlds: a slow-or no-growing business with lower margins.&#8221;</p>
<p style="text-align: left;">Rutledge outlined Wi-Fi and broadband enhancements as part of Cablevision&#8217;s priorities for the upcoming quarter:</p>
<p style="text-align: left; padding-left: 30px;">&#8220;We’ve been building out a Wi-Fi network and we’ve had continuous subscriber utilization increases on that network.  We now have more than one-half-million devices out there that can use Wi-Fi and watch our full cable television service in the home.</p>
<p style="padding-left: 30px;">&#8220;And we’re deploying a new Boost product with higher speed broadband, which includes a more sophisticated wireless router as part of that package.</p>
<p style="text-align: left; padding-left: 30px;">&#8220;We think Wi-Fi is a major strategic part of our business. We think that we can continue to take advantage of that. We think our video product today as a result of Wi-Fi is a superior product to our competitors – all of our competitors, and we think that our data service is enhanced by the Wi-Fi outside the home, and we continue to try to build value for our customers and take market share.&#8221;</p>
<p style="text-align: left;">The cable company is already aggressively marketing its Boost Plus service, which delivers 50/8Mbps broadband for an additional charge of $14.95 a month on top of the standard broadband rate.</p>

<p>The new <em>TV Everywhere</em> app, available for phones and tablets, comes free of charge.  Once authenticated as a legitimate pay television subscriber, users can watch hit series and some older shows from both networks.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2011/09/tbs.jpg"><img class="alignleft size-medium wp-image-20861" title="tbs" src="http://stopthecap.com/wp-content/uploads/2011/09/tbs-300x168.jpg" alt="" width="300" height="168" /></a>Once again, Time Warner customers are on the outside, looking in.  The nation&#8217;s second biggest cable operator has not been a <em>TV Everywhere</em> team player, preferring to launch its own live streaming iPad application and steering clear, so far, from on-demand, online viewing from most of its partner networks, including HBO.  Time Warner Cable executives have, in the past, alluded to licensing fees and user authentication complications for not launching <em>TV Everywhere</em> on-demand viewing for its customers, but the company has not explained why it has not signed on for Turner&#8217;s app.</p>
<p><em>TV Everywhere</em>, a concept on the drawing board for almost two years, is an attempt by the pay television industry to lock down online video programming for paying customers, in an effort to slow down &#8220;cord cutting&#8221; by consumers trying to save money on their cable TV bill.  The concept delivers unlimited access to popular cable programming, but only to those who already pay to subscribe.</p>
<p>Many <em>TV Everywhere</em> projects have been soft-launched without much publicity, but that is not true for Turner&#8217;s app.  The network has commissioned several clever advertisements featuring various network stars promoting the app, and now Turner wants to educate consumers about how to use it to watch shows online.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2011/09/TNT-Logo.gif"><img class="alignright size-medium wp-image-20863" title="TNT-Logo" src="http://stopthecap.com/wp-content/uploads/2011/09/TNT-Logo-300x298.gif" alt="" width="113" height="113" /></a>The most complicated part of the process is getting &#8220;authenticated&#8221; by the application for authorized viewing.  Some cable companies like Time Warner want customers to launch access to <em>TV Everywhere</em> programming from the cable company&#8217;s website, where customers have already been authenticated when they sign up for an online account.  Other companies are using customer account numbers, PIN codes, or passwords printed on monthly bills to let customers register directly for access.  When the application matches a customer account number or PIN code, the content becomes accessible.  It is typically a one-time-only hassle, but there have been cases where customers have had to grab a recent bill more than once to re-authenticate themselves.</p>
<p>Not every show will be made available for online viewing.  Many rerun off-network shows shown on TNT and TBS don&#8217;t currently include streaming rights.  So while users can watch past episodes of <em>Conan O&#8217;Brien</em>, they&#8217;re out of luck if they want to watch <em>Friends</em>.</p>

<p>By the time Hurricane Irene reached upstate New York and New England, it was a tropical storm some say was over-hyped from the outset, but don&#8217;t tell that to utility companies facing weeks of service restorations that will leave some of their customers offline until October.</p>
<p>The worst damage to infrastructure was done in this region, with utility poles swept away in flood waters right along with the homes they used to serve.  Telephone and cable companies in several parts of the region cannot even begin to restore service until higher-priority electric service is brought back.  Besides, you can&#8217;t use a broadband connection if your power has been out for a week plus.</p>
<p>Those addicted to their online connection are making due in parking lots and other Wi-Fi hotspots where service prevailed over Irene.  Wireless connectivity from cell phone companies is also getting a workout, assuming customers are aware of usage caps and limitations which could make September&#8217;s bill much higher than expected.</p>
<p><em>Stop the Cap!</em> has learned some DSL service restoration appointments in upstate New York, Massachusetts, Vermont, and New Hampshire are now extending into October, although companies suggest outside work may resolve problems.  Customers with the worst luck face a lengthy wait for the replacement of utility poles, new utility lines to be strung across them, and replacement of individual lines connected from the pole to individual homes.</p>
<p>Some <em><strong>FairPoint Communications</strong></em> customers are finding Irene did a real number on their DSL service even if power outages were limited.</p>
<p>In southwestern New Hampshire, Robert Mitchell <a href="http://blogs.computerworld.com/18884/in_irenes_wake_dsl_chaos?source=rss_blogs" target="_blank">was presented with a unique error page</a> on his computer after the lights came back on:</p>
<blockquote><p>&#8220;&#8230;we are improving the security of your broadband connection. As such, you have been redirected to the FairPoint Communications broadband service page to install a security update.&#8221;</p></blockquote>
<p>That was a fine idea, except its implementation left customers like Mitchell with the most secure broadband connection around, resistant to all malware and viruses &#8212; namely, by not having any connection at all.</p>
<blockquote><p>My annoyance only increased when I realized that FairPoint may have provided a link to download the security update software, but they were not going to make the process of accessing that software easy.</p>
<p>&#8220;Your Web browser (Firefox) and Operating System (Mac) are not compatible with the DSL Security improvement process&#8230;please re-open this page on a Windows XP, Vista or Windows 7 PC using Internet Explorer,&#8221; the message continued.</p>
<p>Bully for me, I have two Macs in the office. Time to call technical support? Nope, sorry. Both of my phone lines use Vonage, a VoIP service that relies on a working DSL modem for dial tone. Cell service at the house was sketchy at best &#8212; if I could even get through to technical support during a hurricane.</p></blockquote>
<p><a href="http://stopthecap.com/wp-content/uploads/2009/10/FairPoint.jpg"><img class="alignleft size-medium wp-image-5529" title="FairPoint" src="http://stopthecap.com/wp-content/uploads/2009/10/FairPoint-300x110.jpg" alt="" width="210" height="77" /></a>With the help of an old Windows XP machine, Mitchell managed to finally get back online.  Later, he learned the power spikes and brownouts that preceded the blackout in his neighborhood had caused his DSL modem to resort to its original default settings.  When FairPoint customers first connect a DSL modem, the company prompts them to perform the aforementioned &#8220;security update.&#8221;  Only FairPoint stopped offering that update more than eight months earlier.  Now, according to Mitchell, it&#8217;s just the default start page for newly activated DSL modems.</p>
<p>Customers further east in downstate New York, Massachusetts, Maine, Long Island, Connecticut, and New Jersey are finding getting service restoration highly dependent on which provider they use.</p>

<p><em><strong>Time Warner Cable</strong></em> customers numbering about 350,000 found their service out Wednesday after leftover flooding and debris tore up fiber cables serving Maine, New Hampshire and Vermont.  Service was restored that evening.</p>
<p><em><strong>Cablevision</strong></em> customers in Connecticut are still experiencing new outages caused by flooding, and with power company workers contending with more damage in that state than further south in New York, cable crews can&#8217;t restore service until the lights are back on.</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2010/01/cablevision.jpg"><img class="alignleft size-full wp-image-7031" title="cablevision" src="http://stopthecap.com/wp-content/uploads/2010/01/cablevision.jpg" alt="" width="200" height="34" /></a>Cablevision customers on Long Island are still being told not to bother calling the cable company to report outages.  Those that do are often given a date of Sept. 15 for full service restoration, although it could be sooner if damage in individual neighborhoods is less severe.  A Cablevision spokesman said, &#8220;Cablevision is experiencing widespread service interruptions, primarily related to the loss of power.  Cablevision crews are in the field and we will be working around the clock to make necessary repairs, in close coordination with local utilities.  Generally, as electricity is returned to an area, customers will be able to access Cablevision service.&#8221;</p>
<p><a href="http://stopthecap.com/wp-content/uploads/2010/11/Verizon-logo.gif"><img class="alignright size-medium wp-image-14190" title="Verizon-logo" src="http://stopthecap.com/wp-content/uploads/2010/11/Verizon-logo-300x175.gif" alt="" width="180" height="105" /></a><em><strong>Verizon</strong></em> customers in downstate New York and New Jersey faced lengthy hold times to report service outages, and are given a range of dates from later this week until mid-September for full service restoration.  Some pockets of very badly damaged infrastructure may take even longer to access and repair.  Verizon&#8217;s largest union workforce, under the auspices of Communications Workers of America District 1 are accusing Verizon management of slowing repairs with denials of overtime work requests, in part to punish workers for their recent strike action.  John Bonomo, a Verizon spokesperson, denies that accusation, but added the company is not treating the thousands of customers still without service as an emergency, noting landline service &#8220;is not as vital as it had been in past years.&#8221;</p>
<p><em><strong>Comcast</strong></em> customers, mostly in Pennsylvania, Vermont and Massachusetts, are <a href="http://articles.boston.com/2011-08-31/business/29949875_1_cable-service-cable-customers-comcast-spokeswoman" target="_blank">turning to smartphones</a> to cope through extended service outages, according to the <em>Boston Globe</em>:</p>
<blockquote><p><a href="http://stopthecap.com/wp-content/uploads/2009/12/comcast.jpg"><img class="alignleft size-medium wp-image-6694" title="comcast" src="http://stopthecap.com/wp-content/uploads/2009/12/comcast-300x77.jpg" alt="" width="300" height="77" /></a>Comcast Corp. customer Soraya Stevens turned to her iPhone when her cable blew out, logging on to Twitter from her Bedford home for the latest power outage updates. “I would not have any communication or insight without my smartphone,’’ said Stevens, a software engineer.</p>
<p>Some customers who lost cable service lost their TV, Internet, and landline phone, which are often bundled and sold together. Many turned to their smartphones, operating on batteries and the signal from cellphone towers, or friends and family who still had cable service.</p></blockquote>
<p><em><strong>AT&amp;T</strong></em>, which serves landline customers in Connecticut, experienced more outages a day or two after Irene departed as battery backup equipment installed at landline central offices finally failed.  Those equipped with diesel generators are still up and running, but many AT&amp;T customers sold a package of broadband and phone service may actually be receiving telephone service over a less-robust Voice Over IP network, supported with battery backup equipment that shuts down after 24 hours, when the batteries are exhausted.  This has left customers with standard copper wire phone service still up and running, but customers on Voice Over IP completely disconnected.</p>

<p>Bill Henderson, president of Communications Workers of America Local 1298, <a href="http://articles.courant.com/2011-08-31/business/hc-att-landline-outages-20110831_1_landline-internet-phones-power" target="_blank">told</a> the <em>Hartford Courant</em> those landlines aren&#8217;t considered landlines by the Department of Utility Control, and aren&#8217;t regulated for reliability, as the old system is.</p>
<p>&#8220;Technology has risen. Some of the things we&#8217;ve given up in that system is reliability,&#8221; he said. &#8220;This is what I&#8217;ve been screaming about to the DPUC. It&#8217;s a telephone! We need to regulate this service.&#8221;</p>
<p>Customers are also <a href="http://forums.att.com/t5/Network-Coverage/bd-p/reportservice" target="_blank">complaining</a> loudly about AT&amp;T&#8217;s poor wireless performance during Irene, with many tower outages and service disruptions that are still ongoing.</p>
<p>Remember, when services are restored, <span style="text-decoration: underline;">be sure and contact your provider and request a full service credit</span>.  You will not receive one unless you ask.</p>

<p>While hardly the &#8220;storm of the century,&#8221; damages from Hurricane Irene&#8217;s whirlwind tour up the east coast cannot yet be estimated because flood waters in the northeast are still rising this afternoon.</p>
<p>But while millions remain without electricity, some for up to several weeks, telecommunications infrastructure has fared better than expected in a number of areas hardest hit by the Category 1 hurricane.</p>
<p>A review of media reports finds the most substantial damage to cable TV and landline telephone service, mostly due to downed trees and flooding which brought down utility poles in a number of states.  The Federal Communications Commission also reported 1,400 cell sites along the coast were down, and several hundred were running on backup power.</p>
<p><strong>North Carolina &amp; Virginia</strong></p>
<p>The most substantial wind-related damage impacted the states of North Carolina and Virginia where hundreds of thousands are still without electricity, cable, and landline telephone service.  Time Warner Cable, which dominates North Carolina, had 160,000 customers without service Saturday evening, primarily due to power outages and line damage.  As of this morning, 38,000 were still without service with the most damage in Wilmington, Newport, Morehead City, Jacksonville, Havelock, Elizabeth City, Murfreesboro and Ahoskie.  Outage information is available from 1-866-4TWCNOW (1-866-489-2669) for residential customers and 1-877-892-2220 for business customers.</p>
<p>Landline service outages are impacting more than 100,000 customers, and the wind damage has made the outages most severe in these two states.  CenturyLink, AT&amp;T, and Verizon all report substantial damages to their respective networks in several areas.</p>
<p>At least 500 cell towers in North Carolina and Virginia are now operating on battery backup power, which guarantees cell phone outages will only grow worse as the hours progress.  Once battery power is exhausted, cell phone carriers either have to go without service or provision generators to deliver emergency power until normal electrical service can be restored, which is expected to take several days.  Physical damage to cell sites was reported to be minimal, however.  The biggest impact is loss of electricity.</p>

<p><strong>Maryland, Washington, DC, Delaware, Southern New Jersey</strong></p>
<p>A mix of wind and water damage has left sections of this region without electrical service, but damages are reportedly less severe than in North Carolina and Virginia.  The biggest impact is loss of electrical service which has left cell phone towers on battery backup and cable systems offline.  The more urban areas have less infrastructure damage due to underground wiring, but flood waters have created outages on their own.  In southern New Jersey, water damage is still occurring because of slowly rising rivers continuing to flood their banks.</p>
<p><strong>Pennsylania, Northern New Jersey, New York City &amp; Long Island</strong></p>
<p>Substantial damage from excessive rain and downed trees, especially on Long Island, will leave some customers on lengthy waiting lists for service restoration.  Verizon on Long Island is telling some customers it will be at least two weeks before service calls can be completed to restore phone or FiOS service. Substantial neighborhood outages are impacting Cablevision customers on Long Island as well, mostly from downed trees.  At least 700 trees fell in Oyster Bay alone.  In Pennsylvania, the worst damage was actually further inland.  Suburbs of Philadelphia were particularly hard hit.  Electric service repair has been given top priority.  Cable service restoration will probably take longer, especially where utility poles have been damaged.</p>
<p><strong>Upstate New York &amp; New England</strong></p>
<p>The worst damage of all is expected to be in upstate New York and New England, particularly in western Massachusetts and Vermont, unequipped to deal with the floodwaters which have set records in several areas.  A resident of Prattsville, New York escaped with his life and managed to finally reach emergency responders to report the entire community had been washed away in unprecedented flooding.  A great deal of utility infrastructure has gone with it, and the damage for New England&#8217;s FairPoint Communications, particularly in Vermont, is still being assessed.  Some communities in the region have been told it may take up to a month restore electrical service, longer for telephone and cable service.  Because large sections of the region are rural, there are fewer cell towers to cope with power outages, but the impact is much more readily apparent.  In some areas, there is only one provider delivering any significant service, and when battery backups fail, no cell service will function.</p>
<p>Verizon and Time Warner Cable all report service problems in the region.</p>
<p>Communities or infrastructure positioned near rivers are most at risk, and flood waters are still rising in many locations.  The damage, according to emergency officials, is likely to become worse before it gets better.</p>
<p>Although winds only achieved tropical storm-force in the region, they came in unusual wind patterns.  The National Weather Service issued high wind warnings as far west as Rochester in western New York in part because trees are unaccustomed to strong northerly winds and were much more likely to be damaged or uprooted from them.  Nearly one million New Yorkers, mostly east of Syracuse, remain without electricity this afternoon.  Some will wait 1-2 weeks before service can be restored in the most difficult-to-reach areas.</p>
<p><strong>Service Credits Are Yours, But Only If You Ask</strong></p>
<p>Telecommunications providers are notorious for providing service credits only when customers ask for them.  If your service was interrupted by the storm, make a note of when the outage occurred and remember to contact your provider for a service credit after service is restored.  In virtually all cases, providers will not automatically reimburse you for lost service and you will lose the chance to request it 30 days after service is back up and running.</p>

<p>Verizon Communications has found a way to outdo AT&amp;T&#8217;s enormous and unsightly &#8220;<a href="http://stopthecap.com/2011/06/29/san-francisco-still-in-stalemate-with-att-over-lawn-refrigerators-for-u-verse/">lawn refrigerators</a>.&#8221;  They have installed 20 foot fiberglass poles in the middle of historic neighborhoods in Flatbush, Brooklyn on top of which the phone company plans to mount boxes containing equipment to support its FiOS fiber to the home service.</p>
<p>The enormous polygonal poles went up suddenly without advance warning, and neighbors left their homes to gaze up at the mysterious new addition to the Victorian-era community.</p>
<p>“The neighbors started gathering around it like it was the monolith in ‘2001,’ ” Rev. Jeanne Person, <a href="http://www.nytimes.com/2011/07/30/nyregion/victorian-flatbush-area-protests-very-modern-pole.html?_r=1&amp;partner=rss&amp;emc=rss" target="_blank">told</a> the <em>New York Times</em>.</p>
<p>Nobody seemed to know who installed the poles, or more importantly why.</p>
<p>It turns out they are Verizon&#8217;s answer to AT&amp;T&#8217;s enormous and unsightly 4-6 foot tall metal cabinets that the latter has been installing on street corners and in front of homes throughout U-verse service areas.</p>
<p>John J. Bonomo, Verizon’s director of media relations, told the <em>Times</em> the poles provide an interface between underground cables and above-ground wires that thread through backyards.  Bonomo recognized the way AT&amp;T does it attracts <a href="http://stopthecap.com/2011/07/27/att-installs-first-of-495-u-verse-cabinets-on-the-streets-of-san-francisco/">vandals and graffiti</a>.  Verizon&#8217;s solution tries to hide the unsightly boxes in the canopy of neighborhood trees, to varying degrees of success.  It also prevents anyone other than Spiderman from stealing equipment inside.</p>
<p>Besides, Bonomo says, the company got all of the necessary permits from the Department of Transportation.  Well, almost all of the necessary permits.</p>
<p>They forgot the Landmarks Preservation Commission, which regulates the look and feel of protected, historic neighborhoods &#8212; like Flatbush.  Install 20-foot plastic poles without a permit at your peril.</p>
<p>A spokesperson for the Commission says they hope to reach a resolution with Verizon soon.</p>
<p>It&#8217;s not that neighbors are ungrateful that Verizon is extending FiOS into Brooklyn, where it will provide real competition to Cablevision.  Many applaud the fiber service and look forward to signing up.  They just don&#8217;t believe randomly placed 20&#8242; poles are the way to do it.</p>
<p>“First we wanted to know what it was,” Rev. Person said. “Then when we figured out what it was, we wanted to get rid of it. What does landmarking mean if it doesn’t protect us?”</p>
